CHAMBER OF THE BOARD OF CITY COMMISSIONERS YANKTON, SOUTH DAKOTA DECEMBER 9, 2024 In the absence of the Mayor, the regular meeting of the Yankton City Commission was called to order by City Manager Leon at 7:00 p.m. Roll Call: Present: Commissioners Benson, Hunhoff, Miner, Moser, Villanueva, and Webber. City Attorney Den Herder, City Manager Leon, and Finance Officer Yardley were also present. Absent: Commissioners Brunick, Carda, and Mayor Schramm. Quorum present. City Manager Leon requested nominations for the office of acting Mayor for the ensuing meeting. Action 24-348 Moved by Commissioner Benson, seconded by Commissioner Miner, that nominations cease and a unanimous ballot be cast for Commissioner Moser for acting Mayor Pro Tem for the meeting of December 09, 2024. All present voted aye; motion carried, 6-0. City Manager Leon turned the meeting over to Mayor Pro Tem Moser at this time. City Manager Leon submitted a written report giving an update on community projects and items of interest. Lucas Johnson from Banner Engineering gave a presentation on their Bridge Inspection Report. Banner reviewed all twelve bridges and found two of these to be in poor condition (Cedar & 23rd St). These two bridges currently have a weight restriction and are on the capital improvement plan. Consideration of Memorandum #24-255 with verbal corrections recommending that the City Commission approve the renewal of Mobile Home Park Licenses for 2025. 2. Consideration of Memorandum #24-263 recommending that the City Commission approve the renewal of applications for Private Collector of Refuse (aka Commercial collector of Solid Waste) licenses for the 2025 annual licensing period. 3. Consideration of Memorandum #24-267 recommending that the City Commission approve the adult oriented business license application from Zebra Club and Cockatoo Bar for the 2025 annual licensing period. RESOLUTION #24-66 BRIDGE IMPROVEMENT GRANT PROGRAM RESOLUTION AUTHORIZING SUBMISSION OF APPLICATIONS December 9, 2024 Page 6 WHEREAS, City of Yankton wishes to submit an applications for consideration of award for the Bridge Improvement Grant Program, and; STRUCTURE NUMBERS AND LOCATIONS: SN 68-121-204 on Cedar Street in Yankton, SD WHEREAS, City of Yankton agrees to pay the 50% match on the Bridge improvement Grant funds and 100% of ineligible expenses, and; WHEREAS, City of Yankton hereby authorizes the Bridge Improvement Grant applications and any required funding commitments, and; NOW THEREFORE BE IT RESOLVED that the South Dakota Department of Transportation be and hereby is requested to accept the attached Bridge Improvement Grant applications. RESOLUTION #24-65 ADDENDUM TO SALES TAX AGREEMENT AND DEVELOPMENT AGREEMENT WHEREAS, SDCL permits a municipality to enter into agreements pertaining to sales tax reimbursements, and WHEREAS, on September 12, 2016 the Yankton Board of City Commissioners approved a partial sales tax reimbursement agreement to help facilitate the development of a specific portion of a retail site at 100 Douglas Avenue then known as the Big River Burrito Company owned by IHAH, LLC located on property legally described as Lots Seven (7), Eight (8) and Nine (9), Block 1, Lower Yankton Addition to the City of Yankton, South Dakota, and WHEREAS, the Board of City Commissioners desires to amend said agreement to include three locations owned by IHAH, LLC as described below: • 1917 Broadway Avenue (formerly at 100 Douglas Avenue). Action 24-361 Moved by Commissioner Webber, seconded by Commissioner Villanueva, to approve the request to relocate the holiday tree and redesign the public space surrounding the Capitol Building with a “not to exceed” amount of $30,000 to be expended from the BBB fund in 2025, and relocate the tree lighting ceremony to the east side of the Capitol Building once the project is complete. Action 24-362 Moved by Commissioner Villanueva, seconded by Commissioner Benson, to approve the purchase of two (2) 2025 Dodge Durango SUV’s plus installation and parts in the amount approximately $135,639.92 for the Yankton Police Department, Patrol Division, from Broadway Motors of Yankton, South Dakota for the same price of the state bid contract, and approve Resolution #24-67 to declare surplus and trade in listed vehicles. (Memorandum 24-265) All present voted aye; motion carried, 6-0. RESOLUTION #24-67 WHEREAS, SDCL 6-13-1 requires a municipality owning personal property which is no longer necessary, useful, or suitable for municipal purposes shall, by resolution, declare it surplus and may, by resolution, order the sale, trade, destruction or other disposals of said personal property. OFFICE OF THE CITY MANAGER www.cityofyankton.org VOL. 59 NUMBER 22 Commission Information Memorandum The Yankton City Commission meeting on Monday, December 9, 2024 will begin at 7:00 pm. Non-Agenda Items of Interest 1) Finance Department Update The 2025 holiday recycling calendar is planned to be mailed with our December 17th utility bills. Copies of the calendar are available now at the Finance Office. The Finance Office continues to work on licenses that will renew for January 1, 2025. Finance received notice from the Yankton County Auditor that the City’s allowable 2025 tax levy is $3,360,856 (compared to $3,225,337 in 2024). The approved Budget Ordinance 1083 requested $3,354,350 in Section VI-Tax Levy. This extra $6,506 in revenue is still able to be obtained and we have requested for the County Auditor to levy the full total allowable amount. Please see the enclosed Finance Monthly Report for November 2024. 2) Human Resources & Employee Engagement Department Update The position of Transfer Station Attendant closed on Sunday, November 24. Interviews are scheduled and a recommendation for hire will be forthcoming. We are currently accepting applications for the position of Water Distribution/Wastewater Collection Operation Specialist in our Environmental Services Department. Applications will be accepted until filled. Well 365’s December presentation will focus on Tips to Keep Your New Year’s Resolution. The goal of the presentation is to help employees get started in the right direction of good habits for 2025. December’s wellness challenge is underway. Employees are challenged to get 60 minutes of exercise each day for 20 days this month. Employees are asked to submit their log at the end of the month to be entered into a drawing for a prize. The gingerbread house decorating contest was held on December 5. Teams from different departments competed for bragging rights for the best house. The City of Yankton Employee Christmas party was held on December 6 at Meridian Venue. A BIG thanks to Meridian Venue, Counterfeit Catering, Mojo’s Bar, and to our emcee Jeff Erickson for making the party a success. 1 3) Parks & Recreation Department Update An update on the various activities in the Parks & Recreation Department is included in this packet. 4) Police Department Update On November 26, a total of 28 first responders from around the state, including some from YPD, attended training on peer support and critical incident stress management. This training was to teach first responder leaders on how to recognize signs that staff members are struggling to deal with incidents they respond to. This mental health session was paid for by the department and reimbursed by the State’s Heroes Wellness Grant. Chief Foote, Sheriff Crissey, and State’s Attorney Larson sent a letter to vape shops in Yankton to prevent them from selling THC products. Those shops had until December 1 to get the products off their shelves, otherwise YPD will charge fines. YPD provided extra traffic control at the Holiday Festival of Lights on December 5. Officers also had a float in the parade in which they displayed a cardboard replica of the Meridian Bridge. Children of some of the officers rode on the float, driving mini ride-on police cars. 5) Public Works Department Update Street Department crews are routing and crack filling joints on the asphalt streets throughout town. Crews are also hauling grass and leaves from grass pile to the compost pad at the Transfer Station. The street sweepers are also in operation with the mild weather. Christmas Day Holiday Garbage & Recycling Collection Schedule: There will be no solid waste collection on Tuesday, December 24th and Wednesday, December 25th, due to the Christmas holiday. All Monday and Tuesday routes will be collected on Monday, December 23rd, and all Wednesday and Thursday routes will be collected on Thursday, December 26th. All other routes will be collected as scheduled. The Transfer Station will be open shortened hours, from 8:00 A.M. to 1:00 P.M. on December 24th, and closed on Wednesday, December 25th. The City of Yankton reminds residents that wrapping paper, holiday cards, styrofoam, and packing peanuts cannot be placed in the recycle cart for pickup. Wrapping paper and cards most often have glitter or other decorative objects that are not recyclable. If any of these items are with your recycling, they will not be picked up. The above items need to be placed in your regular garbage. The City of Yankton thanks the residents for their cooperation. New Year’s Day Holiday Garbage & Recycling Collection Schedule: There will be no solid waste collection on Wednesday, January 1, 2025, due to the New Year’s holiday. All Tuesday and Wednesday routes will be collected on Tuesday, December 31, 2024. All other routes will be collected as scheduled. The Transfer Station will be closed on Wednesday, January 1, 2025. The City of Yankton will have a one-time pickup of live Christmas trees on Monday, January 6th, 2025. The City is asking Yankton residents to place live Christmas trees by the front curb no later than 7:00 A.M. on Monday, January 6th, 2025, as there will be no live Christmas tree pick up in alleys. In addition, there will be a live Christmas tree drop-off point for Yankton residents at the after-hours yard waste location at the east gate of the Transfer Station. Live Christmas trees can also be taken to the Yankton Transfer Station during regular business hours of Monday through Friday from 8:00 A.M. to 3:45 P.M., and on Saturday from 8:00 A.M. to 11:45 A.M. 2 2024 Projects: Other than some minor unfinished items and/or warranty work, the 2024 street projects are complete. It was another successful year for street projects, and staff are pleased to have completed them before the winter season hit. 2025 Projects: The engineering department has transitioned into the 2025 projects. Staff have been working on design, as time allowed, as the 2024 projects were finishing up. It looks like the 2025 season will be as active as the 2024 season. 6) Community & Economic Development Department Update The Event Central announcement at the last meeting is a good reminder about the public private partnerships and confidentiality needed to help make projects happen. Staff periodically gets requests from private citizens and the media about our knowledge of new businesses coming to town or new private project development. The Community Development Department, Finance Office or City Manager’s Office will only provide the information or name of the business if we have documentation such as a permit issuance on file. This is sometimes awkward because businesses have applied for permits prior to their announcement to the public. However, we provide the information because it is a “public record” at that point. The issue becomes even more sensitive when there is a request about something staff may have knowledge of, but there have not been any written requests for permits or City services. In those instances, we do not disclose anything. This sometimes leads to situations where the general public may end up having knowledge of a new business coming to town and we ethically can’t discuss it, if asked. We will continue to be respectful of the confidentiality of new business prospects interested in the community even if it means “word on the street” may be ahead of the staff’s ability to publicly discuss any details. It is important for the private sector to have confidence in our ability to play the appropriate guidance and support role. It would not be appropriate for us to make initial announcements about private sector business investments. 7) Library Update “Books Are Just the Beginning” is the slogan we work with in all we do. We check out about 11,000 books each month in a variety of formats including digitally. That is truly just the beginning. This year we will have offered over 500 programs with more than 10,000 attendees. Our partners, such as the South Dakota Humanities Council, Parks and Rec, the Mead Museum, Yankton Area Arts, and our Friends of YCL, have made all of these possible. We are already hard at work planning more great offerings in 2025. We will wrap up 2024 with a full event calendar with offerings for all ages. During the holiday school break we will offer BINGO for a Book, Board Games, Craft Buffet and our third annual Noon Year’s Eve Party. As always, check our Facebook page for the latest info on more fun events, book recommendations, and all things library related! 8) Fire Department Update On November 24, the fire department responded to a structure fire in the trailer courts at 2800 Broadway Avenue. Initial units arrived to find a single-wide trailer on fire and one person unaccounted for. Volunteers performed an aggressive search and fire attack, bringing the fire under control in about 30 minutes. Fortunately, no occupants were inside, but unfortunately, a cat perished in the fire. Strong north winds and heavy contents inside and outside the structure made firefighting a challenge. The Vermillion Fire Department assisted with the investigation as part of an initiative to share resources and develop beneficial relationships for the citizens of both cities. The fire department received 50 smoke detectors via a grant from the South Dakota Department of Public Safety. These detectors will be distributed throughout the year. The occupant of the 2800 3 Broadway fire mentioned above did not have a working smoke detector in his home. The department is developing strategies to ensure every person in the City is protected by at least one working smoke detector. Deputy Chief Prendable will attend a class in Sioux Falls this week on sprinkler and fire alarm acceptance testing. This training falls within the scope of his Fire Marshal duties and aims to enhance the department's capabilities in these areas. 9) Information & Technology Services Department Update We have updated digital copiers to new machines at City Hall, Finance, Police and Summit Activities Center. We are continuing to have issues with BluePeak services at the Summit Activities Center. The phone and internet issues appear to be resolved but we are having issues with the cable television services. We will continue to work with them to get the issues resolved. 911 stats for November are incomplete. Due to a logging issue with the software, we are missing about ten days of call data for November. Call volume will appear dramatically lower but in looking at individual station logs it appears consistent with monthly totals. 10) Environmental Services Department Update The wastewater project continues to move forward. Excavation for the new basin is complete. John T. Jones has completed some of the concrete base for the new basin. The excavation also revealed some debris under the existing basins. The new operation will require roughly 20% more volume of product to be stored in the existing basins. With the additional volume and weight, the structural 4 engineers are not able to confidently design a footing for the existing basins without more information on the amount debris under the existing basin. The contractor will have to expose the subgrade below the entire south wall of the existing basin to determine the extent of the debris. At some point each basin will have to be taken out of service to reduce the weight, and excavation and debris removed from under each basin. At that time structural engineers will be able to determine the type and depth of footing that will need to be added. The contractor set up a well pump in the well at Westside Park. The well was originally a free flowing well but has not flowed consistently for many years. The original well had a solid casing down until it hit shale or bedrock. From that point on, the well was not cased. Over time, the portion of the well below the shale had begun to collapse. The material is a very fine sandstone that allows only a minimum amount of water to flow compared to a coarse sand or gravel formation. A well screen was installed to prevent the bottom portion of the well from completely collapsing. Because the sandstone particles are very small, the well screen is very fine screen to hold the materials back. The fine material and fine well screen do increase the potential for material to plug the well screen. Because of the high potential for plugging, it is important to keep flow rates as low as possible to maintain the life of the well. 11) Monthly reports The Building, Salary and Yankton Police Department monthly reports are included for your review.
