July 23, 2024 Wheaton Planning and Zoning Board I. Call To Order and Roll Call Vote Chair Aranas called the Tuesday, July 23, 2024, Wheaton Planning and Zoning Board meeting to order at 7:00 p.m. in-person and via zoom. Upon roll call, the following were: Roll Call Vote Present: Nicole Aranas Chris Dabovich Chris Derrick Bob Gudmundson Cecilia Horejs Absent: Mark Plunkett Dan Wanzung City Staff Present: Tracy Jones, Staff Planner II. Approval of Minutes – June 11, 2024 The minutes were approved as presented. III. Public Comment There was none. IV. New Business ZA #24-10/ Corner Side Yard Setback Variation/ 1926 N. Summit Street/ Cynamon-Murphy Pursuant to notice duly published on June 24, 2024 and letters mailed to neighboring property owners on June 22, 2024, Chair Aranas called to order the July 23, 2024 public hearing requesting a variation to Article 3.4A.5c of the Wheaton Zoning Ordinance to allow a two-story, 23.6-foot by 33.05-foot as-built addition to remain (plus the addition of proposed foundation walls) with a corner side yard setback (adjacent to Daly Road) of approximately 16.8 feet in lieu of the required 23.3 feet, all on property commonly known as 1926 N. Summit Street, Wheaton, IL 60187. Six letters of support were received from neighboring property owners and incorporated into the record. Tim Berneche, 314 Illinois Street, Glen Ellyn was sworn in. Mr. Berneche stated that he was the new architect working on the project. He stated that the subject property is located at the southwest corner of Daly Road and Summit Street. The lot is 100 feet wide, 184 feet deep, and approximately 18,400 square feet in area. In zoning terms, the front of the subject property is on Summit Street and the corner side yard is on Daly Road. The property is improved with an existing two-story single-family residence. Wheaton Planning and Zoning Board July 23, 2024 Page 2 of 3 Mr. Berneche stated that a building permit was granted for a two-story, 23.6-foot by 33.05-foot addition on the west side of the existing home in 2022. However, after construction began on the addition, it was determined that the original setback information provided by the surveyor was inaccurate and the addition was encroaching into the required corner side yard setback. At that time, it was further determined that the addition was not constructed per the approved building plans, and that grading adjustments needed to be made and extra foundation walls needed to be added to the outside of the addition. Staff Planner Jones stated that a stop work order was issued until these issues were resolved. Revised building plans have been submitted, and the grading adjustments and extra foundation walls have already been approved. The only remaining issue is the corner side yard setback variation. Mr. Berneche addressed the ten variation evidence questions as required by the Wheaton Zoning Ordinance. He stated that the proposed variation would not negatively impact the neighboring property owners. Mr. Gudmunson moved and then Mr. Derrick seconded the motion to close the public hearing. On a voice vote, all voted aye. Mr. Dabovich moved and then Ms. Horejs seconded the motion to waive the Board’s regular rules and vote tonight. On a voice vote, all voted aye. Ms. Horejs moved and then Mr. Derrick seconded the motion to approve ZA #24-10 as presented. VI. Adjournment Mr. Dabovich moved and then Mr. Gudmundson seconded the motion to adjourn the meeting at 7:10 p.m. On a voice vote, all voted aye.
