Updates, Issues and Reports STAFF REPORTS 4. Fire Department Report Lt. Ignacio Ayala reported:  1 major fire -60k loss.  9 fire 1 Page |2  6 service  232 medical  277 total incidents  Total undetermined fires 1 in D5 – city total 15. Overall loss – 361,500 in structural damage 86,500 dollars in loss. Almost half a million loss.  Make sure you have a licensed contractor  Heating and ventilation system needs inspected by a licensed inspector.  Thanksgiving coming up. Be attentive while cooking.  Check your smoke detector batteries.  Practice your fire safety plan at home with your kids. 5. Community Police Report Officer Haught reported:  Major crimes YTD o 16 beat down 16 percent from last year o 19 beat 3 percent o 199 down 9 percent o Up 6 percent total violent crimes o Property crime down 17% o 15% down over everything  Complaint in front of Wilbur Middle School with construction while putting in stop light. Trying to get signs to enforce there to help with congestion on Tyler.  Halloween – several trunk or treat events with no issues.  Westlink and Country Acres had cleanups – no issues.  Officer Douty is now Detective Douty  New Captain Stephens.  New Sgt. for CP will start at first of year when Sgt. Yarberry retires.  Cpt. Jason Stephens replaced Wanda Givens. Came from investigations. Worked in sex assault and gang unit. Worked in all four bureaus in various roles. 6. Park & Recreation Department Report David McGuire reported:  Recent hard freezes so we might be able to stop mowing.  Family campout, 3 days left to get signed up at Watson Park – this coming Saturday the 9th. Camp under the stars and get a train ride.  Trick or Treating from pedal boats filled up. Will have to double it next year.  Dec 7, Botanica Zumba and Pound event. Saturday.  Watson Park, Christmas Express, check it out.  Dec 5 Night with Santa at Century II  Mayors Tree Lighting last Sunday in November.  Light the Night will be last Sunday in November as well.  Christmas Break, Kid’s Camp at Rec Centers. Classes ongoing as well. 7. Wichita Public Library Report Tracie Partridge reported:  Library locations will be closed on 11th for Veterans Day. Will close 5 on Wednesday, stay closed on Thursday and Friday for Thanksgiving.  Big Read still ongoing.  November is Kansas Reads to Preschoolers Month.  Nov 7th Westlink hosting family science fair. Hands on science experiments.  Nov 8th learn about Medicare online at ALL. 2 Page |3  Exclusive concert for 1,000 Books participants. Sugar Free All-stars. 8. Public Works & Utilities Report Julianne Kallman shared the following:  OP3 work – prep work done for microsurfacing. Central and Tyler  Gary will be here next month to talk about streets in 2020 maintenance program  Hoover bike path from 21st to 29th zoo to 29th. Funding at City council tomorrow morning.  13th street slated to start next spring. Still trying to acquire one tract.  29th and Maize will start next year. North leg and east leg.  37th street lighting from Maize to Ridge will start next year.  Hoover and 21st will start next year, spring. CM Frye explained why there is such a long wait to get streetlights installed. Explained the update on 29th on Maize. DAB – Could you email the drawings for the 29th and Maize improvements? CM Frye – Yeah we could do that. Action Taken: Motion to receive and file. Motion PASSED 8-0-0. NEW BUSINESS 9. CON2019-00036 Dave Yearout, Metropolitan Area Planning Department, presented on an application on behalf of John and Lisa Pennella (Owners) / Shane Allen – U-Haul (Agent) requesting a Conditional Use to allow outdoor vehicle and equipment sales and service on Lot 1, Rush Addition, excluding the north five feet thereof, which is currently zoned LC Limited Commercial ("LC"). The site is located on the east side of North Maize Road and south of West Central Avenue. Still in protest period. To allow rental operation at 610 N Maize Road. The operation had been there for about 3 or 4 years, but was against zoning code. Planning commission approved unanimously. Received a few calls from neighbors. They were concerned about traffic at Central and Maize. Had nothing to do with U-Haul services. We forwarded their concerns to Action Taken: Motion to APPROVE the application as presented made by Trevor Kurth. Seconded by Roman R. Motion PASSED 8-0-0. 10. CUP2019-00033 Dave Yearout, Metropolitan Area Planning Department, presented on an application on behalf of Premier Holdings, LLC (owner)/KE Miller Engineering, Kirk Miller (agent) to amend CUP DP-267. The subject site is located in the Tyler Landing Commercial Plaza Community Unity Plan (CUP) DP-267, which is located at the southeast of the intersection of 37th Street North and North Tyler Road. Total acreage of DP-267 is approximately 11.22 acres. Request to amend language to allow additional duplex development. Was approved unanimously. Not out of character for what’s happening. No objections on this. No one spoke up at planning commission. In protest period. Q (DAB): Is it the same developer doing all duplexes in that area? A: No. Q (DAB): For the parcel on Tyler, is it similarly close to the entrance to Maize schools? Any concern with congestion? A: We haven’t discussed that with zoning. Those are issues that would be discussed going forward when we discuss plats, but not with zoning. 3 Page |4 Action Taken: Motion to APPROVE the application as presented made by Trevor Kurth. Seconded by Allyssa Unruh. Motion PASSED 8-0-0. 11. 2020-2021 Sally Stang, Director of Housing, presented on 5 year consolidated plan. More than 50,000 people live in the city so eligible for Housing Fund. We have to seek public input for how to use those funds. Community Development Block Grant. 101 eligible uses. Mainly used to fund infrastructure and programs in poverty areas. HOME Investment Partnerships to build low income housing. Emergency Solutions Grant used to address homelessness. Last year started creating new 5 year plan. Now in the second year. Now through February gathering public input to develop action plan. December will appoint GRC. February 2020 GRC review proposals and approve funding recommendations. March 2020, May, June. CDBG must meet national objectives. Not less than 70% of spending must benefit low to moderate income persons. Can fund service programs or construction costs. Public Service category is $1,163,310. We spend a big chunk here. Funds can only be used based on MOU or RFP. Cannot be allocated to a specific provider or ineligible service. Gave examples of how they are allowed to use CDBG funds. Gave examples of how they are allowed to use HOME funds. Explained Community Housing Development Organizations (CHDO). Gave examples of how they are allowed to use ESG funds. What should be funded if the allocation increases and decreases? Which activities are highest priority? Which activities are lowest priority? Are there urgent needs which should be considered? I was surprised to find how narrow our funding scope is here. I am seeking a representative from the DAB to serve on the GRC. The committee would be 3 meetings, although lengthy meetings. Important for us to know how to spend funds in the next year. DAB member JV Johnston volunteered to serve on the GRC. Stang: 2018-2019 helped homeowners make needed safety repairs, helped to build 18 single family homes, shelter services provided overnight services to over 2,000 people. Homeless prevention to 102 families. Great outcomes from that. DV services for over 800 families. Youth program serviced over 3000 kids. Housing First program housed over 93 of most challenging and chronically homeless people. Way to Work program 100 kids graduated successfully. Right now 116 people on the name list for homeless waiting for housing units. Q (DAB): Housing first program, where are individuals housed? A: Private rentals. We provide rent assistance vouchers. Q (DAB): Who owns those? A: It varies. Probably 35 different owners. Q (DAB): Renters Assistance program – what is the success rate? A: We don’t follow up necessarily. We get them out of immediate crisis. Q (DAB): What other steps are involved in addition to paying rent? A: It could be rent, utilities, or mortgage. It’s a one-time payment. Q (DAB): Does anything else accompany that? A: We refer them to CSBG to work with individuals and families for financial planning. There is no requirement they use that service, but many people do. That help is one time a calendar year. C (DAB): Center of Hope does keep stats on following up. C (DAB): It would be interesting to see those stats to get feedback. C (DAB): If you apply for a job and have no address, you have no chance of getting a job. Q (DAB): How do you get feedback from general public? A: We’ve done Facebook forums, neighborhood centers, and some public meetings. WHA at Wichita.gov. C (DAB): And DABs. 4 Page |5 C (CM Frye): Trey Rios was class 5A Maize South Cross Country 7th place finish in state. He finished 5th sister finished 3rd. Sod was put down in stadium today. Grass in outfield. Next Wednesday will announce name of team. Last week Wichita Water Partners announced guaranteed maximum price $494 million. Down $14 million from last estimate. Very happy about that. Less than original projection. Submitted application to EPA to cover $270 million of $494. Means we won’t have to start paying back until 5 years after completion of build. Our goal is to keep rates down as low as possible. Trying to stretch that payment out as long as possible so impact on rate payers is as low as possible. Hoping we can start dirt work next year. Goal to be online and ready to switch over by 2024. Both plants would be operating for a while to make sure the new one is working as it should. All moving forward. Q (DAB): Where will it be located? A: 21st and Hoover, directly east of the Zoo. Q (DAB): Pipes are all in good shape? A: We’ve been replacing pipes for a while. In 2016 we took inventory of all above ground and below ground infrastructure. We are continuing to make improvements. The plant is the critical need. C (CM Frye): Great meeting with Together Wichita. Helped fund a dog park out east. Want them to build a dog park in D5. Looking at a location. Need to talk to neighbors. Could happen next year. Vote tomorrow. Exciting times. Lots of things going on in D5. Updates, Issues and Reports Opportunity is provided for the Council Member and the District Advisory Board members to report any activities, events, or concerns in the neighborhoods and/or Council District. STAFF REPORTS 4. Fire Department Report Fire Department Staff for fire stations in District V will report on specific concerns. 5. Community Police Report Community Police Officers for beat areas in District V will report on specific concerns. 6. Park & Recreation Department Report Park and Recreation Staff will provide updates for parks in District V and report on other activities taking place across the city. 7. Wichita Public Library Report Tracie Partridge, Westlink Branch Senior Librarian, will report on events and programs at the Westlink Branch Library. 8. Public Works & Utilities Report Public Works and Utilities Staff will give an update on District V projects. Recommended Action: Receive and file all Staff Reports Agenda 2 November 4, 2019 NEW BUSINESS 9. CON2019-00036 Dave Yearout, Metropolitan Area Planning Department, will present an application on behalf of John and Lisa Pennella (Owners) / Shane Allen – U-Haul (Agent) requesting a Conditional Use to allow outdoor vehicle and equipment sales and service on Lot 1, Rush Addition, excluding the north five feet thereof, which is currently zoned LC Limited Commercial ("LC"). The site is located on the east side of North Maize Road and south of West Central Avenue. The subject site is developed with a vehicle repair business and an existing car wash facility. In approximately 2016, a U-Haul rental operation was established at this location. Upon a complaint filed by a neighbor to the east, Code Enforcement notified the owner that the operation of the rental business required the Conditional Use to comply with the Unified Zoning Code. This application is the result of that notification. Recommended Action: Based upon the information available prior to the public hearings, planning staff recommends that the request for an ancillary parking lot be APPROVED subject to the following conditions: 1. The entire site shall be developed and operated in conformance with the requirements of Section III- D.6(x) of the Unified Zoning Code. 2. Outdoor storage and vehicle storage yard, as defined by the Unified Zoning Code, shall only be permitted along the eastern property line as noted on the proposed site plan. 3. All provisions associated with the conditions of BZA22-95 concerning the car wash shall remain in effect. 4. A revised site plan, drawn to scale and addressing the conditions of approval shall be submitted for review and approval by the Planning Director or his designee prior to the issuance of a certificate of occupancy, but no later than 30 days after approval of the Conditional Use. 5. If the Zoning Administrator finds that there is a violation of any of the conditions of the Conditional Use, the Zoning Administrator, in addition to enforcing the other remedies set forth in the Unified Zoning Code, may, with the concurrence of the Planning Director, declare that the Conditional Use is null and void. 10. CUP2019-00033 Kathy Morgan, Metropolitan Area Planning Department, will present an application on behalf of Premier Holdings, LLC (owner)/KE Miller Engineering, Kirk Miller (agent) to amend CUP DP-267. The subject site is located in the Tyler Landing Commercial Plaza Community Unity Plan (CUP) DP-267, which is located at the southeast of the intersection of 37th Street North and North Tyler Road. Total acreage of DP-267 is approximately 11.22 acres. The applicants are requesting a minor amendment to Parcels 1, 6 and 7 (approximately 3.66 acres) to allow six duplexes (12 units) on each of the three parcels. The subject site is zoned LC Limited Commercial. Recommended Action: Based upon the information available at the time the report was prepared, staff recommends the amendment to CUP DP-267 be APPROVED subject to the development guidelines of the amended CUP and the following conditions: 1. The amendment shall apply only to Parcels 1, 6 and 7. All other requirements of the CUP remain in effect unless or until a separate zoning action is filed. 2. The applicant shall submit four revised copies of the CUP to the Metropolitan Area Planning Department within 60 days after approval of this case by the Governing Body, or the request shall be considered denied and closed. Agenda 3 November 4, 2019 11. FY 2020-2021 Funding; CDBG, HOME, ESG Sally Stang, Director of Housing Services, will present budget funding sources from the Community Development Block Grant (CDBG), Home Investment Partnership Program (HOME), and Emergency Solutions Grant (ESG). The U.S. Department of Housing and Urban Development (HUD) considers the City of Wichita to be an entitlement city and as such, Wichita receives annual allocations of Community Development Block Grant (CDBG), HOME Investment Partnerships (HOME) and Emergency Solutions Grant (ESG) funds. In order to receive these funds the City is required to prepare a Consolidated Plan every five years. In addition, the City is required to submit an Annual Action Plan which addresses the priorities identified in the Consolidated Plan. Recommended Action: Provide comment regarding community needs and funding priorities for the 2020-21 Second Year Annual Action Plan. 12. Nomination of Grants Review Committee Representative for District V Sally Stang, Director of Housing Services, will present a request for a DAB V member to be nominated for this committee to serve during the 2020 time period. Recommended Action: Nominate a District V representative to the Grants Review Committee.
