The applicant states an employee cleans the parking lot first thing in the morning.
The applicant also cleans the parking lot and in front of nearby houses. He keeps
garbage bins outside of the establishment and has donated large amounts of food to
the community for years.

Albert McGarry - 2330 N 48th St - He states noise from the establishment is a large
issue. There have been parties in the parking lot as well. He has called police, but

Alex Runner - 2377 N 48th St - The neighborhood has evolved so the residential area
surrounds the commercial area. He states there have been piles of litter in the area
from the business. He states the applicant has yelled at him for cleaning up litter.
The applicant has improved somewhat recently. He retracts any inference that the
applicant had bribed neighbors.

The applicant states that they have been in business for fifteen years and run a
responsible business. They try to fix any issues that arise. In regards to the police
report, they purchased the vehicle from Always Towing. When they located an
additional VIN found on the vehicle, they entered it into the system.
Atty. Mike Maistelman - 8989 N Port Washington Rd - Counsel for Always Towing -
Always Towing has a contract with the County Sheriff. In this incident, the sheriff
contacted Always Towing after pulling over the vehicle with an unlicensed driver. At
that time, the sheriff ran a check for the VIN and stated it was not stolen. Always
Towing held the vehicle for the required period of time and then sold it to the
applicant.
Ald. Coggs moved approval with a warning letter based on the police report.

police report were considered with the applicant's Junk Collector License application
last year. Regarding items #12-13, the applicant purchased some scrap metal and
one month later the police came to the premises to ask about the purchase. The
applicant had entered the purchases in NEWPRS right away and sent the receipts to
his bookkeeper to be recorded, so the receipts were not on the premises during the
visit. The applicant is working with the city attorney regarding the incident.

business contributes to economic blight in the area. He has tried to work with the
applicant, but the property has become more and more of a nuisance property.

In regards to the police report, the applicant states that a customer came to tell the
employee that shots had been fired and the customer had already called the police.
He states that the item regarding a responsible person not being on premise
occurred because the licensed employee did not tell the applicant that he was not at
work.

Juan Carlos Ruiz - 8989 N Port Washington Rd - The applicant has several
businesses in the city and he has invested in all of them to improve the quality of
business. He has worked to be an asset to the neighborhood. He is also training all
employees to prevent issues.
Arlisia McHenry, Legislative Assistant for Ald. Hamilton present at the table. The
alderman's office has received several calls concerning issues with noise and
loitering from the establishment. The alderman is not in support of being open 24
hours, but would prefer the business to close at 2 AM. There are still issues and the
employees are still in training. The alderman has been in contact with the applicant,
but the problems have continued. There is too much loitering, so there needs to be
some accountability.
Ald. Kovac moved to amend the hours of the application to close at 2 AM based on
the police report, aldermanic office testimony, and applicant testimony and approval

The applications for 622 W Wisconsin Ave and 612 W Wisconsin Ave were
considered together.
Atty. Michael Whitcomb present with the applicant. He states that the applicant has
no loitering signs inside and people are not allowed to use the bathroom if they are
not customers. The police suggested not allowing customers to stay longer than
fifteen minutes and they began using the practice in February. The applicant has
invested largely in the area. The applicant has managers ask panhandlers to leave.
The applicant states the panhandlers are not supporting the business so it is not
encouraged. Patrons from nearby hotels are happy to have the extended hours for
both establishments.

establishment. It took several months for it to be removed. The parking lot, sidewalk,
and flower beds are filled with litter from both establishments. The loitering in front of
both businesses is excessive. There is also a panhandling issue. The rescue squad
has been called numerous times for people passing out in front of the businesses.
People are allowed to loiter in Dunkin Donuts as well. Stereos from cars parked in
front of the businesses rattle windows in the residential building. The bus stop near
the building also contributes to loitering.
Stacy Callies - 633 W Wisconsin Ave - Director of Westown Association - The
association is in opposition of the extended hours for both businesses. Both are
detrimental to the quality of life in the area. There is aggressive panhandling and
loitering. At a recent condo association meeting, residents stated they would not
have purchased condos had they known of the issues from the establishments.
Stacey Snap - 606 W Wisconsin Ave #501 - She states she is woken up several
times a night by noise from people yelling or music from cars. She states the noise is
generally in front of the store. She has observed people who are not customers
sitting inside of Dunkin Donuts.
Maryann Steele - 8704 37th Ave, Coss Park, Maryland - She owns a unit at 606 W
Wisconsin Ave. She is panhandled every time that she comes to visit.
Cynthia Cordell - 606 W Wisconsin Ave #1802 - She agrees with previous speakers.
She states she has had panhandlers follow her and ask for her to use her debit card
when she states she has no change. Panhandlers use both businesses when they
obtain money. She would feel more comfortable with security, but security wouldn't
be necessary if the businesses weren't open
Dr Linda Tim - 606 W Wisconsin Ave #1301 - The area has declined in front of the
businesses. She no longer uses the exit from her building on Wisconsin Ave. She
moved downtown to be able to walk around, but it is uncomfortable to walk in the
area. She hears noise from the thirteenth floor.
Individuals appearing in support:
Kenneith Nicks - 610 W Wisconsin Ave - He has lived there for eight years. The two
bus stops on the block are hangout spots and the businesses can't prevent that.
Arthur Scott - 610 W Wisconsin Ave - He has lived there for ten years and likes
having a convenient store downstairs. He states there is a lot of traffic, but the
problem can be solved by increasing security and cameras.
David Markward - 610 W Wisconsin Ave - He has never had any problems with
forceful panhandlers. Having the stores open during extended hours is convenient
for him.
Lena Arkham - 610 W Wisconsin Ave - Apt 24 - She has worked at the establishment
for two years. She regularly asks people who are not customers to leave both
locations. She has asked police to remove people sleeping from the back of the
building. They are taking steps to correct the problem. The applicant was not aware
of recent issues, as she had been ill.
Heka Patel - 610 W Wisconsin Ave - She was the manager of both establishments.
She states the panhandlers come from the bus stop and are not customers.
Ravid Redimasuhadi - 610 W Wisconsin Ave - He has observed problems on the
block but does not attribute them to the businesses.
Ald. Stamper moved to make a map of residential units submitted by Ms. Callies part
of the record - Exhibit #1. (Prevailed 5-0)
Ald. Bauman present at the table. He states the block has an extensive problem with
loitering. Some may come from the bus stops, but the majority comes from the
establishments. There are bus stops all around the downtown area that do not have
similar issues. The problem has intensified over the last two to three years.

charges against the bar are being challenged. This was an isolated incident and a
family issue. She advised the applicant to tell police to get a search warrant to obtain
the video. The second incident occurred during a private party after the bar closed.

Officer Michael Anderson - He investigated the July 18th incident. A service worker
observed a woman unconscious on the floor with the applicant's husband, Mr.
Contreras, sweeping up glass. The worker then called 911. After police arrived, the
applicant then arrived on premises and gave them access to the security camera
footage. He observed four individuals on premise drinking. When he arrived, Mr.
Contreras was on premise with intoxicated individuals. There was broken glass and
spilled items on the floor. All individuals were uncooperative. The applicant arrived
on premise and offered access to security cameras. The video showed that Mr.
Contreras allowed patrons in after bar close time. The video also showed patrons
drinking after 3 AM. The woman who was assaulted and knocked out was 18 years
old.
Ald. Perez present at the table. He has concerns with the application because of
drinking after hours, minors in the establishment, an assault occurring, and the lack
of action taken after the assault. He is also concerned that both police incidents
occurred within the first year of operation.
