WHEATON PLANNING AND ZONING BOARD
I. CALL TO ORDER AND ROLL CALL VOTE
Chair Weller called the May 9, 2017 Wheaton Planning and Zoning Board meeting to order at 7:00 p.m. in the
Council Chambers of the Wheaton City Hall, 303 W. Wesley Street. Upon roll call, the following were:

II. APPROVAL OF MINUTES - APRIL 25, 2017
The minutes were approved as submitted.
III. PUBLIC COMMENT
There was none.
IV. OLD BUSINESS
ZA #17-11/ TEXT AMENDMENT/ ARTICLE 14/ I-1 INSTITUTIONAL DISTRICT
Chair Weller reconvened discussion of this item on Tuesday, May 9, 2017. He stated that since the last meeting
Staff had time to clarify the potential development options for Mr. Schlaf’s vacant property on the east side of
Creekside Drive just south of Spring Green Drive.
Director Kozik stated that Mr. Schlaf’s vacant property on the east side of Creekside Drive is part of an existing
Planned Unit Development (PUD) known as The Streams. The Streams PUD was adopted pursuant to the terms
and provisions of an Annexation Agreement and a site plan illustrating the planned development of The Streams
property. The Streams PUD Ordinance incorporated by reference the site plan illustrating the proposed
development of the property. Pursuant to the provisions of the site plan, Mr. Schlaf’s property was designated
as “Parcel D Park”. The development of The Streams PUD was implemented on the condition that all land
designated as “park” on the site plan was to remain as open space without any development thereon.
Director Kozik added that Mr. Schlaf was notified of this determination in February of 1997 when he had
applied for a building permit to construct a single-family home on this lot.
Mr. Almiron suggested adding a definition in the I-1 District.
Ms. Aranas stated that she was hesitant to add a definition, since it was inconsistent with the language in the
other Articles. She added that the entire Article functions as the definition. The rest of the Board agreed with
the comments made by Ms. Aranas.
Mr. Gudmundson moved and then Mr. Wanzung seconded the motion to close the public hearing. On a voice
vote, all voted aye.

Mr. Almiron moved and then Mr. Wanzung seconded the motion to approve the text amendment with the
addition of the word “such” before the word “uses” in both the I-1 Institutional District and the I-2 Institutional
District general descriptions.

V. NEW BUSINESS
ZA # 17-12/ SPECIAL USE PERMIT/ 811 N. WHEATON AVENUE/ RENCH
Pursuant to notice duly published on April 21, 2017 and letters mailed to neighboring property owners on April
19, 2017, Chair Weller called to order the May 9, 2017 public hearing requesting a special use permit to allow a
912-square foot one and one-half story detached garage to be constructed at 811 N. Wheaton Avenue.
Jennifer Rench, 811 N. Wheaton Avenue, Wheaton was sworn in. Ms. Rench stated she was the property
owner. Ms. Rench stated that they are requesting a special use permit to allow a 912-square foot one and one-
half story detached garage to be constructed at 811 N. Wheaton Avenue. Article 24.3.1 of the Wheaton Zoning
Ordinance requires a special use permit to allow the construction of a detached garage over 700 square feet in
size. The existing detached garage would be demolished.
Ms. Rench stated that the garage would measure 24 feet deep by 38 feet wide and would have an interior fixed
stair to an attic storage area. The garage would maintain the required side and rear setbacks, comply with the
height limit for one and one-half story detached garages and observe the maximum lot coverage requirement for
detached garages in the rear yard. The exterior of the garage would be designed to match the exterior of the
house to fit within the design standards of the Northside Residential Overlay District.
Ms. Rench addressed the special use standards as required by the Zoning Ordinance. She stated that the
proposed special use would not be detrimental to the public health, safety, morals, comfort, convenience or
general welfare of the neighboring property owners.
Mr. Wanzung moved and then Mr. Almiron seconded the motion to close the public hearing. On a voice vote,
all voted aye.
The Board decided to vote this evening.
Mr. Wanzung moved and then Mr. Gudmundson seconded the motion to approve ZA #17-12 as presented.
