Community Police Report Community Police Officers will give a brief report on District VI issues, problems and events. Recommended Action: Receive and file. NEW BUSINESS 5. CUP2018-01 Kathy Morgan, Metropolitan Area Planning Department, will present an application from CBB Northlakes, LLC – Kurt Bachman (Owner)/Baughman Company, PA – Russ Ewy (Agent) who is requesting an amendment to The Moorings Community Unit Plan - DP-323. This amendment will eliminate parcels 8 and 10; will significantly reduce parcels 7 and 11; and modify parcel 9 to allow the development of the parcel for self-storage. This CUP has been subject to many revisions and modifications over the years. The original CUP for The Moorings was established in 1976 and filed as DP-78. At that time the CUP did not include the area being addressed in this case. Because of all the changes, most of The Moorings was superseded with CP-323 in 2010. Agenda April 2, 2018 2 A subsequent platting of most of this property also was approved in 2013 to reconfigure the lots within the property. This amendment will make further modifications to the CUP. Namely, parcels 8 and 10 are being eliminated; the total area of parcels 7 and 11 are being reduced; and parcel 9 has been enlarged and the use for this parcel has been changed. The northern portion of parcel 9 is zoned LC Limited Commercial (LC) and includes all the land formerly included in parcels 8 and 10, as well as portions of parcels 7 and 11. The only portion of parcel 9 zoned OW Office Warehouse (OW) is the land west of the Riverlawn Christian Church property on the west side of Cobblestone Street used as ballfields and play areas by the church. This amendment for parcel 9 will designate as an additional use for the entire parcel self-storage warehousing, subject to clarification on screening requirements and the elimination of the supplemental use regulations regarding self-storage warehousing in the LC district. Additionally, the amendment is removing the supplemental use regulation for construction sales and service in the LC district. Given the location of this property and the existing conditions and uses of adjoining properties, these are reasonable uses and conditions. Only the City Council can waive these standards, which will mandate this amendment must be considered by the Wichita City Council. Immediately north of the site are a number of undeveloped parcels within the CUP that are zoned LC. Fire Station Number 13 is immediately to the east on the north side of West 42nd Street North. West of the property is the Arkansas River. The land south and west is owned and used by the Riverlawn Christian Church. The Meritrust Credit Union is located at the northwest corner of West 42nd Street North and North Meridian Avenue. Recommended Action: Staff recommends that the proposed design concept be APPROVED subject to the conditions listed in staff report 6. ZON2018-00001 Kathy Morgan, Metropolitan Area Planning Department, will present an application from Erin McLaughlin (Owner) / Greg Ferris (Agent) who is requesting the rezoning of the two lots (0.94 acre) at this location from SF-5 Single Family Residential (SF-5) to TF-3 Two Family Residential (TF-3). The property is currently developed with a single-family dwelling unit and an accessory structure (pool house) that has its own bathroom and one large, open room. Each lot is less than one-half acre each. There may be opportunity to build a new residential structure on each of the lots in the future if the change in zoning were approved. SF-5 zoning does not allow the further development of the property. The property is platted as the Central Place Addition to the City of Wichita, Kansas, recorded with the Register of Deed’s on August 17, 1948. The surrounding neighborhood is primarily residential uses. Everything in the adjacent area is zoned SF-5 and is occupied by single-family homes. There is TF-3 zoning one block to the southeast of the subject property and two blocks west of the subject property. Recommended Action: Planning staff recommends that the request be APPROVED based on the findings listed in staff report. 7. ZON2018-00008 Kathy Morgan, Metropolitan Area Planning Department, will present an application from Max Air Mechanical – Rachel Parker (Owner)/Greg Ferris – Ferris Consulting (Agent) who is requesting the rezoning of the 0.60-acre property from SF-5 Single Family Residential (SF-5) to GC General Commercial (GC). The owner is also requesting a Protective Overlay be placed on the property which limits uses to those permitted by right in the TF-3 Two Family Residential (TF-3) zoning district and the limited manufacturing, machine Agenda April 2, 2018 3 shop and offices associated with the business. No other commercial or retail uses would be permitted and a restriction on outside storage is offered. The applicant/owner operates a business which manufactures and installs ducting for heating and air conditioning systems. According to information submitted by the agent, the applicant acquired the subject property about two years ago with the belief the business operation would be permitted because of the classification of the property for taxing purposes and how the property had been used in the past. According to the agent, previous uses have included a plumbing warehouse, HVAC shop, offices, an event center, and other commercial uses. The city inspectors have determined the new use does not comply with any “grandfathering” rights and that the land needs to be properly zoned. The surrounding neighborhood is a mixture of single-family and duplex residential uses. The properties immediately to the north and west are zoned TF-3 Two-Family Residential (TF-3). The properties on the east side of Florence Street and south of Douglas Avenue are zoned SF-5 Single-Family Residential (SF-5). The properties one block to the east at the corner of Douglas Avenue and West Street have been rezoned to GC in the past year with Protective Overlays, which are similar in nature to what is being requested for this property. Recommended Action: Planning staff recommends that the request be APPROVED subject to the creation of Protective Overlay #325 a follows: Protective Overlay: 1. Uses shall be limited to those allowed by right in the TF-3 zoning district, and a machine shop and manufacturing business and associated offices, EXCEPT the following uses shall be prohibited: Day Care, Limited; Recycling Collection Station, Private; or Asphalt or Concrete Plant, Limited. 2. No outdoor storage is permitted. 3. All parking lot lights shall be shielded and directed downward. 4. Signage shall be per the sign code for the LC, Limited Commercial zoning district. 5. Landscape and screening shall be per the Unified Zoning Code and landscape ordinance. 6. Maximum building height is 35 feet. 7. Maximum building coverage shall be no more than 35 percent. Manufacturing, Limited and machine shop shall be regulated by the following additional restrictions: 1. The gross Floor Area of any building housing a Limited Manufacturing Use shall not exceed one square foot of floor Area to three square feet of lot Area. 2. The minimum setback of any building from the north and west property lines shall be 30 feet. 3. The maximum number of employees with a limited manufacturing use on any one shift shall not exceed 15. 4. No welding or machine shop use shall be permitted unless the entire frontage of the ground floor along the principal street frontage is used for office space, display or wholesale or retail; or complies with the restrictions found in Section III-D.6.n. in the Supplementary Use Regulations, and amendments thereto. 8. Fireworks Ordinance Chief Crisp, Wichita Fire Department, will present on the Fireworks Ordinance. Over the last five years, the number of fires and injuries resulting from the use of fireworks within the city has trended downward, while the number of complaints called into Emergency Communications (911) has remained relatively steady. The sale of “full power” fireworks in surrounding communities continues to lead to large numbers of fireworks violations within the city. This also poses significant difficulties for law enforcement and fire personnel to enforce the current fireworks ordinances. Agenda April 2, 2018 4 Currently the City of Wichita fireworks ordinance allows the sale and use of only those fireworks tested by the Wichita Fire Department and shown to emit a shower of sparks no more than six feet in any direction. Additionally, the sale and use of approved fireworks is allowed between June 27th through July 5th and during the hours of 6:00 a.m. to midnight. State law and all jurisdictions that surround the City of Wichita, allows the sale and use of all consumer fireworks (class C or 1.4 G) except bottle rockets. On December 19, 2017, Fire Department staff presented information to the City Council regarding potential changes to the existing ordinances. Based on input from the City Council and fireworks wholesalers, staff has developed the following options for proposed amendments to the fireworks ordinance. Option A: Allows sale of “full power” fireworks in the City of Wichita but limits use to designated “safe to shoot areas” with emergency crews on site. The ordinance reduces the dates of use and reduces times of day use of fireworks is allowed Option B: Maintains current restrictions on types of fireworks allowed in the City and reduces the dates and time frames for use. Recommended Action: Staff recommends that the District Advisory Board approve Option A or Option B. BOARD AGENDA 9. Issues of Concern DAB members have the opportunity to ask questions regarding City topics and identify issues of concern to be addressed. Recommended Action: Receive and file. 10. Neighborhood Reports DAB members may report events/activities from the neighborhood/homeowners groups in their areas. Recommended Action: Receive and propose appropriate action.
