LOCAL LIQUOR CONTROL COMMISSION June 8, 2017 I. CALL TO ORDER AND ROLL CALL VOTE Chair Taylor called the June 8, 2017 meeting of the Local Liquor Control Commission meeting to order at 7:30 P.M. in the Council Chambers of the Wheaton City Hall, 303 West Wesley Street. Upon roll call, the following were present: Commissioner Brown, Commissioner Sender, Chair Taylor, Commissioner Wolgemuth. Absent: Commissioner Pearse. City Staff Present: James P. Kozik, Director of Planning and Economic Development. II. PUBLIC COMMENT There was no public comment. III. APPROVAL OF MINUTES – May 24, 2017 Commissioner Wolgemuth moved and Commissioner Brown seconded a motion to approve the minutes of the May 24, 2017 Local Liquor Control Commission meeting as submitted. On a voice vote, all voted aye. IV. NEW BUSINESS Outdoor Special Event Liquor License – DuPage County Fair Association – DuPage County Fair Mr. Jim McGuire, Manager of the DuPage County Fair Association was in attendance to present an application for an Outdoor Special Event Liquor License submitted by the DuPage County Fair Association in connection with the DuPage County Fair to be held July 26th thru the 30th . Mr. McGuire stated that this is the seventh year that the Fair Association has sought permission to serve alcohol at the Fair, and the second year in which an Outdoor Special Event Liquor License is being sought. Mr. McGuire stated that in previous years, the Fair Association obtained a Class F Liquor License to sell alcohol at the Fair. Last year, the Liquor Code was amended to add the DuPage County Fairgrounds as an approved location for Outdoor Special Event. Mr. McGuire stated that the Fair Association is proposing at least three areas within the Fairgrounds for the sale of alcohol. As in previous years, the areas devoted to the sale of alcohol will either be indoors or completely fenced off. Wheaton Police and BASSET/Wheaton Police-trained Directors and staff will be on duty at the entrances to check ID’s and “band” attendees wishing to purchase alcohol. Only BASSET/Wheaton Police-trained Directors and staff are allowed to serve alcohol. Commissioner Wolgemuth then moved and Commissioner Brown seconded a motion to recommend approval of an Outdoor Special Event Liquor License to the DuPage County Fair Association in connection with the DuPage County Fair to be held July 26th thru the 30th On a voice vote, all voted aye. Local Liquor Control Commission Meeting June 8, 2017 Page 2 of 3 Outdoor Special Event Liquor License/Downtown Wheaton Association/ Wheaton Wine Walk Ms. Paula Barrington, Executive Director of the Downtown Wheaton Association (DWA), was in attendance to present the DWA’s application for an Outdoor Special Event Liquor License for a new summer event; The Wheaton Wine Walk, to be held on Thursday, August 10, 2017. Ms. Barrington stated that this DWA fundraising event is planned as a ticketed wine tasting event. The DWA will sell tasting tickets ($35 for 12- one ounce tastings) to the public on-line and at the check in tent at Martin Memorial Plaza on the day of the event. All ticket holders will check in at Martin Memorial Plaza to be carded and receive a wristband (must be 21 years or older); receive their tasting tickets, souvenir wine glass, and a walking map of all the tasting locations. Ms. Barrington stated that the tasting locations will be inside participating restaurants and selected retailers. The DWA will be purchasing the wine and distributing it to the tasting locations. Each location will have one to two wines offered for tastings. Each location will have a Basset trained person (21 years or older) as the server. A special wine stopper that only allows for 1 ounce pours will be in each opened bottle. The server will be responsible for marking off each tasting on the participant’s tasting ticket. Ms. Barrington stated that all tastings must be consumed inside the business premises and that signs will be posted inside the doorways noting that all tastings must be finished inside- no alcohol allowed outside. At each tasting station, a tray of appetizers will be available to participants to enjoy. Ms. Barrington stated that a free trolley will circulate in the Downtown area to provide transportation from the north side of the Downtown to the tasting locations on the south side of Downtown; The Perfect Thing, Adelle’s and Wheaton Center Apartments. A jazz ensemble and one acoustical musical performer will be located on the sidewalks to perform during the wine event. The locations will be at Hale and Wesley, and Front and Hale. Glass rinsing stations (portable water coolers and buckets to catch the water) will be located on the sidewalk at Main and Front, Hale and Front, Hale and Wesley, West and Front, and by Adelle’s on Liberty. Commissioner Brown then moved and Commissioner Wolgemuth seconded a motion to recommend approval of the Outdoor Special Event Liquor License to the Downtown Wheaton Association for this event. On a voice vote, all voted aye. Violation Hearing- Highland Park CVS, LLC - 1400 E. Roosevelt Road Chair Taylor called the public hearing to order and stated that the public hearing is to review evidence relating to allegations of a violation of the Liquor Control Ordinance by Highland Park CVS, LLC, 1400 E. Roosevelt Road, whereby liquor was sold to a person under the age of 21. Chair Taylor indicated that Highland Park CVS, LLC, has entered a plea of guilty to the allegations. Local Liquor Control Commission Meeting June 8, 2017 Page 3 of 3 Mr. Larry Cohen, attorney for CVS, stated that his client takes full responsibility for the violation and apologizes for the incident. Mr. Cohen stated that pursuant to CVS’s zero tolerance policy, the manager of the store who committed the violation was terminated. Mr. Cohen stated that since the incident, all employees involved in the sale of age restricted products have been retrained. Hearing no further questions or comments the public hearing was closed. Commissioner Wolgemuth then moved and Commissioner Brown seconded the motion to go into Executive Session pursuant to the Illinois Compiled Statutes 5ILCS 120/2 (c) (4) at 8:00 P.M. On a voice vote, all voted aye. At approximately 8:05 P.M. the Commission returned to open session. Following an admonishment of Highland Park CVS, LLC, Chair Taylor stated the Commission will be recommending a $500 fine to the Liquor Commissioner. V.
