MINUTES OF THE MEETING OF THE CITY COUNCIL
Wichita, Kansas, March 2, 2021
Tuesday, 09:00 AM
The City Council met in regular session with Brandon Whipple, Brandon Johnson, Jeff Blubaugh, Becky
Tuttle, Bryan Frye, and Cindy Claycomb.
Staff Members Present: Bob Layton, City Manager, Jennifer Magana, City Attorney, and Karen Sublett,
City Clerk.
Mayor Whipple called the meeting to order at 9:00 a.m.
Mayor Whipple stated we are following the guidance of the Sedgwick County Health Department and
reopening our Chamber to the public and would ask that folks stay six feet apart and to keep their masks
on even if they are further apart from someone next to them because the ventilation in here does not give
us the confidence that if there was droplets in the air that they would be ventilated fast enough. Stated for
your safety and the safety of those around you, we ask that you keep your masks on. Stated we are glad to
be back to have folks be in our Chamber and utilize this space and hopefully will get more folks as the
numbers go down and appreciate the folks who have been showing up at Century II.

Mayor Whipple moved to approve the minutes of regular meeting on February 23, 2021

I) PUBLIC AGENDA
1.) Sybil Strum - Missing property
Sybil Strum 326 N. Walnut Street, stated she wants to know where her missing stuff went. Stated when
they decided to tear down her house, without her knowing, and getting her a contractor without her
knowing. Stated she had a Victorian tub from 1910 and a white metal front door and wants to know where
they went. Stated Central came into her house without permission and destroyed it without telling her
what was going on. Stated she also had a storm door on the side of her house and in the front with the
metal door and Victorian tub, which she could have had an antique dealer pick up. Stated Central has
been a bully to her.

Vice Mayor Johnson stated a citizen reached out and asked us to support criminal justice reform and hold
him I would mention it at the Council Meeting.

1.) PUBLIC HEARING AND RESOLUTION OF INTENT TO ISSUE INDUSTRIAL

Tim Goodpasture Economic Development, presented the item.
Council Member Claycomb asked staff if that is minimum annual salary or average salary.
Tim Goodpasture Economic Development stated it is minimum.
Vice Mayor Johnson asked if this would have qualified under our former Economic Development policy.
Tim Goodpasture Economic Development stated it would have qualified but the percentage of abatement
would have been substantially lower based on what they are investing in job creation today. Stated based
on the job creation they will qualify for 30%, based on the investment they are qualifying for 40% and the
fact that they are in a regional growth plan sector, they qualify for an additional 10%, which gets them to
80%. Stated he does not know what they would have qualified under the previous policy, but it would
have been well below 50%.
Vice Mayor Johnson stated this is another business that is going to benefit from an improved policy that
we have.
Tim Goodpasture Economic Development stated correct.
Council Member Blubaugh thanked Rand Graphics for making their capital investment in District 4 and is
excited to see employment grow and your company grow.
MOTION:
Mayor Whipple moved to close the public hearing, adopt the Resolution and authorize the necessary
signatures.

4.) DESIGN CONCEPT FOR MCLEAN BOULEVARD, CENTRAL TO 13TH STREET
NORTH. (DISTRICT VI)

Vice Mayor Johnson asked if this crosswalk would be similar to the one on 17th and Woodlawn.
Gary Janzen Public Works Engineering stated yes it would be or the one at 17th and Ridge. Stated we
also have one on east Central near Prost German Restaurant.
Council Member Claycomb stated this is a great example of where residents came to City staff and to her
and advocated that we do something in this corridor. Stated we suggested that they work with the Bicycle
and Pedestrian Advisory board, which they did and Bike and Ped made a recommendation that went to
DAB 6 and Bike Walk Wichita got behind this. Stated it was really emphasized by folks that it was
difficult for pedestrians and bicyclists to get across to the river path, which they really wanted to use and
thanked the residents and staff for their hard work on this.
MOTION:
Mayor Whipple moved to approve the design concept and authorize the necessary signatures.

Mark Manning Finance Department, presented the item.

Vice Mayor Johnson thanked staff for all their hard work that has gotten us through an unprecedented
year and being in the type of position we are in now. Stated he has had a couple of meetings with some
folks about health care opportunities and looking at exploring that and it seems promising to maybe
reduce the burden on the City of Wichita and would like to have that conversation to see if that can help
out.
Mayor Whipple stated when we made the adjustments in the budget to account for anticipation of this
COVID economy and were looking to deficit spend about five million dollars and now we are actually
$4.4 million in the black.
Mark Manning Finance Department stated yes.
Bob Layton City Manager stated it was actually a million dollar deficit in the general fund that we
anticipated.
Mayor Whipple stated we anticipated one million and because of factors particularly pertaining to
CARES Act money that we were able to utilize as well as a surprise in the amount of sales tax revenue
coming in; that allowed us to be up about four million dollars instead of down about a million dollars.

MOTION:
Mayor Whipple moved to receive and file the Quarterly Financial Report for the year ended December
31, 2020.

1.) SELECTION OF CANDIDATE TO FILL VACANCY IN CITY COUNCIL DISTRICT III.

Mayor Whipple asked legal staff to give an overview of this process.
Jennifer Magana City Attorney stated by City ordinance the process for selecting an individual to fill this
vacancy is set forth. Stated the candidates have been narrowed down to five from the DAB selection
process and those five candidates are now before you and the Council by ordinance will make a motion
on a written ballot vote to select that individual at this time.

Mayor Whipple asked which section of the ordinance this follows.
Jennifer Magana City Attorney stated it is under section 2.04.040.
Mayor Whipple stated it is his understanding that each candidate will present themselves in alphabetical
order and will have three minutes to address the Council and then we will begin the balloting.
Jennifer Magana City Attorney that process of presenting to yourselves and the three minutes is set by
you and staff and the balloting is set by ordinance.
1) Jared Cerullo stated I am here today to ask for your support. I am truly humbled and honored to even
be considered for this seat. Wichita is my home town, I have lived on the south side since the day my
mother brought me home from the hospital. It is with gratitude and a sense of responsibility and purpose
that I seek to serve the residents of District 3. I believe to be an effective Council Member you must be
willing to work hard and work together working with people you might not always agree with. As a
broadcast journalist for almost 25 years, I learned that if you want to learn about your community, you
need to listen to its residents. One of the most important skills that journalism has taught me is to see both
sides of a story and form an educated view of that story. Please allow me to use those same skills to help
build a better District 3 in Wichita. Like many other people in this community, I lost my job a few years
ago. It was a job I loved and hoped to remain in for my entire career but like so many others, destiny had
other plans. Losing my job wasn't quite as bad as it turned out to be, at the time I thought it was the end of
the world, I lost my job at one of the lowest points in my life, and just three months after my mother
became permanently disabled from emergency brain tumor surgery. It was an honor and a privilege to be
able to have the time to help my father take care of her for the last eight long years of her life.
Unfortunately my mother passed away a little more than a year ago, she fought hard against that tumor
and I will fight hard every day for Wichita. With the unprecedented amount of development going on for
the past decades, believes that people are excited about Wichita and its ability to live, work and play.
Wichita is a City on the cusp of greatness and in order to achieve that greatness we must commit
ourselves to create a culture of unity and shared opportunities and when it comes to that commitment, I
will be al in. I am all in for supporting our small businesses, improving our relationships with our large
employers in the City, I'm all in for continuing to work for fostering new and existing partnerships with
City staff and community leaders and I'm all in for making sure we support and provide world class
education to our students who are looking to go to college or even if you are an adult, looking to jump
start a new career because of recent layoffs. I want to help expand our bi-partisan relationships with our

state representatives to get a bigger portion of the pie so we can help our City keep functioning better. I
want to help our residents get walkability and help increase our community programs, maintaining our
core services including police and fire. I stand before you today to ask for your support, please allow me
to join you in partnership to lead this great City.
2) Cindy Miles stated I moved to Wichita about 20 years ago, my husband grew up here on the south side
and when we came here we came to the south side, District 3. I immediately got involved in issues in this
community, issues related to child abuse and neglect, domestic violence, trying to figure out how to better
fight crime, mental health and substance abuse, homelessness and poverty. I learned to become an
advocate for those people that were related to the issues that I was involved in and when I got a chance in
2012 to serve on the committee to develop a 20-year plan for the City and County, I was elated because it
was an opportunity to address issues in different ways. As I did that work and learned more on how we
plan for the development of our City and County, as I learned about the issues that we face whether it is
mass transit or being behind in the maintenance of our streets and roads and bridges, and as I heard from
the people in the community talk about things that they felt like were important, I became more and more
passionate about how I could be involved in implementing this plan and other things in this great City. I
went on to make the commitment that one day I wanted to run for this seat. I spent eight years doing
preparation serving on the MAPC, the South Central Neighborhood Planning, the Delano District
Planning and looking at how we transform Clapp Park. I've looked at a wide variety of issues, a diversity
of issues because I think that somebody who is going to serve in this street needs to have that. I am
challenging you today to do what is best for District 3 and the City. To pick a candidate whether it is
myself or somebody else that has lived in the district for a period of time, that has been involved and
engaged, that has served in that district and served the City on a wide variety of issues. I'm asking you to
think about some of the people who have passionately served the district like George Theoharis or Hoyt
Hillman. I want somebody to know the history of why Southfork didn't succeed and what we can do to
make it succeed. I want somebody that knows the challenges that we faced on the Broadway Corridor and
the other challenges we faced in the district. That is my challenge to you today and I appreciate this time
to speak in front of you today.
3) Virgil H. Miller, Jr stated I retired from the Wichita Police Department in October 2020 after 30 years
of service to the City and I have desire to continue contributing to the City as a whole and the people of
District 3 in particular. I grew up in south Wichita, my first job was done south at a McDonalds and
discovered I enjoyed working with people. After the birth of my oldest child, I began to look for a job that
would provide for my family. The factory job I had was not for me and reinforced the fact that I enjoyed
working with people. I became a member of the Wichita Police Department in the summer of 1990. As a
police officer I was assigned to patrol south and was pleased to work in the neighborhoods that I grew up
in and was raising my family in. I requested a position in community policing and found satisfaction in
proactively addressing the concerns of the residents in those neighborhoods. I felt the people in the
neighborhoods that I was assigned, appreciated my input and that I was there to help them with their
problems and provide tools to reduce future issues in the same locations. The problems just like the
people were and continue to be adverse and many times the issues were not even a police issue but people
were counting on me to help them find a solution. Sometimes the problems were a matter of perspective
by encouraging neighbors to be neighborly and by facilitating conversations I helped the people
understand each other and eliminated those perceived issues. I talked about running for City Council a
few years before my retirement and had not made the firm decision to do it until after my retirement when
I realized that the District 3 seat would be open in November 2021. Though I've already given more than
30 years of service to the people of south Wichita, I feel there is still much more I can give and had told
many people while getting signatures for the petition for this appointment, that you will not find my name
on the Internet for unethical behavior. I have always worked and behaved in a way to make my wife,

children and grandchildren proud. The people in south Wichita need a representative on the Council that
is willing to not just work for them but with them, a person who has spent decades living with them and
getting to know them, a person who shares their concerns, walks in their neighborhoods, shops at the
same stores and is approachable. The new Council Member doesn't need to be perfect, but does need to
have a desire to do better not just for himself and his family, but the district and City as a whole. This
Council needs to have a member who is willing to address the issues brought to him as well as stand up
and make sure the people of District 3 are being treated with equity. I believe I am the right person for
this appointment and look forward to working with each of you in the future.
4) Joseph Shepard stated I humbly stand before you and grateful to be one of many to make it this far in
the process. I would like to pause to express my sincere gratitude to the residents of District 3, the District
3 Advisory Board and countless others who were responsible for me standing before you today. I do not
stand here on my own nor do I take this opportunity for granted. Representing District 3 and the City of
Wichita in this capacity of City Council, as I've come to learn throughout the past few months, is both an
honor and a privilege that requires sacrifice. I am ready to listen, learn and act to create an even stronger
Wichita in District 3 that we are all proud of. Eleven years ago becoming a resident of Wichita was not
my plans, however, after quickly experiencing the candor and care of the community, I decided to make
Wichita my home. I would like to give back just a small portion of what this community has given to me,
my village. While pursuing my MPA I learned directly from City staff about the operations, benefits, but
more importantly the challenges of local government. It is my sincere hope that educational knowledge
coupled with my work ethic, service on City boards, listening skills, desire to learn and be a team player; I
can work alongside each of you and the residents of District 3 to tackle the challenges and rise together as
one unit. As I reached out to residents of the district and community partners to learn what they would
like to see in a public servant, the words connector and servant leader emerged from the conversations. A
servant leader is who I strive to be at my core, leading with grit, grace and gratitude. I hope through our
time together you have been able to see my heart and my commitment to do right by everyone, even when
it made me uncomfortable. These are challenging times in our City but my commitment to all those
invested if I am given the opportunity, I will work hard for District 3 and with the Council to the best of
my ability. Having overseen a $9.2 million dollar budget used to fund operations and departments, I have
experienced what it is like to make tough choices during a year there was a shortfall. My first job out of
college granted me the opportunity to work alongside companies across the state both in the public and
private sector to help make progress on adapted challenges and in my current role I have had the privilege
of working with internal and external partners to lay the foundation of my area moving it from a one
person team to a three person team and generating additional revenue and income to carry out a strategic
plan. I humbly believe my work is not done and I can learn much more from serving in this position while
utilizing professional experiences to serve the people and the City that I love to call home, at a different
level. I conclude this morning thanking each of you for your time, the people of District 3, City staff,
Wichita and for their support throughout this process.
5) George Theoharis stated I am an Airforce veteran, retired Boeing employee and I have a degree from
WSU in marketing. I have lived in District 3 for the past 42 years and have been actively involved in my
neighborhood and currently serve as the president of three neighborhood associations, I have been a board
member of Grandview Heights for the past 22 years and a board member for Meade the past eight years. I
have helped lead 34 cleanups during that time and in addition I have served on the Bicycle and Pedestrian
Advisory Board, and attended every Animal Service Advisory Board meeting since its inception in July
2015 and also serving on the Dangerous Dog Sub-Committee. I have worked with Wichita Independent
Neighborhoods for many years, I worked in collaboration with a diverse group of Wichitans. I know most
of the Department Heads of the City as well as the Chiefs of Police and Fire and all will tell you of my
great passion. I plan on having great dialogue and working relationships with the Mayor and City Council

Members. I have a good working relationship with the County Manager and look forward to working with
County elected officials and staff as needed. I have worked with our state legislators of both parties to
solve neighborhood problems to include help from the DA. I made a point to get to know and work with
the people who can solve problems and if I cannot help someone directly, I find out who can and let them
get to a successful resolution. I will be a full time Council Member and I am retired and will devote as
much time as needed to get this job done right. My wife is a retired nurse with health care knowledge,
who has maintained her license and will work by my side, so you are getting two for the price of one. We
would be a team for District 3 and the City of Wichita. As a member of the Council, I will focus my
efforts in four areas: 1) public safety is a major issue in the neighborhoods including property crimes and
I am a strong supporting of community policing; 2) partnering to rebuild Wichita's economy after the
effects of COVID putting people back to work and helping businesses open safely and finding other
business and manufacturing opportunities; 3) neighborhood issues such as neighboring movements
starting in south central, code enforcement, animal service concerns and bike paths and trails; and 4)
education as in getting the word out what a City Council member can do in keeping citizens engaged with
monthly reports on what the advisory boards are discussing and bi-monthly reports on Clapp Park. I am
here to serve, I can think outside the box and people say I am a problem solver. I will bring these talents
to all of District 3 and the City of Wichita.
Mayor Whipple stated that concludes our list of candidates and will remind the Council and the public the
process in which we will have a written ballot. Each Council Member has five ballots, if we were to not
have a Council majority of four votes by these five ballot votes, then this will automatically go on to the
next meeting. Stated if at that meeting after five rounds and we don't have a winner, we will go to the next
meeting and if that continues a coin will be flipped to determine the winner. Stated we will ask Council
Members to identify on ballot one who their choice is and sign their ballot for the clerk to collect and read
aloud.

Mayor Whipple stated the five rounds have concluded with no clear winner, therefore, according to our
ordinance, the next up to five rounds of voting will take place at the next meeting.
Council Member Blubaugh asked legal staff what happens in the event there is a three way tie.
Jennifer Magana City Attorney stated the ordinance does not address that but she will look into that
option.
Council Member Frye stated to be clear our next meeting will be March 16th since we do not have one
next week.
XI) COUNCIL MEMBER APPOINTMENTS AND COMMENTS

Council Member Claycomb reappointed the following to DAB 6: Shaun Rojas, Bill Washburn, James
Deckard, Sergio Devora-Najera, Melinda Kellogg, Linda Matney, Scott Lucas, Angela Martinez, Gisela
"China" Pena, and youth member Alayna Welch.
Council Member Claycomb made the following appointments: Zach Gingrich-Gaylord, District 6
Advisory Board; Mark Baker District 6 Advisory Board and Debra Foster, MAPC.
Vice Mayor Johnson appointed Leslie Davis to DAB 1.
MOTION:
Mayor Whipple moved to approve the appointments.
Motion carried 6 to 0.
Vice Mayor Johnson thanked Gabriel Fonseca who served on DAB 1 for a number of months but have
since moved to District 2 as well as Aaron Mays who started off on DAB 2 and due to redistricting, we
lives in district 1 and served on DAB 1 and has termed out and thanked him for his service.
Mayor Whipple stated we have a workshop today at 12:30 p.m. to go over NLC's Code of Ethics
recommendations and response to our code of ethics.
