MINUTES OF THE MEETING OF THE CITY COUNCIL
Wichita, Kansas, February 9, 2021
Tuesday, 09:00 AM
The City Council met in regular session with Brandon Whipple, Brandon Johnson, Jeff Blubaugh, Becky
Tuttle, Bryan Frye, and Cindy Claycomb.
Staff Members Present: Bob Layton, City Manager, Jennifer Magana, City Attorney, and Karen Sublett,
City Clerk.
Mayor Whipple called the meeting to order at 9:00 a.m.
Approve the minutes of regular meeting on February 2, 2021
MOTION:
Mayor Whipple moved to approve the minutes of regular meeting on February 2, 2021.
Motion carried 6 to 0.
Proclamation - National Burn Awareness Week
Mayor Whipple read aloud the Proclamation.
I) PUBLIC AGENDA
1.) Rob Grant - WPD
Rob Grant, 315 S. Hydraulic stated on January 24, 2021 he was driving from his house to the gym. Stated
he heard police sirens and was immediately hit by a car and then hit a building. Stated he got out of his
truck and fell multiple times and was scared and realized the police had been pursuing someone. Stated he
could see several officers standing with their guns out; no one came over to him to see if he was okay and
was not rendered aid because they had their guns out on a suspect. Stated eventually he received contact
from an officer and was very emotionally distraught. Stated he told the officer that he did not agree with
the police chasing people downtown because it is so dangerous and is residential and the risk to innocent
people is high. Stated his family arrived at the scene and is not sure how he walked away without any
physical injuries but his emotional and mental state have been significantly altered. Stated every day since
being hit he feels extreme emotions about how it could have been one of his sons and how he could have
died. Stated he was not able to work for a week due to no car and trying to figure out how to replace it.
Stated that truck was the first car he has ever owned on his own and was paid off. Stated this is a burden
on his family and their lives went into a tailspin in an instant because of this wreck, which could have
been avoidable if she wasn't being chased. Stated the amount of work that it has taken his family to
navigate has been exhausting. Stated they haven't been given any help from the police and can't even get a
police report for six weeks and asked how he is supposed to move forward with all of these blocks; none
of which are his fault. Stated once he located his truck he had to pay the towing company $200. Stated
what she could have possibly done to be chased by the police. Stated he was told that it was for a traffic

stop and she took off; why not let her go and catch up with her later. Stated her life is forever changed as
well and is not sure if she is even the bad guy in this situation. Stated he is now weary of driving and
scared to go through intersections and has concerns for the people who have already lost their lives and
the rest of us, whose lives are forever changed. Stated for those of us who are struggling to get ahead and
are then hit with costs that were not our plan and could have been avoided, is sad that his neighborhood
now feels unsafe due to police chases. Stated please stop chasing anyone in downtown Wichita.
2.) Marlon Toney - WPD
Marlon Toney stated in May of 2019 he came upon a terrible wreck while on his way to Century II and
went around and did not stop because he saw that help was being rendered but could see that the
wreckage was devastating. Stated while at Century II he received a call from his girlfriend who said her
family had been in the wreck he had just passed by and later received the news that two of her family
members had been killed. Stated he understood that this wreck was at the end of a police chase that took
place downtown. Stated he had a difficult time afterwards and couldn't go to school due to witnessing this
devastating wreck and took him a long time to recover from what he saw and how it impacted someone so
close to him. Stated on January 24th of this year, he received a call from his mom that his stepdad had a
wreck and needed help. Stated he was closer to the location and my mom asked me to go to him and try
and comfort him because of how distraught he was on the phone. Stated he walked on to a scene that
shocked him, his stepdad was visibly shaken and emotional. Stated his stepdad didn't receive help directly
after the wreck and told us he got himself out of the car and stumbled several times and doesn't
understand why no one went over to help him immediately. Stated it doesn't seem like the police had
learned anything from a wreck that had already deeply impacted him. Stated we live downtown, this is
our neighborhood and this is the second time an event like this has impacted his life and doesn't think that
innocent bystanders should be at risk due to police pursuits in the downtown areas. Stated his stepdad
could have been killed, he is still processing everything and though we didn't lose a life, we lost property
and sees the harm it is causing day after day as his parents try and figure out what to do. Stated please
stop initiating police pursuits in the downtown area.
3.) Marquis Toney - WPD
Marquis Toney stated he is upset over what took place on January 24th regarding the crash that Rob was
involved in. Stated he feels it was an arbitrary and unnecessary thing that didn't even need to happen and
this isn't the first time he has been involved in a situation like this. Stated two years ago a friend of his had
family that was killed in a car crash that was the result of a police chase. Stated both of these events came
out of nowhere because by nature police chases happen randomly and without warning. Stated he doesn't
think this is right nor does he feel the way this was handled was right. Stated the officers involved did not
seem all that passionate or understanding to what was going on and doesn't think it is fair to put innocent
people in potentially deadly and life-threatening situations if the point of a police officer's job is to protect
and serve people. Stated he is angry that he and his family have had to deal with the aftermath of
something like this twice and is angry watching his stepdad struggle. Stated this is our neighborhood, this
is he lives and wants his streets to be safe from unnecessary pursuits that cause permanent damage to
innocent people.
4.) Kelli Grant - WPD
Kelli Grant stated it is clear from her family that pursuits in downtown Wichita have had a significant and
profound impact on all of them. Stated as a mom of a traumatized and grieving son who saw the wreckage
two years ago, I can tell you that the feelings of helplessness and desperation were intense. Stated she

watched her son struggle to get out of bed, watched a whole group of teenagers gather at her house time
and time again to cry and support each other and grieve. Stated it changed all of us forever. Stated on
January 24th, when she was told a pursuit had been initiated and her husband had been involved as a
result, she was shocked and then livid. Stated watching her husband in an emotional state that she has
never seen him in was shocking to her. Stated the amount of time, energy and money needed to navigate
the past two weeks have been immense. Stated she was once a single mom on welfare and knows she
could not have recovered from this if this had happened during those years. Stated they wrote statements
with WPD on January 29th with Sedgwick County Commissioner Cruse present and were advised that
WPD is willing to work with them on policy considerations and change, however, Rob does still not have
a police report and have received no communication from WPD. Stated police pursuits are inherently
dangerous and many departments have issued no-pursuit policies across the United States. Stated pursuits
often cause an officer to develop tunnel vision, which is a biological reaction. Stated police chases kill
about one person per day in the U.S., more than floods, tornadoes, hurricanes and lightening combined.
Stated there are not readily available statistics on how many pursuits end in a crash of an innocent
bystander that is not fatally injured, nor is there much available on the cost of property damage like the
buildings that have been hit in both of these situations. Stated the risk to the public is an aggravating
factor when considering a pursuit. Stated it is well known that cars can be classified as deadly weapons
when utilized in a reckless or harmful way. Stated African Americans are more likely to be killed by
police pursuits and more likely to be chased in urban areas and while this fact may not be the case in this
situation, it is a statistic worth consideration in weighing the risks to all of our community members.
Stated the reality to this situation is not minimal, in fact it is quite grave, and today our downtown is not
walkable without significant risks. Stated our community has been harmed as a result of police initiated
pursuits in downtown Wichita. Stated over the last 23 years she had done work on policies and changes
and has been involved with creating new processes within the criminal justice system and is in the last
stages of her PhD that is focused on this exact social and criminal justice issues. Stated Council Member
Claycomb has taken time to meet with her and has agreed to engage in the process from the bench in
support and is ready to engage the Citizens and Review Board to get this moving. Stated she has done all
the research and has a draft policy ready for you that is aimed at protecting all people that live, visit, or
want to visit downtown Wichita.
Council Member Claycomb thanked Ms. Grant and her family for being here today and as she mentioned,
we have met and has also spoken with Chief Ramsay about this and has agreed to sit down with the
Police Department and Ms. Grant to talk about this. Stated she also suggested as she mentioned, that the
Wichita Citizen's Review Board would be a good place to start off because in their mission they advise
the Police Department about community concerns.
II) CONSENT AGENDA ITEMS 1 THROUGH 19
Council Member Johnson stated he doesn't want to pull any items and just wants to highlight consent
items II-8 and II-9, Mennonite Housing continuing to build new homes in District I and bringing families
opportunities for home ownership. Stated he wanted to highlight the good work that they do.
Council Member Frye stated he doesn't know if it is necessary to pull consent item II-6, but wants to get
clarification from the City Manager. Stated consent item II-6 is assistance for a firefighter grant program,
and believes the Council had received a letter for support of this from the IAFF regarding the cancer
screenings and asked if this would satisfy that request.
Bob Layton City Manager stated yes it would for a three-year period.

Mayor Whipple stated he will pull this item as we have the representative of the Wichita Fire Department
here so that person can confirm that question.
MOTION:
Mayor Whipple moved to approve consent agenda items 1 through 19 in accordance with the
recommended actions shown thereon, excluding item II-6.

III) BOARD OF BIDS AND CONTRACTS
1.) REPORT OF BOARD OF BIDS AND CONTRACTS DATED FEBRUARY 8, 2021.

Melinda Walker Purchasing Manager, presented the February 8th Board of Bids.
MOTION:
Mayor Whipple moved to receive and file report, approve the contracts and authorize the necessary
signatures.

IV) UNFINISHED COUNCIL BUSINESS - NONE
V) NEW COUNCIL BUSINESS
1.) CONVENTION CENTER 2021 BUDGET ALLOCATION.

Donte Martin Assistant City Manager, presented the item.
Council Member Frye stated we say that any unrecovered expenditures will be offset by transfer from the
Transient Guest Tax Fund; in our consent packet, we have the Visit Wichita Monthly Financial Report for
year to date showing that the Transient Guest Tax revenue was about $1.65 million. Stated are there
reserves that would help cover that because otherwise, they have no money to do anything for the rest of
the year.
Donte Martin Assistant City Manager stated Mark Manning is better suited to answer that question.
Mark Manning Finance Department stated the Transient Guest Tax Fund does maintain a decent reserve
and even more beneficial to this action today, you may recall that last year we did not transfer the $1.4
million dollars that was scheduled to be transferred in 2020 and that boosted the reserves in the Transient
Guest Tax Fund, which will enable them to subsidize Century II this year.

Bob Layton City Manager stated the balance that we traditionally kept there has been for capital projects
so if we use it for operations, that is fewer dollars we have available in the capital.
Public Comments:
1) Celeste Racette stated she is glad to hear you are keeping a minimum of staff to run Century II because
they are the only ones who know the ins and outs of the building, how to keep it running, and how to
smooth the transition with exhibitions that are scheduled this year. Stated Century II is the property of
Wichita taxpayers, not a private company that may come in to manage it. Stated 17,265 citizens signed
our petition to keep the building and is not in favor of the Request for Proposal (RFP). Stated Century II
finances were never expected to break even, it was always expected to operate at a loss, why, to subsidize
performances by non-profit groups in Concert Hall. Stated to subsidize rent for local exhibits, to subsidize
charity car shows in Exhibition Hall. Stated the whole reason the hotel guest tax or the Transient Guest
Tax was created for was to pay for the operating costs of Century II. Stated Charter Ordinance No. 221
says, this is the first priority of funding from the hotel guest tax and yet, you took $2.5 million from the
hotel guest tax and gave it away freely to millionaire Jim Korroch to build his Fairfield Inn in WaterWalk.
Stated the bond debt issued on this giveaway, will cause taxpayers over $4 million to pay off, because it is
$2.5 in principal and another $1.5 million in interest that these bonds are costing taxpayers because you
raided the hotel guest tax to give him this freebie. Stated you let Visit Wichita drain the hotel guest tax to
build their slush fund of $3 million in cash and securities and hasn't heard anyone on City Council address
the fact that Visit Wichita has built up cash and investment balances in their financial statement and is
requesting today that when you publish their income statement, she wants to see their balance sheet as
well on a monthly basis. Stated you also let executive Ruffin have the exclusive catering contract for
Century II taking the food beverage profits and the Century II meeting room rental income all because he
took the Hyatt Hotel off your hands and yet we citizens lost $12 million dollars on the Hyatt Hotel sale.
Stated it was a bad business decision made by City Hall. Stated this diverted income should have been
used to cover Century II's operating costs, so when you publicize the operating deficit, remember, you
have raided the hotel guest tax that was created to take care of the expenses of Century II and Charter
Ordinance No. 221 says this is the first priority of funding for the hotel guest tax.
2) Monica Marks stated she has always supported the Century II campaign due to the fact that we can't
afford any else. Stated we have lost money on every major development that we have had such as the
Hyatt, Arena and the ball park that is sitting empty. Stated we definitely should build anything else, we
should fix this building. Stated we are using this building for an inappropriate cause right now and at the
most busy this room has been today there are nine people in here. Stated this room is a fraction of the size
of the Council Chambers and we should not be segregating democracy over here. Stated we should have
not been relegated to a room across town, we should have been able to come in to City Hall and speak in
person to you directly about every issue going on. Stated there is a downward trend in COVID right now,
they have opened the schools and eased restrictions on bars and this feels weird and wrong over here like
we are not allowed into the City Hall building.
Council Member Blubaugh asked the City Manager if we have a timeline as to when we can expect the
public to come back into our chamber.
Bob Layton City Manager stated Council Member Frye asked him to consider that last week and we are
talking about that at the staff level right now.
Mayor Whipple asked if we can have someone who is a medical professional give us some advice on that
as well. Stated his concern is basing this off of what other institutions are doing and thinks that other

institutions such as schools have a different perspective of getting the services that schools provide for
children and is a different set of scenarios than City Hall where we can affectively have a live
conversation with someone at Century II. Stated he doesn't want any more of our employees to catch this
and if there is any policy, let's hope it is based on medical science and not on pressure.
3) John Todd stated his opinion is that privatizing Century II and the market we are in, is premature.
Stated you don't pick a down market to privatize and it doesn't make any sense to ask a private sector
company to come in and manage a facility that is not performing. Stated no reasonable private company
would manage Century II without public subsidy or if you looked carefully at the contract that was
written, there would have to be some language in there that would reward them greatly down the line such
as maybe an option to purchase it or lease it. Stated an outside management company complicates future
deliberation concerning maybe repurposing the building or other things that relate to the building. Stated
his recommendation is keep the management in the City's hands and if you want to work on Century II to
maybe put out some ideas for repurposing the building and it is his understanding that Mr. Bill Warren
would still entertain doing an assessment of Century II on ideas for the best marketing for it and would do
it free of charge.
4) Karl Peterjohn stated the segregation we have here is unfortunate and it would be much better to have a
public forum where the citizens are in the same place with the elected officials and doesn't know of any
scientific evidence that we should be operating this way. Stated he believes the City should retain on this
historic structure, the current City management and has a lot of concerns about this contract. Stated since
we have this historic structure that he does not believe has been maintained the way it should be and
could be with historic tax credits; thinks the City should look at a broader model and would be happy to
provide a copy of a report that was put together as part of the state commission back in the late 1990's.
Council Member Claycomb stated she wants to make sure that the public is not confused; we are talking
about the Convention Center budget allocation right now and the last two speakers did not address that
item and doesn't want the public to be confused about what we are voting on right now.
MOTION:
Mayor Whipple moved to approve the necessary budget adjustments; authorize the expenditures budget in
2021 for the Convention Center; and authorize staff to take the necessary actions to operate the facility
with City staff in 2021.
Motion carried 6 to 0.
2.) CENTURY II – REQUEST FOR PROPOSAL.

Council Member Frye asked staff if he has a timeline for phase 1 and 2 to be complete.
Donte Martin Assistant City Manager stated he would anticipate that we would have the RFP on the street
within a week and would anticipate a 60-90 day review process. Stated his hope of May or June of this

year, that we would have completed the evaluation and review process and be in a position to make a
recommendation to City Council.
Vice Mayor Johnson stated he knows there were some of the partners with Century II organizations that
use the facility; this potential RFP would not reduce their access to Century II or significantly increase the
cost of any usage that they might have.
Donte Martin Assistant City Manager stated any group that submits a proposal, it is with the
understanding that they would assume any contracts the City has with current tenants and other
organizations. Stated in terms of cost structures, they would assume the contract and current costs, the
cost that would come forward through the proposal; we don't know at this time but that would be a part of
the evaluation process.
Public Comments:
1) Celeste Racette stated staff pointed out in his slide that public comments have been solicited for the
RFP and asked where the results of these comments are. Stated she didn't see anything that commented on
what the public had to say about the RFP. Stated staff noted the City was going to follow its
Administrative Regulations (AR) for the review of the RFP contract; did you all know that the City is
currently in violation of its own AR. Stated the CAFER doesn't note this violation, the City is currently
violating the AR to have an internal auditor overlooking the contracts that exceed a certain dollar amount.
Stated all of the contracts or exhibits that have to be included in the RFP, had already rolled into short-
term contracts so that they will end this year. Stated the cost of these contracts to continue, you wouldn't
commit to the fact that the costs would stay the same and will be watching carefully to see how you are
going to impact these contracts for these vendors that are currently in Century II with the RFP. Stated
Century II is a unique performing arts building in Wichita's cultural center. Stated other historic buildings
in downtown Wichita advertise as having a hip vibe and is at a loss as to why we cannot revitalize
Century II and we must continue down this path of privatization. Stated the movement to save Century II
from privatization didn't come from businesses, it came from us the taxpayers, Wichita citizens who said
this is the building we choose and want to take care of. Stated we should be advertising Century II as
unique, hip, modern architecture just like we advertise for the businessmen who smartly renovated
historic buildings in downtown using historic tax credits. Stated Century II and the former public library
deserve to be renovated for future generations to enjoy, not privatize, they are too hip for that.
2) Karl Peterjohn stated he agrees with the prior speaker and emphasized that we are going to continue to
try and get information out because of the historic nature of these buildings. Stated we are in a
challenging environment and those who cannot retain an understanding of their past, will have very
difficult and challenging future.
3) John Todd stated he agrees with what the former two speakers said and would request that his
comments that were made on the last item would be considered today and asked staff to share the public
comments with them that were left on the line.
Council Member Claycomb stated any changes to the RFP from public comment, the City Manager told
her that the comments we received, most of them were not directed at the RFP.
Donte Martin Assistant City Manager stated that is correct. Stated one request was that the contracts we
posted to the website, which staff has done. Stated as far as questions directly related to the RFP, they
didn't result in changes and some of the questions were, who is going to review the RFP and what is the

process and staff answered that question; who will make improvements to the physical structure
and maintain it, staff deferred them to the RFP and answered the question; and does this include City run
services such as Wichita TIX, staff pointed them to the RFP and answered the question. Stated none of
those things required a change to the RFP, it mainly required clarification.
Council Member Claycomb stated going out with an RFP, we are not voting today to lock ourselves into a
management service contract, we are just voting to go out to look at RFPs.
Donte Martin Assistant City Manager stated correct, we would release a RFPs, we would perform a
screening selection committee to review those proposals and we have the option of not going forward but
could continue to manage Century II with City staff or we could decide to go forward and present a
contract to City Council for approval.
Council Member Claycomb asked what would be our anticipated length of a contract if we decided to do
a professional management contract.
Donte Martin Assistant City Manager stated part of it depends on the proposals that come in and what
makes the most sense based on proposals. Stated the other day he and the City Manager were in
discussions with the County Manager and they talked about their review of management contracts in
relation to their relationship with Intrust Arena. Stated there is a body of knowledge for us to look at and
determine what the appropriate length is and what makes the most sense for the City of Wichita as it
relates to potentially outsourcing management of Century II.
Council Member Claycomb stated the example of the Ice Center was brought up and because we have an
expiration on contracts, we have the ability to get out of those.
Donte Martin Assistant City Manager stated regardless of the overall length anticipated in the contract
there will be exit provisions and an opportunity for the City of Wichita to cancel the contract if it is not
meeting our expectations.
MOTION:
Vice Mayor Johnson moved to approve the release of the Request for Proposals.
Motion carried 5 to 1 (Nay: Brandon Whipple).

Council Member Frye stated he wants to recognize a couple of individuals who recently passed,
Municipal Court Judge Ted Griffith and former park board member and president of the Pachyderm Club,
John Stevens.
RECESS - EXECUTIVE SESSION
MOTION:
Mayor Whipple moved to recess into Executive Session for 30 minutes to receive information on offers of
settlement of two civil cases pursuant to K.S.A. 75-4319(B)(2): for legal consultation with the City
Attorney which would be deemed privileged in the attorney-client relationship pending litigation,
potential litigation, and legal advice. The Executive Session is required to protect attorney-client privilege

and the public interest. The Executive Session will begin at 10:15 a.m. and end at 10:45 a.m. The meeting
will resume in the Council Chambers.
