May 8, 2018 WHEATON PLANNING AND ZONING BOARD I. CALL TO ORDER AND ROLL CALL VOTE Chair Weller called the May 8, 2018 Wheaton Planning and Zoning Board meeting to order at 7:00 p.m. in the Council Chambers of the Wheaton City Hall, 303 W. Wesley Street. Upon roll call, the following were: Roll Call Vote Present: Nicole Aranas Christopher Dabovich Bob Gudmundson Cecilia Horejs Dan Wanzung Scott Weller Absent: Mark Plunkett City Staff Present: Tracy Jones, Staff Planner II. APPROVAL OF MINUTES - APRIL 24, 2018 The minutes were approved as presented. III. PUBLIC COMMENT There was none. IV. NEW BUSINESS ZA #18-05/ SPECIAL USE PERMIT AND REAR YARD SETBACK VARIATION/ 1004 WHEATON PLACE/ EDDY Pursuant to notice duly published on April 21, 2018 and letters mailed to neighboring property owners on April 19, 2018, Chair Weller called to order the May 8, 2018 public hearing requesting a special use permit to allow a 1,085-square foot one and one-half story detached garage to be constructed at 1004 Wheaton Place. The application is further requesting a variation to Article 3.4A.8b of the Wheaton Zoning Ordinance to allow a rear yard setback of 5.0 feet in lieu of the required 10.0 feet. The property contains two existing detached garages that would be demolished if the new garage is approved. A letter of support from the adjacent neighbor to the west at 1001 N. Wheaton Avenue was submitted and incorporated into the record. Kelly Eddy, 1004 Wheaton Place, Wheaton was sworn in. Mrs. Eddy stated that the subject property is located on the northwest corner of Wheaton Place and Forest Avenue. The site is improved with an existing two-story frame residence and two existing detached garages that would be demolished if the new garage is approved. The property is 125.0 feet in width by 167.7 feet in depth. Ben Eddy, 1004 Wheaton Place, Wheaton was sworn in. Mr. Eddy stated that the proposed garage would measure 39.0 feet in width by 27.0 - 29.0 feet in depth and would have an interior pull-down stair to an attic storage area. The garage would maintain the required side setbacks, comply with the height limit for one and one-half story detached garages and observe the maximum lot coverage requirement for detached garages in the rear yard. The exterior of the garage will be designed to match the exterior of the house to fit within the Northside Residential Overlay District. Wheaton Planning and Zoning Board May 8, 2018 Page 2 of 3 Mr. Eddy stated that they are requesting a special use permit to allow a 1,085-square foot one and one-half story detached garage. Article 24.3.1 of the Wheaton Zoning Ordinance requires a special use permit to allow the construction of a detached garage over 700 square feet in size. Mr. Eddy further stated that they are requesting a variation to Article 3.4A.8b of the Wheaton Zoning Ordinance to allow a rear yard setback of 5.0 feet in lieu of the required 10.0 feet. Since the garage has some but not all the elements of a typical one and one-half story garage, staff required the larger setback for a one and one-half story garage of the lesser of 8 percent of the lot width or 10 feet. The required rear yard setback for a one-story detached garage would be 5.0 feet. Chair Weller questioned what elements the garage had of a typical one and one-half story garage. Staff Planner Jones stated that one and one-half story garages typically have an attic area with a fixed stair and a higher pitched roof. This garage has an attic area with a pull-down stair and a moderately pitched roof to match the house. Mr. and Mrs. Kelly jointly addressed the special use and variation standards as required by the Zoning Ordinance. They stated that the proposed special use and variation would not be detrimental to the public health, safety, morals, comfort, convenience or general welfare of the neighboring property owners. The Board discussed both the special use and variation components of the application. The Board stated that based on the property size and the fact that the proposed garage would replace two existing detached garages, they were supportive of the special use component of the request to allow a garage over 700 square feet in size. The Board further stated that based on the proposed garage having a similar setback as the existing detached garages and the proposed garage utilizing the existing shared drive approach with the neighbor to the west, they were supportive of the rear yard setback variation to allow a setback of 5 feet in lieu of the required 10 feet. Mr. Dabovich moved and then Mr. Gudmundson seconded the motion to close the public hearing. On a voice vote, all voted aye. The Board decided to vote this evening. Mr. Wanzung moved and then Mr. Gudmundson seconded the motion to approve both the special use and variation components of ZA #18-07 as submitted.
