Wichita Police Department Report Officer Bradley Haught, Wichita Police Department, reported: YTD compared to last year – 16 beat 36% down on violent crime and 1% down on property crime 19 beat 7% down on violent crime and up 14% on property crime 199 beat No change on violent crime 19% up on property crime 16 beat ag assault down 43% auto theft down 28% DV down 55% accidents down 42%. Accidents down across the board because traffic has been down due to stay at home. 19 beat ag assault up 53% larceny from auto up 50% and accidents down 24%. 199 beat larceny from auto up 50% accidents down 25%. Vandalism is up across the board into the 20% range. Nothing back on firework enforcement yet. 18 officers worked, paired up with firefighters. DAB 5 • July 6, 2020 • Minutes • Page 2 6. Park and Recreation Department Report Reggie Davidson, Park and Recreation Department, reported: Reopened facilities beginning of June – worked with Public Works for safety concerns Rec centers touchless bathroom facilities Masks required in common area and 6 feet of distance required Working with health department and KDHE to implement programs Numbers limited to 50% capacity Started softball tournaments at South Lake with safety precautions New software rolled out for tennis center to do online court rentals and for league play 7. Wichita Public Library Report Tracie Partridge, Wichita Public Library, reported: Select in person programs starting in July at Advanced Learning Library and Evergreeen Library only Programs requiring registration to stick to imposed limits and requiring facemasks People can place holds through online catalog Customers can request librarians to create a reading list for them Librarians creating grab bags for babies and early readers Continuing with summer reading program, participation is down. Ends July 23rd Offering 1 on 1 tech help at ALL through book a librarian service 8. Public Works & Utilities Report Steve Degenhardt, Public Works & Utilities, reported: Projects Under Construction  29th & Maize Intersection o Scope  The project will lengthen the existing left turn lanes on 29th Street and construct a dedicated right turn lane for northbound Maize Road. o Current Activities  Turn lane construction complete on both 29th and Maize Road  Mill and overlay of existing asphalt in progress  Median added to make QT north drive right in/right out o Traffic Impact  Eastbound 29th Street is reduced to one lane  North bound right turns are restricted for trucks  Maize Road is one lane in each direction o Schedule  Construction began in April  Estimated completion is mid-July  13th Street, Cowskin Creek to 135th Street o Scope  The project will reconstruct 13th Street to a three-lane roadway. The project also includes drainage improvements, sidewalk, and a 10-foot multi-use path on the north side of 13th Street. The intersection at 135th Street will be reconstructed to include left turn lanes in all directions. The intersection will remain a four-way stop upon completion as traffic signals are not warranted at this time. o Current Activities  Tree removal and storm sewer work in progress o Traffic Impact  13th Street is closed west of the 135th Street intersection (13th Court) to Liberty on the east.  13th Street is two-way traffic from 119th Street to Liberty DAB 5 • July 6, 2020 • Minutes • Page 3  135th Street will be one lane northbound only through the intersection. CM Frye: All pools are getting worked on this year. Not good having pools closed this summer, but it gives us a chance to get work done now and have things opened next year. It made sense to do it this way and it gave us some cost savings. CON2020-00019 Matt Williams, Metropolitan Area Planning Department, presented an application on behalf of Kashif Kian; Martin Gow; Marcus Gow (Applicants). The applicant is requesting a Conditional Use to allow Outdoor Vehicle and Equipment Sales on property located on the southeast corner of North Ridge Road and West 13th Street North. The subject property is zoned LC Limited Commercial and is occupied by an existing gas station. Planning recommended approval with an additional stipulation to limit five cars for sale at a time and to not allow work on cars and no salvaged vehicles. DAB and members of the public asked and made the following summarized questions and comments: Q (DAB): Public input at Planning Commission? A (Williams): No, got phone calls from people who live behind there, they weren’t sure what was happening. Q (DAB): How big is the lot? A (Williams): Says the site is 1 acre, though that seems large. Gas station has five parking spots to the left and eight to the right. Q (DAB): What work are they doing there? A (Williams): Didn’t mention any work and no work is required. C (CM Frye): I believe it is being converted to a Jump Start. A (Williams): I didn’t hear about that two weeks ago. If that’s the case, maybe he doesn’t care anymore and would rescind. Q (DAB): Any other examples of car dealership/used car sales in a residential area? A (Williams): No, usually it’s in a former gas station. C (DAB): Site still seems small. Q (DAB): If passed, could he tear down the gas station and completely convert to used car sales? A (Williams): He submitted a site plan already, he would have to submit an all new site plan. Q (DAB): What was discussed at MAPC? A (Williams): Nobody spoke against it. Applicant explained rationale that he just wanted to make some money on the side. The entrance to the gas station is not on the neighborhood side. Q (DAB): Does he already own car lots? A (Williams): No, he’s owned this gas station for 15 years. Q (DAB): Will he be selling or will someone else be selling the cars? A (Williams): Conditional Use doesn’t specify who, but he said it would be him. Action Taken: Motion made by Trevor Kurth and seconded by Dennis Clary to DENY the application per staff’s recommendation. Updates, Issues and Reports Opportunity is provided for the Council Member and the District Advisory Board members to report any activities, events, or concerns in the neighborhoods and/or Council District. STAFF REPORTS 4. Fire Department Report Fire Department Staff for fire stations in District 5 will report on specific concerns. 5. Community Police Report Community Police Officers for beat areas in District 5 will report on specific concerns. 6. Park & Recreation Department Report Park and Recreation Staff will provide updates for parks in District 5 and report on other activities taking place across the city. 7. Wichita Public Library Report Tracie Partridge, Westlink Branch Senior Librarian, will report on events and programs at the Westlink Branch Library. 8. Public Works & Utilities Report Public Works and Utilities Staff will give an update on District 5 projects. Recommended Action: Receive and file all Staff Reports Agenda 2 July 6, 2020 NEW BUSINESS 9. CON2020-00019 Matt Williams, Metropolitan Area Planning Department, will present an application on behalf of Kashif Kian; Martin Gow; Marcus Gow (Applicants). The applicant is requesting a Conditional Use to allow Outdoor Vehicle and Equipment Sales on property located on the southeast corner of North Ridge Road and West 13th Street North. The subject property is zoned LC Limited Commercial and is occupied by an existing gas station. Recommended Action: Based upon information available prior to the public hearings and evaluating the conditions and uses of the surrounding neighborhood, staff believes the establishment of a car sales lot at this location is inappropriate and would be detrimental to the neighborhood. Therefore, staff is recommending the request be DENIED. Should the MAPC feel this request should be approved, staff recommends the request be subject to the following conditions: 1. A revised site plan, drawn to scale and addressing the conditions of approval shall be submitted for review and approval by the Planning Director or his designee prior to the issuance of a certificate of occupancy, but no later than 30 days after approval of the Conditional Use. 2. All requirements of Article III, Section III.D.6.x. of the Unified Zoning Code shall be met. 3. No outside storage of salvaged vehicles or parts shall be permitted in association with this use. 4. The site shall be developed in general conformance with the approved site plan. All improvements shown on the approved site plan shall be completed prior to the operation of a vehicle sales lot; except the building addition may be completed at a later date, subject to a revised site plan confirm adequate parking. 5. The site shall be developed and operated in compliance with all federal, state, and local rules and regulations. 6. If the Zoning Administrator finds that there is a violation of any of the conditions of the Conditional Use, the Zoning Administrator, in addition to enforcing the other remedies set forth in Article VIII of the Unified Zoning Code, may, with the concurrence of the Planning Director, declare that the Conditional Use is null and void.
