District IV Advisory Board Minutes December 02, 2019 www.wichita.gov The District IV Advisory Board meeting was held at 6:30 p.m. at the Alford Library at 3447 S. Meridian, Wichita, KS 67217. He then asked everyone to stand for the Pledge of Allegiance. Mr. Gomm proceeded with the agenda and asked approval for the December 2, 2019 agenda. DAB Member Kit Corby made a motion to approve and DAB Member Matt Lashley gave a 2nd. Motion was approved 8/0. The next item was approval for the November 4, 2019 DAB meeting minutes. DAB Member David Kapaun motioned to approve and DAB Member Kit Colby gave the 2nd. Motion was approved 8/0. STAFF REPORTS DAB Member Michael Gomm asked CP Officer Roddy Winder to give his report. Officer Winder stated that he covered 14 Beat for Patrol West. He reminded everyone that we are now in Page 1 of 11 District IV Advisory Board Minutes December 02, 2019 www.wichita.gov the big shopping season and that car break-ins are on the rise. Please keep your possessions out of sight by putting them in the trunk. Auto thefts are also on the rise as drivers are warming up their vehicles with the keys still in the ignition. Officer Winder suggests a remote starter for those that do this, or simply stay with the vehicle. As there were no questions for Officer Winder, Chairman Michael Gomm then called on DAB Member Matt Lashley who was filling in for Library Branch Manager Robyn Belt who was not present to read the Alford Branch Library report. Mr. Lashley reported: Alford’s Circulation count for November was 10,157 items. Alford’s gate count for November was 5,873 visits. 1. There is still time to finish your 2019 ReadICT Reading Challenge! If you are looking for a title to finish out the year, join your ReadICT book-loving online community for a real-life meetup and book swap. Bring your favorite book (or bag of books) to discuss and swap. Any leftover books will be donated to the Friends of the Wichita Public Library. Suzanne Tobias and library staff will be on hand to spark your reading interest. The event is next Saturday, December 7th from 10:30am-12:30pm at the Advanced Learning Library. 2. Let your teen start off their Winter Break right with a cozy afternoon at the library. On Monday, December 23, grades 6 through 12 are welcome to chill here at Alford doing puzzles, enjoying popcorn, and discussing books. The program will run 2:30pm-3:30pm 3. All Wichita Public Library locations will be closing early at 3pm on Tuesday, December 24th and remain closed on Wednesday, December 25th for the Christmas holiday. We will also close early on Tuesday, December 31st at 5pm, and be closed all day on Wednesday, January 1st, 2020 for New Year’s Day. PUBLIC AGENDA Kansas State Representative Nick Hoheisel was on the scheduled agenda and gave legislative updates for the upcoming 2020 discussions. Rep. Hoheisel says that he has been meeting with a lot of different groups prior to the start of the next session that begins in January 2020. Rep. Hoheisel said that he specifically wanted to reach out to the DAB as City government is the closest government representation to the populace. One of Rep. Hoheisel’s major focus will be on transportation. The State is currently wrapping up the T-Works program, and the State will be rolling out a new transportation program named Forward. Areas of interest in the Wichita area will be the Southwest Bypass (K245 to west 54 Highway/Kellogg) going to Goddard. Another area is the north junction for K96/I-135/I-235/K254. This is high on the legislative agenda to get Page 2 of 11 District IV Advisory Board Minutes December 02, 2019 www.wichita.gov completed. Another one is east Kellogg past Webb Road to Kellogg now that the Webb/Kellogg intersection is open. This leads directly to Andover. Criminal Justice Reform is another major issue. Recently the Governor had to send 100 prisoners to Arizona at the daily cost of $75 @ prisoner. The State prisons are currently at 105% occupancy. The criminal justice reform is investigating ways to deal with offenders by not sending them to a prison. Tax Reform is another issue, especially sales tax on food items. Right now we have one of the highest food taxes in the region. The most important issue that Rep. Hoheisel will be working on is Mental Health. There will be lots of talk and action on the mental health crisis. This is affecting all of us, especially in south Wichita right now. Rep. Hoheisel mentioned the incident that happened inside a Dillons Grocery Store at 31st & Seneca where a veteran with mental health issues walked in and took his own life. There have been many “mental health shootings” as well. Handling these problems will be costly now, but will save money in the long run. Rep. Hoheisel is supportive of the recently formed Integrated Care Team (ICT) that handles mental health crisis incidents, and there are currently some pilot programs at schools that address mental health. He is hoping that they can expand both of these programs. DAB Member Matt Lashley asked if the reform will cover drug and alcohol treatment. Rep. Hoheisel replied yes, that this is something that the Sedgwick County Sheriff Easter is pushing for due to the majority of incidents being caused by substance abuse. Vice Mayor Blubaugh stated that many people believe that Kellogg is now done, when in fact Kellogg is NOT completed. The Vice Mayor states that there needs to be a bypass at 119th St west and west Kellogg. He wants to do whatever he can to get more attention for this intersection and would like to work with Rep. Hoheisel on achieving this. The Vice Mayor has heard that there might be some State funds for this, and Rep. Hoheisel replied that there are some excess funds for transportation issues, but he hasn’t heard much about this issue from the Transportation Committee that he serves. DAB Member Jonathan McRoy asked if there will be future mental health courts that are equipped to handle suspects with mental health problems. Rep. Hoheisel replied that there is currently a Criminal Justice Reform Commission and they submitted their preliminary report last week, and he is unsure if this is in the report. Chairman Gomm asked for a brief rundown of what the Criminal Justice Reform covers. Rep. Hoheisel stated that it includes investing in more mental health facilities/beds and raising the threshold for felony offenses for property damage from $1,000 to $1500. Rep. Hoheisel asked if he was wanting to know about decriminalization or legalization (of marijuana). Mr. Gomm, replied not really. He is wanting to know more about how to reduce the current 105% capacity in prisons and jails. There are 15-16 recommendations in the Criminal Justice Reform report and Page 3 of 11 District IV Advisory Board Minutes December 02, 2019 www.wichita.gov he can post it on line so that it can be easily accessed by those who would like to see the recommendations. DAB Member Matt Lashley asked if there is going to be decriminalization. Rep. Hoheisel responded that they are still a long way from that occurring. There is a shot that medical (marijuana) will be approved this year, but it will be a narrow version of what is occurring in other Midwest states. DAB Member McManamey asked if more criminals could be confined under house arrest. Rep Hoheisel replied that house arrest could be an option, but if it is for drug possession or abuse, a system would have to worked out to collect UAs and other drug tests. Vice Mayor Blubaugh addressed Rep. Hoheisel by stating that if he is needing any feedback on any issues to let him know so we can collect feedback for him. During Rep. Hoheisel’s discussion, members of the Wichita Fire Department arrived, so Chairman Gomm asked them to give their report at this time. Cpt. Jim Heath stepped forward and stated there had been 17 fire alarms, 46 service alarms, 429 medical alarms, for a total of 492 incidents in District 4 during October. There was a fire at 6211 S Seneca that was caused by an electrical issue causing $20,000 in loss. Cpt. Heath then asked if anyone had heard the term, Close Before You Dose. This is the new push nationwide, and said that UL (Underwriter’s Laboratory) are constantly running tests and statistics and that it is important to keep all bedroom doors closed at night. If a fire starts in the living room, that a closed door would be about 100 degrees compared with an open door that would allow temperatures up to 1000 degrees. He further stated that most fire related deaths are caused by carbon monoxide poisoning. An open bedroom door allows for 10,000 ppm and 100 ppm with a closed door. About half the fires deaths reported from homes happen between 11 pm and 7 am. In addition, it is important to check your smoke alarm monthly as 3 out of 5 deaths from fire in the home have no working smoke alarm or no smoke alarm at all. There were no questions for Cpt. Heath. Chair Michael Gomm then opened the Public Agenda to those who were not on the agenda. At this time Jeff Fluhr, President of the Greater Wichita Partnership went to the podium. Mr. Fluhr is gathering feedback from as many Wichita residents as possible for the Riverfront Legacy Master Plan design concepts. The Riverfront Legacy Master Plan will consider all elements together, including a performing arts center, convention center, the former library, Century II, pedestrian bridge, WaterWalk area and open riverfront gathering space, as well as connecting elements from Kellogg to Douglas, west bank development, downtown and area neighborhoods. The plan will build on previous studies for the east side of the Arkansas River as well as new developments such as the ballpark on the west side. Mr. Fluhr handed out cards to all the DAB Members and left extra cards at the sign-in table for guests. There is a questionnaire that shows many different scenarios that include a new Page 4 of 11 District IV Advisory Board Minutes December 02, 2019 www.wichita.gov convention hall and a new performing arts center, as well as parking and green space. (the questionnaire can be accessed at https://www.riverfrontlegacywichita.org/contact) Mr. Fluhr asked everyone to take a few minutes to look over the design concepts/scenarios and respond to the simple questions asked about each scenario via the questionnaire. Chairman Gomm then called on Chris Stark who had raised his hand to speak on the public agenda. Mr. Stark went to the podium and thanked Vice Mayor Blubaugh for all the help he has given the bike paths in District 4, as well as the DAB. Mr. Stark states that the Sycamore path that is near him basically leads to nowhere and needs to be expanded, especially on McCormick where he has been ran off the road as well as hit from behind from careless drivers. VM Blubaugh thanked Chris for bringing this up because VM Blubaugh is focusing on connecting the bike paths from Pawnee Prairie Park to Newman University and then Friends University and on into Delano. He has also been looking down south and believes there are opportunities to make connections to Haysville and Derby. Mr. Blubaugh has been in touch with the Mayor of Haysville who is willing to help with this. The Vice Mayor is not wanting the City to just focus on the West and East connections when there is a need for a south connection as well. Chairman Gomm then called on another person who had raised their hand to speak. Mr. Chad Rasmussen approached the podium and he is protesting the issue at 1530 S Meridian that is going in on that corner lot. Mr. Gomm asked him if this is one of the issues on the agenda, and Mr. Rasmussen replied yes. Mr. Gomm replied that the time to speak on this will be when the item comes up on the agenda under New Business. Chairman Gomm then asked for the planning cases to be presented. NEW BUSINESS CON2019-00041: Mr. Philip Zevenbergen, Associate Planner with MAPD, presented the case. Mr. Zevenbergen stated that the applicant, Shawn and Jacqueline Aday, is requesting a Conditional Use to build an accessory apartment in SF-5 Single-Family Residential. The site is currently being developed with a single-family home, detached garage and an outbuilding (barn). The accessory apartment will be located in the outbuilding. The subject property is located in the Aday Addition, which is zoned SF-5 Single-Family Residential. The applicant submitted the attached site plan showing the location of the new residence, detached garage and an outbuilding located on Lot 1, Block A of the Aday Addition. Properties north and east of the subject site are large, unplatted lots ranging from one to eight acres. Property to the west is located in the Fieldcrest Addition, platted in 1965, and is zoned SF-5 and is developed with single-family dwellings. Property Page 5 of 11 District IV Advisory Board Minutes December 02, 2019 www.wichita.gov south of the subject site is located in the Cedar Lane 4th Addition, platted in 1962, is zoned SF-5 and is developed with single-family dwellings. Mr. Zevenbergen went over the conditions that are listed on the provided staff report. He then stated that the protest period ends this coming Thursday, December 5, and if no one protests this then it will be allowed by MAPD and will not have to be heard at the City Council meeting. The DAB had no questions, and there was no one in the audience that had questions. Chair Michael Gomm then asked for a motion. DAB Member Don McManamey made a motion to approve, and DAB Member Matt Lashley made a 2nd motion. CON2019-00041 was approved 8/0. CON2019-00044: Mr. Philip Zevenbergen, Associate Planner with MAPD, presented the case. Mr. Zevenbergen stated that the applicant, Manuel Roman Cortez, is requesting a Conditional Use to allow outdoor vehicle sales on property zoned LC Limited Commercial generally located on the northeast corner of South Meridian Avenue and West Harry Street. The property is currently undeveloped and has no address. The property has two drive entrances to the paved areas on the east and west sides in addition to alley access on the east. As seen on the site plan, the applicant intends to pave the middle portion of the site, construct a 10-foot by 6-foot office, and display up to 6 cars on the west side of the property. The site will provide one employee parking space and 2 customer parking spaces, one of which will be accessible. Access to the employee parking spaces will be from the western driveway. Access to the customer parking will be through the alley, which means the eastern driveway shall be closed. Per the Unified Zoning Code (UZC), outdoor vehicle and equipment sales may be permitted with a conditional use in the LC zoning district. Vehicle repair will not be provided as part of the car sales business on this site. Outdoor vehicle and equipment sales uses are subject to supplementary use regulations control in UZC Section III-D.6.x, which are attached to the staff report. Mr. Zevenbergen stated that it appeared that the building directly to the north of this lot was possibly an abandoned motel with 3 doors on the south side of the building, and 3 doors on the north side. There would be a 5-foot setback allowing for passage between the two properties. Across Meridian to the west was a car repair shop, a retail business, Huge Discount Flooring, is the SW corner of Harry and Meridian, and a bar, A & J’s Music Room, is on the SE corner of the intersection. DAB Member Don McManamey asked if this particular lot had a cement block building on it, and Mr. Zevenbergen stated no, that there was no building on this lot. The lot is very small and only has a tree on it and there is an alley to the east of the lot. There were no further questions from the board, and so discussion was open to the public. Mr. Chad Rasmussen came to the podium and stated that he is the owner of the property (building) to the north of the lot. Mr. Rasmussen stated that he purchased the property in 1997 and about a year ago, the apartments located within were closed down. He stated that the Police Page 6 of 11 District IV Advisory Board Minutes December 02, 2019 www.wichita.gov Department told him he had to board up the windows and post “no trespassing” signs. Mr. Rasmussen was concerned that if a building is put on the lot to the south of his property that he wouldn’t be able to access his property. Mr. Rasmussen also stated that all of the plumbing and electrical have been stripped out of the building, and he is trying to sell the building/property. Mr. Rasmussen finished by stating he is protesting this plan. Chair Michael Gomm asked Mr. Cortez to come to the podium and asked Mr. Cortez if he is only on putting cars on this lot, or a structure, or what. Mr. Cortez replied that yes, he is putting cars on the lot and a small 10 X 6 ft structure that will hold one employee (desk) and have a small restroom facility. Mr. Cortez said that he is interested in purchasing the property that Mr. Rasmussen said he would like to sell. Mr. Gomm suggested that these two owners meet to discuss a transaction. DAB Member Rebecca Robertson asked that if the two buildings would have about 7 feet between them. Mr. Zevenbergen replied, yes, 7 to 8 ft. depending on the width of the paved walkway to the apartments. This is why a 5 ft. setback has been stipulated. Ms. Robertson then asked if the setback was just for the building, or would it also be for the lot on which the vehicles will be displayed. Mr. Zevenbergen replied that it was for the new structure only. The vehicles can be parked to the property line of the lot. DAB Member Dalton Glasscock asked if a fence was required between the two properties, and Mr. Zevenbergen replied no, that both properties were zoned limited commercial and therefore fencing was not required between these two properties, and that the alley on the east allows as a buffer between the lot and the residential area. There were no further questions from the public and discussion was brought back to the DAB. Dab Member Don McManamey stated he thought about anything would be better than what was currently there (seen) at that particular location. He then made a motion to approve and a 2nd motion was made by DAB Member Jonathan McRoy. Motion was approved 8/0. The next item for New Business … PUD2019-00015: Mr. Philip Zevenbergen, Associate Planner with MAPD, presented the case and stated that the Planning Commission had already heard and approved this matter on November 21, 2019. The applicant is seeking to establish the Tru-Building Commercial Planned Unit Development (PUD #71) located on the south side of West Maple Street and east of South Julia Street (5929 West Maple Street). The subject property is presently zoned SF-5 Single-Family Residential and is essentially vacant. Mr. Zevenbergen explained that a PUD allows for flexibility allowing for custom uses and custom setbacks. The Planning Department staff then works with the developers on what those are. The intent of this PUD is to: “…redevelop the existing nursery use with office, commercial, manufacturing, and warehouse uses. The PUD allows a certain level of flexibility with site development regulations which would otherwise not be permitted under the existing zoning. The applicants are expecting to begin construction of the project in one phase soon after receiving development application approvals.” Page 7 of 11 District IV Advisory Board Minutes December 02, 2019 www.wichita.gov At the November 21st Planning Commission hearing there was no opposition and it was a 13/0 decision to approve this case. Of note, the PUD does allow for a cell phone tower for ATT and one of the conditions for approval is that it be confined to a 50 ft. X 50 ft. location that will be towards the center of the site and not near the street and it will have to conform to height restrictions per the residential zoning regulations. There will also be added, upon approval, a contingent right-of-way condition along Julia Street to allow for additional traffic as this gets developed. Otherwise, the conditions of this PUD will adhere mostly to Office/Warehouse zoning requirements in order to establish guidelines for the Planning Department as this develops. Overall, this site is located in the Established Central Area that encourages in-fill development, and this is a good location to do so considering the mix of uses in the area. The area to the west is residential, and further south is familiar to most people as a major retail and hotel area along the Kellogg frontage. DAB member Rebecca Robertson asked about the type of manufacturing that would be allowed at this site. The staff reports states that it is general manufacturing, but it is limited to inside the building and it is a broad use category. Ms. Robertson stated that she is concerned about any noise that would come from manufacturing and if it would affect the residences to the west of this site. Ms. Robertson is hoping for more retail business at this location. Chair Michael Gomm asked if anyone had protested this at the MAPC hearing on November 21, and Mr. Zevenbergen replied no, that it was not even heard at the Planning Commission, that it had simply gone on their consent agenda. The agent for the applicant, Russ Ewy with Baughman Company, was in attendance and stepped up to the podium to address Ms. Robertson’s earlier question. Mr. Ewy stated that there had be no one from the area that had objected to this development and that it was a relocation for an existing construction company. The reason that General Manufacturing has been included in this plan is that Tru-Building is looking to do injection molding of bumper stops (parking blocks) and general manufacturing would meet this need. Chair Michael Gomm stated that his only concern was the volume of traffic that is currently along Julia Street. It seems that this residential street is becoming an arterial street due to Wal- Mart and Sam’s Club to the south of this location. Mr. Zevenbergen stated that through this planning process the traffic engineers will be looking at the plans and the developer may be required to make changes depending on traffic findings. Mr. Ewy reminded everyone that the Maple & Julia intersection does have a dedicated left turn lane on westbound Maple. DAB Member Matt Lashley made a motion to approve, and DAB Member Rebecca Robertson followed with a 2nd motion. Motion approved 8/0. The next item on the agenda… Page 8 of 11 District IV Advisory Board Minutes December 02, 2019 www.wichita.gov PUD2019-00016: Mr. Philip Zevenbergen, Associate Planner with MAPD, stated that the applicant is seeking to establish the Starkey Development Center Planned Unit Development (PUD #72) located on the north side of West Maple Street and west of South West Street (4500 West Maple Street). The subject property is presently zoned GC General Commercial (GC), B Multiple-Family Residential (B), SF-5 Single-Family Residential (SF-5) and is within an existing Community Unit Plan Starkey Development Center C.U.P. (DP-198). The subject property is occupied and heavily used by Starkey for its current operations. The applicants recently acquired properties on the west side of their campus along Young Street zoned SF-5 and are expanding facilities and operations, which requires the rezoning request. Mr. Zevenbergen added that Colin McKenney, CEO of Starkey Inc, was in attendance if there were any questions for him, as well as Russ Ewy with Baughman Company who was the agent for this project. The addition of this facility will accommodate approximately 500 Starkey clients. This PUD would cover additional uses that are not covered under Office/Warehouse although most of the building is used for this purpose. Access to this site will be from Maple, Tracy, and Young streets, and a screening fence or landscaping will be provided along the north and west boundaries. Any loading docks, trash receptacles, and outdoor storage will be properly screened in addition to the landscape screening. All of the buildings will be required to have the same architectural standards for uniformity. DAB Chairman Michael Gomm asked if there had been any protests. Mr. Zevenbergen replied that this is not his planning case, but as far as he knows there have been no objections. MAPC will be hearing this case on Thursday, December 5, 2019. Agent Russ Ewy then approached the podium and stated that he could answer any questions about the construction plans. DAB Member Rebecca Robertson asked Mr. Ewy how many new buildings are planned for the new site, or was this to be an addition to the current building(s). Mr. Ewy replied that he believed that the PUD was for expansion and additions of the current building, but deferred the question to CEO Colin McKenney. Mr. McKenney stated that Starkey will be adding 20,000 sq. ft. of new program facility space and will be remodeling some of their existing spaces. As they develop this area there will be five (5) structures removed from the site. “Net gain is an acre at this site. 3 homes will be demolished to allow proper drainage for this site and a church that sits on Douglas Avenue north of the site that is not ADA compliant.” DAB Member Don McManamey asked what services are currently being done at this location. Mr. McKenney replied that Starkey has been at this site for over 60 years and now serves special support-needs adults with case management services, day activities, life skill training, and some work activities that take place in their building. Their staff helps support 41 group homes and apartment complexes, and parking for about 110 vehicles. Page 9 of 11 District IV Advisory Board Minutes December 02, 2019 www.wichita.gov Ms. Robertson asked if they were changing anything that they are doing there, but just expanding due to growth, and Mr. McKenney confirmed this as correct. The DAB members agreed that this something they can all get behind, and DAB Member Dalton Glasscock made the motion to approve. DAB Member Jonathan McRoy gave a 2nd motion, and the motion passed 8/0. Vice Mayor Blubaugh then addressed Mr. McKenney thanking him for all they do for the community at Starkey and assured Mr. McKenney that he would be at the Thursday groundbreaking ceremony. BOARD AGENDA As there was no Old Business on the agenda, Chairman Gomm then opened up the meeting for discussion amongst the DAB Members. DAB Member Don McManamey asked about the plans for the Harry Street bridge. He wanted to know why it was being reduced to 2-lane. Vice Mayor Blubaugh said the new design is for 3 lanes (1 being a turn lane) as traffic engineers state that this is a better design for traffic flow and will help reduce construction costs. Chair Michael Gomm thanked those on the board who showed up at the ribbon cutting for his new business, Glass Guru. Mr. Gomm then gave congratulations to Vice Mayor Blubaugh for his recent campaign victory as Council Member for District 4. DAB Member Matt Lashley then asked Vice Mayor Blubaugh about the plans for West Street as there are now traffic cones set out on West Street. Vice Mayor Blubaugh stated that this has been a long process to have improvements made for better traffic flow on West Street, and that he started this effort five years ago. Staff Rebecca Fields added that the area around south West Street is earmarked as one of the City’s major expansion areas for future industry and new jobs, and a center turn lane will be added to West Street to accommodate all of the commercial trucks that use this stretch of road. Vice Mayor Blubaugh stated that the next major challenge other than 119th St & Kellogg is how we are going to address K-42/West Street/Pawnee intersection. A roundabout is being discussed, but nothing has been finalized as a permanent solution for the traffic at this intersection. Representative Nick Hoheisel spoke up and said that he hears from constituents about the I-235 exit onto West Street, especially if headed south. There is no acceleration lane and it is the only exit off of the interstate that does not have traffic lights. Vice Mayor Blubaugh added that another high traffic accident area is exiting Kellogg on to Ridge Road to head north. The Vice Mayor thinks that this is a light synchronization issue causing people to run the light when it turns red. DAB Member Lashley is asking that the NW corner of S West Street and W MacArthur Road be paved as commercial trucks continue to cause ruts when turning west onto MacArthur from West Page 10 of 11 District IV Advisory Board Minutes December 02, 2019 www.wichita.gov Street. Mr. Lashley stated that the truck traffic is “unreal” on far south West Street and on MacArthur. Page 1 of 3 DISTRICT IV ADVISORY BOARD AGENDA 12-02-2019 NEW BUSINESS CON2019-00041: The applicant is requesting a Conditional Use to build an accessory apartment in SF-5 Single- Family Residential. The site is currently being developed with a single-family home, detached garage and an outbuilding (barn). The accessory apartment will be located in the outbuilding. RECOMMENDED ACTION: Based upon the information available at the time the staff report was prepared, staff recommends APPROVAL of the application. CON2019-00044: The applicant is requesting a Conditional Use to allow outdoor vehicle sales on property zoned LC Limited Commercial generally located on the northeast corner of South Meridian Avenue and West Harry Street. The property is currently undeveloped and has no address. The property has two drive entrances to the paved areas on the east and west sides in addition to alley access on the east. As seen on the site plan, the applicant intends to pave the middle portion of the site, construct a 10-foot by 6-foot office, and display up to 6 cars on the west side of the property. The site will provide one employee parking space and 2 customer parking spaces, one of which will be accessible. Access to the employee parking spaces will be from the western driveway. Access to the customer parking will be through the alley, which means the eastern driveway shall be closed. Per the Unified Zoning Code (UZC), outdoor vehicle and equipment sales may be permitted with a conditional use in the LC zoning district. Vehicle repair will not be provided as part of the car sales business on this site. Outdoor vehicle and equipment sales uses are subject to supplementary use regulations control in UZC Section III-D.6.x. which are attached to this staff report. RECOMMENDED ACTION: Based on the information available prior to the public hearing, MAPD staff recommends the application be APPROVED subject to listed conditions. PUD2019-00015: The applicant is seeking to establish the Tru-Building Commercial Planned Unit Development (PUD #71) located on the south side of West Maple Street and east of South Julia Street (5929 West Maple Street). The subject property is presently zoned SF-5 Single-Family Residential and is essentially vacant. The intent of this PUD is to: “…redevelop the existing nursery use with office, commercial, manufacturing, and warehouse uses. The PUD allows a certain level of flexibility with site development regulations which would otherwise not be permitted under the existing zoning. The subject property is presently zoned GC General Commercial (GC), B Multiple-Family Residential (B), SF-5 Single-Family Residential (SF-5) and is within an existing Community Unit Plan Starkey Development Center C.U.P. (DP-198). The subject property occupied and heavily used by Starkey for its present operations. The applicants recently acquired properties on the west side of their campus along Young Street zoned SF-5 and are expanding facilities and operations, which requires the rezoning request. RECOMMENDED ACTION: Based on the information available at the time of the public hearing, staff recommends APPROVAL of the application subject to the listed conditions.
