A. 21PSB-0845: On February 17, 2020, a Wichita Police Department (WPD) supervisor
attended training in Arizona, when it was alleged he made racially offensive comments.
B. 19PSB-3884: On December 9, 2020, a former WPD employee submitted a written
complaint through the Fraternal Order of Police (FOP), where he alleged members of the
executive staff had committed misconduct. The complaint submitted was in response to
an investigation, which was initiated against him on December 4, 2019 where he was
alleged to have committed misconduct while employed by the Wichita Police
Department.

1. Call to Order – Chairperson Fowler
The meeting was called to order at 4:04 p.m.
2. Approval of Minutes
Bender made a motion to approve the February 25, 2021 minutes. Second by Lopez. The
minutes were approved as written.
3. Public Agenda - 15 minutes is set aside for this portion of the meetings.
Twila Puritty introduced herself as a frequent attendee of the meetings and an applicant for
board service. She is the CEO of Wichita Urology Group, and believes her business experience
would be a good contribution to the group. She presented two questions to the board:
1. On the list of complaints, why are there numbers skipping? Capt. Nicholson explained that
the list is comprehensive of all internal and external complaints, some of which are still
under review. They appear on the list when they are resolved and entered into the system.
The document can be confusing to read, and he is open to suggestions to make the report
more understandable. Puritty referenced March 19 where there were nine missing. Capt
Nicholson said there may be a lag time for entering into Blue Team system. Lt.
Richenberger said some listed are still ongoing and would not be released. Fowler clarified
that the board has the opportunity to review only closed cases, and does not have the
opportunity to pull open cases. Kester referenced the second column from the left, which
places the cases in sequential order based on date received which is why they don’t always
fall in case order. Capt. Nicholson said some lag time exists between when received and
number assigned. Fowler offered that the report title can be misleading, and is more
accurately a listing of ongoing complaints. Ailslieger said for the most part the report is in
case order. Bender asked Puritty if she had a specific concern, for example a concern that
complaints were not included in the report. Puritty said she didn’t know enough about the
process to state an actual concern.
2. Regarding Dr. Chappell’s presentation at the meeting last month, why is there no mention of
it on the agenda? Fowler said it would be included in staff reports. He explained that WPD
is considering the request, but was not able to get a report back as of this meeting date.
Bender encouraged her to contact the City Manager regarding interest in serving on the board.

4. Staff Report Update – Captain Nicholson
From February 19 to March 20, there were one excessive force, 11 improper conduct, 23
procedural violations, two safety violations and one unnecessary force. The most investigated
complaint for the time period was failure to follow policy, five rude conduct and various others.
There were a total of 23 external complaints and 15 internal. Disposition includes 23 ongoing,
one officer resigned under investigation, nine received coaching/mentoring, two were
exonerated and three were unfounded. Year to date, there were 62 external complaints and 40
internal complaints.
Puritty asked if there was a way to present this information in a comparative format, so that
trends could be noted (e.g. peak times of year). Nicholson noted the suggestion.
Following up on the data review requested by Walt Chappell on behalf of the Racial Profiling
Advisory Group at the February meeting, Captain Nicholson noted that one analyst has since
left the City, leaving the department with only three data analysts. They are performing mission
critical duties (e.g. records management), but will work on the request within a month. Fowler
offered that WPD was very responsive to the request and had subsequently responded via
email to Fowler, Chappell and Bender.
Fowler requested to pull for review 20PSB-5312 and 21PSB-0269.
5. HOT (Homeless Outreach Team) Presentation
Officer Anne Mackey spoke on behalf of the Homeless Outreach Team. She has been an
officer for 15 years, including service at Patrol North, CP East, Patrol South and now HOT.
Officer Nathan Schwiethale founded the team nine years ago. Currently, HOT is a four man unit
with Matt Lowe, Ryan Doshier, Dave Nienstedt.
Officer Nate is a south side veteran with 20 years on the force. While on patrol in the core area
downtown and during community policing, he saw a growing number of homeless people. In
2009, there were 384 homeless and 71 chronic homeless. In 2011, there were 634 homeless
and 140 chronic homeless.
He researched response efforts in cities across the country, and found that homeless programs
led to 84% fewer days in jail and a 78% drop in arrests. There are economic impacts on the city,
as one homeless person costs a municipality $54,000 annually.
Police often find themselves between fielding the concerns from the community (e.g. “Broken
Window Theory”) and advocates for the rights of the homeless, often non-profit organizations
perceiving police as heavy handed. Police forces also have to mitigate legal concerns including
unlawful search and seizure, destruction of property, targeting homeless, property rights and
panhandling.
The City of Wichita enacted a camping ordinance modeled after Cooper vs. State of Seattle. It is
illegal to camp in the city of Wichita without a permit. Exceptions are made when no shelter
space is available, which is more common for women as there are more shelters housing men.

Camping sites are given 72 hours to move on or the camp materials are considered abandoned.
In some communities, the ACLU has filed law suits over camping ordinances for not allowing
due process.
Responsibilities of HOT Team include answering calls for 911, calls for service, contacting
homeless individuals and connecting them with assistance if needed. They practice
nontraditional policing. Traditional policing such as giving tickets for actions like drinking or
urinating in public, creates a cycle of arrests with outstanding warrants for previous actions.
When Officer Nate created the team, he knew they had to do something different. The HOT
Team created a procedure to enforce the ordinance: 1) Make contact and gain information
about the person (similar to case management), 2) Document a warning with specific referral to
local resources; 3) Allow the individual 24 hours to move, go to shelter or issue citation.
In nine years, the HOT Team has never written a camping citation, meaning the procedure has
led to 100% compliance. Officer Mackey presented a video of a success story and a picture of
the posting announcing the date the camp will be cleaned up.
“Finding a way home” program is another option for homeless able to reach out to family
anywhere in the Continental US. Thanks to private donations, they will buy a bus ticket for the
homeless individual to be reunited with family.
Sometimes they have to deny donations such as sleeping bags, as they cannot promote
camping. They encourage donations to shelter spaces instead.
Police serve as vital connectors between the Homeless and local service providers. Officer gets
to know the person and the story and then can direct the person to the best resource(s).
Year to date, the Homeless Team helped house 1,155 people. Annual homeless person count
shows some improvement. In 2011, there were 634 2011 homeless and 140 chronic homeless.
In 2019, there were 593 homeless and 20 chronic homeless. United Way helps approximately
3,000 per year. Estimated savings of homeless programs is $62,370,000 in nine years.
In recent years, there were large news segments on prevention of panhandling and instead
giving more money to non-profit providers.
Questions:
Fowler asked what shifts the officer work. Officer Mackey answered that they work four 10 hour
shifts weekdays 7:00 am to 5:00 pm because that is when service providers are open. In the
early years, they tried having a night shift officer, but found they were unable to connect with
services.
Fowler asked Officer Mackey to walk the board through an example of their interactions with the
homeless. Officer Mackey said generally the homeless individuals are not angry. Those who
want help will call, and many seek shelter on their own (police never have contact). Sometimes
individuals are nomadic and open to moving along. Today, they interacted with individual who
had been through addiction treatment in the past, and was willing to return.
Ailslieger asked about the difference between “homeless” and “chronic homeless.” Officer
Mackey said that chronic homelessness is defined as being homeless for at least a year or
more. Ailslieger asked if some are living the life they want to live? Officer Mackey said many
are living in addiction, often with mental illness. Ailslieger asked if talking someone into going to

Comcare is difficult. Officer Mackey said many in this population have already been through the
cycle of seeking treatment. It’s also difficult to tell the difference between mentally ill and meth
use (mirrors symptoms of schizophrenia). Addiction is so powerful that it takes over. Ailslieger
asked if the officers inquire about family to contact. Officer Mackey said in her experience on
the Team, that question has opened her eyes. Typically, every bridge has been burned with
family and friends. It is hard to have relationships with people who are addicts. They are placing
themselves in a difficult situation, but the offer for inpatient treatment is always available.
Bender noted that he had worked with the HOT team in its first seven years, while he was
serving as director of Union Rescue. He said this program is unusual in comparison to other
cities, and serves as an incredible resource. Many other cities have visited Wichita to learn
about the model which is connecting those in need with those available to serve. While services
are available, not all individuals want to take advantage. Capt. Nicholson said the HOT Team
are considered subject matter experts. They serve under his command at South Patrol. Their
actions have helped the City stay ahead of lawsuits from ACLU. In fact, there are so many
services in Wichita, some communities ship their homeless individuals to Wichita.
Puritty asked about Officer Mackey’s favorite part of the job. Officer Mackey said this position is
the most emotionally exhausting, but she believes in serving this mission and following God’s
plan.
Ailslieger asked if they see many families who have not sought shelter. Officer Mackey said
they rarely find families with small children in their interactions with the homeless. Children
would be immediately placed in shelter through DCF.
Puritty asked if they have an annual report to review and the location of the procedure manual.
Capt. Nicholson said all data is kept and he can share the information with anyone interested.
6. Executive Session – Review of Complaint(s)/Investigation(s)
Fowler moved to recess into executive session for at least 20 minutes to receive information on
case number 20PSB-5178 and 20PSB-3483 for the purpose of addressing personnel matters of
non-elected personnel and to protect privacy interests of individuals that may be identified.
Second by Lopez. Approved. Return no earlier than 5:20. Began at 5:00 pm.
Returned at 5:22 pm. As to the two cases reviewed, the board makes no recommendations.

Next meeting April 22, 2021.
The board asked to review cases 20PSB-5312 (Fowler), 21PSB-0269 (Fowler), 21PSB-0845
(Harris), and 19PSB-3884 (Harris).

Harris made a motion to adjourn. Second by Lopez. The motion passed unanimously and the

investigations.
5. Executive Session – Review of Complaint(s)/Investigation(s)
A. 21PSB-0845: On February 17, 2020, a Wichita Police Department (WPD) supervisor
attended training in Arizona, when it was alleged he made racially offensive comments.
B. 19PSB-3884: On December 9, 2020, a former WPD employee submitted a written
complaint through the Fraternal Order of Police (FOP), where he alleged members of the
executive staff had committed misconduct. The complaint submitted was in response to
an investigation, which was initiated against him on December 4, 2019 where he was
alleged to have committed misconduct while employed by the Wichita Police
Department.
C. 21PSB-0667: On January 8, 2021 an officer with the the WPD arrested someone for
felony domestic violence charges. This person was handcuffed and placed in the back of
the car but escaped by climbing out of the window while the officer was distracted.
D. 21PSB-1218: on March 19, 2019 complainant called PSB to allege that a WPD officer
racially profiled him and did not secure him properly in the back of his vehicle and he fell
over onto his stomach while being driven to the jail and aggravated a pre existing back
injury.
