The District II Advisory Board meeting was held at 6:30 p.m. at Fire Station #20 located at 2255 S.
Greenwich Road Wichita KS, 67207. The Council Member, seven board members, four staff and one
member of the public were present.

STAFF REPORTS
Community Police Report
Officer David Hinners, Patrol East, Beat 35- Reminded the DAB members to secure their cars before going
out into the malls and shopping centers. Hinners reported that there has not been a huge increase in
burglaries in District II and encouraged people not to have their Christmas tree showing in the window, with
Christmas presents under it, due to potential theft.
DAB member- Have there been any issues with illegal hundred dollar bills on car windshields? Henry- We
have heard about it, but no calls have been received. One hundred dollar bills are being placed on car
windshields. People would get out of the car and grab the bill, then someone would be watching and waiting
to steal the car.
DAB member- How do you become trained in Community Policing? Hinners- The process begins in the
police academy, it is really no different than patrolling. Wichita has been assigned Community Policing
before they named it community policing.

Fire Report
Captain Warren King WFD, Station # 20, reported that in the City, there were 13 fires, 6 incidental and
only one occurred in District II. It was a small fire with $200.00 worth of damages. Total damages were $403
thousand dollars for 2014. There has also been an increase in alarms from 911 calls. King encouraged
everyone to be careful with electrical cords around trees and flammables that are near the homes. Questions-
none.

NEW BUSINESS
CUP2014-00035 Amendment to DP-194 Parcel 1 to allow a “night club in the city”
Bill Longnecker, Senior Planner, presented on a request for a GC General Commercial zoned site, Parcel 1,
is located within the GC and LC Limited Commercial zoned DP-194, the Home Design Center Community
Unit Plan (CUP). DP-194 is located one block east of Rock Road, between 32nd Street North and 29th Street
North, on the east side of Penstemon Street. The applicant is requesting amendment #4 to DP-194 to allow
unlimited alcoholic liquor sales and entertainment on Parcel 1; “a night club in the city.” The Unified Zoning
Code (UZC) defines a night club in the city as …”an establishment located in the City that provides
entertainment, which may include the provision of dancing by employees or patrons, and where cereal malt
beverage or alcoholic liquor are offered, consumed or served to the public or its members, and which may or
may not serve food.”; UZC, Sec.II-B.9.b. The site currently has a full service restaurant (Drinking Eating
Restaurant/DER), Mulligan’s Pub. Questions-none.
Nick Howell motion to approve CUP2014-00035. Blaine Knott seconded. Motion passed 7-0.
CON2014-00030 Conditional Use to permit a “nightclub in the city”
Bill Longnecker, Senior Planner, presented on a request for Conditional Use to permit a “nightclub in the
city”. The application area is 2.36 undeveloped acres that are zoned Limited Industrial (LI) which are located
at the end of North Lindberg Court (approximately ¼ mile north of East 13 th Street North, ½ mile east of
North Webb Road). The subject site is platted as a portion of Lot 3, Block 1, Waterfront 6 th Addition, and is
one of three lots situated on the Lindberg Court cul-de-sac that is the terminus of North Lindberg Court. The
applicant, Noah’s Event Center, is seeking “conditional use” approval for a “night club in the city” that will
part of an event center offered for rent for private events such as weddings, reunions, anniversaries,
birthdays, corporate or charitable events, art shows or similar activities. Per the “Wichita-Sedgwick County
Unified Zoning Code” (UZC), an establishment that serves alcohol and also provides live entertainment or
dancing is defined as a “nightclub in the city.”
DAB member- Why is there a website, phone number and the need to have someone to answer the phones?
Longnecker- It is not a Conditional Use that the staff added. If there is a change, it needs to be done by the
City Council. Staff tries not to get involved in hours of operation.

DAB member- How do you mandate the conditional terms? Longnecker- Code enforcement is not working
on the weekends, at that point residents would have to call the police.
DAB member- Is there more than one entrance? Longnecker: This property was platted, so access to the
drive is accessed through plat. The fire department has to make sure that they have enough room to get in and
out.
CM Meitzner- The 18 items are a combination of the neighbors putting it together with the owners. They
agree that this is what is livable to everyone that live in the area. This is the reason there was no protest. They
are allowing music, but no speaker type music. It worked out well before it went to the planning commission.
DAB member- Will they have to have a permit for tents each time they want to use one? Longnecker: No,
there is nothing in the conditions that would exempt them from having a permit for each use.
CM Meitzner- Within the contract, the owner has the right to shut an event down at any time.
Blaine Knott made a motion to approve CON2014-00030. Nazi Jesri seconded. Motion passed 7-0.
Updates, Issues, and Reports
Council Member Meitzner: Encouraged DAB members to attend the Breakfast on Saturday, Dec. 6 at 8:30
a.m. CM Meitzner discussed the $300 million dollars in road expansions and street improvements in District
II. CM Meitzner also commented that the City will benefit from having Kellogg road apart of the KDOT
project and briefed today’s City Council Meeting regarding explanations of IRB’s (property taxes).

Recommended Action: Based upon the information available prior to the public
hearings, planning staff recommends that the request for an amendment to DP-194 to
allow a night club on Parcel 1 be APPROVED, with the four listed conditions.
