• Dr. Michael Birzer will be giving a citation analysis presentation on citations and
accidents reported in the City of Wichita area for the 2019-2020 year.
6. Hiring Process Presentation – Sergeant J. Vogel
• Training Bureau academy staff will give an overview of the Wichita Police
Department’s (WPD) hiring process for police recruits, and will ask for feedback on
the Department’s process.
7. Discussion – Request to Law Department – Board Member P. Kitchen
• Consideration of request to the City of Wichita Law Department regarding
information on legal costs.

1. Call to Order – Chairperson Fowler
The meeting was called to order at 4:06 P.M.
2. Approval of Minutes
Lopez made a motion to approve the July 22, 2021 minutes. Seconded by Bender. Minutes
were approved as written.
3. Public Agenda - 15 minutes is set aside for this portion of the meetings
Before the public agenda began, Fowler made a statement that public speeches be kept to
three (3) minutes. Additionally, it was mentioned the meetings were being streamed on the
Wichita Police Department (WPD) YouTube channel and public speakers were asked to state
their name before proceeding.
Twila Purity mentioned Bender’s recap (to be discussed on item six (6) of agenda) had
wonderful material. However, Purity asked the Board where they want to go as a Board and
what their future goals entailed. Additionally, Purity asked what the Board looks for when
reviewing complaints and investigations. Purity also mentioned that when data was asked for
regarding the Department’s Bureaus – it was provided. However, Purity asked for City
Manager’s data and reports along with the top ten (10) officers regarding monthly complaints.
Purity stated she took the monthly reports for the year and noticed data was being given in
chunks and not by month. Additionally, she inquired why some complaints took days to close
out and others took months.
Bender asked the Board for clarification regarding Purity’s concerns.
Lawanda DeShazier wanted to thank the WPD for taking the time to provide documents to the
Board and public. Additionally, she wanted to know the process of complaints and how they are
investigated.
Walt Chappell began by stating he would be resigning his position of Vice Chair of the Racial
Profiling Advisory Board. His concern was that no citation data has been provided. A motion
was made in February 2021 regarding this data. A second concern was double standards
pertaining to law enforcement personnel being involved in crimes and no information is provided
regarding that person. Chappell mentioned the Board is unable to review cases pertaining to

WPD personnel until after the cases and court litigations have been closed. Chappell asked the
Board to consider a motion asking for legal expenses pertaining to defending officers. In August
2020, PIO Charley Davidson gave a list, but nothing provided since. Chappell asked the Board
to ask the City Attorney for a complete analysis regarding actual cost and taxpayer dollars when
defending law enforcement personnel in a court setting.
Fowler made a statement the allotted 15 minutes had been concluded. Purity asked about the
15 minutes given, whether that was the Department’s doing or the Board’s. Fowler stated it was
figured at the start of the Board. Fowler, again, asked the public to keep their speeches to three
(3) minutes.
Timothy Sims inquired about a motion put forth back in February 2021 regarding an ongoing
one-page document pertaining to motions made by the Board. Sims inquired about receiving a
copy of the requested document. Fowler made a statement that the request has been fulfilled
and is attached to the bottom of the minutes, which is presented at each meeting and given to
the public.
4. Staff Report Update – Captain Nicholson
Nicholson began the staff report update, stating Warehime broke down the number of
complaints closed and number of new complaints received. A total of 11 external complaints
were received and a total of 8 internal complaints were received between July 16 – July 31,
2021. Of the new entries received, 1 officer was investigated from the Central Bureau, 4 were
from Investigations, 5 from Patrol East, 4 from Patrol North, 5 from Patrol South, 1 from Patrol
West, and 1 from the Training Bureau.
Of the closed entries from previous months, 30 entries were closed and 37 officers of the
Department’s total 854 were investigated. Comply with Policy was the most violated at 8,
Handling of Evidence and Personal Property was 5, and Use Good Judgement was 3.
Fowler inquired about ongoing trends pertaining to policy violations. Nicholson stated most
violations come from young (i.e. newer) officers regarding the following of proper policy and
procedures. Additionally, any openings are being filled by young officers.
Fowler asked what would constitute comply with policy violations. Nicholson stated failing to
activate body worn camera is the number one violation for comply with policy. Additionally,
failing to activate body worn camera can now result in discipline.
Purity asked Nicholson if there are the same amount of officers within each Bureau. Nicholson
stated most Bureaus are somewhat equal between 85-90 officers and investigations has about
100 detectives.
Bender wanted to take a moment to thank Warehime for the breakdown in data.
Warehime wanted to give clarification that statistics and graphs will be given for calendar month;
hence the reason for the data being so short for August’s meeting.
5. Disposition Letters for Investigations – Sergeant Lemons
Lemons presented three (3) drafts that were given by the Racial Profiling Advisory Board: 1.
Acknowledgement of Complaint, Assigned Complaint, and Disposition. The Acknowledgement
of complaint comes from the initial citizen. The Assigned Complaint has the same components

as the first document; however, a specific timeframe regarding the complaint and the detective’s
information along with supporting documents would be added – this could work simultaneously
with PSB. The Disposition requested would have an assigned reference number, investigator
name, information regarding the policy in which the detective came up with a finding, asked for
last review process to go through CRB and asked to enclose a brochure with finding. Lemons
asked the Board for additional feedback.
Fowler asked if there were any questions for the Board, but gave positive feedback regarding
improved letters.
Warehime stated a Spanish version has been provided on the internet. Adding witnesses to the
online complaint form is now easier and multiple witnesses may be added. However, there is no
option to download videos, but a question will be asked if video is available (yes or no) and the
complainant can select “yes” or “no” and a detective will know to contact the complainant
regarding video evidence.
Vincent Hancock (public) stated the documents are progressing and the verbiage is more
understandable. Additionally, it was recommended that the document note the decision doesn’t
come from PSB, but rather Executive Staff. Nicholson agreed that PSB doesn’t make decisions
and the final finding comes from Executive Staff.
Bender appreciated the various findings, but wanted to understand why one determination is
different from the other, i.e. (not) sustained versus un-sustained. Warehime noted that it is
written in policy separate ways.
DeShazier wanted to thank the Department for the input, but wanted to view the brochure.
Additionally, it was noted the brochure was designed 12 years ago with little to no updates. It
was recommended that the brochure update the language used. DeShazier asked what the final
step means. Fowler stated, citizens would ask the Board to review their complaint during
Executive Session. DeShazier mentioned the average citizen might not understand the
verbiage.
6. Review of Draft Report on Accomplishments of the Citizen Review Board – Board
Member Bender
Bender made a statement that his document could be made available to the public; however, it
should be noted the document is not comprehensive or all inclusive. Bender noted he used
previous meetings to create the draft. He stated 1,000 complaints were screened and had
asked the Professional Standards Bureau (PSB) for complaint totals.
Purity asked if the Department took into consideration Bender’s findings and accepted feedback
on recommendations. Fowler stated, during the process of review the Board makes suggestions
and comments and Executive Staff does hear about the comments made. The Board has asked
Command Staff members to come and speak regarding suggestions, and an exchange of
information is confidential under the ordinance and information cannot be published. However,
policy recommendations can be made. Additionally, Purity asked if there was follow-up. Fowler
stated, when questions are asked the Board is satisfied with the information given during
Executive Session.
Kitchen noted a correction to be made with Bender’s report, stating the CPA class was 12
weeks and not 12 months. Document to be corrected.

Lopez made a motion to approve the amended document. Board second unanimously.
7. Proposed Policy Changes – Chairperson Fowler
Fowler began the discussion stating the document provided to the Board was to summarize the
process and current procedure for grievance and arbitration. Fowler stated this policy would
give the following: 1. Discipline records for serious conduct violations (i.e. commit a crime)
should be considered public record, at some level, and no longer subject under KORA because
the City would recommend the documents are no longer confidential when a crime has been
committed and 2. When the discipline process has been completed, it is recommended the
arbitration and grievance proceedings become public record and are no longer subject to KORA
exemption.
Fowler stated the community would be interested in grievance and arbitration process. A final
recommendation was made that grievance and arbitration proceedings be matter of public
record. Fowler asked the Board about policy recommendations.
Bender stated he supported recommendations. Asked if the document would be filed with the
City Manager, Council, or Attorney. Fowler stated the recommendation would be filed with the
City Manager. It should be noted, that the Board is an advisory board and doesn’t have the
authority to make changes.
Lopez concurred with Bender. Rojas inquired to Lopez why he supported the document. Lopez
stated a balance needs to occur regarding confidentiality relating to employees versus public
servants.
Kitchen noted that he had read the document but was still processing his decision. Harris made
a similar statement. Harris inquired “Where does it go from here?” “How does it benefit?” “Who
does it benefit?” Fowler stated, the document could benefit the Department and shine into the
city litigation. Fowler stated no decision needed to be made at this month’s meeting. It was
recommended because FOP contract comes up for review in December and this could be an
input into the process.
Lopez answered Harris’ concerns, stating the document could benefit the public stating the
Board needs to start moving in a direction of where they need to go. Bender agreed with Lopez,
stating an obligation to the citizens of the community that reasonable review is part of the
operation.
A public comment was made (unknown male), where there needs to be an understanding
between discipline and personnel matters. What type of discipline is being utilized when officers
are violating policy or crimes (i.e. excessive force or abuse).
Sims stated the document had excellent recommendations. Hancock agreed that it was a great
document. Hancock mentioned he had done research from other jurisdictions and pointed out
number 11 to define serious misconduct and excessive force. Only serious policy violations
should be considered.
Rojas was concerned that officers work hard and are given tough situations on a daily basis.
Giving information on coaching/mentoring violations seems unfair. Fowler stated the document

is intended to be for serious concerns and policy violations. Rojas stated the FOP might struggle
with the recommendations.
Chappell noted the accountability and transparency. Chappell asked for a motion on data be
passed regarding legal requests.
Fowler asked the Board if they wished to adopt the recommended document.
Ailslieger stated the discussion had been good, but was not able to vote. Ailslieger asked for
more time to consider the request and to conduct her own research. Ailslieger wants to be able
to write the report as concisely and workable as possible and would like the opportunity to
discuss this topic again.
Kitchen inquired about FOP contract. Nicholson said negotiations have already begun but could
conclude by December 2021.
Ailslieger asked for another 30 days to consider document. Lopez inquired if the Board prolongs
the discussion another month, will it give appropriate time for contract process and to be given
to City Council. Ailslieger stated the Council meets once a week, so they would have time to get
the document in front of the Council.
Fowler stated he would be willing to vote on the document at this month’s meeting. Kitchen
asked to consider number 11 on document that before mentioned. Fowler asked to take into
consideration arbitration and grievance recommendation as it was more time sensitive.
However, Ailslieger still asked for time to think things through. Bender and Lopez asked for a
compromise.
Fowler asked the Board to make a motion, stating the Board defers consideration and propose
resolution to number 1; however, the Board adopts recommendation to number 2 to the City
Manager and City Council. The Board will defer until next month regarding policy change in
paragraph 10, adopts as policy recommendation relating to grievance and policy.
Lopez second motion. Passed unanimously.
8. Executive Session – Review of Complaint(s) / Investigation(s)
Fowler moved to recess into executive session for at least 30 minutes to receive information on
case numbers 21PSB-3957 and 21PSB-3958, for the purpose of addressing personnel matters
of non-elected personnel and to protect privacy interests of individuals that may be identified.
Request passed unanimously by all Board Members. Return no earlier than 5:58 P.M. Began at
5:28 P.M.
Returned at 6:03 P.M. As to the cases reviewed, the Board made no recommendations.
9. New Business – Chairperson Fowler
No new business from the Board. However, a recommendation relating to Chappell’s request
regarding the Law Department’s response regarding money spent on defending law
enforcement personnel should be placed on September’s agenda.
Bender inquired about Dr. Michael Birzer’s review of citation statistics.

Fowler stated the legal defense request by Chappell to be placed on the agenda for
September’s meeting. Additionally, Fowler stated he would have to defer to Dr. Birzer regarding
the review of citation data not being completed; however, it should be completed by
September’s meeting. Bender inquired if Dr. Birzer was conducting this analysis on a volunteer
or paid basis – Reichenberger informed the Board it was a paid status. Additionally, it was
mentioned by Fowler that Chappell has been given some data.
10. Adjourn
Ailslieger made a motion to conclude the meeting. Second by Rojas.
The meeting adjourned at 6:06 P.M.
The next meeting will be held on September 23, 2021, at 4:00 P.M. in the City Council First
Floor Boardroom (455 N. Main St, Wichita, KS 67202).

April 2021 • Motion to have WPD leadership come and present about how the WPD
reaches out to learn from other Police Agencies, and what other Police
Agencies asked to learn from the WPD.
• Request to have a discussion at a future meeting about the pros and
cons of confidentiality provisions the police disciplinary procedures.
May 2021 • Requested to start reviewing WPD policies. Mainly those policies that
are about how WPD interacts with the community.
June 2021 • Requested that City Manager direct staff to provide for YouTube
streaming of meetings.
• Also requested that the agenda for CRB meetings be posted no later
than the Monday prior to a scheduled Thursday meeting.
July 2021 • Recommended that a statement be added before executive session
asking that all those that cannot stay for executive session exit the room
quickly.
• Recommended that there be a designated time for the board to ask
questions and after the board has finished asking questions, then the
public will be allowed to ask questions.
August 2021 • Motion passed regarding accomplishments of Citizen Review Board to
be published with amended corrections.
• Motion passed asking the Board to adopt recommendation to number 2
in proposed policy recommendations.
• Recommendation to review citation data from Dr. Birzer be placed on
September agenda.
