District VI Advisory Board Minutes www.wichita.gov Monday Evergreen Resource Center March 6, 2017 2700 N. Woodland, Wichita, KS 67204 6:30 p.m. Conference Room The District VI Advisory Board meeting was held at 6:30 p.m. at the Evergreen Resource Center Conference Room 2700 N. Woodland, Wichita, KS 67204. There were nine District Advisory Board members, nine staff members and nine members of the public in attendance. Approval of Minutes The minutes for February 6, 2017, were approved. Motion passed (7-0) (Deckard/Boyajian) Public Agenda Scheduled Items: Anne Maack,Wichita Rowing Project Presentation, reported seeking public comment on shelter for the rowing equipment in South Riverside Park. She discussed having a 99 year lease with the City. The City involvement would include ownership maintenance and insurance of facility via Park and Rec Department. The Board asked/made the following questions/comments: DAB: Do you foresee sponsoring races? Anne: Yes, 3 Regattas throughout year are expected. DAB: Does the river cause problems for rowers? Anne: We try to be the eyes and ears of the community and maintain the river. DAB: You will have matching funds? Anne: We hope to raise 242k of the 480k cost with the supplement coming from grant funding. DAB: How many boats will be stored? Anne: 20 to 25 shelves Anne: To make sure we have thorough feedback, any concerns about impact to neighborhood? None reported. DAB: What is the proximity of building to water? Anne: A good distance. Vice Mayor Janet Miller: Cindy, will park maintain this? Cindy: That will be decided soon. Historically any group in contract with the City are responsible for the building, and many times they are not able to do so financially. Anne: These things will be determined soon. Action taken: Receive and file March 6, 2017 Off-Agenda Items: Dan Warren thanked everyone for voting on the testing in Peach Orchard. He reported Don Henry said twice that there are no dangers to health. He reported KDHE did not say these things and could not say these things. He reported 10% of pm10 comes from unpaved roads and that causes health problems for elderly people when inhaled. He reported KDHE stated people are to take care of roads and are also responsible for monitoring health issues in Wichita. He reported by reducing speed from 30 to 20mph on unpaved streets; it can reduce pm10 levels by 80% and pm25 levels by 60%. He reported that even with vehicle windows rolled up, people are still exposed to pm10 dust and this whole neighborhood needs to be fixed. He reported fighting this for 20 years. Action taken: Receive and file Staff Presentations Officer Schwiethale, WPD Patrol South, reported on a 70 camera system in June. WPD is working with businesses to potentially tie more cameras into the system. He reported the camera system will monitor strategic locations to identify crimes and act as a deterrent to crime in old town. Statistics are down for larceny and burglaries due to the arrest of suspects that were responsible for many of these crimes. Officer Jerrell, WPD Patrol North, reported on parking concerns at Pleasant Valley and Ortiz schools. He also reported on TreatCo dog treat plant and its continued use of air cannon use to scare birds which is causing noise complaints. He reported that the cannon will face inward to reduce noise problems and is set to 20 minute intervals instead of 4 minutes. He provided information on Support Local Law Enforcement Parade on April 8th and encouraged all to attend. DAB member expressed concern about a neighbor who went outside with a butcher knife and how situation was handled. Officer Jerrell stated he would look into it. Officer Tejeda, WPD Patrol West, reported officers will be walking with floats associated with their neighborhood associations. He also reported on illegal activity in Sim Park which has caused WPD to ramp up activity in the park. He also reported on a Subway store at Douglas and Seneca that was robbed. Darren Mullen, WFD Station 7, reported Wichita Fire Department has responded to over 12,000 calls already this year. He reported on one accidental fire on North Armstrong and one fire at 21st and Broadway at an unoccupied commercial building. He also reported on 1.2 million dollar loss so far this month in fires. He reported to be cautious and not throw cigarette butts or burn recreationally in winds over 15 mph. He reported on Wichita Thunder holding Police vs Fire hockey game. Wichita Children’s Home got $2500 in raised funding from the event. WFD lost Carl Grigsby a couple weeks ago. There has been a great outpouring of support from the community, and we would like to thank the community for that compassion and kindness. VM Janet Miller: There is a fund set up for Grigsby’s son who has recently lost both parents if anyone would like to donate. New Business CON2017-00002 Kathy Morgan, Metropolitan Area Planning Department, presented an application from Timothy and JoAnn Pitzer, who are requesting a Conditional Use to permit a Bed and Breakfast Inn and an Accessory Apartment located at 1230 N. Waco. The residence has three available bedrooms (suites) and the applicants wish to utilize them for the Bed and Breakfast. The applicant maintains their private residence on the third floor of the house. The accessory apartment is located above the proposed new detached garage located behind the house to the east. The Unified Zoning Code (“UZC”) allows Bed and Breakfast as a Conditional Use in the residential zoning districts in compliance with UZC site requirements for parking, screening, lighting, and compatibility setback standards and with Landscape Ordinance requirements. There are no specific requirements specified for Bed and Breakfast Inn other than the stipulation that it be an owner-occupied or manager-occupied structure. The site plan showed the two structures (principal structure and detached garage), the access off North Waco and the area that they propose to utilize for parking. According to the Unified Zoning Code (UZC), the Bed and Breakfast will require three parking spaces for the three suites which are provided along the north property line. Parking for the residents and the accessory apartment will be provided in the March 6, 2017 garage and on the parking area immediately adjacent to the detached garage. According to the UZC, a Bed and Breakfast is an owner-occupied or manager-occupied residential structure that provides rooms for temporary lodging or lodging and meals for not more than 15 transient guests on a paying basis. A transient guest is a person who occupies a room for a period of less than one week at a time. The Board asked/made the following questions/comments: DAB: How does wording need to change to establish attached garage will not be used for previous suggested purpose? Kathy: Accessory apartment language will be removed from line 8. VM Janet Miller: Any further discussion? DAB: No. Action Taken: Sanders/ Deckard made a motion to approve the Conditional Use permit. Motion carried (7-0) CON2016-00004 Dave Clements, Metropolitan Area Planning Department, presented an application from Jay Russell who is requesting a Conditional Use to allow “Rock Crushing,” on a portion of a 160-acre site, zoned SF-5 Single-Family Residential (SF- 5). The Unified Zoning Code (UZC), allows consideration of rock crushing as a Conditional Use in the SF-5 zoning district; UZC, Sec.III-D.6.gg. It should be noted that the rock crusher operation is proposed to be added to an existing sand extraction operation authorized by a Conditional Use for mining and quarrying, CON2014-00012. This Conditional Use for sand extraction included a phasing plan, conditions on operations, facility hours and a site plan that included an area for recycling. Upon conclusion of the sand extraction operation, the area will be partially redeveloped with single- family subdivision. The rock crusher operation is proposed to be added to the designated 27-acre recycling area. The applicant has provided a letter with additional details about the proposed operation. The Board asked/made the following questions/comments: DAB: What is the approximate time of completion? Phil Meyer: 10-14 years. DAB: Will you end operation if you finish early? Phil Meyer: Yes and when done, the land will be available for development. Action Taken: Deckard/Sanders made a motion to approve the zone change. Motion carried (7-0) Resolution of Support for Application for Housing Tax Credits (Rushpointe II) Mark Stanberry, Housing and Community Services Department, will present request for resolution of support for application for Housing Tax Credits. The Housing Tax Credit (HTC) Program is administered by the Kansas Housing Resources Corporation. Enacted in the Tax Reform Act of 1986, the HTC Program is designed to secure private equity capital for the development of affordable rental housing. The Program can provide as much as 70%-80% of the total development cost, which reduces the amount of debt financing in affordable rental housing developments. This credit allows lower rents and greater affordability. The State receives a tax credit allocation from the Federal government, and requires developers/owners to obtain a resolution of support from the local government when submitting applications for financing through the Program. The City has received a request from Mark Cox of Vintage Development Company LLC in partnership with Kansas Elks Training Center for the Handicapped for a Resolution of Support with their application for 9% Housing Tax Credits for the Rushpointe II housing project. The proposed Rushpointe II housing project is to be developed at 124 W. 10th Street and 6908 E. 32nd Street North. According to the applicant, the proposed project will include a total of 24 housing units. The project will provide for eight apartment suites within a newly constructed building at 124 W. 10th Street, following demolition of the existing building, and 16 apartment suites within two newly constructed buildings at 6908 E. 32nd Street North, with all units designed for individuals with disabilities. The Board asked/made the following questions/comments: DAB: What disabilities? Sheila Brown, Ketch: Intellectual disabilities. DAB: Is existing parking part of building? Sheila: We have additional parking on other side of the building. DAB: How long? Sheila: We have one year to complete after approval. March 6, 2017 Action Taken: Sanders/Claycomb made a motion to approve recommendation for adoption of the Resolution of Support for the HTC application. Motion carried (7-0) Resolution of Support for Application for Housing Tax Credits (Main Street Lofts) Mark Stanberry, Housing and Community Services Department, presented request for resolution of support for application for Housing Tax Credits. The City has received a request from The Alexander Company, Inc., for a City Council resolution of support with its application for 9% Housing Tax Credits for the Main Street Lofts housing project. The proposed Main Street Lofts apartment project involves complete renovation of the former Commerce Bank building located at 150 N. Main Street. According to the applicant, the proposed project will include a total of 119 housing units, including eight studio units, 91 one-bedroom units, and 20 two-bedroom units on the top nine floors. Commercial space, a leasing office, and other amenities are to be located on the first floor and lower level. Parking will be offered in the existing parking garage immediately across the street to the north. Action taken: Sanders/Deckard made a motion to approve recommendation for adoption of the Resolution of Support for the HTC application. Motion carried (7-0) BOARD AGENDA Issues of Concern None Neighborhood Reports Gisela Peña shared that a Hispanic woman, who had her two children in the car with her were attacked by a group of Non- Hispanics who spit in her face and she was uncomfortable reporting the incident to the police. She asked that the community consider the safety of the Hispanic population in the current political atmosphere and support the Hispanic community. DAB Pro-tem election – Cindy Claycomb wins with 3 votes and is the new Pro-tem. The next DAB VI meeting will be held at 6:30 p.m. on April 3, 2017, at Evergreen Resource Center conference room. The following is a brief summary of the rock crusher operation:  The rock crusher is anticipated to operate during the normal hours of the sand extraction facility, 7:00 a.m. to 5:00 p.m.  Material to be crushed/recycled is clean concrete and asphalt debris from local construction and demolition projects. The material is nearly 100% recyclable and will be crushed for gravel aggregate to be used in local construction and road projects. The recycling area, as shown on the site plan, will be for stockpiling clean fill material to be used as needed.  The gravel crushing/recycling operation will operate at times when there is sufficient material stockpiled for recycling. The crusher can process 150 tons of material per hour, so there must be sufficient material available for the crusher to operate at an efficient level.  The operator of the rock crusher indicates that the facility could operate for a maximum of 90 days per year.  The facility complies with permit requirements of the Kansas Department of Health and Environment.  The rock crusher is equipped with a hydraulic water system as a method to reduce dust from the crusher operation. Agenda March 6, 2017 3 The subject property is located approximately one-mile west of the Arkansas River in a City-County area that is a mix of agricultural land, single-family residences, with active sand extraction and quarry operations. There is single-family residential development around other inactive sand pit operations in the vicinity of the site. North and northwest of the site are single-family residences and a residential area developed around a sand pit lake. Approximately a ½-mile north of the site, across 53rd Street North, between the Arkansas River and Ridge Road, there are four large sand pit lakes. Three are active extraction operations, with the one retired operation developed with single-family residences. South of the subject site is a single family subdivision. East of the site, across Hoover Road, are three sand pit lakes, and scattered single family development. Land surrounding the application area is zoned SF-20 Single-Family Residential (SF-20), and LC Limited Commercial (LC). Mr. Michael Nigg is the property owner to the north of the site, at 5101 North Hoover Road. Mr. Nigg has submitted a letter indicating his support of the request, based on certain conditions. These items have been included in the conditions listed in staff report. Please note that the frequency of crusher operations is still being discussed by the applicant and Mr. Nigg. Recommended Action: Planning staff recommends that the request be APPROVED subject to conditions listed in the staff report. 7. Once the project is reviewed by the DAB, DCC, Planning and MABCD, it is forwarded to the City Council for a public hearing with a staff recommendation regarding the Resolution of Support for the HTC application. The proposed Rushpointe II housing project is to be developed at 124 W. 10th Street and 6908 E. 32nd Street North. According to the applicant, the proposed project will include a total of 24 housing units. The project will provide for eight apartment suites within a newly constructed building at 124 W. 10th Street, following demolition of the existing building, and 16 apartment suites within two newly constructed buildings at 6908 E. 32nd Street North, with all units designed for individuals with disabilities. Recommended Action: Staff recommend that the District Advisory Board APPROVE a recommendation Agenda March 6, 2017 4 for adoption of the Resolution of Support for the HTC application, waiving the 20% market-rate unit requirement. 8.
