17051 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, November 13, 2017, at 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Alan Johnson, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, and Dave McNeil. Mayor Levsen led the Pledge of Allegiance. MINUTES Rux moved, Bunsness seconded to approve the minutes of November 6, 2017, as circulated. All voting aye, motion carried. OPEN FORUM – No one was present. CONSENT CALENDAR Ronayne moved, Lunzman seconded to approve the following items on the consent calendar: PETITION OF VOLUNTARY ANNEXATION – for Lot 16, Block 3, Wylie Park Estates Fourth Addition to Aberdeen, Brown County, South Dakota and the adjacent 33’ of Birch Drive Right-Of-Way (1606 Birch Drive) – refer to City Attorney, City Engineer, and City Planning/Zoning Director for review and recommendations. SET JOINT HEARING DATE – of November 28, 2017 at 8:45 a.m. in Brown County Commission Chambers for a hearing on a petition to rezone from (A-1) District and (M-AG) District to (M-AG) District for Lot 1, Hedges’ Second Subdivision in the NE ¼ of Section 26, T124N, R64W of the 5th P.M., Brown County, South Dakota (12849 – 387th Avenue). SET HEARING DATE – of November 20, 2017 at 5:30 p.m. in City Council Chambers for a hearing on an application for a Special Four-Day Retail On-Sale Liquor License on November 22 – 25, 2017 for ACT2, Inc. dba Aberdeen Community Theatre, 417 South Main Street. LOTTERY NOTICE – James Valley Model Railroad Association – receive and place on file. All voting aye, motion carried. NEW BUSINESS RESOLUTION NO. 17-11-01R City Planning/Zoning Director Brett Bill presented a petition from Northern State University to vacate public right-of-way for property described as the North 6’ of 14th Avenue, SE Public Right-Of-Way adjacent to Lot 1, R.E. Huffman Outlots commencing at the East Right-Of-Way line of State Street South and continuing East 1,116’ to the West Right-Of-Way line of Dakota Street South. Ronayne moved, Remily seconded to approve Resolution No. 17-11-01R to vacate the public right-of-way on 14th Avenue, SE between South State Street and South Dakota Street. All voting aye, motion carried. HEARING ON TRANSFER OF LIQUOR LICENSES This being the time and place set for a hearing on applications for the transfers of Retail On-Sale Liquor and Package Off-Sale Liquor Licenses from Ronald J. Rivett at 2020 – 8th Avenue, NE Suite #11 to Rivett Lodging Aberdeen, LLC at 2405 – 6th Avenue, SE, recommendations to approve contingent upon inspections by the Health and Fire Departments were received. Remily moved, Ronayne seconded to approve the transfers of the Retail On-Sale Liquor and Package Off-Sale Liquor Licenses from Ronald J. Rivett at 2020 – 8th Avenue, NE Suite #11 to Rivett Lodging Aberdeen, LLC at 2405 – 6th Avenue, SE contingent upon inspections. All voting aye, motion carried. ADDENDUM TO ANIMAL CONTROL AGREEMENT City Manager Lynn Lander explained a request for an addendum to the Animal  17052 Control Shelter Agreement with the operator, Bonnie Bitz, for the rental of the dog pound and for animal control services. Remily moved, Bunsness seconded to approve the addendum to the agreement for rental of dog pound and for animal control services increasing the rates to the operator effective January 1, 2018 and to authorize the City Manager to execute the addendum. All voting aye, motion carried. BID LETTING ON THIRD AVE BRIDGE PROJECT City Engineer Robin Bobzien presented the Bid Letting Authorization to allow the SD Department of Transportation to do the bidding on the Third Avenue Bridge Project No. BRF 2306(00)16-3 PCN 05R5 and to acquire state and federal funding as necessary. Rux moved, Olson seconded to approve the Bid Letting Authorization for the Third Avenue Bridge Project. All voting aye, motion carried. PAYMENT FOR WATER RECLAMATION FACILITY PROJECT City Engineer Robin Bobzien presented a payment request from Industrial Process Technologies in the amount of $80,820.90 for work on the Water Reclamation Facility 2016 Improvements Project. Bunsness moved, Johnson seconded to approve the Payment Request #7 in the amount of $80,820.90 to Industrial Process Technologies. Upon roll call, all voting aye, motion carried.
