LOCAL LIQUOR CONTROL COMMISSION
July 14, 2016
I. CALL TO ORDER AND ROLL CALL VOTE
Mr. Kozik called the July 14, 2016 Local Liquor Control Commission meeting to order at 7:30 P.M.
in the Council Chambers of the Wheaton City Hall, 303 West Wesley Street.
Upon roll call, the following were present: Commissioner Brown, Commissioner Pearse,
Commissioner Sender, Commissioner Wolgemuth. Absent: Chair Taylor. City Staff Present: James
P. Kozik, Director of Planning and Economic Development.
Commissioner Pearse moved and Commissioner Wolgemuth seconded a motion to nominate
Commissioner Sender as Chair Pro-Tem. On a voice vote, all voted aye.
II. PUBLIC COMMENT
There was no public comment.
III. APPROVAL OF MINUTES – JUNE 9, 2016
Commissioner Pearse moved and Commissioner Wolgemuth seconded a motion to approve the
minutes of the June 9, 2016 Local Liquor Control Commission meeting as submitted. On a voice
vote, all voted aye.
IV. NEW BUSINESS
Outdoor Special Event Liquor License/Downtown Wheaton Association/ Wheaton Wine
Walk
Ms. Paula Barrington, Executive Director of the Downtown Wheaton Association (DWA), was in
attendance to present the DWAs application for an Outdoor Special Event Liquor License for a new
summer event; The Wheaton Wine Walk, to be held on Thursday, August 11, 2016.
Ms. Barrington stated that this DWA fundraising event is planned as a ticketed wine tasting event.
The DWA will sell tasting tickets ($35 for 12- one ounce tastings) to the public on-line and at the
check in tent at Martin Memorial Plaza on the day of the event. All ticket holders will check in at
Martin Memorial Plaza to be carded and receive a wristband (must be 21 years or older); receive
their tasting tickets, souvenir wine glass, and a walking map of all the tasting locations.
Ms. Barrington stated that the tasting locations will be inside participating restaurants and selected
retailers. The DWA will be purchasing the wine and distributing it to the tasting locations. Each
location will have one to two wines offered for tastings. Each location will have a Basset trained
person (21 years or older) as the server. A special wine stopper that only allows for 1 ounce pours
will be in each opened bottle. The server will be responsible for marking off each tasting on the
participant’s tasting ticket.
Ms. Barrington stated that all tastings must be consumed inside the business premises and that signs
will be posted inside the doorways noting that all tastings must be finished inside- no alcohol
allowed outside. At each tasting station, a tray of appetizers will be available to participants to

enjoy.
Ms. Barrington stated that a free trolley will circulate in the Downtown area to provide
transportation from the north side of the Downtown to the tasting locations on the south side of
Downtown; The Perfect Thing, Adelle’s and Wheaton Center Apartments and that a jazz ensemble
and two acoustical musical performers will be located on the sidewalks to perform during the wine
event. The locations will be at Main and Front (by Starbuck’s), at Hale and Front, and under the
marquee of the Wheaton Grand Theater. (weather permitting).
Glass rinsing stations (portable water coolers and buckets to catch the water) will be located on the
sidewalk at Main and Front, Hale and Front and at Hale and Wesley.
Commissioner Wolgemuth stated that he felt two of the proposed "tasting stations"; Kimmer's Ice
Cream and Moore Toys were not appropriate for the event. Paula Barrington, Executive Director of
the DWA, stated that all of the businesses participating in the event volunteered their locations as
"tasting stations" in order to showcase their businesses to new customers.
Commissioner Pearse then moved and Commissioner Brown seconded a motion to recommend
approval of the Outdoor Special Event Liquor License to the Downtown Wheaton Association for
this event.
With Commissioner Brown and Pearse voting aye, Chair Pro-Tem Sender abstaining and
Commissioner Wolgemuth voting nay, the motion carried.
Liquor License Application/CVS/Class D License/2000 S. Naperville Road
Mr. Boyk, District Manager and Mr. Wesley Addison, Store Manager, were in attendance on behalf
of Highland Park CVS, LLC, to present an application to the City for Class D Liquor License for
their new store that is currently under construction at 2000 S. Naperville Road.
Mr. Boyk stated that CVS performs bi-annual compliance checks at all their locations that have
liquor licenses. Mr. Boyk stated that CVS has a zero-tolerance policy with regards to violations of
their liquor sales policy.
When questioned by Commissioner Pearse about the cashiers ability to override the registers, Mr.
Boyk stated that it is possible to override the system, although such an act would violate CVS policy
and would result in the cashiers termination.
Commissioner Wolgemuth then moved and Commissioner Brown seconded a motion to
recommend approval of a Class D License to Highland Park CVS, LLC for their store at 2000 S.
Naperville Road. On a voice vote, all voted aye.
Proposed Amendment to the Liquor Code/Class W License/Fairground
Mr. Kozik stated that he has prepared a proposed amendment to the Liquor Code regarding the
creation of a new “fairground” license classification. Mr. Kozik stated that the proposed
classification comes at the request of the DuPage County Fair Association who would like to sell

alcoholic liquor as part of its concession business at smaller events that are held at the fairgrounds
throughout the year.
Because of the magnitude of the event, Mr. Kozik stated that the DuPage County Fair would still
require an Outdoor Special Event Liquor License.
Mr. Kozik stated that the language of the proposed license classification is loosely modeled after a
Villa Park license classification for the Odieum, a facility which hosts similar events as the
fairgrounds. The proposed hours would be Monday thru Sunday, 11:00 a.m. to 12:00 p.m.
midnight. The proposed fee would be $500.
Mr. Jim McGuire, Manager of the DuPage County Fair Association, stated that the proposed license
classification is an opportunity for the Fair Association to increase revenue to fund building
improvements.
In response to a question from the Commission, Mr. McGuire stated that the Fair Association's lease
on the property runs through the year 2020.
Commissioner Pearse then moved and Commissioner Brown seconded a motion to recommend
approval of the proposed Class W Liquor License Classification. On a voice vote, all voted aye.
VI. ADJOURNMENT
The meeting was adjourned at 8:15 P.M.
