There were eight DAB members present (note: there are two vacancies on the board and the council member position is currently vacant). There were also seven City staff and 14 members of the public in attendance. The current agenda and minutes from January 6, 2021 were approved. Staff also discussed relevant public safety topics and answered questions from the DAB and public. 2. Wichita Fire Department WFD staff provided monthly district statistics, shared information on seasonal fire and public safety topics, and answered questions from the DAB and public. CUP2020-00047 Philip Zevenbergen, Associate Planner, Metropolitan Area Planning Department presented an application on behalf of Evergy Kansas South Inc. (applicant) and Professional Engineering Consultants (agent) for a City CUP Amendment to DP-169 to allow Major Utility and revise screening wall requirements on property zoned LC Limited Commercial, generally located on the southwest corner of East Pawnee Avenue and South Oliver Avenue (2423 S. Oliver). The Metropolitan Area Planning Commission approved this request unanimously at the January 21, 2021 public hearing. The applicant/agent was not in attendance. DAB did not have any concerns about this zoning case. A member of the public asked the following summarized question: Public: Would Evergy give any consideration to placing more lighting in the surrounding area where there is a need for additional lighting? A: I cannot speak for Evergy, but I will pass along this recommendation to an Evergy contact. Action Taken: Motion made by Jared Curello and seconded by Ron Tracy to APPROVE the application with the listed conditions per staff’s recommendation. Motion to APPROVE PASSED 7-0-1. Clapp Park Master Plan Update Larry Hoetmer, Landscape Architect, Park & Recreation Department and PJ Novick, Principal and Hank Moyers, Associate with Confluence provided a preview of the Clapp Park Master Plan, which is slated to go to City Council for final adoption in spring 2021. DAB and members of the public engaged in conversation about the plan with the presenters. The following bullet points are a summary of comments and questions shared and the responses and answers provided: DAB 3 • February 3, 2021 • Minutes • Page 2  Make sure Aviation Hill is unattractive to skaters. o The radius of the hill will be a deterrent to skaters.  Will the park end up costing the same or more than the space did when it operated as a golf course? o The golf system is setup as an enterprise fund that must be self-sufficient. Golf courses do not use the same funding mechanism for maintenance as City parks do.  What are the revenue opportunities? Will the plan be funded through the City’s general fund? o Revenue opportunities mostly lie in partnerships with private operators and vendor and rental fees. An example of a partnership would be the bistro listed in the plan. The City would solicit services (e.g. operation of the bistro) through an RFP process. Once a business is selected, negotiations would take place to determine what percentage of that business’s revenue goes back to the City. The City also has the option to charge vendor or rental fees for events such as a farmers market or concert, or the City could utilize similar agreements regarding receiving a percentage of revenue. Funding for park infrastructure will be addressed through the CIP process, while park maintenance has been and will be absorbed into the Park & Recreation Department’s budget.  Develop and build in a way that prioritizes preservation of the trees. o This was a significant consideration in the development of the plan.  Consider widening the paths to better accommodate both cyclist and pedestrian traffic. o Widening exiting cart paths is recommended in the plan.  Consider the orientation of the amphitheater to best prevent audiences from staring into the sun during evening shows and consider the need for shade. o In determining the orientation of the amphitheater, we also had to consider the effects of the sun on performers.  There is a strong demand for more parking near Griffith Elementary. o There may be an opportunity to partner with USD 259 in the future to address this.  Are there any incentives for private partnerships to benefit from the park being in an Opportunity Zone? o This needs to be explored further.  What security measures will be in place to ensure the park remains a safe space? o The plan utilizes CPTED (Crime Prevention Through Environmental Design) to focus on aspects such as lighting, visibility, accessibility, etc. to optimize security. Park & Recreation staff also routinely consult with law enforcement to maintain security at all City parks. There is also an ordinance for all parks to close by midnight and open at 6 a.m.  How deep will the ponds be? Could they possibly be used for ice-skating? o The ponds are not intended for ice-skating as that would require a very cold, long winter.  Will this plan be heard by MAPC? o The plan will be presented to the Park Board prior to going to City Council in spring 2021 for final adoption. Once the plan moves into implementation (e.g. building infrastructure or architectural aspects), then it will go through the planning process which results in a hearing with MAPC.  The bigger the sledding hill, the better! The hill at Sedgwick County Park seems to be a popular main attraction.  Develop plans to offer equipment for pickleball and cornhole in a way that does not put the equipment at risk for theft. Richard Ruth motioned to approve/endorse the plan. Jared Curello made a substitute motion to approve/endorse the plan with the stipulation that City Council not take any action until an interim District 3 Council Member is appointed. Action Taken: Substitute motion made by Jared Curello and seconded by David Kapaun to APPROVE/ENDORSE the plan with the condition that City Council refrain from taking any action until an itnerim District 3 Council Member has been appointed. Housing & Community Services 2021-22 Third Year Annual Action Plan: CDBG, HOME, ESG Funding Logan Bradshaw, Management Analyst, Housing & Community Services presented. The U.S. Department of Housing and Urban Development (HUD) considers the City of Wichita to be an entitlement city and as such, Wichita receives annual allocations of Community Development Block Grant (CDBG), HOME Investment Partnerships (HOME) and Emergency Solutions Grant (ESG) funds. In order to receive these funds the City is required to prepare a Consolidated Plan every five years. In addition, the City is required to submit an Annual Action Plan which addresses the priorities identified in the Consolidated Plan. The City submitted a Consolidated Plan for the 2019 through 2023 program years, and staff is soliciting comment regarding funding priorities for the fiscal year beginning July 1, 2021, and ending on June 30, 2022. HUD has not announced the City’s allocation amounts for the upcoming program year. Preliminary plans will be based on estimated funding at current levels and will be adjusted to reflect actual allocation amounts. District Advisory Boards and the general public are being asked to provide comment regarding changes that should be made if the actual funding allocations are increased or reduced, and to provide comment regarding urgent needs that may not be addressed under the current funding plan. Public comments will be used by staff to finalize the annual plan after HUD has provided final funding amounts. DAB made the following suggestions:  A larger percentage of funds this year should go into the home repair program to help support homeowners in need of assistance for keeping their properties maintained and compliant with MABCD violations.  The City should prioritize programs that increase the supply of affordable housing.  Funding should be allocated for support services which focus on seniors who may be isolated and living in poor and deteriorating living conditions. Richard Ruth shared information about the Kansas Appleseed organization and alley cleanup efforts in the South Central neighborhood. Ronald Tracy shared he will be working on a tree removal project and asked if anyone is interested in obtaining 3-4’ trees. Analysis: The City submitted a Consolidated Plan for the 2019 through 2023 program years, and staff is soliciting comment regarding funding priorities for the fiscal year beginning July 1, 2021, and ending on June 30, 2022. HUD has not announced the City’s allocation amounts for the upcoming program year. Preliminary plans will be based on estimated funding at current levels and will be adjusted to reflect actual allocation amounts. A presentation regarding programs funded during the last program year is attached. District Advisory Boards and the general public are being asked to provide comment regarding changes that should be made if the actual funding allocations are increased or reduced, and to provide comment regarding urgent needs that may not be addressed under the current funding plan. Public comments will be used by staff to finalize the annual plan after HUD has provided final funding amounts. Financial Considerations: The 2021-22 funding is proposed at current levels for discussion purposes: CDBG: $2,933,865; HOME: $1,535,187; ESG: $246,609. There is no impact on the General Fund. Legal Considerations: The comments provided by DAB members, citizens, and various community groups will be used to identify community needs and develop the City’s annual spending plan when actual allocation amounts are determined, as required by HUD for CDBG, HOME and ESG funds. Recommendations/Actions: It is recommended that the District Advisory Board Provide comment regarding community needs and funding priorities for the 2021-22 Third Year Annual Action Plan. (WCC III) PROPOSED USE: To realign and consolidate parcels, include Major Utility as a permitted use, and revise screening requirements BACKGROUND: This application is for an amendment to the Spencer Gardens Community Unit Plan (DP-169) to realign and consolidate parcels, include Major Utility as a permitted use, and revise the screening requirements. The property is zoned LC Limited Commercial and is located on the southwest corner of East Pawnee Avenue and South Oliver Avenue. The CUP permits a utility on Parcel 4. However, Evergy intends to discontinue that substation and build a larger substation on portions of what currently are Parcels 1, 2, and 3. This CUP Amendment is in conjunction with SUB2020-00051, which is a replat of the Spencer Gardens 2nd Addition. The lot lines of the current plat do not match parcel boundaries. In addition the replat will consolidate Parcels 1 through 4 on the west and north sides into a single Parcel 1 since it is under common ownership and will be one use. The remaining parcels on the east side of the CUP will become Parcels 2 and 3 respectively. The attached CUP drawing reflects parcel boundaries as they will stand after the replat. In addition to adding a permitted use, this amendment will revise the screening requirements for the utility. The Unified Zoning Code requires that no solid screening fence be taller than eight feet. General Provision 10 states that a solid or semi solid screening wall shall be at least eight feet but not exceed ten feet in height and be installed on the west property line of Parcel 1. Screening is not required along the west property line as that property is also zoned commercially. The only required screening would be along a portion of the north property line where it is across the street from residentially zone property. The attached site plan shows a nine-foot stonecast wall surrounding the substation compound. General Provision 10 shall be amended to update the location of screening as shown on the site plan. Property to the north is zoned TF-3 Two-Family Residential and LC. There are single family residences in the TF-3 zone and pawn shop in the LC zone. Property to the south is zoned LC and GC General Commercial with pawn shops and retail. Property to the east is zoned LC with a car lot, restaurant, and vacant retail space. Property to the west is zoned GC with self-storage warehousing and retail. CASE HISTORY: In 1987, the Spencer Gardens CUP was originally approved. Since then, it has been subject to several amendments and an administrative adjustment, which redrew lot boundaries and adjusted the net land areas of various parcels. In June 1988, the Spencer Gardens 2nd Addition was recorded with the Sedgwick County Register of Deeds. ADJACENT ZONING AND LAND USE: North: TF-3, LC Single family residential, Pawn shop South: LC, GC Pawn shops and retail East: LC Car lot, restaurant, vacant retail West: GC Self-storage warehouse, retail PUBLIC SERVICES: Both East Pawnee Avenue and South Oliver Avenue are paved, four-lane arterial streets with sidewalks on both sides. All public services are available to the site. CONFORMANCE TO PLANS/POLICIES: The Community Investments Plan (the Wichita-Sedgwick County Comprehensive Plan) includes the 2035 Wichita Future Growth Concept Map. The 2035 Wichita Future Growth Concept map indicates the site is appropriate for “new employment” and is located within Wichita’s 2035 Established Central Area. The “new employment” classification applies to those areas that likely will develop or be redeveloped within the by 2035 with uses that constitute centers or concentrations of employment. In addition, the Wichita-Sedgwick County Comprehensive plan identifies the Established Central Area and Metropolitan Area Planning Commission Page 2 CUP2020-00019 and ZON2020-00021 recommends an Urban Infill Strategy for the Established Central Area. The Wichita: Places for People Plan provides recommendations for urban infill development in the Established Central Area. The subject site is located within the Established Central Area in an area identified as Regional Center by the Places for People Plan. In addition, this site is also located within an identified “area of opportunity.” The Places for People Plan defines Areas of Opportunity as those “areas that generally exhibit economic challenges, a disconnected development pattern and a lack of walkable places and facilities. These areas need strategic investment, both public and private, to assist in redefining and reinvigorating the area.” A development such as this aligns with the goals of the Plan for strategic investment, as a larger substation provides greater capacity to the utility network for development. RECOMMENDATION: Based upon the information available at the time the staff report was prepared it is recommended that the request be APPROVED, subject to the following conditions: 1. The CUP drawing shall be revised to include the details of this amendment. a. General Provision 10 shall be amended to state the following: “A solid screening wall at least eight (8) feet, but not more than ten (10) feet high constructed of brick, stone, masonry, architectural tile, or other similar material (excluding wood or woven wire) shall be installed around the parameter of the major utility compound. b. General Provision 12 shall be amended to change the phrase “Superintendent of Central Inspection” to “Zoning Administrator.” c. A legal description of the property is required to be on the face of the of the final CUP drawing. 2. The site shall be developed in substantial conformance with the revised provisions of the approved CUP. 3. The applicant shall submit four copies of the amended and approved CUP within 60 days of final approval to the Metropolitan Area Planning Department or the amendment shall be deemed null and void. This recommendation is based on the following findings: 1. The zoning, uses and character of the neighborhood: Property to the north is zoned TF-3 Two- Family Residential and LC. There are single family residences in the TF-3 zone and pawn shop in the LC zone. Property to the south is zoned LC and GC General Commercial with pawn shops and retail. Property to the east is zoned LC with a car lot, restaurant, and vacant retail space. Property to the west is zoned GC with self-storage warehousing and retail. 2. The suitability of the subject property for the uses to which it has been restricted: The subject property is currently zoned LC Limited Commercial and a major utility is already permitted within CUP DP-169. 3. Extent to which removal of the restrictions will detrimentally effect nearby property: The approval of the proposed CUP amendment should have minimal detrimental impact on nearby property. 4. Length of time the property has been vacant as currently zoned: The subject property has never been developed. 5. Relative gain to the public health, safety and welfare as compared to the loss in value or the Metropolitan Area Planning Commission Page 3 CUP2020-00019 and ZON2020-00021 hardship imposed upon the applicant: Approval of the request will permit the improvement investment in the capacity of the utility network. Denial would presumably represent a loss of economic opportunity to the applicant and/or land owner. 6.
