17122 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, February 20, 2018, at 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. City Councilor Alan Johnson was absent. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, and Dave McNeil. Mayor Levsen led the Pledge of Allegiance. MINUTES Rux moved, Bunsness seconded to approve the minutes of February 12, 2018, as circulated. All present voting aye, motion carried. OPEN FORUM – No one was present. OLD BUSINESS REQUEST TO OCCUPY RIGHT OF WAY AT 224 SOUTH MAIN ST. A discussion on a request that was continued from last week’s Council Meeting for permission to occupy the right of way at 224 South Main Street, Dakota Territory Brewing Company, for a basement egress stairwell was presented. Bunsness moved, Rux seconded to approve the occupancy of the right of way at 224 South Main Street with a stairwell to access the basement of the building and authorize the City Attorney to prepare the property instrument for such permission as long as the occupancy of the right of way is needed. All present voting aye, motion carried. CONSENT CALENDAR Olson moved, Remily seconded to approve the following items on the consent calendar: SET BID DATE – of March 6, 2018 at 2:00 p.m. for an advertisement for bids on the 8th Ave., NW Street Reconstruction Project (ST-2018-1). LICENSES – Residential Building Contractor – Todd Cunningham dba GC Builders; Residential Building Contractor – Schumacher Seamless Gutters; Taxi Cab Driver – Gregory Ketterling; Taxi Cab Driver – Manuel Rodriguez. REQUEST PERMISSION – to serve and permit the consumption of alcoholic beverages at the Wylie Park Pavilion for a Sitter Family Reunion on June 2, 2018. All present voting aye, motion carried. NEW BUSINESS PROPERTY TAX REFUND City Finance Officer Karl Alberts presented a request for a property tax refund for 214 North Lincoln Street, owned by Richard Cleland, due to a missed tax freeze deadline according to the Brown County Auditor’s Office. Ronayne moved, Bunsness seconded to approve a property tax refund in the total amount of $718.23 of which City’s share being $226.60. All present voting aye, motion carried. DECLARE SURPLUS PROPERTY FOR SALE City Engineer Robin Bobzien presented a request from the Public Works Department to declare surplus property a circle equipment part for a 770 John Deere Grader and allow the equipment part to be offered for sale. Ronayne moved, Remily seconded to approve the request to declare as surplus property a circle equipment part for a 770 John Deere Grader and to offer this equipment part for sale on sealed bids. All present voting aye, motion carried. CHANGE ORDER/PAYMENT FOR S. 2ND ST. TRAFFIC SIGNAL PROJECT City Engineer Robin Bobzien presented Change Order #1 decreasing the contract amount by ($13,000.00) and Payment Request #1 in the amount of $31,940.00 to Efraimson  17123 Electric Inc. for work on the South 2nd St. Traffic Signal Poles and Mast Arms Project (TRAFFIC-2017-1). Slaight-Hansen moved, Remily seconded to approve and authorize the City Manager to sign Change Order #1 in the amount of ($13,000.00) and Payment Request #1 in the amount of $31,940.00 to Efraimson Electric Inc.
