Page |1 District VI Advisory Board Minutes October 17, 2018 www.wichita.gov The District VI Advisory Board meeting was held at 6:30 p.m. at Evergreen Branch Library, 2601 N. Arkansas, Wichita, KS 67204. Eleven board members, Council Member Claycomb, twelve city staff, and three guests were present. Scheduled Items: NONE 2. Off-Agenda Items: NONE Staff Reports 3. Fire Department Report: Lieutenant Dan Feil, reported.  29 Fire alarms  70 Service alarms  559 Medical alarms  667 Total incidents in District VI  25% of fires city-wide in September happened in District VI  Reminder to change the batteries in your smoke detectors  Smoke detectors do have a shelf life of about 10 years  Tonight’s 29th St/Broadway fire at car crusher business. No buildings involved Page |2  DAB Question: Could the city require those types of businesses to have a fire suppression system? 4. Police Department Report: Officers Nate Schweithale, Roddy Winder and Juan Atondo, reported.  Schweithale (Patrol South)  400 Block of N. St. Francis – Vagrancy issues – Broadway Corridor team and HOT team have been addressing and there is some improvement  Old Town – Heroes Sports Bar served with nuisance letter for excessive calls. Since being served, there has been a significant reduction in calls to the business  2nd and Broadway Parking Garage – Homeless problem, lots of trash including hypodermic needle. There is a trespass affidavit on file, add more signage, and police presence will be increased  Winder (Patrol West)  There has been an overall reduction in crime in District VI  Larceny to autos is up city-wide – lock cars and remove all belongings  Do not store firearms in car  DAB Question: Are earbuds legal to use while driving  Answer: There is no current ordinance that specifically addresses earbuds, but could be cited for inattentive driving  Atondo (Patrol North)  Change is state law may be leading to an increase in gun thefts.  Road rage issue at 13th and Broadway this evening – Four year old boy shot  53rd/Seneca – Burglary – Vacant House. $8,000 worth of woodworking tools taken. All tools are identifiable with “Brooks” in scripted and they are yellow and green in color  North High event – Coffee with a Cop – 8AM to Noon this Saturday  Cloud Elementary Career Day event  Vice President Pence will be in town tomorrow. Avoid West Kellogg tomorrow evening around 8:00 p.m. New Business 5. Fireworks Presentation: Chief Tammy Snow and Deputy Chief Stu Bevis gave an overview for the Fireworks Enhanced Enforcement efforts in 2018. The Wichita Fire Department, in conjunction with the Wichita Police Department, deployed personnel on the evenings of July 3 and 4 to enforce the new fireworks ordinance. Goals  Improve community safety by enforcing the amended fireworks ordinance  Deter illegal use of fireworks  Educate the public Performance Metrics  June 22 – July 5 reporting period  22 teams patrolled the city each night  Dispatch received 1,437 fireworks complaint calls  51 reported injuries due to fireworks, an increase of 15  Fireworks related incidents went up by 17 (there were 4-5 structure fires)  Dollar loss due to fireworks related incidents was down  138 citations were written – 27 in District VI Citizen feedback  Citizens reported reduced use of illegal fireworks leading up to the holiday Page |3  Many citizens thanked the City for enforcement efforts  Other feedback was negative and critical of enforcement efforts, including writing citations Concerns  Staffing of teams was very problematic  Officer safety is significant concern  No back up readily available to assist the teams  Fire officers not equipped, trained or experienced in issuing citations in hostile situations  Due to limited staff and logistics, only small amounts of fireworks were confiscated, leaving some illegal materials with citizens  More teams were needed to adequately cover the city and patrols on additional nights to address overall use of illegal fireworks Financial Considerations  Fireworks sales permits generated $48,000 (32 permits)  Enhanced enforcement efforts cost an estimated $27, 417  This resulted in net revenue of $20,583  $20,000 in fines from citations written have been collected to date. $13,000 more is pending Summary  Many citizens continued using illegal fireworks even after the widely publicized plan to issue citations  Unclear if writing of citations had a positive impact on the safety of the community  Cost of enforcement effort was adequately covered by collected fees and fines  Enforcement efforts pose a significant risk to staff DAB members’ comments and questions  What type of ticket is issued?  Answer: An environmental ticket. It goes to collection agency if unpaid  We need continual enforcement to change the culture. Don’t give up on your efforts  Can you do a focused enforcement area?  Answer: We are looking at all types of strategies  How are we going to protect or officers and firefighters and reduce the risk to them  Answer: We are looking for community input. We first asked City Council and now we are seeking the public’s input at all District Advisory Board meetings. We will analyze the input and make adjustments. We definitely need more WPD officers involved  We all appreciate your efforts. Saddens us to see the citizen’s reactions to law enforcement. This is a good ordinance. Need to continue enforcement efforts  Possibly look into using WPD Reserve Officers  Can we offer better pay for those who work enforcement  We will have to talk to legal department  Can we do less enforcement  That is opinion driven. Perhaps shorten the time frame to shoot and make everything legal? This new ordinance was driven by the number of nuisance incidents  Can we follow-up next year with people that were issued citations to remind them of the ordinance  We’ve done that in the past and it has had little effect Deb Kinkor, 1808 N. McComas: Thank you for your efforts. We do need this ordinance. We need more police officer involvement Page |4 6. ZON2018-00042 Dave Yearout, Principal Planner, presented the request by KW Developments LLC/Gerald Wells (owner), for City zone change from SF-5 Single Family to TF-3 Two Family, generally located east of I- 235 and one-quarter mile south of West central Avenue on the east side of Hoover Avenue. The applicant was not in attendance. The DAB heard the request so that adjacent property owners and Wichita residents had an opportunity to express their concerns. No concerns were expressed. After staff presentation by Yearout, DAB members questioned if there was a rendering of the proposed duplex and if improvements would be made to the alley. Yearout explained that no rendering has been presented and the official plat does not indicate an alley exists. Therefore, the alley is on private property. Action Taken: Motion made by Weihe to APPROVE the application based on staff recommendations. Brown seconded. Motion PASSED 10-0. Board Agenda 7. Issues of Concern: None 8. Neighborhood Reports: None Updates from Council Member Baseball Update  Triple A team has agreed to relocate to Wichita  Demolish Lawrence Dumont Stadium (LDS) before the end of the year  Design-Build new LDS  Three agreements  Baseball Management Agreement – next week  Facility Use Agreement – next week  Development Agreement – land use around stadium with baseball owner  Eight bidders on demolition – Ranged from $146,000 to $800,000. Staff will present recommendation to Council next week. Must be down by the end of the year  Request For Proposals for new stadium has been issued – must be completed by March 2020  Selection committee to choose best proposal – three Council Members, City Staff and Baseball Owners  DAB Question: Will McLean be closed  Claycomb – It most likely will change, but it hasn’t been designed yet Tallgrass Film Festival starts tonight Attended passenger rail meetings in Milwaukee in an effort to get Amtrak back to Wichita No DAB VI meetings in November Meeting adjourned at 8:20 p.m.

Fire Department Report Staff will give a brief report on District VI issues, problems and events. Recommended Action: Receive and file. 4. Community Police Report Community Police Officers will give a brief report on District VI issues, problems and events. Recommended Action: Receive and file. NEW BUSINESS 5. Fireworks Presentation Deputy Chief Bevis and Chief Snow, Wichita Fire Department, will present on the Fireworks Enhanced Enforcement Teams. The Wichita Fire Department, in conjunction with the Wichita Police Department, deployed personnel on the evenings of July 3rd and 4th to enforce the fireworks ordinance. The presentation will briefly review those efforts. 6. ZON2018-00042 Kathy Morgan, Metropolitan Area Planning Department, will present an application from KW Developments LLC/Gerard Wells (owner) who is requesting a zone change from SF-5 Single Family Residential (SF-5) to TF-3 Two Family Residential (TF-3) to the 0.26 acre property located at 444 N Hoover Avenue. Agenda October 17, 2018 2 The property is currently vacant. The surrounding neighborhood is residential uses on SF-5 and TF-3 zoned lots. The properties north and west of the subject site are zoned TF-3, which are developed with duplexes. East and south of the subject site is SF-5 zoning district, which are developed with single-family detached houses. Recommended Action: Planning staff recommends that the request be APPROVED based on the findings listed in report. BOARD AGENDA 7. Issues of Concern DAB members have the opportunity to ask questions regarding City topics and identify issues of concern to be addressed. Recommended Action: Receive and file. 8. Neighborhood Reports DAB members may report events/activities from the neighborhood/homeowners groups in their areas. Recommended Action: Receive and propose appropriate action.
