Page |1 District V Advisory Board Minutes November 5, 2018 www.wichita.gov The District V Advisory Board meeting was held at 6:30 p.m. at Fire Station #21, located at 2110 N. 135th St. W, Wichita, KS 67235. Updates, Issues and Reports  Council updates from CM Frye  21st St. improvements are finished – much nicer  Nov. 6 Council workshop on new NW water treatment plant – 5-year build at a cost of $524 million  Lawrence Dumont Stadium – Demolition has begun. Should be complete by the end of the year. Three design/build bids for new stadium were received are being reviewed  Cargill – Will open new location next month – 700-800 jobs Page |2 PUBLIC AGENDA 2. Scheduled items: NONE 3. Off-Agenda Items: (presented at end of meeting) Bill Langley, 944 N. Crestline  Revise city ordinance 6.04.010 and 6.04.025 – feral cats  Defines a free-roaming cat  Caregivers can have up to 12 cats  Cats will be neutered and ears will be clipped  Colony cats will effect wildlife  Numerous studies have been done that show this type of program does not work to control feral cats  Cats are predators – they kill birds and other wildlife  B. Frye comments:  This has not come before Council  It is still with the Animal Advisory Board  Will be heard by DABs before any decision is made STAFF PRESENTATIONS 4. Fire Department Report: Capt. Ken Ast reported.  9 fire alarms, 30 service alarms, 275 medical alarms, 314 total incidents  12 new recruits will graduate after the first of the year  Salvation Army collections have begun  Time change – Did you change your smoke detector batteries?  CM Frye’s 24-hour shift at Station #1  Citizens Fire Academy next spring 5. Community Police Report: Community Police Officer Bradley Haught, reported.  Officer Douty put out a notice last month about a white HHR that has been involved with numerous burglaries – suspect arrested  Veteran’s Day Parade this Saturday  Toy Run this past Saturday  No-shave November for Cancer Society  Holiday food basket donations being collected – will benefit 600 Sedgwick County families  Oct. 23 Country Acres Neighborhood Association organizational meeting 6. Park and Recreation Department Report: No report 7. Wichita Public Library Report: Tracie Partridge, Westlink Branch Senior Librarian, reported.  1,000 Books Before Kindergarten – Over 3,100 children registered  11th year for Big Read Wichita – Station 11 – Author to speak on Nov. 15  Nov. 17 – Used book sale at the Advanced Learning Library - $5 per bag  National Novel Writing month  Native American Heritage month  Aviation History month Page |3  Caring for your Beard  Simplify Your Life – Organizational principles – Rachel Murphy  Library to be closed the following dates: Nov. 11-12 and Nov. 22-23 8. Public Works Report: Mike Armour, Engineer, reported.  Kellogg/I-235  All ramps open  Final lane striping being completed  OP3 Program – work in progress  13th Street, 119th to Maize Rd – pavement repairs this winter followed by micro surfacing  Hyatt-funded repairs are wrapping up  Ridge Road sidewalk – 29th to 33rd – next year  13th Street, Azure to 135th – Expand to three lanes – construction to begin next spring  29th & Maize Rd – staff evaluation to improve turn lanes  Traffic Study results from N. Gilda Street area  Number of vehicles per day very typical for the number of houses in the neighborhood  24-hour counts are very normal for that size of neighborhood  No date is set to improve the I235-Central interchange  Traffic counts do not warrant improvements  Citizen questions o Can we have a 4-way stop at Eisenhower and Newell? o Can we close Boyd off , south of the QuikTrip? o Why were no traffic counts taken on Newell? o What are our options?  Frye – Limit city vehicles on Boyd and Eisenhower and have engineering take additional counts Action Taken: Motion made to Receive and File all Staff Reports. Motion PASSED 7-0. NEW BUSINESS 9. 2018 Fireworks Summary Report Deputy Chief Bevis, Wichita Fire Department, presented on the Fireworks Enhanced Enforcement Teams. The Wichita Fire Department, in conjunction with the Wichita Police Department, deployed personnel on the evenings of July 3rd and 4th to enforce the fireworks ordinance.  The Wichita Fire Department, in conjunction with the Wichita Police Department, deployed personnel on the evenings of July 3 and 4 to enforce the new fireworks ordinance.  Goals  Improve community safety by enforcing the amended fireworks ordinance  Deter illegal use of fireworks  Educate the public  Performance Metrics  June 22 – July 5 reporting period  22 teams patrolled the city each night  Dispatch received 1,437 fireworks complaint calls  51 reported injuries due to fireworks, an increase of 15  Fireworks related incidents went up by 17 (there were 4-5 structure fires) Page |4  Dollar loss due to fireworks related incidents was down  138 citations were written – 28 in District V  Citizen feedback  Citizens reported reduced use of illegal fireworks leading up to the holiday  Many citizens thanked the City for enforcement efforts  Other feedback was negative and critical of enforcement efforts, including writing citations  Concerns  Staffing of teams was very problematic  Officer safety is significant concern  No back up readily available to assist the teams  Fire officers not equipped, trained or experienced in issuing citations in hostile situations  Due to limited staff and logistics, only small amounts of fireworks were confiscated, leaving some illegal materials with citizens  More teams were needed to adequately cover the city and patrols on additional nights to address overall use of illegal fireworks  Financial Considerations  Fireworks sales permits generated $48,000 (32 permits)  Enhanced enforcement efforts cost an estimated $27, 417  This resulted in net revenue of $20,583  $20,000 in fines from citations written have been collected to date. $13,000 more is pending  Summary  Many citizens continued using illegal fireworks even after the widely publicized plan to issue citations  Unclear if writing of citations had a positive impact on the safety of the community  Cost of enforcement effort was adequately covered by collected fees and fines  Enforcement efforts pose a significant risk to staff  DAB Comments  Days leading up to the 4th were better  The 4th was like past years  Maybe make everything legal on the 4th only  Ban everything – we are an urban area  People are always going to shoot on the 4th  Reduce the days and hours to shoot  It’s really a 50/50 split for and against fireworks  No clear direction 10. Entitlement Funding Presentation Logan Bradshaw, Housing and Community Services, and Tavon Watkins, Management Fellow - The City is required to develop a new Consolidated Plan for the 2019 through 2023 program years, and staff is soliciting comment regarding community needs and funding priorities. The first program year will begin July 1, 2019, and end on June 30, 2020. HUD has not announced the City’s allocation amounts for the upcoming program year.  Center of Hope does a great job  RAD program – public housing stock being rebuilt. Slated to start next simmer  These programs are really important Page |5  After-school programs needed  Domestic Violence shelters needed  Possibly pave Central/Gilda are with CDBG funds  Utility assistance & rent assistance  Home improvement grants  In-fill renewal 0 Mennonite Housing 11. Grants Review Committee Member Nomination Logan Bradshaw, Housing and Community Services: The Grants Review Committee includes representation from all District Advisory Boards, Wichita Independent Neighborhood Association, the United Way, Sedgwick County, USD #259, Wichita State University, as well as large and small businesses. The 14 GRC members are appointed annually by the City Council. Housing and Community Services Department staff meets with GRC members throughout the proposal evaluation period. After review of the applications and proposals and public comments, the GRC makes recommendations to the City Council for HOME, ESG and CDBG funding for the next program year.  Alissa Unruh volunteered to fill the DAB V position and was unanimously approved 12. CON2018-00037 Dale Miller, MAPD, presented the request by HMH Real Estate, LLC (Owner) / Kaw Valley Engineering – Levi Bond (Agent), for City Conditional Use Amendment of previous Conditional Use to modify operation and site plan for additional storage on property zoned LC Limited Commercial generally located on the south side of west Central Avenue east of Maize Road (10303 West Central).  Applicant and agent for applicant in attendance  MAPC recommended approval  4-5 neighbors in opposition  Dave Rush, 10241 W. Taylor  Sold the property  Stuff/junk parked all over the place  Lots of trash  It was cleaned up in the last two days  Noise and visual – fencing is inadequate  90% of people who received letters are protesting  Joyce Rush, 10241 W. Taylor  Wall is only six-foot – not tall enough to block business  Not enough screening  Industrial equipment does not belong there  Only one access to property  Safety hazard  They have not been good neighbors  Massive fuel tanks should not be allowed  Drainage issues  Levi Bond, Kaw Valley Engineering, Agent for Applicant  Vehicle and equipment sales/rentals  Rentals must be smaller than a truck  Not going to store cars/campers Page |6  Noise complaints – they are well under the minimum decibel  All repairs take place indoors  Open 8AM -7PM  Adding 12 trees to south property li  Fuel tanks – four concrete barriers in place – required by fire department  Drainage plan in place  Any area that is used for traffic or circulation will be paved Action Taken: Motion made by Gutierrez to take the staff recommendation and APPROVE the application subject to the following conditions: 1. The entire site shall be developed and operated in conformance with the requirements of Section III-D.6(x) of the Unified Zoning Code, except as noted in the conditions of approval noted herein. This shall specifically require the complete paving with asphalt or concrete of the entire area designated for outdoor display of vehicles for sale or display. 2. Outdoor storage and vehicle storage yard, as defined by the Unified Zoning Code, shall not be permitted. 3. The site shall be required to meet the full storm water design standards applicable by Wichita City Code, including compliance with any improvements to manage storm water issues associated with the paving of the designated portion of the subject property. 4. All provisions associated with the conditions of CON2012-00003 shall remain in effect. 5. A revised site plan addressing the conditions of approval shall be submitted for review and approval by the Planning Director or his designee prior to the issuance of a certificate of occupancy, but no later than 30 days after approval of the Conditional Use. 6. If the Zoning Administrator finds that there is a violation of any of the conditions of the Conditional Use, the Zoning Administrator, in addition to enforcing the other remedies set forth in the Unified Zoning Code, may, with the concurrence of the Planning Director, declare that the Conditional Use is null and void. PUBLIC AGENDA This portion of the agenda provides an opportunity for citizens to present issues that are not part of the regular agenda for the meeting. There is a five minute time limit for each speaker. 2. Scheduled items: Recommended Action: Receive and file 3. Fire Department Report Staff will give a brief report on District V issues, problems and events. 5. Community Police Report Community Police Officers will give a brief report on District V issues, problems and events. 6. Park and Recreation Department Report David McGuire, Assistant Recreation Supervisor, will provide update for parks in District V and report on other activities taking place across the city. 7. Wichita Public Library Report Tracie Partridge, Westlink Branch Senior Librarian, will report on events and programs at the Westlink Branch Library. 8. Public Works Report Gary Janzen, City Engineer, will give an update on District V projects.
