1 ZONING ADMINISTRATOR 2 NOVEMBER 6, 2024 MEETING MINUTES 3 4 Village Staff: David Schoon, Director of Community Development 5 Christopher Marx, Associate Planner 6 7 Call to Order: 8 Mr. Schoon called the meeting to order at 4:00 p.m. 9 10 New Applications: 11 a. Case No. 24-25-ZA - 331 Sheridan Road: An application seeking approval of a zoning variation to provide 12 less than the minimum required corner yard setback from the private road easement along the north property 13 line. The Zoning Administrator has final jurisdiction on this request. 14 Mr. Schoon described the application submitted and asked for the applicant’s presentation. He noted he reviewed 15 all of the submitted materials. 16 17 Sam Kang of Airoom LLC identified himself as the architect for the project and representative for the applicant. He 18 stated the applicant would like to remove the existing spiral staircase to convert the space to deck area. He noted 19 that the roof coverage and impervious surface area would not increase. The presenter stated the appearance from 20 the outside would be improved by the proposed modification which would have the same profile and design as the 21 existing railings. He stated that there would be no change in the corner yard setback from its existing distance. 22 23 Mr. Schoon stated there was no one in the audience to comment on the application and no written 24 correspondence was received. Roofed area to remain same. Current required setback is 24.11 feet and existing roofed area setback is 22.36 feet which is 1.75’ less than required. Standards for granting of zoning variations are as follows: 1. The property in question cannot yield a reasonable return if permitted to be used only under the conditions allow by regulations in that district: BUILDING A DECK FURTHER BACK UNDER A EXISTING ROOFED AREA WILL NOT YIEDL A REASONABLE RETURN. 2. The plight of the owner is due to unique circumstances. Such circumstances must be associated with the characteristics of the property in question, rather than being related to the occupants: EXISTING ROOFED AREA WAS BUILT UNDER DIFFERENT SETBACK RULES AND OWNER DID NOT CREATE THIS UNIQUE CIRCUMSTANCES. 3.
