District III Advisory Board Minutes for August 3, 2016 District III Advisory Board Minutes August 3, 2016 www.wichita.gov The District III Advisory Board meeting was held at 6:30 p.m. at the WATER Center, 101 E. Pawnee, Wichita, KS 67211; Councilman James Clendenin, ten District Advisory Board members, four City staff and nine signed in members of the public were present. Minutes from the July 5, 2016 meeting were approved. The agenda for the current meeting was approved. Councilman James Clendenin, Welcomed Daisy Olivar and Marco Alcocer to District III Advisory Board. Stated that Marjorie Griffith resigned and Catherine Johnson will take her place. Catherine will be appointed next month. Swearing in of District III Advisory Board Karen Sublett, City Clerk sworn in the following District III Advisory Board Members: Elena Ingle David Robbins Paul Davis Emily “Emy” Winterhaltor Gerald Henry Jessica Hutton Daisy Olivar Marco Alcocer STAFF REPORTS Fire Report Lieutenant Kyle, from fire station 2 reported that there were two house fires today (August 3, 2016) which have even keeping them busy. Thirty-one fires in June versus 17 last year. Six-hundred ninety nine medical call and two-hundred sixty eight service alarms this time last year there were two-hundred sixty eight medical 1 District III Advisory Board Minutes for August 3, 2016 and two-hundred and five service calls. Out of the nine fires four were arson, one was accidental, one undetermined and three are under investigation. Councilman James Clendenin, Fire numbers are up encourages everyone to be careful. Lieutenant Kyle, School is starting back up so please be cautious of children. Public Hoyt Hillman, inquired on identification of the body found in the river. Gave thanks to the search team. Lieutenant Kyle, was not sure if the body had been identified. Councilman James Clendenin, stated that this is more on police might have information on the identity. Public Mr. Hubler, Gave thanks to the traffic light at 63rd and Hydraulic. Encouraged others to contact Councilman if you have an issue because he will take care of it. Councilman James Clendenin, Fire has increased over this last year. Will look into having a public aware on fire safety on channel 7 and on social media. Police Report Officer Josh Hayze 29 beat, stated there were fifty-five auto thefts in the area. Burglaries increased, there were ninety. The increase in numbers could possibly be attributed to most officers being tied up with the Summer of Mercy protest. The south side Scat is working on several projects to assist with identifying several suspects. This morning one suspect in connection with a burglary was picked up. Additional suspects have been identified. DAB Paul Davis, stated that he is pleased with the job Chief Ramsay is doing. Paul thought it was distasteful that the Eagle publically posted negative comments regarding Chief Ramsay declining or taking a raincheck on the offer to go to the White House. Especially when he declined because of a scheduling conflict. Councilman James Clendenin, stated that Chief Ramsay was scheduled to officiate a wedding that day. He is very good at doing what he says he is going to do or he is going to do all he can to ensure it happens. Chief will have other opportunities to visit the White House. Officer Josh Hayze, stated that the cookout was a huge success and there are others scheduled. South Patrol is scheduled for Saturday, August 13, 2016. Neighborhood Night Out is scheduled for Tuesday, August 9, 2016. Public Barry, Why is the date of Neighborhood Night Out changed to August instead of October? Officer Josh Hayze, was not sure why the dates changed. Public, Stated that he appreciates Community Policing and the idea that they are to build report with neighbors. Chief headed back towards Community Policing? Will there be an opportunity to reestablish neighborhood watches? Neighborhood Watch would be great to have especially when the officers are tied up with other duties. Add more signs? Officer Josh Hayze, Neighborhood Watches are established by the neighborhood. The neighborhood would come to the police and request that they want a neighborhood watch. To establish a neighborhood watch there needs to be 50% of the block on board to have a neighborhood watch. Once that is done the police can get all the items needed. 2 District III Advisory Board Minutes for August 3, 2016 DAB Elena Ingle, stated that the City of Wichita use to have a training for those that wanted to be a part of the Neighborhood Watch. Is this still available? Officer Josh Hayze, stated that he has not heard about this but he could inquire and provide an answer at a later date. DAB Marco Alcocer, asked if police were still utilizing bicycles to patrol? Officer Josh Hayze, Yes, there are still a low number of police on bicycles usually when they are on a special assignment. With low man power on the streets those that are bike trained can only focus on a specific area. Such as if they are doing a special assignment on a specific street then they can go on bikes. If you know of a street that can benefit from bicycle policing please let PD know and that can be looked at but to have police on bicycles just is not feasible at this time. Marco Alcocer, Do you know if they would look at having a bicycle/car combo that way they can utilize both. Officer Josh Hayze, this idea can be ermined. DAB Dave Robbins, Are police still using the buddy patrol method? Officer Josh Hayze, No that method was utilized after the Dallas situation over that weekend for the most part we are back to individual patrolling. The single car squads increases response time. DAB Paul Davis, when you call 911 for non-emergency items them now have the capability to transfer you to a non-emergency line. Officer Josh Hayze, if you have a police issue that you wish to discuss you can send an email or call the police stations. PUBLIC AGENDA Scheduled Items None Off-agenda items DAB Paul Davis: The Eisenhower airport now has direct flights from Wichita to Seattle on Alaskan Airlines. There is now an incident family support team at the Airport. This team trains to be supportive to families when things arise. Paul provided pamphlets for those interested in being on this team or for additional information. Public Bill Stoffer, stated that he is representing Laurie Lawrence from District I. They represent a board on Environmental Health issues in the city. Laurie Lawrence is a sponsor of a program called Band the Bag. Mr. Stoffer does not like the term band the Bag because it adds the condonation that people will be penalized for using bags. Mr. Stoffer would like to use Bagitmovie.com. The issue is that plastic bags end up in the sewer lines people flush them down the toilets, they wind up in the storm drains. This is a national issue the Dallas area is in conversation to start taxing to utilize the plastic bags. The goal is that there will be more done to educate citizens on this issue. Requested that that the city co-sponsor an ordinance to help with the issue. Councilman James Clendenin, Seems like this has become a bigger issue ones we went from plastic to paper. This is an issue especially down by the river. His household actually reuses their plastic bag. 3 District III Advisory Board Minutes for August 3, 2016 DAB Daisy Olivar, Stated that while she was on vacation in California she was charged 5$ for a plastic bags. Which at first she thought the idea made no sense. After viewing a video on the educational side as to why they charged for bags it made sense. Daisy stated that this could be an option here in Wichita to alleviate people from throwing away the plastic bags. If one had to pay for the bags one would be likely to reuse bags. Bill Stoffer, stated that he would like a video or educational piece to publicized here in Wichita. Taxing is not the ideal way to go but he fears it is coming. Councilman James Clendenin, stated that he has received two or three calls this week about the bags down by the river so he abosulutly agrees a public awareness piece would be a good thing. DAB Paul Davis, told Mr. Stoffer about a Wichita Recylcing Coalition that meets Monday, September the 8th at 1pm at the East heights United Methodist Church located at Douglas and Crestway. They are working on trying to get a bottle bill passed through legislator. In the business that Mr. Davis is in they worked on getting the cloth bags which you can reuse. NEW BUSINESS Scheduled Items Improvements to the intersection at Mt. Vernon and Hillside Tim Davidson, stated that Shawn Mills and Bryce Berkus were also with him. Mt. Vernon and Hillside will receive new turning signals, and left turn lanes going in each direction so it will go to three lanes. Later down the road it will get bike lanes will be marked. The design went to council on February 29th and approved. Programmed construction in CIP for 2019. Funding is all general obligation funds. While doing construction the traffic will be conducted to one lane. The areas will be milled and overlayed add pavement markings. The right of way is concrete the radius will be widen which will allow for wider turn lanes. Bike lanes can’t be added now because this is a different scoop of project. This will be another CIP project. The budget is 1.6 to 5 million dollars. DAB Elena Ingle, Will the lanes on George Washington be three lanes? A: Tim Davidson, No, George Washington is not a part of this project. DAB Elena Ingle, are there plans to change the how Hillside is laid out? Councilman James Clendenin, stated that he will speak with Paul Gunzelman regarding adding reconstruction of Hillside later. DAB Elena Ingle, can we add better signage and lane paint when the bike lanes come because the way the bike lanes are on Mount Vernon and Oliver it does not flow correctly. DAB Marco Alcocer, Will the street remain the same width or will obtain portions of the right-of- way? A: Tim Davidson, Yes, portions of the right-of-way will be utilized. The driveway to the southwest for the church will be removed as well. This increases safety for this project. Public Mr. Bill Stoffer, Is this expansion is due to traffic in that particular area and the bike lanes are an afterthought? Tim Davidson, No, going to three lanes is a safety thing. This intersection is below the threshold to have more than three lanes. North of Mt. Vernon on Hillside gets under 10, 000 vehicles. To have more than three lanes the area must have 20,000 vehicles, so we are less than 4 District III Advisory Board Minutes for August 3, 2016 half. Three lanes will be safer. This will reduce accidents by 20%. There is a master plan to connect the bike lanes along Mt. Vernon. Public Barry Bike Walk Wichita, stated that they are very supportive of this project. They are seeing more and more people riding bikes. This is a safe project, just as stated previously it will take time for citizens to get use to the bike lanes. Barry is pleased to hear about this project. Councilman James Clendenin, stated that Mount Vernon has had issues going from four lanes to three lanes or vise verse. At this time they are not going to stripe the bike lanes. DAB Dave Robbins, Are the bike lanes restricted to just bicycles? A: Councilman James Clendenin, stated that motorized vehicles should not drive in the bike lanes. Recommendation: Motion Approved: Bruce Bass motioned Elena Ingle seconded Motion carried 9-0 ZON2016-00022 & CON 2016-00015 Bill Longnecker, stated that he did not understand as to why Dab wanted to revisit this case. Bill emailed the historical cases for review of DAB that were approved back in 2009. This case request to change GC zone to limited industrial (wreckage & salvage yard). Compared the previous cases and grounds for approval found no significant reason for not approving? There were no valid protestors on these cases. Turned it over to Paul Davis. DAB Paul Davis, stated that he would like to address the way that the cases are presented. The agents will represent their clients in the manner that their client wants them too. Paul provided slides where he explained the view of a salvage yard and a towing company yard. Paul stated that he spoke with the property owner and he confirmed that he does plan on utilizing the area for salvage. Paul provided the definitions of salvage stated that wrecking is not used anymore and he thinks it is wrong to use this term. Wrecking does not exist anymore as a term utilized. This application is not an issue the language and terminology is out of date in zoning codes. Greg, the zoning codes need to be reviewed and revised to update the zoning terminology. DAB: Bruce Gass, asked if DAB is able to make a request to amend a zoning code? Councilman James Clendenin, stated that this conversation is on the table at City Hall to redefine zoning language. DAB Dave Robbins, toured the salvage yard and observed one of the nicest salvage yards in town. The property is very well maintained. Councilman James Clendenin, requested that the compliment be passed along to the property owner. Public, stated that salvage yards in south Wichita along the highways entering into the city look bad. They show junk along the highways. Proper fencing should be required. A: Bill Longnecker, stated that it is in the conditions that proper screening be included. Recommendation: Motion Approved: Bruce Bass motioned Paul Davis seconded Motion carried 8-1 Elena Ingles opposed 5 District III Advisory Board Minutes for August 3, 2016 ZON2016-00032 Bill Longnecker, presented the request for a city zone change from Single-Family (SF-5_ to Two- Family Residential (TF-3) zoning on approximately 2.73 acres of Riverdale Additional. North of 55th street on both sides of Victoria. The applicant is seeking to add duplex. The planner recommends approval of this. There is a vacation case to be heard by planning on Thursday. There was a hearing to discuss the setback issue and several citizens showed up to discuss zoning. The Riverdale addition was built in 2003 so these lots have been sitting for a while vacant. The houses in Riverdale are single family. Councilman James Clendenin, asked if the applicant or agent were present. Bill Longnecker, stated that neither are here tonight. Councilman James Clendenin, Were they notified? Bill Longnecker, Yes, they receive notification. DAB Elena Ingles, Did any residence object to this? A: Bill Longnecker, Yes, but the meeting they attend was not the correct meeting to object at. The MAPC or DAB meetings are the meetings to object at. DAB Daisy Olivar, if approved with the properties have significant parking? A: Bill Longnecker, Yes, the street is wide enough. Usually the newer duplexes have a double car garage with a double car driveway. Councilman James Clendenin, it is very unfortunate that the applicant is not here. It would be nice for the public to have a visual of what their plan is. DAB Bruce Bass, asked if this was Councilman James Clendenin’s neighborhood. Councilman James Clendenin, stated this is his neighborhood. Neighbors came to his door with petition. At that time he made a suggestion because a convent was maintaining the area. Bill can you tell us if there is covenant that still convers this area? If there is a covenant it is a private convent. The zoning code and city have no jurisdiction. DAB Dave Robbins, stated that he attends the property actions and wonders if any of these properties were sold at auction? A: Councilman James Clendenin stated that these property’s’ have switch hands several times. Dave Robbins are these convent or HOA? Councilman James Clendenin There was an HOA but that is no longer active. Public: Are these going to be low income duplexes? A: Bill Longnecker stated that the zoning code only defines that the housing be two dwellings the code has nothing to do with one’s ability to pay rent or own the home. Recommendation: Motion deferred until applicant or agent can provide information on property. Swearing in of District Advisory Board Karen Sublett, City Clerk will swear in District III Advisory Board Members 2. Fire Report WFD will report on any specific issues of concern in the area. Recommended Action: Receive and file. 3. Police Report Community Police Officers will report on community policing issues in the area. Recommended Action: Receive and file. PUBLIC AGENDA 4. Recommended Action: Provide comments/take appropriate action. NEW BUSINESS 6. Improvements to the intersection at Mt Vernon & Hillside Tim Davidson, CIP Civil Engineer, Public Works and Utilities, will present the design concept for improvements to the intersection at Mt Vernon & Hillside. An open house will be held to provide an opportunity for an informal discussions with interested parties beginning at 6:00 p.m. prior to DAB meeting at 6:30 p.m. Recommended Action: The design concept be APPROVED. 7. ZON2016-00022 & CON2016-00015 Bill Longnecker, Senior Planner, will re-examine a request for a zone change to LI Limited Industrial (LI), and a Conditional Use for a Wrecking/Salvage Yard. The applicant is requesting a zone change from SF-5 Single-family Residential (“SF-5”) and GC General Commercial (“GC”) to LI Limited Industrial (“LI”) and a Conditional Use to permit a wrecking/salvage yard on three unplatted tracts that total approximately 7.9- acres. The subject property is mostly vacant, with the northern tract developed with a car lot. The Unified Zoning Code (UZC) definition of a “wrecking and salvage yard” includes the proposed use: “…a lot, land, or structure used for the collecting, dismantling, storing, and/or salvaging of machinery, equipment, appliances, inoperable vehicles, vehicle parts, bulky waste, salvage materials, junk, or discarded materials; and/or for the sale of parts thereof. Typical uses include motor vehicle salvage yards and junkyards.” The UZC, Art III, Sec III-D.6.e, requires a Conditional Use for a wrecking/salvage yard in the LI zoning district. Recommended Action: Based on updated information found, planning staff recommends that the request be APPROVED. 8. ZON2016-00032 Bill Longnecker, Senior Planner, will present a request for city zone change from Single-Family Residential (SF-5) to Two-Family Residential (TF-3) zoning on approximately 2.73 acres of Rivendale Addition to Wichita, Sedgwick County, Kansas. The applicant proposes to build duplexes on 13 platted lots located on either side of Victoria Street, immediately north of 55th Street South. Recommended Action: Based upon information available prior to the public hearings, planning staff recommends that the request be APPROVED. BOARD AGENDA 9.
