Minutes 1 October 1, 2012 District VI Advisory Board Minutes www.wichita.gov Monday Evergreen Recreation Center October 1, 2012 2700 N. Woodland 6:30 p.m. Clubroom /Lounge The District VI Advisory Board meeting was held at 6:30 p.m. at the Evergreen Recreation Center Lounge Clubroom 2700 N. Woodland. There were four (4) District Advisory Board members in attendance, four (4) City staff and seven (7) members of the public who signed in. Rusco, Patrol North Council Member Miller called the meeting to order at 6:32 p.m. welcoming everyone. Miller asked members to introduce themselves and state their representation for serving on the board. Approval of Minutes The September 19, 2012 minutes were not approved due to lack of a quorum. Staff Presentations 3. Community Police Report Patrol North: Officer Rusco reported for Beat 41, 42 and 48. Rusco said there was an increase in robberies on 41 Beat, the robberies at 400 W. Central and 551 W. Central do not appear to be the same person. On Beat 42 the Mark 8 Motel at 1130 N. Broadway shows 150 cases since January 1, 2011 to present with 10 cases for narcotic seizure warrants. Officers are working with the owner to stop these issues. *****Action: Receive and file Minutes 2 October 1, 2012 4. Fire Department Report Captain Scott Lee from Station 7 reported in August there were 21 fire investigations-11 accidental-8 incendiary/arson and 2 undetermined 500 medical alarms 160 other alarms Fire Safety Talk for October is to discuss having two exits in case of fire, especially for kids, this is very important. Oct. 15th there will be stations tours and school visits. Landwehr asked if arson cases are resolved. Lee responded it is hard to solve some such as if a kid is playing with a lighter. Landwehr asked if this arson report is consistent across the months. Lee said not always and finished saying there were nine (9) fewer structure fires for 2012 than 2011. *****Action: Receive and file New Business 5. Neighborhood Clean-up Program Terri Dozal, Neighborhood Assistant presented with power point the changes that are being made to the 2013 Neighborhood clean-up program. The following are questions/comments from the board. Responses in Italics. Ben-Hills - I don’t know what I’ll be charged. Ben-Hills - Will I get a bill after the clean-up? If you are a Dollar-for Doer clean-up and your total clean- up bill was more than expected you would get a bill from the city for the remaining part you owed. Will we have 80 clean-ups? That has been the estimated clean-ups in the past years. What will happen with any money left over at end of year? I don’t know yet. Ben-Hills - Will this include the tire pick-up? Yes it will. Midtown is a huge area and we always select a small area that is the worst. We wouldn’t pick an area where we had to pay. Indian Hills said they could possible pay a few hundred dollars but not more than that. Could two neighborhoods go in together for a clean-up? I don’t know yet, I would have to ask. Could neighborhoods rent dumpsters and have in their locations for several days? I don’t know yet, I would have to ask. Do most neighborhoods clean their entire association boundary? I don’t believe many do, usually just part of the boundary area. Maybe we could get a clean-up every 3-4 years since neighborhoods don’t have money to pay. Couldn’t the city tap into the Fire/Police budgets since clean-ups help reduce crime? I don’t know yet, I would have to ask. *****Action: The District VI Advisory Board provided feedback on the 2013 Neighborhood Clean-up Program. Planning 6. CON2012-00031 The District VI Advisory Board (DAB) considered a City request for a Conditional Use to permit a Nightclub/ Event Center generally located on the northeast corner of 33rd Street North and Arkansas Avenue. The members were provided the MAPD staff report for review prior to the meeting. Bill Longnecker, Planner presented the case background, reviewed the staff recommendation and answered questions of members and the public. Minutes 3 October 1, 2012 Miller stated she asked for the case to be heard again at DAB because there were conflicting meeting dates sent out the first time and then at the mid August meeting there were no residents present and then a valid protest petition was received. Longnecker said since the last presentation the building didn’t pass the fire/building code and needed to add sprinklers or put up a wall to make two sections to make the facility smaller. Both sides would need in and out openings. Landwehr asked if the applicant has to pay for the renovation or does the owner pay. Longnecker said whatever is stated in their contract. The city has no control on this. O’Leary-Siemer asked if he has heard from USD259 with a protest and where was the notice sent. Longnecker said they had not heard from them and the notification was sent to the downtown headquarters as that is the name of the property owner. O’Leary-Siemer said the building administration should have been informed and then they notify the Ortiz school to take to the parent council. Brandon Reef, 3350 N. Jackson Ct. said he was not able to come the first time this was heard. This is big for the neighborhood and with this place opening on Friday at 8am that’s when people are taking their kids to school. The parking lot is not big and it’s full all the time now. There was a party awhile back and the drinking went on until 2am. Then the speeding along Jackson began as it’s easier to access 29th street. There are lots of kids in this area. It’s not a place for loud music or drinking. Robert Little, 3354 N Jackson Ct. said he lives in an area of 45 houses that are all low-income, single parents with children and some are small children. He said we have a park in our neighborhood; there is the Elk’s Lodge open several weekends of the month. The parking is full and they keep the doors open and you can hear the music and people. Loud arguments start and then the driving drunk down Jackson Street. There is El Gato Negro club three (3) blocks away and you can hear that noise from here. Along north Broadway off from 37th Street there are all kinds of buildings they could put this there. You have a shopping strip surrounded by residents with Head-Start beginning at 7:30 a.m. with constant traffic in the parking lot. Is the security to be licensed? Mindy Tann, 3366 N. Jackson there is always late night traffic; it’s not well lit, increased vandalism and violent crimes. She has had people drive thru her side yard with small kids in the yard. This will put children more at risk. Police in area at night, I think its more traffic in our neighborhood at night. Pamela Pendleton, 3434 Arkansas said she lives behind the owner of that property who doesn’t take care of the property now. There is too much noise already and people show total disrespect with their stereos up loud and they shoot guns. There are 2-3 venues in this area already and we just have too many kids for it to be safe. Grace Vargas, 3374 N. Jackson said increased crime will depreciate the value of our homes. This will deter other residents from moving here. I just moved in here and am concerned about safety. Jose Vasquez, applicant lives at17th Street said he signed a contract for five (5) years and tried putting in a grocery store but didn’t have business so he wants to open this location for private parties. He said he would open at 8am on Fridays for cleaning and decorating for the event. There would be no alcohol served until after 8pm. He just wants to make an honest living. His security will be licensed and have it for in and outdoors. There will be no drinking in the parking lot. Van Walleghen said this is a different story tonight. I generally site with the neighborhood and people living in the neighborhood are the priority. Landwehr said she lives in a neighborhood with group homes. This area already has bars, enough is enough. Claycomb asked what about a venue without serving alcohol? Landwehr said that could be an option. Minutes 4 October 1, 2012 O’Leary-Siemer agreed with MAPD report. This is a nuisance and my concern is with security for children. Inappropriate things happen behind schools. Miller told the public the MAPC and DAB meetings are public hearings for people to voice their opinions but once a case reaches the City Council there would be no more public input. You can listen to Channel 7 to hear the discussion and I invite you all to come back. Laurie Walker, representative for Habitat for Humanity asked if all these comments would be shared with the City Council and Miller said yes as the DAB is an advisory committee to her and everything said tonight would be heard by the other council members. *****Action: There was no action taken due to lack of quorum. Board Agenda 7. Problem Properties 2606 Hyacinth: continues to be a mess. Business on Corner of 13th/Emporia, the SE Corner is vacant and has tall grass and weeds. *****Action: Receive and propose appropriate action. 8. Neighborhood Reports Indian Hills NA: the 16 & 1700 blocks of N. Charles along with Emerson School will be holding a Celebrate Safe communities event. NCIPP: a new rehab program for Broadway-Santa Fe 13th/17th streets will be hosting a Block Party at Hope Park. There will be Ice cream and games for the kids and important business for the adults. *****Action: Receive and file. Updates from the councilmember Announcements The next DAB VI meeting will be held on Monday, November 5th. PLANNING 6. CON2012-00031 Conditional Use to permit a Nightclub - Event Center Generally located on the northeast corner of 33rd Street North and Arkansas Avenue. Staff will be present to review background and answer questions. *****Recommended Action: Based upon information available prior to the public hearings, planning staff recommends that the request for a night club be APPROVED, subject to the following conditions listed in the staff report. Problem Properties DAB Members are given the opportunity to identify and report problem properties throughout District VI. *****Recommended Action: Receive and propose appropriate action. 8.
