District VI Advisory Board Minutes www.wichita.gov Wednesday Evergreen Branch Library Dec. 18, 2019 2601 N Arkansas, Wichita, KS 67204 6:30 p.m. Conference Room The District VI Advisory Board meeting was held at 6:30 p.m. at the Evergreen Branch Library conference room, 2601 N. Arkansas, Wichita, KS 67204. There were 6 District Advisory Board members, the Council Member, 2 staff members and 4 member form the public. PUBLIC AGENDA This portion of the agenda provides an opportunity for citizens to present issues that are not part of the regular agenda for the meeting. There is a five minute time limit for each speaker. 1. Scheduled items: None 2. Off-agenda items: None NEW BUSINESS 3. CON2019-00049 Conditional Use request for an accessory apartment. Kathy Morgan, Metropolitan Area Planning Department, presented a request for a Conditional Use in SF- 5 Single-Family zoning district to convert and existing two-car detached garage (30 feet by 24 feet) into an District VI Advisory Board Page 2 Minutes for December 18, 2019 accessory apartment located north of the existing primary residence located at 831 North Flora Street South. The site is currently developed with a single-family home with a detached garage. The Wichita-Sedgwick County Unified Zoning Code (“UZC”) defines an “accessory apartment” (Art. II. Sec. II-B.1.b) as a dwelling unit that may be wholly within, or may be detached from a principal single-family dwelling unit. Accessory apartments are also subject to supplementary use regulation Art. III.Sec.III-D.6.a (1) a maximum of one accessory apartment may be allowed on the same lot as a single-family dwelling unit that may be within the main building, within an accessory building or constructed as an accessory apartment; (2) the appearance of an accessory apartment shall be compatible with the main dwelling unit and with the character of the neighborhood; (3) the accessory apartment shall remain accessory to and under the same ownership as the principal single-family dwelling unit, and the ownership shall not be divided or sold as a condominium and (4) the water and sewer service provided to the accessory apartment shall not be provided as separate service from the main dwelling. Electric, gas, telephone and cable television utility service may be provided as separate utility services. RECOMMENDATION: Based upon information available prior to the public hearings, planning staff recommends that the request be APPROVED, with the following conditions: (1) The accessory apartment shall remain accessory to and under the same ownership as the principal single- family residence (located at 831 North Flora Street South) and the ownership shall not be divided or sold as a condominium. (2) The accessory apartment is only permitted to be located within the existing detached garage. (3) Submit a measured drawing site plan for approval by planning staff prior to the issuance of a building permit. (4) The water and sewer provided to the accessory apartment shall not be provided as separate services from the main dwelling. Electric, gas, telephone and cable television utility service may be provided as separate utility services. (5) The applicant shall obtain all applicable permits including, but not limited to: building, health and zoning. This will include turning in plans for review and approval by the MABCD for the accessory apartment. (6) Development and maintenance of the site shall be in conformance with the approved site plan. If the Zoning Administrator finds that there is a violation of any of the conditions of the Conditional Use, the Zoning Administrator, in addition to enforcing the other remedies set forth in Article VIII of the Unified Zoning Code, may, with the concurrence of the Planning Director, declare that the Conditional Use is null and void. Boyajian wants to know if the Conditional Use is to allow somebody to reside at the accessory structure, and if that is what the DAB is voting on. Morgan replied that the zoning code allows within SF-5 that you can have an accessory structure, the Conditional Use is in place so that the accessory structure remains on the zoning lot and that in the future it cannot be divided from the main structure. The conditional use requires that the accessory structure remains on the same utilities as the main residence, I.e., water sewer and electric. Matney asked if accessory structure will continue to run on a water well. Morgan replied that there is not a water line assessable to the property, and explained that it would be up to the neighbors to sign petition to get the water extended. In the meantime it will be on a water well. Council Member Claycomb asked if there are further questions or comments. None. Action Taken: Matney made a motion to approve staff’s recommendation seconded by O’Leary-Siemer. Motion passed 6-0 4. Issues of Concern DAB members have the opportunity to ask questions regarding City topics and identify issues of concern to be addressed. O’Leary-Siemer, reported that traffic post are being removed at 13th street and Perry. 5. Neighborhood Reports DAB members may report events/activities from the neighborhood/homeowners groups in their areas. Recommended Action: Receive and file. UPDATES FROM COUNCIL MEMBER Council Member Claycomb asked if the DAB would like to hear a presentation regarding the new Northwest Water Facility. DAB replied yes. The next DAB VI meeting will be held at 6:30 p.m. on Jan. 6, 2020, at the Evergreen Library, 2601 N. Arkansas, Wichita, KS 67204. ADJOURN
