Wichita Citizen Review Board Minutes June 24, 2021 4p.m. City Council Board Room 455 N. Main St, Wichita, KS 67202 Present: Jay Fowler (Chair), Paul Kitchen, Shaun Rojas, Stephanie Luna, Sharon Ailslieger, Dennis Bender (via phone) City of Wichita Representatives Present: Jennifer Magana, Captain Wendell Nicholson, Lieutenant Bob Reichenberger, Lieutenant Krys Henderson, Sergeant Carl Lemons, Deputy Chief Jose Salcido and Zachary Kester 1. Call to Order - Chairperson Fowler The meeting was called to order at 4:06 p.m. 2. Approval of Minutes The May minutes were amended to correct the spelling of Mr. Barfield's name. Kitchen made a motion to approve the May 28, 2021 minutes; seconded by Luna. The minutes were approved as amended. 3. Public Agenda - 15 minutes is set aside for this portion of the meetings Twila Purrity came up to share her observations of the board . She wanted to express how much she appreciated the WPD personnel that help with the CRB meetings. She expressed concern that the Board could not point to specific accomplishments they had achieved. This concerns her, because if there were to be a major incident involving the police department she feels it would reflect poorly on the Board that they couldn't point to major accomplishments. She believes that the Board is not adhering to all of the terms dictated by ordinance 50-912, which created the Citizen Review Board. An example she gave was if a board member misses two consecutive meetings they are supposed to be removed from the Board. She encouraged the Board to review the ordinance and make sure that they are meeting all of the requirements. Next, Walt Chappell asked the Board what their quorum was. Fowler responded that their quorum was four and they had five members attending . He also asked about a presentation on a citation analysis that was supposed to be presented to the Board . He believes that there is no correlation between the number of citations issued and the number of accidents prevented . He also asked that the video of the meetings be posted to the City's YouTube channel. Chappell asked about how much it costs to defend police officers regarding civil suits. At 4: 19 Fowler called an end to the public agenda. 4. Staff Report Update- Captain Nicholson From May 13, 2021 to June 20 th , 2021 : 21 improper conduct, 21 procedural violation, 3 safety violation, 1 unnecessary force, 29 external complaints and 17 internal complaints of these 1 was cleared by AXON video , 10 were resolved with coaching and mentoring, 1 was not sustained, 18 are ongoing, 1 resulted in termination, 15 were unfounded. The most common violation was 5 instances of attentive to complaints by citizens, followed by 5 complete and thorough investigation, 5 comply with policy. For the year (2021 ): 130 external complaints and Created July 16, 2021 by Zachary Kester, Administrative Aide, Wichita Police Department 73 internal complaints. Most common cited violation was rude conduct, followed by comply with policy, complete and thorough investigations and attentive to complaints by citizens. Fowler asked about the status of having the meetings recorded and uploaded to YouTube. Lieutenant Reichenberger stated the City Communications T earn has declined to continue providing staff to record and stream the meetings. At this time there is no plan to record and stream the meetings. Kitchen asked that the agenda posted to the website prior to the meeting. Fowler asked that the agenda be posted no later than the Monday prior to the meeting. Fowler said that he will be making a motion, in New Business, that the Board make a recommendation to the City Manager to delegate appropriate resources to record and stream the meetings. Fowler asked to pull cases 21 PSB-2239 and 21 PSB-1160 for review. Purrity asked for clarification on disposition findings. Specifically she asked for help understanding how a complaint could be unfounded. Captain Nicholson gave clarification on how an investigation could result in an unfounded complaint. She also asked about seeing, on the year to date stats, the disposition for how those complaints were closed. Captain Nicholson said that he would speak with Keely about that. 5. Chair Elections - Chairperson Fowler Ailslieger nominated Fowler to remain as Chair; nomination was passed unanimously. Fowler said that he would only hold the office of Chair for one more term. Kitchen nominated Harris to become Vice-Chair; nomination was passed unanimously. Ailslieger nominated Luna to remain as Secretary; nomination was passed unanimously. 6. Police Discipline Records Discussion - Lieutenant Henderson Lieutenant Henderson gave a presentation on research he had done regarding how police departments across the country handle dissemination of police discipline records. Fowler said statute 45-221, the Open Records Statute, does not say that records are confidential. The statute says that the government entity can exempt them from disclosure. It is not a statute that mandates confidentiality; however, it is a statute that allows for confidentiality. Fowler believes it is a choice to keep police discipline records confidential, because the department has the ability to release this information during specific circumstances. Since the creation of the Citizen Review Board, the WPD has been creating a spreadsheet of all closed PSB investigations and how those investigations were closed . Rojas is very proud of the work that the Board has done with the WPD to get that spreadsheet created and available to the public. He also asked whether it was standard procedure, when hiring a person with prior law enforcement experience, to contact the agency they were employed with prior. Henderson answered that it is part of the hiring process to contact the agency that the applicant previously worked with. Nicholson explained that a nationwide issue is that sometimes large agencies will terminate an officer and a smaller agency will hire that officer based solely on the fact that they already have a commission. Fowler asked when the WPD notifies KS C-POST of discipline. Nicholson responded that KS C- POST is usually notified when an investigation has been completed. Fowler followed up by asking what kind of discipline gets reported to KS C-POST. Chappell said he believes there is a double standard for officers. Henderson addressed this by stating, when an officer has committed a crime that the department releases their information and what crime they are being charged with. Fowler stated that the public should be patient and wait for adjudication to occur before making serious allegations. Fowler asked if the WPD has taken a position to modify the Fraternal Order of Police (FOP) contract regarding confidentiality. Henderson answered by stating that he was not involved in contract negotiations. 7. Policy 409 Discussion - Sergeant Lemons Lemons gave a presentation on WPD Policy 409 relating to vehicle and pedestrian stops. Fowler asked if there are any planned revisions for Policy 409. Lemons said, the Department does not have any specific revisions being made to the policy; the policy is up for review. Reichenberger clarified that the Department reviews all policies once a year. There have been no proposed changes to Policy 409. There was a question from the public about what reasonable suspicion was. Lemons clarified by saying that reasonable suspicious is when the officer is able to articulate their belief that an individual has committed a crime or is in the process of committing a crime. Chappell suggested that we stop the pretext stops, as vehicle and pedestrian stops are very confrontation for both the officer and the citizen. Nicholson advised that the traffic analysis data should be available to be presented at next month's meeting. 8. New Business - Chairperson Fowler Fowler made a motion that the Board request the City Manager to provide staffing to record and stream the CRB meetings on YouTube. "Meetings of the CRB have presentations of useful information for citizens to consider and provide a component of the community engagement role of the CRB. The CRB requests the City Manager direct staff to provide for YouTube streaming of meetings with archiving and to post agendas of upcoming meetings no later than the Monday before a scheduled Thursday meeting." This motion was seconded by Rojas and passed unanimously. 9. Executive Session - Review of Complaint(s)/lnvestigation(s) Fowler moved to recess into executive session for at least 20 minutes to receive information on case number 20PSB-5029 for the purpose of addressing personnel matters of non-elected personnel and to protect privacy interests of individuals that may be identified. Seconded by Rojas. Approved. Return no earlier than 6:04 p.m. Executive Session began at 5:44 pm. The Board returned at 6:04 p.m . from Executive Session. As to the case reviewed, the Board made no recommendations. 10. Adjourn Created July 16, 2021 by Zachary Kester, Administrative Aide, Wichita Police Department Bender made a motion to adjourn. Seconded by Rojas. April 2021 • Motion to have WPD leadership come and present about how the WPD reaches out to learn from other Police Agencies , and what other Police Agencies asked to learn from the WPD. • Request to have a discussion at a future meeting about the pros and cons of confidentiality provisions the police disciplinary procedures. June 2021 • Requested to start reviewing WPD policies. Mainly those policies that are about how WPD interacts with the community. Executive Session – Review of Complaint(s)/Investigation(s) A. 21PSB-2239: On May 13, 2021, a complainant was stopped for a traffic violation in the 6100 block of E. 21st Street. During the stop, the complainant stated the officer pointed his duty weapon at the complainant without reason. B. 21PSB-1160: On February 3, 2021, Wichita Police Department officers responded to a disturbance with shots fired in the 900 block of S. Market Street. After a suspect was located and taken into custody, he became combative and was taken to the ground by officers. While on the ground, an officer drive stunned him with his Taser. 8.
