The District VI Advisory Board meeting was held at 6:30 p.m. at the Evergreen Park & Recreation Center Lounge
Clubroom 2700 N. Woodland, Wichita, KS 67204. There were six District Advisory Board members, two staff
members and six members of the public in attendance.

Vice Mayor, Janet Miller, called the meeting to order.
Approval of Minutes
The minutes for January 9, 2017, were approved. Motion passed (6-0) (Claycomb/O’Leary-Siemer)

CON2016-00061
Dave Clements, Metropolitan Area Planning Department, presented a request on behalf of applicant, Gary H. Morris,
for a Conditional Use permit to allow vehicle sales on property zoned LC Limited Commercial; located at 404 E. 13th
Street N. The subject site is developed with a one-story brick commercial building constructed in 1986. The applicant
proposes to use approximately 2500 square feet of the existing building for second hand retail and approximately 500
square feet for office to operate a the used car sales. Per the Unified Zoning Code (UZC), outdoor vehicle and equipment
sales may be permitted with a conditional use in the LC zoning district. No vehicle repair will be provided as part of the
car sales business. The applicant’s site plan shows the existing commercial structure with customer and vehicle sales
parking spaces marked. The site has two drive accesses, one onto East 13th Street and one onto North Topeka Avenue. The
site plan also indicates a drive access to the 20-foot wide alley on the east side of the property.

The Board asked/made the following questions/comments:
DAB: If the parking lot behind the lot were to be paved, would the business be allowed to park additional cars? A: The lot
behind is not large enough to be paved for additional cars per code and maneuverability standards.
DAB: If someone else bought the property, what could it be used for? A: This property is zoned Limited Commercial, a
very general classification, which would allow retail, office, etc.
DAB: If part of the property can be used for other sales, does parking have to be provided for other businesses? A: Yes.
One to three spaces per 1000 square feet for retail balance allocated to car lot. Vice Mayor Miller: Six to seven spaces for
building and remainder for used car sales.
DAB: How is this enforced? A: A plan has to be submitted. If ever a complaint is made, the City can use plan to enforce
proper use. There is concern because other car lots don’t seem to provide parking for customers.
DAB: Do they have to declare how many cars are parked as used cars? A: It is not enforced unless there’s a complaint.
Janice Bradley, Peace and Social Justice Center: She asked to vote against request due to parking for residents already
being limited. She stated the house behind this lot has been renovated, as well as others, and parking in the area has been
lost for different reasons lately. She stated that the plan does not sound well thought out and is asking DAB to consider
denying. She also stated that neighbors are also opposed to this, as well as the Historic Midtown Association. She stated
that changing the zoning and the use following ownership of property bother her.
VM Miller: The MAPC will vote on this tomorrow. If approved, there will be a two week petition period before going to
council. DAB: So if it is not approved, the change will dissolve? VM Miller: Yes.
Action Taken: Boyajian/ Gard made a motion to deny request based on the character of the neighborhood and the
objection of residents. Motion carried (5-1)
CON2016-00062
Dave Clements, MAPD, presented a request on behalf of applicant, Alex Lent, for a Conditional Use permit to allow a
drinking establishment for on-site consumption of craft beer on property zoned LC Limited Commercial; located at 707
N. Waco Ave. The site is located within an existing restaurant/catering business (Sweet Allie B’s) located in a retail strip
center. The strip center was built in 1980. Sweet Allie B’s is a full service restaurant with a liquor license. The applicants
propose to establish an on-site microbrewery and tavern/drinking establishment to sell their product in the restaurant.
They will not be producing craft beer for distribution. When a tavern, drinking establishment or nightclub is located
within 300 feet of a church or place of worship, public park, public or parochial school or residential zoning district,
approval of a Conditional Use is required; Unified Zoning Coode (UZC), Sec.III-D6.w. Water’s Edge Apartments are
located immediately south of the strip center. The area to the north, of the site is zoned LC and is developed with a five-
story office building. The surface parking lot serves the retail strip center and the office building. The applicant’s request
would not introduce a new use into the immediate area. The restaurant currently maintains a license for liquor sales to
restaurant patrons. South of the site is a B Multi-Family zoning which is developed with multi-story apartment buildings
on approximately 40 acres. East of the site is a LI Limited Industrial developed with the American Red Cross facility and
the Sedgwick County Jail facility. There is also a retail strip center at the southeast corner of Waco and Murdock.
Tyson Tompkins: He stated they will make and sell the beer onsite. He also stated it’s a nice spot and encouraged those
in attendance to stop by.
Action Taken: Claycomb/ Deckard made a motion to approve the Conditional Use permit. Motion carried (6-0)
ZON2016-00064
Dave Clements, MAPD, presented a request on behalf of applicant, Jonathan Headrick, for a zone change from SF-5
Single-Family Residential to GC General Commercial; located at 740 W 53rd St N. The applicant is requesting a rezoning
to allow on-site production of pottery, as well as wholesale distribution of goods produced at the location. The application
pertains to a 0.46 acre site located at the northwest corner of North Shelton Avenue and West 53rd Street North. The
subject property is currently developed with a single-family residence and a detached garage/workshop.

Jonathan Headrick: He stated they’d like to use the shed for a pottery studio. He also stated there are artists that would
like to use this space. He stated they would put in a parking lot and meet zoning requirements to keep renting the
residence if possible.
The Board asked/made the following questions/comments:
DAB: Is residential allowed? A: No, I don’t think so. VM Miller: Protective overlay issue will need to be clarified to
determine if residential will be allowed.
DAB: Will you have kilns? Do they have to be vented? A: Yes, there will be kilns and they do need to be vented.
DAB: Can the lot be split into SF5 and General Commercial? A: Planners did not recommend this. This would not likely
meet code requirements due to the size.
Action Taken: Deckard/ Matney made a motion to approve the zone change. Motion carried (6-0)

DAB Member Boyajian stated there is a camper on the river, 100 yards north of the exercise area at Sim Park which is
causing a great deal of trash gathering. VM Miller asked staff to follow up.

Recommended Action: Planning staff recommends that a Conditional Use for a microbrewery with
tavern/drinking establishment be APPROVED based on the five conditions listed in the staff report.
