December 13, 2022 Wheaton Planning and Zoning Board I. Call To Order and Roll Call Vote Chair Aranas called the Tuesday, December 13, 2022 Wheaton Planning and Zoning Board meeting to order at 7:00 p.m. in-person and via zoom. Upon roll call, the following were: Roll Call Vote Present: Nicole Aranas Chris Dabovich Chris Derrick Bob Gudmundson Dan Wanzung Absent: Mark Plunkett Cecilia Horejs City Staff Present: Tracy Jones, Staff Planner II. Approval of Minutes - September 27, 2022 The minutes were approved as presented. III. Public Comment There was none. IV. New Business ZA #22-28/ Text Amendment - Definition of Family and Group Care Homes/ Articles II, VII, VIII, IX, X, XI, XII, XIII, XIV, & XIX Pursuant to notice duly published on November 21, 2022, Chair Aranas called to order the December 13, 2022 public hearing requesting an amendment, initiated by the City Attorney, to the text of the Wheaton Zoning Ordinance, Article II, to improve upon the definition of “Family” for compliance with the Fair Housing Act, 42 U.S.C. § 3601, et seq., and repeal the definition of “Group Care Home” in its entirety. The application further proposes amendments to Articles VII, VIII, IX, X, IX, XII, XIII, XIV and XIX to remove Group Care Homes as permitted and special uses in Residential Districts and in the I-1 Institutional District and C-4 CBD Perimeter Commercial District. Staff Planner Jones stated that after the notice for this amendment request was published, City Staff realized that an additional amendment to Article V should have been included in the notice to allow for a variation procedure. Staff Planner Jones stated that given the issue with the notice, City Staff would recommend that the Board take public comment from anyone in attendance tonight, and then continue the public hearing until Tuesday, January 10, 2023 for further discussion. This would give City Staff time to republish the notice to include an additional amendment to Article V before the larger amendment request is discussed in detail by the Board. There was no one in attendance either in-person or via zoom to provide public comment.  Wheaton Planning and Zoning Board December 13, 2022 Page 2 of 2 Mr. Dabovich moved and then Mr. Wanzung seconded the motion to continue the public hearing until Tuesday, January 10, 2023 to give City Staff time to republish the notice to include an additional amendment to Article V before the larger amendment request is discussed in detail by the Board. On a voice vote, all voted aye. V. Miscellaneous There was none. VI.
