Page 1 CITY COUNCIL PROCEEDINGS SEPTEMBER 1, 2020 MINUTES OF THE MEETING OF THE CITY COUNCIL Wichita, Kansas, September 1, 2020 Tuesday, 09:00 AM The City Council met in regular session with Brandon Whipple, Cindy Claycomb, Bryan Frye, Becky Tuttle, Jeff Blubaugh, James Clendenin, and Brandon Johnson. Staff Members Present: Bob Layton, City Manager, Jennifer Magana, Director of Law, and Karen Sublett, City Clerk. Mayor Whipple called the meeting to order at 9:00 a.m. Approve the minutes of regular meeting on August 25, 2020 MOTION: Mayor Whipple moved to approve the minutes of regular meeting on August 25, 2020. Motion carried 7 to 0. Proclamation - Government Support Day. Mayor Whipple read aloud the proclamation. I) PUBLIC AGENDA 1.) Scot Pierce - Health Mandates Public Application. Scot Pierce stated he is a lifelong resident of Wichita and served for nearly 20 years the citizens of Sedgwick County and Wichita as a full time paramedic for Sedgwick County EMS and went on to get an undergraduate degree in the sciences. Stated he is here today as what he believes a representative of the vast majority of Wichita citizens who are asking for choice and is formally asking the City Council to repeal the mask mandate that has been imposed previously in and around the situation with COVID-19. Stated as a scientist he has had extensive study in COVID-19 since its onset in the U.S. Stated we know that science evolves and in the early days this pandemic got political legs, which has changed the hue and the landscape on how we made decisions in and around it. Stated to date we know a lot more about COVID-19 than ever before, we know its pathos-physiology, we know according to the CDC, who recently has relaxed many of its guidelines in terms of travel restrictions and return to basic common living; we know that now more choices are being made than ever in and around the mitigation and the risks of COVID-19. Stated he is asking the Council to repeal the mask mandate because we know that prior to COVID-19 there were hundreds of studies that revealed what mask do and don't do. Stated in the current setting we know a Nano-particle that is literally 0.00175 microns and in the medical and viral world you have to understand that is a redwood forest micron that cannot be seen without an electrical microscope. Stated the common cloth masks that we wear today are only able to filter anywhere from 30 to 400 microns, which in the micron world is a redwood forest log. Stated in relationship to COVID-19, we know it laughs at the ability to filter a Nano-particle of a COVID-19 molecule. Stated if he were infected it would not stop him from potentially presenting you with disease. Stated if it were the magic Page 2 CITY COUNCIL PROCEEDINGS SEPTEMBER 1, 2020 bullet, we should suspect to see not only a significant decrease but almost a delete of COVID-19 cases in Wichita and Sedgwick County but we are not seeing that. Stated we are seeing similar numbers that are highlighted every day as if it infers death. Stated we are faced with living with COVID-19 not from COVID-19. Stated COVID-19 is here to stay and is now on the list of perils that we must live with. Stated what he is asking for in the repeal of the mandate is that we make a choice; science reveals that if you are in fact healthy, you are not likely to infect another person with COVID-19. Stated he is asking that the Council give serious consideration to the fact that we must evolve with it and must make decisions that evolve with the current trend as to what we know about the disease and how to effectively mitigate it. Stated we know that most of the deaths are associated with patients who are at risk with comorbidities. Stated it is important to delineate from a public perspective to a personal perspective that patients need to make choices how to mitigate that risk themselves and if you are at risk, you should mitigate the risk responsibly, if you are not at risk then you should be allowed to make the choices to live freely and to make choices freely. Stated when he checked in this morning to speak, the masks that were provided out on the table are literally paper towels. Stated your entity folded paper towels and stapled with rubber bands. Stated his paper towel mask is dirty and has greasy thumbprints on it and his guess is the maintenance person who made these, did not wash his hands before putting them together. Stated he would not put this on his face and it is not an adequate filtrate to any kind of viral micron and is laughable. Mayor Whipple stated you have presented yourself as a scientist, what are your academic credentials? Scot Pierce stated he did his undergraduate in the sciences and has a bachelor's degree in bio-chemistry and his career has been in and around medicine for the duration of his adult life and has worked for big pharma. Mayor Whipple stated you mentioned a study and asked Mr. Pierce if he can offer any studies that they can look up to help them get a better understanding of your perspective which has gone against our medical experts. Scot Pierce stated he doesn't have them in front of him and would be happy to email those to you. Council Member Johnson stated he appreciates hearing Mr. Pierce's perspective. Stated one thing he continues to hear about masks and the concern is as other folks live freely without their masks, it still puts at risk some of our older population and those who have other issues and asked Mr. Pierce what he would say to folks who worry about that. Stated if we repeal it, then folks are freer to not wear masks, even if you are a systematic, people who could potentially transmit this to someone is going to visit grandparents and then they catch it. Scot Pierce stated ultimately we are responsible for personal health. Stated when the World Health Organization in early March declared this a pandemic and a public health crisis, this thing got political legs and became now my responsibility to mitigate risks for you, when ultimately it should have been mitigating personal risks for myself. Stated he still thinks that exists and thinks if you are in fact at risk, if there are risk factors in the mix, you are ultimately responsible for mitigating that risk. If you have two or more comorbidities and are at risk for exposure, you probably should limit your exposure and contact and if you are sick or have a fever, you should probably wear a mask. Stated he is not an anti-masker and thinks there are some settings where they are probably appropriate. Stated we have done a terrible job of deciding where the line is; we say it is okay to walk across a restaurant with a mask on but as soon as we Page 3 CITY COUNCIL PROCEEDINGS SEPTEMBER 1, 2020 sit down at a table, that seems to be a safe zone as if this virus is the smartest thing on the planet. Stated we have created these boundaries that are not very consistent. Mayor Whipple stated if you are at risk of having this or spreading it that we should personally take responsibility of mitigating that risk; we are all at risk of having this and spreading it unknowingly, should we all be then mitigating that risk. Scot Pierce stated this thing has evolved, in the beginning we all believed that everyone was going to get it no matter what and that science continues to evolve. Stated we now understand its pathos-physiology more than ever and know the ways that it will or will not get you via exposure or non-exposure. Stated the CDC is even evolving daily with relaxing their guidelines because they are making public claim now on their website that risk is contingent on a lot of factors and if you are otherwise healthy, that is not one of the factors. Mayor Whipple stated you are the first scientist to present themselves as a scientist who is in conflict with this. Stated the word pandemic means that it crossed an ocean and has traveled from its origin and asked Mr. Pierce to clarify his statement that he does not believe it is a pandemic. Scot Pierce stated we are treating it as if it were still the viral assault that came across the pond initially, we are still treating it the same way. Stated based on some studies, he is of the opinion that the potential for this has evolved and has morphed slightly to not be the same that it started out as, which could be secondary to a lot of things that we have done to mitigate such as social distancing, isolation, segregation and wearing masks. Stated he does not think it is the same animal that it started out to be and we are much smarter than we were in the beginning and treating it much more effectively and all of the data suggests that both death and mortality are decreasing significantly across the board both on a global scale and in the U.S. and predicts that will be consistent in Wichita and as a resident of Wichita, wants to be able to make the choice to mitigate his personal risks and be able to have freedoms to make the choices to attend church, go to a restaurant or go to a public forum in any setting to enjoy a sport. Council Member Blubaugh asked the City Manager to clarify with the amount of PPE money we are getting, are we having a maintenance man take paper towels and staple rubber bands to them and provide them to our guests that are speaking. Bob Layton City Manager stated what we are providing are temporary mask coverings prepared by staff and cannot tell you who is doing it but in this building our security staff is doing it as part of their responsibilities but is only intended to be temporary for those who don't bring their own masks. Council Member Blubaugh asked what kind of research we have done when we first introduced those. Bob Layton City Manager stated the speaker is correct they do not have the same impact as some other mask coverings but it does provide some protection. Mayor Whipple stated the speaker wasn't accurate with his description of how this virus is transmitted although he was accurate with the size of it and what the mask is to do is to stop the droplets that carries the virus. Stated the average size of a droplet, the mask that is made out of a paper towel, will absorb that droplet and absorb the virus with it, which is the purpose of it. Page 4 CITY COUNCIL PROCEEDINGS SEPTEMBER 1, 2020 Council Member Blubaugh stated with the County being the health authority here in Sedgwick County, have we checked with the County to make sure that this type of mask is adequate. Bob Layton City Manager stated he does not know that we did but will. Stated we looked at early CDC guidance and they had layers of protection and this was a layer of protection but was towards the bottom and primarily to deal with the transmission of the droplets. Scot Pierce stated while he doesn't disagree with the Mayor, there probably is some measure to stopping droplet content in its totality, but it is a paper towel and is to suggest that Bounty is a safe measure. 2.) Emily Coello - Mask Mandate. Emily Coello stated our City will never recover from the COVID-19 recession if the Wichita City Council continues to mandate operating rules for businesses and the personal behavior of individuals. Stated recently Mayor Whipple discussed the need for more federal aid for our recovery, but the only thing we need in Wichita is for the economy and schools to fully reopen without restriction, please let us work without further government interference. Stated the local and state mandates that were informed by failed models, which had predicted millions of American deaths, destroyed our economy and created a paralyzing fear that has overtaken the community. Stated your reliance on models and not empirical data, continues to haunt Wichita. Stated certain businesses are restricted to what they offer on their menu, others are not permitted to operate at full capacity or only during certain hours. Stated the arbitrary physical distancing rules meet us every time we leave our homes and go to church or go to the store and you have also required face coverings for everyone over the age of five. Stated here we are in September and none of the mandated mitigation measures are based on scientific evidence, we are six months into this and there is so much scientific data to inform our public policy and last week the CDC updated their COVID-19 death numbers for America. Stated only 9,210 people in America died from COVID-19 alone, which is just six percent of the total numbers of death that we have been fed all summer. Stated the other 94 percent had two to three other serious illnesses to include things such as heart disease, sepsis, dementia, the majority of the people who did die were of advance stage and 95% of the people who died were in nursing homes. Stated cases are not deaths and fears that the Council and their public policies are being driven by the case numbers. Stated Dr. Atlas of the White House Task Force, has stated repeatedly that 99% of those who test positive have no serious problems with the infection and half of those people who test positive are a systematic. Stated some of those people who are not a systematic may have flu symptoms, so what they would do is stay home and recover like you would with any illness. Stated your stated goal for the initial lock down was to keep hospital beds empty, which we did but now when the City Council, County Commission and School Board meet, everyone is talking about the desire to lower the case numbers and then each body passes more restrictions on our population. Stated Dr. Atlas has said that it also doesn't matter how many cases there are, it only matters who has a case and said that under 70 the infection fatality rate is just 0.04%, which is less than the seasonal flu. Stated he has repeatedly said there is no risk to children but yet the City Council has required masks for children over five. Stated there are 50 deaths reported in the County according to the website, most of these deaths have occurred in senior homes but yet the working and school age population remain locked down. Stated at a recent City Council Meeting one member asked what it would take to stop passing shut down extensions and the discussion that followed focused on case numbers; Mayor Whipple said "I think six percent is a good point to get to and then at that time we could lessen restrictions." Stated the number of cases does not matter, it is who is getting it and we should be concerned about the elderly and those with comorbidities but we can't keep restricting businesses, schools and individual behavior when the vulnerable population is such a small percentage of the population and we don't need more mandates. Stated the vulnerable Page 5 CITY COUNCIL PROCEEDINGS SEPTEMBER 1, 2020 should take precautions for themselves. Stated your transmission mitigation measures are not based on science, the science behind six feet distancing is according to Dr. Atlas, embarrassingly weak and there is no proof that masks prevent transmission either. Stated the two most visible symbols of the COVID situation, masks and six foot distancing and there is no empirical data to show that either are effective and implores the Council to let the mandate expire next week and let individuals decide what is best for themselves. Vice Mayor Claycomb stated she wants to make sure that the public that is listening understands that the City Council isn't establishing the rules for businesses or for schools. Stated those are being established by the County Commission, the Board of Health and the School Board. Emily Coello stated with what the City Council does informs with what the County Commission and informs what the School Board does, it is very cyclical. Mayor Whipple stated we get a lot of calls about what the County or School Board is doing and we do not as a City Council have the authority to govern the School Board or the County, or responsibility is the City of Wichita. Stated he wants to clear up a misstatement that in March the modeling showed that we would have an estimated 200,000 deaths in America from COVID-19 or complications related to COVID-19 and asked the City Manager if he knows how many people have died up to this date from COVID-19. Bob Layton City Manager stated nationally it is 180,000. 3.) Carlos Coello - Mask Mandate. Carlos Coello stated he is asking the City Council to reconsider the mask mandate requirements for Wichitans. Stated Dr. Fauci from the NIH and the White House Task Force originally told us that masks do not help prevent the spread of the virus. Stated now he is pushing for masks, why? Stated Dr. Fauci has been seen multiple times pulling off his mask when cameras are supposedly off; why he is the exception to his own rule. Stated I am an architect and have visited multiple construction sites throughout his career and it is very common to see these masks being worn by construction workers, especially those who work with drywall. Stated when they remove the mask, you can clearly see the drywall particles have made it all the way into their nose. Stated a drywall particle is a minimum of three microns maybe as big as a 100. Stated a micron is a one-millionth of a meter, a meter is about three feet, so you take three feet, divide it by a million and three of those is a minimum of the size of a drywall particle. Stated the Corona Virus is smaller than that but is not two or one micron, it is 0.12 microns, which is a 24th of the smallest particle you will find in drywall. Stated the masks, bandannas, or any random piece of cloth that people are using to cover their face, do not work, even the N95s. Stated you might say it doesn't hurt to wear a mask, however, it does. Stated masks reduce the ability for us to breathe fresh air and wearing a mask prevents oxygen from getting into our bodies and instead we are inhaling our own carbon dioxide, which increases the acid and overwhelms the compensatory mechanisms of the body and kidneys have to work harder and people are getting kidney failure because of this. Stated this is just one example of many other issues you can have from wearing masks. Stated if you go to www.primarydoctor.org it shows that mask serve more of as an instrument of obstruction of normal breathing rather than an effective barrier to pathogens. Stated masks are neither effective nor safe and have become placebos to calm and appease those who have fallen victim to fear injected into our society with a goal to paralyze us and our economy. Stated it has put neighbors, co-workers, and family members against each other and the most dangerous side effect is the impact on our mental health, especially our children. Stated it is time to Page 6 CITY COUNCIL PROCEEDINGS SEPTEMBER 1, 2020 follow the science and unite again as Americans and time to move forward with confidence. Stated he has more information and data that he will email to the Mayor and Council Members and asked the Council to vote against any future mask requirements. 4.) Anh Tran - Sex Trafficking in Wichita. Anh Tran stated today she is going to talk about harsher punishments for sex crimes and asking you to possibly bring up the bill that mandates that we chemically castrate anyone who harms a child under the age of 13 or repeat sex offenders. Stated in the City of Wichita there are around 360,000 people and of that there are over 2,840 sex offenders. Stated in Kansas there are no laws that mandate that we know where they live or if they live close to a daycare or a school. Stated she is asking that we take these children into consideration when we ask for more mandates for their health and safety and hopes that we can put laws into place to protect our children. Council Member Johnson asked Ms. Tran if she knows who Dr. Karen Countryman-Roswurm at WSU. Anh Tran stated yes and has been talking to their organization about joining and educating herself more through them as well. Council Member Johnson stated she would be an excellent person to connect with and is one that he always looks from her posts and information to educate himself on sex trafficking and ways to intervene. Mayor Whipple stated ICT SOS is also a very good organization to look into. 5.) Tonya Hudson - Mask Mandate. Tonya Hudson stated one of the speakers was referencing the paper towel that he had to wear today and was dirty and doesn't believe that anybody with common sense could imagine strapping something dirty to your face, is going to provide health benefits. Stated regarding death rates in the U.S., as of the 29th of August, the CDC quietly updated the COVID numbers to admit that only six percent of the 153,504 deaths recorded actually died from COVID. Stated the key word is "from" COVID, because historically when this began, all of the deaths that had been reported had been linked with COVID but not necessarily the cause of death, which is only 9,210 deaths, which is still a large number but if you do the research and look at the data as far as car accidents and various other factors that result in death, that is an extremely low number. Stated she tried having a conversation online with Mayor Whipple and unfortunately the comment that she left and string of comments that followed, were removed, which she finds disheartening that a leader in our community would silence his constituents. Stated these were constituents who were in opposition to the mask mandate and finds it very frustrating that those views are not wanted to be openly heard on a public platform. Stated the Mayor asked one of the earlier speakers if he would email the data or website with the information that he was providing and questions the legitimacy as to whether that information will actually be read considering the fact that information that is being provided online is being removed. Stated she is here today representing 973 other people who are tired of the mask mandate and is here to talk about the actual damage that masks can cause. Stated out of 978 people, 79 people have experienced emotional distress and anguish resulting from not wearing a mask; someone who is exempt and receiving dirty looks or has been refused service from a business or establishment and who has been caused to feel anxiety simply for the fact that they are not conforming to this mandate even though they are medically exempt. Stated 71 people have experienced headaches, 53 people experienced light- headedness, 40 people have experienced panic attacks, 33 people have experienced emotional distress and Page 7 CITY COUNCIL PROCEEDINGS SEPTEMBER 1, 2020 or depression, 30 people have been verbally assaulted for not wearing a mask, 28 people have experienced claustrophobia, and 23 people have had an asthma flare-up. Stated in total there are approximately 500 people out of almost 1,000 and if you extrapolate those numbers to the City of Wichita, you are looking at half of our City who is being affected in a negative way by this mandate. Council Member Johnson stated he wants to highlight for the record that our third speaker brought up that masks can cause a CO2 issue and quickly googled that and the American Lung Association and Stanford both put out articles in June that said that is not true and in addition to that, when we look at local clinics, talked to a couple of doctors that wear masks all day and who have monitored their oxygen intake and it continues to stay between 98-99%. Stated the masks are not causing that and is not an issue from studies he has seen and is open to see other studies that prove that incorrect. Mayor Whipple stated Ms. Hudson mentioned social media and directed her to the official Mayor of Wichita page which is different from his personal page and you can post anything you want there. Tonya Hudson stated she understands that you have a personal page and an official page, however, when you are utilizing your personal page to present public information that is directly related to City matters, and you have constituents who are responding to that and then you remove those comments; you are silencing your constituents. Stated if you don't want comments on your personal page, would recommend you not utilize your personal page for City matters. Mayor Whipple stated if you want to interact with the official page, you can. Stated he removes people who antagonize, fight or use his platform to promote any type of fake information on his personal page. Stated you can do what you want on my official page. II) CONSENT AGENDA ITEMS 1 THROUGH 15 MOTION: Mayor Whipple moved to approve consent agenda items 1 through 15 in accordance with the recommended actions shown thereon. Motion carried 7 to 0. COUNCIL BUSINESS III) BOARD OF BIDS AND CONTRACTS 1.) REPORT OF BOARD OF BIDS AND CONTRACTS DATED AUGUST 31, 2020. Council Member Johnson asked what non-responsive bidder mean. Hannah Lang Finance Department stated in that particular bid, we had a bidder bid something that was Page 8 CITY COUNCIL PROCEEDINGS SEPTEMBER 1, 2020 outside of the specifications that we proposed, which made them a non-responsive bidder because they didn’t bid what we specked. WAA REPORT OF BOARD OF BIDS AND CONTRACTS DATED AUGUST 31, 2020. (No public comment) Council Member Johnson stated he would love to see this information in a separate presentation on YouTube that we can share especially during this time when people are concerned about the City budget. Council Member Clendenin thanked staff and said one of the things we have tried to do over the past 8-9 years is to keep those debt levels in check, which is the thing that stood out to him the most in this presentation. Stated the whole point was, when we hit times like this, that we are not saddled with a bunch of debt that is keeping us from doing projects in the community and keeping our interest rates low and appreciates staff helping us make those crucial decisions.
