District I Advisory Board Minutes September 9, 2019 www.wichita.gov The District I Advisory Board meeting was held at 6:00 p.m. at the Atwater Neighborhood Resource Center located at 2755 E. 19th St. N., Wichita, KS, 67214. Approval of Minutes Motion to approve the minutes Motion by Thompson/Taben, carried 6:0. Staff Reports 3. Fire Report Station 10: In August, there were 651 total incidents: 33 fire alarms, 77 service alarms and 541 medical alarms. 4. Police Report Patrol North: S. Oldridge, there are a lot of larcenies to autos. Please remove all items from your cars. Parking in the driveway and leaving garage door openers allows people to get in your home. Patrol South: L. Carlson, Community Policing Officers, Broadway Corridor Officers, and the Homeless Outreach Team have been giving extra attention to the area of 2nd and Topeka near the Drop in Center to address ongoing vagrancy. There has been a lot of positive feedback from business owners since the initiative began. Q: Is it true that there are not enough beds for people to go? A: If there are not enough beds in the community then some form of camping can take place. The Homeless Outreach Team would have to clarify. The initiative mentioned concerns drinking alcohol in public and active warrants. There are also camping concerns that have to be addressed. Thornton, Crime statistics of Commercial robbery -100% decrease, Robbery from person- 66% decrease, Aggravated assault - 25% decrease, Residential Burglary - 12.5% decrease, Auto theft -21% increase, and Larceny from auto-17% increase. Patrol East officers will work on September 22nd at Open Streets ICT along Douglas from Noon-5pm. 5. Library Report Anne Ethen, Library: This week is Senior Wednesday at the Advanced Learning Library. On Wednesday, September 11, from 1:30-2:30 p.m., you can learn about the new KC-46 Tankers that arrived this year at McConnell Air Force Base and how these next generation planes will improve operations. If you’re interested in starting a small business in Wichita, consider attending the “Small Business Panel with Grow with Google” Thursday, September 12 from 6-8 p.m. at the Advanced Learning Library. Three small business owners will serve as panelists, including Andrew Gough (owner of Reverie Coffee Roasters), Summer Guerrero (owner of Affinity Automotive Services) and Andrea Stang (owner of The Hive Wichita). On Friday, September 20, the Angelou Northeast Branch will host the next Candid Conversations Book Club from 7- 8:30 p.m. This month, we will discuss The Learning Tree by Gordon Parks, a story about racial prejudice in small- town Kansas during the 1920s. The discussion will be led by Carla Eckels, Director of Cultural Diversity for news and engagement at KMUW. Get tech assistance at the Angelou Northeast Branch Library on Monday and Thursday evenings from 6:00pm to 9:00pm, while the Library is closed. Build digital skills through the guided Google Applied Digital Skills curricula. Assistance with job applications, resumes, printing documents, internet research, and other digital needs will be given first priority. The NEA Big Read: Wichita kicks off Saturday, September 28 during the Kick Off Party at the Advanced Learning Library from 2-4 p.m. This year, we will read and explore Lab Girl by Hope Jahren. Information about programs related to this year’s NEA Big Read: Wichita can be found at www.bigreadwichita.org. Recommended Action: Receive and File Public Agenda Board will hear public issues from individual citizens regarding City issues not scheduled on the agenda. Each presentation is limited to five minutes unless extended by the Board. 4. Scheduled Items Riverfront Legacy Master Plan Jeff Fluhr and Evan Rosell, Greater Wichita Partnership will present information about the Riverfront Legacy Master Plan. Comments: A master plan is a blueprint for the future. It provides a framework for future projects and how they can work together in the same space. The Riverfront Legacy Master Plan process will focus on the east bank of the riverfront area in Wichita and create a comprehensive vision and master plan that connects current and future projects and both banks of the Arkansas River. The process will build on previous studies and engage the community. The plan will consider all elements, including a performing arts center, convention center, Century II, the former library, WaterWalk area, connections to the west bank developments and riverfront gathering space. The scope will focus on the area south of Douglas Avenue to US-54/Kellogg and east to Main Street and connect projects from both sides of the river and with the greater downtown area and neighborhoods. 2 District I Advisory Board Minutes September 9, 2019 Page 3 of 5 Questions from DAB: Q: What is the funding mechanism? A: RCLCO Real Estate Advisors is looking at funding opportunities; we do not have a funding commitment at this point. Q: What did you like best from the outside contractors? A: The expertise that they are bringing. Q: I appreciate the various voices, how can people participate? A: We are meeting with USD259 students and other options are to attend the open gathering, or submit visions on our website: www.riverfrontlegacywichita.org, Legacy Lounge is launch a train car near just north of Century II to share your thoughts and ideas. Q: I am glad that all voices are planning to be heard; the one thing we do not have is the hotel space to accommodate conventions. A: Yes, that is a part of the plans and we need to do more. We need industry standard facilities also. Q: Are you looking at a time frame to develop the area? A: It will be a multi-year plan/project with moments to accelerate. Q: What is the general vibe? A: This is a passion and real interest to improve our downtown. There are many people asking what they can do. This is a moment to be defining. People do not want so-so; they want to do it well. Young people want to be able to go somewhere that is active. Open space that can be free outside of buying a ticket to certain events. Questions from Citizens: Q: What is the City’s budget? A: The total budget for the planning process is about $700,000. The private sector secured more than 70 percent of the total needed for the plan so far, the City of Wichita and Sedgwick County provided $100,000 each. Q: Do you have any ideas of what it will cost with deferred maintenance? A: That will be discussed in our October meeting. We are looking at the cost to build and maintain Q: Did any of those groups endow maintenance funding? A: We are looking what another City has done and looking at leverage of public and private sector. Q: How do you intend to avoid what happened to the arena? A: We learn from every situation, and there will be a real particular number in January to share. Q: What do you say to people who say that you have already made up your mind? A: we have not. Q Are there opportunities for Wichitans’ to be hired on for the projects? A: That is the next phase of this process. We will look at business expansions and more. DAB MEMBER ARRIVES 5. CON2019-00031 CBD Central Business District (CBD) to Conditional Use to permit a Drinking Establishment Scott Knebel, Metropolitan Area Planning Department, will present this request. The applicant is requesting a Conditional Use to allow a tavern and drinking establishment on property zoned CBD Central Business District (CBD) and generally located on the north side of East Douglas Avenue approximately 200 East of Hydraulic Avenue (1716 East Douglas Avenue). The building is presently vacant. The applicant submitted the attached site plan showing the manner in which modifications are proposed for the drinking establishment, to be known as The Lava & Tonic Tiki Bar. The proposed site plan envisions changes to the front façade of the building creating an outdoor seating area serving the business. There is also the intent to obtain permission for use of a portion of the sidewalk area for this activity. Separate permits are required for that activity. The use requires a conditional use because the location is within 300 feet of a residential use as noted. Recommended: Based upon the information available at the time the staff report, staff recommends the request be APPROVED, subject to four conditions. Comments from MAPD:  The primary change is to the front façade of the building similar to Hopping Gnome Brewing Company near them. Questions from DAB: Q: Have you heard from the residents within the triggered area? A: We heard from one person Q: Was everyone notified within the required range? A: Yes Q: Is it standard protocol about providing restroom space for outside seating? A: It depends on overall occupancy; it could trigger more bathroom space. There are 16 seats scheduled for outside. Q: Do you how much space is needed for ADA space? A: A 6-feet sidewalk would allow two wheelchairs to pass by. Q: Is midblock pedestrian crossing scheduled? A: It is propose in the Douglas project from Douglas to Grove Street. Comments from Applicant:  This is a time old trend to bring a new vibe to Wichita. The area has a nice cove of restaurants and breweries. Questions from DAB: Q: Is this like the Wave? A: No, no entertainment license will be sought with this project. The tiki-bar is a lounge theme that came out in the 30’s to bring in a tropical theme. No TV’s will be in the bar. Q: Are parking requirements met? 4 District I Advisory Board Minutes September 9, 2019 Page 5 of 5 A: There is no parking requirement because of the Central Business District area. We see a lot of foot traffic; our landlord is looking into other parking options nearby. Our hours of operation are opposite of some of the businesses in the area. Comment from Citizen:  This request in within my neighborhood association and I do not see a problem with it Recommendation: Holland/Thompson made a motion to recommend that City Council approve the request. Motion carried 7:0. Board Agenda 7. Updates, Issues and Reports Opportunity is provided for the Council Member and the District Advisory Board members to report any activities, events, or concerns in the neighborhoods and/or Council District.  Intake for youth with Real Men Real Heroes began tonight  Cheer contest 6-7:30pm, October 2nd hosted by Wichita Golden Bulldogs and City of Wichita Park and Recreation.  Open Streets ICT and the Avenue Art Day is on the same day and same area.  Tomorrow, City Council will vote on a potential agreement for Naftzger park to have a privacy component  Be encouraged to spread this information out  City Council voted to hire a Fuse Fellow to help with maximizing Opportunity Zones  Evergy Community investment funds were awarded and it is on the Wichita Community Foundation website  There will be a community meeting with Evergy to replace steel poles with wooden poles  There has been a request to modify City’s comprehensive plan for utility. Per state law, we do not have a lot lead way.  9th street dedication was on August 31st and it was a great turnout  Tomorrow is a candid forum at Roxy’s downtown  There will be a meeting next Tuesday, September 17th 5:30pm for those interested in saving Century II  Child Support Amnesty will be hosted at Atwater NRC, 9am-6:30pm on Friday, September 20th  Expungement Screening Event is September 27th from 10:30am-5pm at the Advanced Learning Library Recommended Action: Receive and file Adjourn Motion to adjourn the meeting Motion by Scanlon/Taben, carried 7:0. The accessory apartment shall be completed and maintained in compliance with the provisions applicable to taverns and drinking establishments in the Unified Zoning Code, as found in Article III, Section III-D(6)(w) as noted above, namely: A. No restroom facilities need be provided for the initial sixteen occupants to be served in the outdoor area, but restroom facilities shall be provided to full Code requirements for the portions of the permitted occupant load exceeding sixteen persons. B. No noise generated in conjunction with the outdoor use shall exceed a sound level of five decibels as measured on the 'A' scale of a sound pressure level meter over the normal background noise that is discernible at any property line of a lot within 1,000 feet that has a residential zoning classification. Normal background noise shall be established by taking the average of ten sound level readings in any ten-minute period. C. If lighting facilities are provided, the intensity of light and arrangements of reflectors shall be such as not to interfere with residential uses. The lighting shall be in compliance with the lighting requirements of Sec. IV-B 4. D. The outdoor use shall be designed and maintained in compliance with all other licenses, regulations and requirements of the fire, health, and building codes, including requirements for emergency access to or from any barriers that limit ingress or egress. 2. All permits and approvals shall be obtained, with copies placed on file with the Metropolitan Area Building and Codes Department. 3. A revised site plan addressing the conditions of approval shall be submitted for review and approval by the Planning Director or his designee prior to the issuance of a certificate of occupancy, but no later than 30 days after approval of the Conditional Use. 4. If the Zoning Administrator finds there is a violation of any provision or condition of the Conditional Use, or any other provision of the Unified Zoning Code (UZC), the Zoning Administrator shall enforce all remedies of Section VIII of the UZC, and with the concurrence of the Planning Director, declare the Conditional Use null and void.
