District IV Advisory Board Meeting Minutes April 01, 2013 www.wichita.gov The District IV Advisory Board Meeting was held at the 6:30 p.m. at the Lionel Alford Branch Library, 3447 S Meridian. Five (5) DAB members, eleven (11) staff and five (5) citizens were present. Members Present Staff Present Councilmember Gray Kelli Geier, City Manager’s Office Bruce Werth Bill Longnecker, Planning Don McManamey 4 police staff June Bailey 4 fire staff Nancy Wilhite John Philbrick, Property Management Jerry Warren Order of Business Call To Order Councilmember Gray called the meeting to order at 6:37 p.m. The April 1, 2013 agenda was not approved due to lack of quorum. The December 10, 2012 and January 7, 2013 meeting minutes were not approved due to lack of quorum. PUBLIC AGENDA The public agenda allows members of the public to present issues not on the agenda to the District Advisory Board. Each presentation is limited to five minutes unless extended by the Board. 1. Scheduled Items Lisa Blume, The Stand Together Coalition, made a presentation to the Board regarding a proposed social hosting ordinance for Sedgwick County trying to eliminate underage drinking, including people providing alcohol to minors. Kansas state statute does make underage drinking illegal in the state of Kansas, but is largely unenforceable due to the size of the City of Wichita and lack of a social hosting ordinance. This coalition meets the fourth Tuesday of every month from noon until 1:00 pm. They presented some statistics: 30% of underage young adults drank in the last 30 days 173 DUIs were issued to people under 21 last year, with 19 of those involving injury/accidents Other negative consequences of underage drinking are property damage and sexual assault There were three high profile underage drinking stories in the news in 2012 Councilmember Gray asked how does the 30% stat given above relate to other points in history? Blume responded that while overall underage drinking has decreased, the coalition wants to promote the message that drinking is not a rite of passage; as well as, educate underage people on the effects of drinking since so much more research has become available. Gray also stated that the enforcement aspect of underage drinking is separate from the issue itself. He stated that a law may or may not be the solution to this problem. We need to not bog down the legal system, so we need outside resources to help enforce this law by working with the backside of the law. Bailey echoed Councilmember Gray’s comments and also asked what the current age is now for a young person to take a drink. Blume responded that 14 is the median age for young people to take a first drink. 2. Off-Agenda Items No items were submitted. STAFF PRESENTATIONS Public Safety Reports 3. Community Police Report Police staff reported the following: 24 beat o lowest crime statistics in March 2013 in three years o There were three auto thefts – all were recovered and two had suspects o There were two larcenies by South High with equipment being taken out of the trunk and they have a suspect o Bailey asked if there was a suspect holding people up at gunpoint on beat 24? The officer stated the suspect had been caught. 12 beat o Auto larceny special assignment that caught two juvenile offenders, 12 and 15 o Ice Sports had 30-50 auto larcenies from January 1, 2013 to March 15, 2013 – people need to remember not to leave items in their vehicle Seatbelt monitoring at West High Purses and sports bags are being taken from vehicles at the Sporting Zone, 9020 W Harry Construction theft at Kellogg and Tyler Gang Walk – April 20 at McAdams Park sponsored by the Wichita Police Department and the Latino Police Officer Association 4. Fire Report Fire staff reported the following: 18 structural fires 2 arsons occurring in their own residences Doing a lot of multi-family dwelling building inspections Just finished with severe weather response training, urge citizens to be prepared also Councilmember Gray asked for clarification that accidental fires are not arson. The fire staff present stated that is correct. Gray also asked if an arson finding can be challenged and if there will be criminal charges filed in the arson cases. Staff replied that yes criminal charges will be filed in the arson cases and that usually an insurance company has their own private investigator to make a determination in an arson case before it is settled and payment is received. Action Taken: Received and filed. NEW BUSINESS 5. ZON2013-00003 Bill Longnecker, Planning, presented this zone change request from LC Limited Commercial ("LC") to CG General Commercial ("GC") on 7.55 acres to allow additional uses, generally located north of Maple and east of Sycamore (300 S. Sycamore - Lawrence Dumont Stadium.) The applicant is requesting the GC zoning to allow additional uses, such as the past carnivals that have been a participant in the annual River Festival; Unified Zoning Code (UZC) Sec.II-B.11.b, Outdoor Recreation and Entertainment. Outdoor Recreation and Entertainment (including a carnival) is first permitted by right in the GC zoning district; UZC Sec.III-B.16.b.(3). The site is also located within the D-O Delano Neighborhood Overlay District (“D-O”). Mr. Longnecker was present to answer questions regarding this request. He stated that this land is not being replatted at this time due to the lack of resources needed and poor timing. He further stated that this is not being rezoned all at once in an effort to expedite this process since there are many carnival event requests. Bailey asked if there had been contact with the neighborhood regarding this request. Longnecker also stated that there has been no contact with the neighborhood regarding this request; however, the Delano Association Board is satisfied with the overlay standards currently in effect, which supersede zoning designation of the land. Action Taken: Due to a lack of quorum, no formal vote was taken, but all five DAB members present recommended approval of the conditional use request. OLD BUSINESS 6. No items were submitted. BOARD AGENDA 7. Board Updates and Issues Werth – There is an Easter egg hunt Saturday, April 6 at Calvary Baptist Church hosted by the Park Neighborhood Association. Wilhite – Pure Kansas is having its fifth annual Earthfest Saturday, April 27 at the Water Center. Bailey – Orchard Breeze is having a neighborhood cleanup Saturday, May 18. Geier – This week is Amnesty Week, an opportunity for those with outstanding warrants to take care of them without further repercussion. Stanley Neighborhood City Hall is still providing free tax preparation for the next couple of weeks. Love Wichita is Saturday, April 27. This is a day of serving where churches around the City gather to assist those in need with various projects (property repair, neighborhood cleanup, etc.) 8.
