District I Advisory Board Minutes June 4, 2018 www.wichita.gov The District I Advisory Board meeting was held at 6:00 p.m. at the Atwater Neighborhood Resource Center located at 2755 E. 19th St. N., Wichita, KS, 67214. Fire Report Station 10 (see report) 6 actual fires, Fire Ordinance reviewed, Q: Is there a special number to call for fireworks concerns? A: It will be confirmed. District I Advisory Board Minutes June 4, 2018 Page 2 of 4 4. Police Report Patrol South: L. Carlson, Working on graffiti in the Old Town area and they have one suspect in mind. You can use communitycrimemap.com to view crime that has occurred in the area. Patrol North: A. Stark, there has been an increase in larceny to autos. Thieves are checking for unlocked cars. Auto- thefts are also on the rise. The Say YES program kick-off was today for kids to get free bus passes. Camp awareness took place at McConnell Air Force base to interact with kids this year. Q: What do you say when you call in about a suspicious character in the neighborhood? A: Any description that you can provide. 5. Library Report Anne Ethen, Library: Angelou branch will host a computer for beginners class this Thursday, Candid Conversation will begin June 15th at the Angelou Branch. The New Advanced Learning Library will open June 16th. On Saturday, June 16th a book brigade will take place to pass books from the old location to the new one. Recommended Action: Receive and File New Business 6. CUP2018-00019 LC Limited Commercial to Amendment of Plaza Twenty One Community Unit Plan (DP-56) Dave Yearout, Metropolitan Area Planning Department, will present this request. This application proposes to amend the Plaza Twenty One Community Unit Plan (DP-56) for Parcel 4 to add as a permitted use a night club in the City. This entire parcel is zoned LC Limited Commercial (LC). No rezoning is at issue, only the amendment to the CUP. Parcel 4 is now occupied by four buildings, including the “strip center” building at the east side of the parcel where the Lava Hookah Lounge is located. According to the CUP, Parcel 4 is limited to the following uses: Shopping Center Facilities, Retail Sales, Theatre, Financial Institutions, Restaurant, Offices and Private Clubs. The Lava Hookah Lounge, which is a permitted use within the complex, is now seeking a license to sell alcoholic liquor or cereal malt beverages under the provisions of the City Code, which means under the provisions of the Unified Zoning Code, the operation will be classified as a “night club in the city”. To allow this activity, an amendment to the CUP is required because of the distance of this Parcel to residentially zoned property. The addition of a “night club in the city” to the permitted uses in Parcel 4 is the limit of the amendment proposed. RECOMMENDATION: Based upon the information available at the time the staff report was prepared it is recommended that the request be APPROVED, subject to the following conditions: 1. Parcel 4 proposed uses shall be modified to read as follows: “Shopping center facilities, retail sales, theatre, financial institutions, restaurant, offices, private clubs and night club in the city; provided, however, sexually oriented businesses are not permitted.” 2. The CUP drawing shall be revised to include the details of this amendment as one drawing. 3. The site shall be developed in substantial conformance with the revised provisions of the approved CUP. 4. The applicant shall submit four copies of the amended and approved CUP within 60 days of final approval to the Metropolitan Area Planning Department or the amendment shall be deemed null and void. Comments from MAPC: NE Corner of 21st and Woodlawn. The Hookah Lounge would like to now sell alcohol. A few calls were received but no one spoke up against it. Questions from DAB: Q: Will the age to enter the business change if the sale of alcohol is approved? A: That age regulation would be based on the alcohol consumption laws. 2 District I Advisory Board Minutes June 4, 2018 Page 3 of 4 Q: Will this affect the time this business would be open? A: No Q: Do you know if security is present? A: Not aware Action Taken: Scanlon/Thompson made a motion to recommend that City Council approve the request. Motion carried 6:0. 7. PUD2018-00002 CBD Central Business District and B Multiple Family Residential to Zone change to PUD Planned Unit Development (PUD) to create Kansas Food Bank Warehouse Planned Unit Development (PUD #59) Dave Yearout, Metropolitan Area Planning Department, will present this request. The applicant is seeking to establish the Kansas Food Bank Warehouse Planned Unit Development (PUD #59) on the 2.3-acre tract generally located on the south side of Douglas Avenue between Minnesota Avenue and Minneapolis Avenue and just west of I- 135. This property was rezoned to LI Limited Industrial (LI) and a Protective Overlay (PO-123) in 2003 to accommodate the original redevelopment of the property for the warehouse. The property was subsequently rezoned in January of 2006 to the CBD Central Business District (CBD) as part of a rezoning along Douglas Avenue from Washington Avenue to I-135. The rezoning covered the land then owned by the Kansas Food Bank, but did not change the conditions of the Protective Overlay (PO-123). Recently, the Kansas Food Bank acquired additional properties to the south of the original development and the ownership now includes all the land encompassed within the PUD. The Kansas Food Bank Warehouse 2nd Addition is also being processed at the present time, which replats all the land and addresses the vacation of a portion of the alley to the south. Additional dedications for easements and relocation of some utilities are being guaranteed through the replatting process. RECOMMENDATION: Based upon the information available at the time the staff report was prepared, staff recommends APPROVAL of the application subject to 3 conditions. Comments from MAPD: The turnaround on Minnesota Street has been addressed and the other street is being studied. Traffic concerns will be addressed at the MAPC meeting. Questions from DAB: Q: What areas will have reduction in the PUD? A: Information was read from the report. Q: What about the no sign regulation that is near the highway? A: The no billboard restriction has been in place since the business began. The applicant is not complaining. Questions/Comments from Public: Concern: Concern of semi-trucks being next to 90-year old plus home and the damage to the property right next door. No reassurance about potential damage to property nearby. 3 District I Advisory Board Minutes June 4, 2018 Page 4 of 4 Concern: Security is a concern with the foodbank and the staff are not turning on their lights and providing security. People sleep behind the property and break into the building. The lighting under the bypass is not being addressed. Concern: The semi-trucks from the foodbank are a concern when they come on the residential street, parking for volunteers is a concern. The setback is a concern and maintenance of the current property is a concern. We were under the impression that only the parking lot was being expanded. Concern: The homes have already been brought and now the business is asking for a zoning change. There is a concern of the upkeep of landscaping and traffic flow. The dead-end dark spot needs to be addressed. No expansion conversation took place with the neighborhood. The big building with no lights blocks site issues. Comments from DAB: Residents are encouraged to report any nuisance concerns to City staff and call 911 for safety concerns. Action Taken: Mayes/Brumley made a motion to recommend that City Council approve the request with conditions of addressing lighting to stay on during the evening, remove right in-right out traffic on Douglas entrance and add-in right exist only on Minneapolis to turn traffic towards Douglas, recommendation of a masonry fence and consistent architecture standards on all four-sides of the building. CM Johnson: Juneteenth is June 16-23rd wrist bands are $5, Council will vote and June 12th for a swimming pool in District 1. CSR Alexander: Youth event flyers are available at the sign-in table.
