Local Liquor Commission

December 8, 2022 I. CALL TO ORDER AND ROLL CALL VOTE Chair Taylor called the December 8, 2022 meeting of the Local Liquor Control Commission to order at 7:00 P.M. in the City Council Chambers of the Wheaton City Hall, 303 West Wesley Street and via Zoom. Upon roll call, the following were present: Commissioner Brown, Commissioner Pearse, Commissioner Sender (via Zoom), Chair Taylor and Commissioner Whitmer. Absent: None. City Staff Present: James P. Kozik, Director of Planning and Economic Development. II. PUBLIC COMMENT There was no public comment. III. APPROVAL OF MINUTES – October 27, 2022 Hearing no questions or comments, Commissioner Brown moved and Commissioner Sender seconded a motion to recommend approval of the minutes of the October 27, 2022 Local Liquor Control Commission meeting as submitted. On a voice vote, all voted aye. IV. NEW BUSINESS 2023 License Renewals / Section 6-90 of the Wheaton City Code Chair Taylor stated that Section 6-90 of the Wheaton City Code requires that licensees found guilty of a violation in the previous year must attend a liquor license renewal meeting before the Local Liquor Commission prior to a license renewal. Chair Taylor stated that the fourteen licensees that had a violation in 2022; Hashimi Enterprise, Inc. d/b/a 7-Eleven Express 625 W. Roosevelt Road, 302 Wheaton LLC d/b/a 302 South 401 Town Square, Aldi, Inc. d/b/a Aldi 20 W. Loop Road, Honey Jam Café II LLC d/b/a Butterfields 351 Rice Lake Square, Buchanan Energy (S) LLC d/b/a Casey's #6540 1000 E. Roosevelt Road, RDK Ventures LLC d/b/a Circle K #6709 100 W. Geneva Road, Roundy's Illinois Co d/b/a Mariano's #8513 625 S. Main Street, Royale Liquors LLC d/b/a Pete's Fresh Market 151 Rice Lake Square, Le Donne, LLC, d/b/a Sogno 100 N. Hale Street Suite 200, Sushi Ukai III, Inc. d/b/a Sushi Ukai 281 Rice Lake Square, Suzette’s Creperie 211 W. Front Street, EMC Eatery, Inc. d/b/a Wheaton House 133 W. Front Street, Whole Foods Market 89 Danada Square East and Wok N Fire Wheaton LLC d/b/a Wok N Fire 120 E. Liberty Drive Suite 190. Chair Taylor stated that all fourteen licensees were in attendance tonight, either in person or virtually. WHEATON LIQUOR CONTROL COMMISSION MEETING December 8, 2022 Chair Taylor called each licensee up to the podium individually and they each explained what steps they have taken since their violation to ensure that future violations do not occur. After a discussion by the Commission of the actions taken by each licensee, Commissioner Pearse moved and Commissioner Brown seconded a motion to recommend approval of the 2023 License Renewals for the licensees appearing this evening. On a voice vote all voted aye. V. MISCELLANEOUS BUSINESS Election of Chairperson Chair Taylor stated that in accordance with the new rule changes adopted by the Mayor and City Council pertaining to Boards and Commissions, although he will remain on the Commission, he will be stepping down in his role as Chair in January and welcomed a motion to nominate a new Chair for 2023. Commissioner Brown moved and Commissioner Whitmer seconded a motion to nominate Commissioner Pearse as Chair for 2023. On a voice vote all voted aye. VI.
