Woodland, Wichita, KS 67204 6:30 PM Lounge Clubroom The District VI Advisory Board meeting was held at 6:30 p.m. at the Evergreen Park & Recreation Center Lounge Clubroom 2700 N. Woodland, Wichita, KS 67204. There were eight District Advisory Board members and two staff members in attendance. Approval of Minutes The minutes for October 3, 2016 were approved. Motion passed (8-0) (Hamilton, Dunakey) Public Agenda Scheduled Items: None Off-Agenda Items: Judy Ervin, 4841 N. Arkansas, wants to follow up with the case from the last meeting on the Conditional Use to permit a Tavern and Drinking Establishment for the Baby Doll nightclub. She is aware the board approved the request on this application and received a letter on the outcome from the MAPC. CM Miller: Yes, this board did approve it for Conditional Use with conditions and it went on to MAPC and it was denied. Now, it goes to City Council where discussion and a vote will take place. There is a two week period to protest the application. Your interest and the others on this case shows you’re all a model case on how neighbors should be involved. Mike Hays, 614 W. 48th St., owns property south of Baby Dolls nightclub, located at 4900 N Arkansas. He expressed the nightclub is operating as a strip bar with the following problems; drugs, prostitution and violence. CM Miller: This isn’t going to change anything nor can this body do anything. People are aware of the conditions. Anything that can be required can be an improvement, but that has to do with a number of things. The owner will need to spend money and may not want to do any of these conditions. There has been no service calls to WPD. You need to October 19, 2016 continue to call and give a specific address. The Record Dispatcher needs the specific address. There will be a new ordinance in place for excessive use of resources, particularly for property that has lots of calls for services. Police can fine the property-owners and then lower the number of calls made. It is very difficult to shut down nightclubs. *****Action Taken: Receive and file New Business PUD 2016-00008 Bill Longnecker Bill Longnecker, MAPD, presented a request for a zone change from SF-5 Single-Family Residential (SF-5) to PUD Planned Unit Development (Dwire Commercial PUD). The 4.59 acre unplatted site is located north of 235/K-96 and 40th Street North, on the east side of Seneca Street and the southeast end of a sand pit. The proposed use is for an event center that allows alcohol and music for entertainment, a private recreational vehicle campground, and other commercial uses. The Board asked/made the following questions/comments: DAB: Would this allow 250 people into the single-family residential side of Seneca Street and allow 250 school buses? A: Seneca is the only way to go in and out. Seneca was not intended for this. This is the only way in and out. CM Miller: K-Dot has a plan to remove the bridge and the plan is funded. Planner: 40th Street will need to be improved. There are no plans to improve Seneca. Agent: Here’s a quick background why we are here. The Dwire brothers are using property against code violation on parking inoperable Recreational Vehicles (RVs) off their property. They received a letter on a violation from code enforcement to vindicate the situation. We are addressing land use and zoning codes and would like to allow the brothers to continue their operation in the exact manner for private and personal use. DAB: The RVs are on the property for some time and there’s no city sewage? How often is the outhouse cleaned? Applicant/Owner, David Dwire : The bathrooms do not work in the RVs and are cleaned out once a week. Applicant/Owner, John Dwire: The three RVs out there are used on the weekends for the kids and then head back home. No one lives out there. We’re not putting a nightclub out there. We want to start making plans to make it a better attraction for the whole neighborhood. A member of the public spoke in opposition of this request. Mike Patterson, 4254 N. Seneca: There are a couple of problems. There is no turn around there, and you can only go north. I have a circle drive, and they use it. It looks like a trailer trash. If they did not comply with residential, why should they comply now? DAB: How long has the Single Family Residential been established? A: Since 1999. DAB: Is the SF-5, the same definition as it now? A: Yes. ****Action Taken: Boyajian/O’Leary-Siemer made a motion to accept the staff report as Denied per staff recommendation. Motion carried: (6-2) BOARD AGENDA Issues of Concern None Neighborhood Reports None October 19, 2016 UPDATES The next DAB VI meeting will be held on November 7, 2016 at 6:30 p.m. at Evergreen Park & Recreation Center (2700 N. Woodland, Wichita KS 67204 6:30 p.m. South Side Room ORDER OF BUSINESS -- Call to Order -- Approval of Minutes for October 3, 2016 PUBLIC AGENDA This portion of the agenda provides an opportunity for citizens to present issues that are not part of the regular agenda for the meeting. PUD2016-00008 Bill Longnecker John and David Dwire (applicants/owners) Baughman Company c/o Russ Ewy (agent) proposes a zone change from SF-5 Single-Family Residential (SF-5) to the Dwire Commercial PUD Planned Unit Development (PUD). The 4.59-acre unplatted site is located north of I-235/K-96 and 40th Street North, on the east side of Seneca Street and the southeast end of a sand pit. The site is gated and posted no trespassing, which limits access to the site in regards to describing its current use. The Metropolitan Area Building and Construction Department’s Code Enforcement division (MABCD – OCI) has observed, from Seneca Street, least two “recreation vehicles” (RVs) with a vehicle parked at each RV, a porta-potty, a tractor and a dump truck on the site. The site’s SF-5 zoning does not allow this type of storage. The commercial PUD would allow an a private RV park for three RVs, an event center/nightclub, retail use, office use, a restaurant or a farmers market all that would allow 250 people into the single-family residential side of Seneca Street. The applicants could have applied for SF-20 Single-Family Residential zoning with a Conditional Use for a private RV park to resolve their conflict with MABCD and their neighbors. Recommended Action: Planning Staff recommends DENIAL based on four findings listed in the staff report. Agenda 2 October 19, 2016 BOARD AGENDA 4.
