The District IV Advisory Board meeting was held at 6:30 p.m. at the Alford Library at 3447 S.
Meridian, Wichita, KS 67217. There were ten (10) District Advisory Board members in
attendance as well as Councilman Blubaugh. There were seven (7) City Staff, and twenty (20)
members of the public present.

ORDER OF BUSINESS
At 6:33 p.m. DAB member Alex Martinez opened the DAB meeting and asked everyone to take
their seats and called the meeting to order. He then asked everyone to stand for the Pledge of
Allegiance, after which he asked for a motion to approve the agenda for March 5. A motion was
made by Nick Hoheisel, 2nd by Stephanie Hartman. The minutes for the 2018 February 5th
meeting were then approved (motion made by Rebecca Robertson and 2nd by Nick Hoheisel).

STAFF REPORTS
Councilman Blubaugh then asked for a report from the Wichita Fire Department. Cpt. David
Voss reported that there were 4 fires in February, three being accidental and 1 still under
investigation. He further stated that we all need to be on high alert during this very dry, windy
weather and that there was a burn ban in effect.
Councilman Blubaugh then asked for Wichita Police reports.
Community Police Chris Robinson, Beat 299, reported that auto larcenies were up, but all other
crimes were down including the 911 calls from the Wind Ridge Apartments. Officer Robinson
stated that they only received five 911 calls last month from this problem complex. Board
Member Don McManamey commented that there were some incidents occurring in the 2200
block of south Vine, and that perpetrators attempted to kick in a front door at one of the
residences. Officer Robinson said that he would follow up on this.
Officer Darrin Williams, Beat 15, reported for Patrol West and stated that most of the
Community Police Officers would be helping downtown the week of March 12th due to the
NCAA Tournament being held at INTRUST Bank Arena. In addition he emphasized that when
working out in your yard this season to keep your garage door closed and secured. It only takes
a few seconds for someone to steal something out of your garage. He also reminded the
attendees to keep any valuables out of sight in your vehicle, and to move these items to your
trunk or glove box prior to where you are headed. Board Member Michael Gomm asked Officer
Williams what areas to avoid during the NCAA Tournament and was only told that all of
downtown would be busy and there was a closure on Commerce Street, but that he didn’t know
the exact date of this. But in addition to the Tournament there was also going to be the St.
Patrick’s Day Parade and a Swap Meet at Century II on the 17th of March, so the downtown area
will be a big mess!
The next staff report was from Robyn Belt, Manager of the Alford Branch Library. Robyn
reported that Alford’s Gate Count for February was 6,800 visits, and that Alford’s Circulation
count for February was 12,898 items. The Friends of the Wichita Public Library Book Sale is
being held this week at our Central location. Fill a bag of books for just $5. The preview night
for Friends of the Library members will be Wednesday, March 7 from 5pm-7pm, memberships
can be purchased at the door. The sale is open to the public Thursday 10:30am-7pm, then Friday
and Saturday 10:30am-3pm. However, last time the last 2 days of the sale were cancelled
because everything sold out. Get there early! All library locations will be closed on Sunday,
April 1st, which is the Easter holiday. Otherwise, libraries are open 1pm-5pm every Sunday until
Memorial Day weekend.

PUBLIC AGENDA
No one responded when Councilman Blubaugh asked if there was anyone who had NOT
scheduled, but wanted to speak. Councilman Blubaugh then asked for Lt. Scott Hiser of the
Salvation Army to speak since he was on the agenda.
Lt. Hiser stated that most everyone had heard about the Salvation Army and that they were an
outreach organization. The West Orchard Corps & Community Center are located at 1910 S
Everett and that they have emergency social services, as well as adult and children’s programs.
They have a community center gym, and they are looking for volunteers to help with the “open
play” program. Councilman Blubaugh thanked Lt. Hiser and invited him back to speak any
time.
NEW BUSINESS
Scott Knebel, Planning Manager with MAPD, presented all cases under “New Business”.
First up was case PUD2018-00001. Mr. Knebel went over the staff report that reported the
applicant is seeking to establish the Steve Masters Center Planned Unit Development (PUD #58)
on the SF-5 Single Family Residential (SF-5) zoned 0.87-acre unplatted tract general located on
the north side of 47th Street South, approximately one quarter mile west of South Seneca
Street. The intent of the attached PUD is to permit the continued use of this property for the
business activity the applicant has conducted for some time. The business is primarily a mowing
service business, but because of past activity associated therewith which has left mowers and
other equipment outside of enclosed buildings, the applicant has been cited for violations of the
Zoning Regulations. Mr. Knebel stated that MAPD had received 40% protest petition that was
signed by six (6) property owners within 200 feet, and there was another page but it was not
filled out properly. In addition there were 5 properties that signed, but not within the 200 feet
from the applicants property line. Due to this, the vote at City Council will require 6 votes in
which to approve the request.
Councilman Blubaugh asked to hear from the public in attendance and there were several who
spoke; Lois Chavez, Helen Lynch, Roman Quezada, Greg Shurtz, Max Fischer, Kira Miller,
Shadie Masters, Helen Lynch, Roman Quezada, Max Fischer, Kara Miller, Shadie Masters, Pete
Chavez, Joyce Garrett, Buddy Shurtz, and Steve Masters. There were statements made in favor
and against Mr. Masters continuing to operate his business out of this residence.
DAB Member Matt Lashley asked Mr. Masters if his ground water and soil have been tested for
any illegal dumping of oil or chemicals, and Mr. Masters replied no. Mr. Masters said that he
disposes of his oil at three separate companies.
DAB Member Nick Hoheisel asked Mr. Masters how long he had been repairing mowers, and
Mr. Masters replied 20 years. He stated that when he purchased the property it was unplatted

and there were no zoning restrictions at that time. Mr. Hoheisel then asked how many mowers
did Mr. Masters sell each month? Mr. Masters replied that it varies by season with April, May,
and June being the busiest times for him. Mr. Hoheisel asked Mr. Masters if he had any
objections to the provision/conditions listed on the staff report that are required by Mr. Masters
to complete, and Mr. Masters stated no. Mr. Hoheisel then asked if he had the twelve (12) paved
parking spaces, and Mr. Masters replied yes.
DAB Member Michael Gomm then asked about all of the junk in the yard on his property that is
visible by aerial satellite images. Mr. Masters replied that this must be an older view, because he
now has a large outbuilding that houses all of his mowers and other equipment.
DAB Member Kit Corby asked Mr. Masters how many employees did he have, and Mr. Masters
replied “one”. Ms. Corby then asked about the business hours in which Mr. Masters was open.
Mr. Masters replied that Monday thru Saturday that he was open from 9 am – 7 pm, and on
Sundays from 1 – 5 pm. However, from November thru February the weekday hours are from 1
– 6 pm.
Member Michael Gomm then asked Mr. Masters ‘why should we treat you any different than
others who want to rezone their properties ‘? Mr. Master’s reply was to point out that his
neighbor, Mr. Shurtz, is running a commercial business on his property. (Mr. Shurtz openly
denied). Then Mr. Masters stated that Jeff Lange owned a house next to the Sonic Drive-in (at
Seneca & 47th St) and that Mr. Long “across the way” signed an approval for Mr. Masters to stay
in business.
DAB Member Rebecca Robertson asked Mr. Knebel why the DAB is being asked to “deny” the
request since MAPC approved the request based on conditions. Mr. Knebel explained that the
MPAC is different than what the staff (MAPD) recommends. Mr. Robertson then asked Mr.
Knebel is the property owned by Mr. Masters has access to Millwood Street (behind the
property) and Mr. Knebel replied “yes”. Mr. Master then stood up and stated that he would only
use the back entrance off of Millwood during his business hours.
DAB Member Don McManamey commented that he was concerned about making a
determination on this case without the latest report from MAPC. He further stated that he would
like to see Mr. Masters given the chance to meet the conditions. He continued stated that he is
generally in favor of what the neighbors want, but he is hoping that this compliance will help
settle things down in the neighborhood.
At this time, DAB Member Stephanie Hartman made a motion to deny the request due to
comments made by neighbors of Mr. Masters. Michael Gomm gave a 2nd motion, and
Councilman Blubaugh asked for a vote. The vote was 2 aye and 8 nay. Motion did not pass.
DAB Member Nick Hoheisel then motioned that the request be approved as noted by the MAPC,
and Matt Lashley gave a 2nd motion. The motion carried 8/2.
The next item on the agenda was ZON2018-00003 and CON2018-00006. The applicant is
requesting a change in zoning from SF-5 Single-Family Residential District (SF-5) and MF-

29 Multi-Family Residential District (MF-29) to LC Limited Commercial (LC), and a
Conditional Use for an event center in the City for the 3.07-acre property at 537 West
MacArthur Road, which is south of MacArthur Road on the west side of Gold Street and just
to the west of I-235. The proposed event center will serve alcohol and have live entertainment,
thus making it a nightclub. The attached applicant narrative proposes a set of operating
conditions for the event center. The rezoning is necessary to be able to pursue the conditional
use for the event center. Since the event center will serve alcohol and have live entertainment,
the Unified Zoning Code (UZC) defines the use as a nightclub, which requires a Conditional
Use when located with 300 feet of a residential zoning district. The subject property abuts
residentially-zoned properties to the north, south and west and is across the street from
residentially-zoned property to the east.
Mr. Knebel stated that the Planning Department is asking for approval based on the event
center being open for “invitation only” events, and that the department is looking to them for
specific details on where the outside events would take place, as well as other conditions.
There were no questions or comments from the public and no questions from the DAB.
DAB Member Nick Hoheisel made a motion to approve, and Matt Lashley gave a 2nd motion.
Motion carried 10/0.
Mr. Knebel then proceeded to the next case, ZON2018-00004 and CON2018-00007. These
applications are designed to accommodate the building of a structure designed to be used for
the indoor salvage and storage of aircraft components. The site is currently zoned SF-5
Single Family Residential, and has previously been used as a single family residence. The
application would see the construction of a 9,600 square foot warehouse on site, along with 9
parking spaces, two drive entrances, a privacy fence, and added space for future building
expansions. This business is an expansion of an existing nearby business located at 7070
West Harry Street and 6925 West Mariposa Lane, and that three buildings were being added.
Mr. Knebel stated that a site plan still needed to be submitted and approved.
There was no one in attendance that objected to this request.
DAB Member Nick Hoheisel made a motion to approve, and Jason Platter gave a 2nd motion.
Motion carried 10/0.
The next item on the agenda was the Delano Neighborhood Plan 2018. The 2001 Delano
Neighborhood Revitalization Plan was adopted as an amendment to the Wichita-Sedgwick
County Comprehensive Plan in March 2001. After 15 years of implementing projects
outlined in the 2001 Plan and changing conditions in the neighborhood, active neighborhood
groups (Delano United and the Delano Neighborhood Association) and the City of Wichita
recognized that the time was right to take a look at how the neighborhood would navigate its

next chapter. The Metropolitan Area Planning Department was formally asked to revisit the
Plan and draft an update.
A PowerPoint presentation was given and Mr. Knebel stated that although the DAB agenda
stated that we would just receive information and comments, Mr. Knebel was asking for the
DAB’s approval via vote. There were eleven (11) separate land uses identified in the
presentation, and land use #5, master parking plan, will start planning in May of 2018. Peter
Roenne, 145 S Doris, asked if MAPC is addressing the 2-lanes plus parking that is currently
on Douglas Avenue (and drivers wanting it to be 4-lane). Mr. Knebel replied yes, this is also
a concern of the City and they will be addressing this.
DAB Member Matt Lashley gave a motion to approve the Delano plan, and Stephanie
Hartman gave a 2nd motion. Motion passed 10/0.
BOARD AGENDA
There was no Old Business to report, the board members were wanting to discuss fireworks. The
DAB concerns were primarily the changes in fees to sell fireworks. The board members thought
that $5,000.00 was indeed too much money for a non-profit to need to sell fireworks, and that the
non-profits should pass less than commercial businesses. All of the board members thought that
the fees were a very important issue. Several of the board members thought the current City
code should be kept, but should be enforced which has not been done in the past.
Kendice Talty, attendee, stated that her autistic son cannot handle the loud noises from fireworks
and hopes that there is more enforcement. DAB Member Rebecca Robertson has her if she had
called 911 on the neighbors that were illegally using fireworks, and Ms. Talty replied yes.
Councilman Blubaugh commented that he will be in Washington, DC next week and will not
return until Wednesday night. CM Blubaugh then asked for a motion to adjourn. A motion was
made by Don McManamey and a 2nd given by Kit Corby. Motion carried 10/0.

NEW BUSINESS
PUD2018-00001:
The applicant is seeking to establish the Steve Masters Center Planned Unit Development

primarily a mowing service business, but because of past activity associated therewith which
has left mowers and other equipment outside of enclosed buildings, the applicant has been
cited for violations of the Zoning Regulations. This application is an attempt to resolve all
zoning violations for the business being operated at this site.
2018-00
According to records of the City and discussions with the applicant, the applicant acquired this
property a number of years ago and used it for his residence. Subsequently, the mowing
business was established. There have been a number of accessory buildings also constructed
on the site by the applicant, many associated with the business.
All of the properties surrounding the site are zoned SF-5 Single Family Residential.
Residential uses are located north, south, and east of the site.
Recommended Action: While the use of a PUD to modify zoning standards to allow this
use is permitted; the overall character of the neighborhood and the intensity of the proposed
use are not compatible. Therefore, staff recommends the establishment of the requested PUD
be DENIED.
ZON2018-00003 and CON2018-00006:

conditional use be approved subject to the conditions listed on the staff report.
