A. 20PSB: 2781: On June 30, 2020, a Wichita Police Officer utilized his Taser to apprehend a
suspect for an existing warrant. It is alleged the officer discharged his weapon as the
suspect ran from the officer, striking the back area of the suspect and causing the suspect
to fall. It was alleged the suspect was pregnant at the time of this incident.

1. Call to Order – Chairperson Fowler
The meeting was called to order at 4:07 p.m.
2. Approval of Minutes
Sims made a motion to approve the October 22, 2020 minutes. Second by Bender. The minutes
were approved as written.
3. Public Agenda - 15 minutes is set aside for this portion of the meetings.
No one signed up in advance or appeared to present at the meeting for the public agenda.
4. Staff Report Update – Captain Nicholson
Statistics since the group last met are from October 13, 2020 to January 12, 2021: 2 excessive
force, 40 improper conduct, 50 procedural violations, 5 safety violations and 3 unnecessary
force. Disposition included: 1 cleared by Axon, 25 cleared by coaching/mentoring, 7
exonerated, 1 not-sustained, 30 still ongoing, 3 officers stipulated discipline, 1 sustained, 31
unfounded and 2 were within policy.
YTD statistics – 248 external complaints, 145 internal complaints. Most frequent violations:
complete/thorough investigation, complying with policy, rude conduct (#1 with 71 complaints).
Sims asked if when a case is cleared by coaching/mentoring is the coaching/mentoring given to
the complainant or the staff person. Capt. Nicholson stated it is given to the staff person.
Sims asked how coaching/mentoring is offered before a finding was determined. Capt.
Nicholson explained that if an officer commits a policy violation while on a call, a letter is still
sent acknowledging the violation existed but the case is cleared with coaching/mentoring. Used
only for A or B penalty, not for more serious (C, D, E, F) violations.
Sims asked if a complaint was received to initiate an investigation. Capt. Nicholson said it
depends upon the source of the complaint. For example, if an officer commits a minor violation
(e.g. backing into a trash can), then coaching/mentoring can be offered to address the issue. If
the complaint is external (e.g. reported as being rude), then the Axon video is viewed and past
history of the officer is taken into consideration. Then they determine the findings and most
appropriate response (e.g. sustained, coaching/mentoring, written reprimand).

Fowler suggested they pull closed case 20PSB-2781 for further review. Case involved
unnecessary force by use of Taser to take someone into custody. CRB members are
encouraged to suggest cases they feel should be pulled.
Ailslieger inquired about reports which are not complete or failed to be made, and whether that
would be part of the job. Does it signal a problem with the officer? Capt. Nicholson admitted
sometimes laziness is involved, but cases of this nature are more common among younger
officers new to the force trying to figure out how to accomplish all the job duties.
Bender asked about the case where an Axon camera stolen from personal vehicle, and
whether there is a sales market for items like these. Capt. Nicholson said there is no known
market as it would be unable to connect to a system.
5. Overview of NIBIN (National Integrated Ballistic Information Network) and Update of
Gang Investigations – Lieutenant Chad Beard
Capt. Nicholson introduced Lt. Chad Beard, the leader of the Gang Felony enforcement section.
Lt. Beard has been with WPD for 23 years. He is qualified as a gang expert in federal and state
courts. He has worked on gang crime most of that time including as an intelligence officer,
detective, in the field and in charge of the Gang Felony Assault Section.
NIBIN: Lt. Beard presented a short video to introduce the Wichita Crime Gun Intelligence
Center (CGIC) and how it uses NIBIN. The Center is located on the WSU campus and has been
operational since 2019. The program is in partnership with WSU Forensic Science program and
the Bureau of Alcohol, Tobacco and Firearms (ATF). In 2020, there were 727 leads, 3,750
matched casings and 150 NIBIN lead arrests. WSU is now offering a course on forensic
ballistics in collaboration with the CGIC. There are 10 internships available at the Center.
NIBIN was started by the ATF in 1999 to provide a web-based format to analyze cartridge
casings recovered at a crime scene. Can compare those to see if they match other
investigations, confirming that gun is being used in multiple crime scenes. An essential tool for
ongoing crime reduction strategy, and part of several grants to address violent crime in the city.
NIBIN works by comparing the cartridge casing (aka shell casing), which is discharged after the
gun is fired. Typically for firearms which are multiple round, although they can do some
comparisons for casings from revolvers, shotguns and rifles. Every firearm leaves a “fingerprint”
of markings on the cartridge casing. No two firearms are the same.
Brasstrax machine housed at CGIC which incorporates information and uses the stereoscope to
compare the top of cartridge casing and marks made. Following a shooting incident, the
cartridge casings are gathered and compared to determine how many guns were used at the
scene. Data is entered into Integrated Ballistics Identification System (IBIS) which links to the
National Correlations Center in Alabama. The national center confirms if the casings are from
the same firearm.
E-Trace is used as well. There is no national firearms registry. However, E-Trace will show
where the firearm was manufactured, the store where it was sold, and the original buyer. Will
not show subsequent sale or transfer information. E-Trace is used when a firearm is recovered
(e.g. traffic stop where firearm is recovered from felon). Can also help detect straw purchases,

where another individual purchases a firearm on behalf of a felon. As a US Citizen, firearms
may be sold to another party without a license.
Wichita GCIC was established to perform timely collection, management and analysis of crime
gun evidence to identify shooters, disrupt criminal activity and prevent future violence. Use
programs such as NIBIN and E-Trace in conjunction with human intelligence doing proactive
work identifying violent offenders and trying to get them off the streets. Timely is defined as
striving to make evidence entries within 48 business hours.
The partnership between WPD, WSU and ATF is beneficial and unique. All three own a portion
of the Brasstrax machine. MOU’s are in place with other agencies (FBI, DEA, US Marshalls,
KHP, Sedgwick County Sheriff), allowing them to bring cartridge casings to the center for
analysis. The CGIC Team is staffed by 22 people from WPD, ATF, FBI and WSU.
There are 240 NIBIN sites in the country. In 2020, Wichita CGIC ranked 35th for leads
generated, 55th for acquired cartridge casings, and 55th in leads associated with 220 cases and
124 crime guns. There were 150 persons arrested related to a NIBIN lead (Jan – Oct 2020).
2020 statistics (as of mid-December): 2,410 total cases, 2,269 WPD cases, 10,422 total casings
examined, 947 leads generated and 1,524 test fires. Over 1,000 leads as of one week ago. Test
fires are conducted when a gun is recovered to see if there is a match with a cartridge found.
Gang Felony Assault Section handles non-fatal cases. Lt. Beard hosts a weekly “Wichita
Shooting Review” presenting recent shootings/shots fired, NIBIN leads, hot spot locations,
victim and suspect information.
• Shootings in 2021 are more than 2020, which was the most active shooting year in
Wichita (198 shootings in 2020). In 2021, four out of the last five homicides have
involved gang members. No sign of gang feud, but the victims and/or suspects were
identified gang members. Victims are consistently male, African American, ages 25-45.
• Hot Spots locations (where most shooting incidents occur) are Grove from Central to 28th
Street, Northwest Wichita, Hilltop and Plainview. Recently several in Southwest Wichita.
• NIBIN Enforcement Support System (NESS) reports create a chart to identify links
between casings found at different crime scenes, firearms recovered, suspects arrested
and homicides.
• Priority Offenders – individuals exhibiting violent behavior, gang membership, wanted
person, parole/probation status.
• Wanted persons – drugs, weapons, domestic violence, robbery, homicide, felonious
assaults and/or parole violations.
Sims asked if all staff are commissioned officers. Lt. Beard explained that all but the NIBIN
techs and Director of WSU Criminal Justice Center are commissioned.
Rojas asked about the technician’s role in the process. Lt. Beard said the technician looks at all
casings to see if they are eligible to be entered into the NIBIN system. Technicians at the
correlation center in Alabama review potential matches and compare to images in the database.
Rojas asked if there a standard agreed-upon science in the country. Lt. Beard said yes, all
technicians go through training and certification in Alabama. Required to update regularly. If
testifying in court, must have additional certification through KBI or ATF.

Fowler asked about the science claiming all marks are unique. Lt. Beard said sources state no
two the same, and all markings are unique. Can bring additional information.
Sims asked about citizens’ rights to follow up on cases. Lt. Beard said if contained in a criminal
case, he cannot release information but can give a general update to the citizen. Regarding the
specific case mentioned by Sims, there is no capability currently to analyze lead bullets in
Wichita. GCIC only handles cartridges. Can compare more easily when the gun is recovered.
Gang Intelligence Crime Unit: Gangs came to Wichita in the late 1980’s, primarily from the
West coast but also from Chicago and New York to sell crack cocaine. Turf wars erupted
between rival gangs and drive-by shootings became the attack of choice. Seeing the same
activity again with drive-by shootings up 110% over last year (150 drive-by shootings this year).
Mission of the Gang Unit is to focus on crimes committed by gang members, identify viable
charges, assemble and disseminate intelligence and eliminate gang violence. K.S.A. 21-6313
(2006) defines gang membership, makes it illegal to use intimidation to keep a member or to
recruit new members, and requires a $50,000 bond on new felony charges for a gang member.
WPD Policy 527 explains use of information and documentation in database.
There are 105 identified gangs in Wichita with 52 subsets. A total of 2,069 documented
members (1,781 active, 288 associates), 577 incarcerated and 244 deceased. A gang is defined
by state statute as a group of three or more persons with a common sign/color/symbol that then
involve themselves in criminal activity. Deceased members are tracked as they are often
honored by active gang members (e.g. tattoos).
The identified gangs represent most nationally-known groups, as well as Hispanic, Asian and
motorcycle gangs. There is a predominance of Bloods gang members in Wichita at this time.
The Gang Unit maintains contact with KDOC to monitor prison gang activity and how it may
affect the community. Hate groups and extremists are very difficult to deal with as they claim
free speech protection under the 1st Amendment as long as crime is not being committed.
The Gang Unit addresses gangs in three main ways: Prevention, Intervention, and Suppression.
They work closely with the juvenile intervention unit and Safe Neighborhoods program focusing
on preventing youth from joining, and working with parents of identified youth in gangs.
There is a strong network of teamwork and communication with federal partners and
prosecutors, including the designated DA assigned to gang crimes.
Wichita has a gang problem. WPD is continuing to develop information and focus on the most
violent offenders and activities.
Sims asked if they have worked with David Gilkey. Lt. Beard explained they have worked with
him in the past, and are hoping to bring him into the focused deterrence program work.
Visitor in Gallery (name unknown) inquired about measuring success of prevention. Lt. Beard
said WSU serves as the research partner with the Project Safe Neighborhoods program.
Admittedly prevention efforts are difficult to measure, meaning sometimes the focus is on
number of contacts made or when gang members drop out.
Visitor in Gallery (name unknown) asked if the categories of prevention and suppression have
been around for a while. Lt. Beard offered that programs which work must be long-term and

involve many facets. Having positive interactions with officers in schools and access to after-
school programs can help deter juveniles from joining gangs and participating in gang activity.
Gang activity between after-school and 11:00 pm is the second-most active time, with midnight
to 3:00am the most active.
Ailslieger asked if gangs divided by age or intermixed. Lt. Beard said gang members come from
all ages, ranging from 13-14 to 50-60’s. Some very active sub-groups are made up of only
young members (under age 18). Now seeing a return of older gang sets. Some do age out.
While not outlined in the State statute, WPD gives the opportunity to be removed from the gang
list following three years of no gang activity.
Ailslieger asked if gang members stay in school. Lt. Beard shared they often stay in school to
maintain social interactions. COVID has created a lot of down time for students, though.

Fowler moved to recess into executive session for 45 minutes to receive information on case
numbers 19PSB-3327, 19PSB-2929 and 20C073774 with possible consideration of 20PSB-
1214 to receive information which may involve attorney client privilege for personnel matters of
non-elected persons and matters which related to private property of persons in order to protect
privacy interest of identified individuals. Second by Bender. Began at 5:19 pm.
Returned at 6:17 pm. The board reviewed the various items on the agenda and made no
determination that any further actions should be taken at this time.
7. New Business – Chairperson Fowler
None for today. Pastor Sims may submit an agenda item for a later date.
Walt Chappell, Chair for Racial Profiling Committee, has asked Fowler and Sims to be on the
agenda to talk about Dr. Birzer’s report and a different perspective on the analysis of the data.
Fowler would welcome the presentation and discussion. Tentatively scheduled for February
meeting. Requesting 45 minutes. Allotted time depends upon the number of agenda items.
Ailslieger has been approached by several people with concerns over the computer software
purchased with CARES Act money and whether it was actually COVID related. Capt. Nicholson
will get an answer from Chief Ramsay and Deputy Chief Givens for Ailslieger.
Rojas spoke to new police recruits and wanted to commend WPD on a very diverse class.
Bender asked if officers are more accessible to the news media than they were in the past.
Capt. Nicholson said they are now encouraged to develop a relationship with the media.

• A presentation regarding their findings of the 2016-2018 traffic citation analysis that
completed in August 2019.

A. 20PSB: 2781: On June 30, 2020, a Wichita Police Officer utilized his Taser to apprehend a
suspect for an existing warrant. It is alleged the officer discharged his weapon as the
suspect ran from the officer, striking the back area of the suspect and causing the suspect
to fall. It was alleged the suspect was pregnant at the time of this incident.
