JOINT CITY COUNCIL/COUNTY COMMISSION PROCEEDINGS
City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South
Dakota, April 23, 2018, at 5:30 p.m., Joint City Council and County Commission Meeting.
Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Alan
Johnson, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, Rob Ronayne by teleconference
call, and Clint Rux. City Councilor Jennifer Slaight-Hansen was absent. Brown County
Commissioners present were Nancy Hansen, Duane Sutton, and Rachel Kippley. Brown County
Commissioners Tom Fischbach and Doug Fjeldheim were absent. City Staff present were Lynn
Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, and Chris Gross. County Auditor
Maxine Fischer was present.
Mayor Levsen ledge the Pledge of Allegiance.
ORDINANCE NO. 18-04-02
City Planning/Zoning Director Brett Bill presented a petition from Alan and Debra
Neitzel and an Ordinance No. 18-04-02 to rezone property described as proposed Lot 1, Neitzel
First Subdivision in the NW ¼ of Section 6, T123N, R63W of the 5th P.M., Brown County,
South Dakota (3060 North Dakota Street) from (R-1) Low Density Residential District, (M-
AG) Mini-Agricultural District, and (A-1) Agricultural District to (M-AG) Mini-Agricultural
District. Rux moved, Johnson seconded to approve first reading of Ordinance No. 18-04-02 as
presented. Upon roll call, all present voting aye, motion carried.
Sutton moved, Hansen seconded to approve first reading of Ordinance No. 18-04-02
(475) as presented. All present voting aye, motion carried.
There being no further business, Hansen moved, Sutton seconded that the meeting be

CITY COUNCIL PROCEEDINGS
City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South
Dakota, April 23, 2018, at 5:32 p.m., regular meeting of the Board of City Council Members,
Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Alan
Johnson, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, Rob Ronayne by teleconference
call, and Clint Rux. City Councilor Jennifer Slaight-Hansen was absent. City Staff present were
Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Chris Gross, and Bob Braun.
Mayor Levsen led the Pledge of Allegiance.
MINUTES
Rux moved, Olson seconded to approve the City Council Meeting minutes of April 16,
2018, as circulated. Upon roll call, all present voting aye, motion carried.
OPEN FORUM – no one was present.
OLD BUSINESS
ORDINANCE NO. 18-04-07
City Attorney Ron Wager asked the Council to consider changes to clarify Ordinance
No. 18-04-07 presented for second reading regarding Chapter 12 – Buildings and Building
Regulations. The following changes were made to the Ordinance: Section 12-162 – License
required. (b)(3) insert “when” after “property”; in Section 12-162 License required (b)(3)a.
insert “The homeowner” before “is present”; delete prefix “sub” in “subcontractor” from the
ordinance; and in Section 12-168 Penalties – delete “in violation of” insert “regulated under” and
insert “for such work or service and the person is not licensed as required under this article” after
“materials”. Johnson moved, Bunsness seconded to approve second reading as amended and
final adoption of Ordinance No. 18-04-07. Upon roll call, all present voting aye, motion carried.

Family Irrevocable Living Trust at the April 23, 2018 City Council Meeting.
PLATS – 1) Forsting First Addition to Aberdeen in the NE ¼ of Section 13, T123N, R64W of
the 5th P.M., Brown County, South Dakota (117 North Jay Street); 2) Rawstern-Avera St.
Lukes Consolidating Subdivision in the SE ¼ of Section 13, T123N, R64W of the 5th P.M.,
Brown County, South Dakota (321 South Kline Street); 3) S and S Nelson Addition to the City
of Aberdeen in the SW ¼ of Section 24, T123N, R64W of the 5th P.M., Brown County, South
Dakota (1615 South Lincoln Street); 4) Neitzel First Subdivision to the City of Aberdeen in the
NW ¼ of Section 6, T123N, R63W of the 5th P.M., Brown County, South Dakota with
stipulation that the accompanying petition to rezone is accepted (3030, 3060, and 3112 North
Dakota Street).

NEW BUSINESS
ORDINANCE NO. 18-04-01
City Planning/Zoning Director Brett Bill presented a petition from Mike Carrels of
Spike, LLC and an Ordinance No. 18-04-01 to rezone property described as Lot 1, Northwest
C-Express Addition to the City of Aberdeen in the NW ¼ of Section 13, T123N, R64W of the
5th P.M., Brown County, South Dakota (711 North 2nd Street) from (C-1) Neighborhood
Commercial District and (C-2) Highway Commercial District to (C-2) Highway Commercial
District. Remily moved, Rux seconded to approve first reading of Ordinance No. 18-04-01 as
presented. Upon roll call, all present voting aye, motion carried.
ORDINANCE NO. 18-04-09
City Attorney Ron Wager presented Ordinance No. 18-04-09 regarding restrictions and
service of municipally distributed water and explained the changes to Section 54 – Utilities of the
Aberdeen City Code. Bunsness moved, Rux seconded to approve first reading of Ordinance No.
18-04-09 as presented. Upon roll call, all present voting aye, motion carried.
HEARING ON SPECIAL LIQUOR LICENSE
This being the time and place set for a hearing on an application for a Special One-Day
Retail On-Sale Liquor License on May 5, 2018 for Hub Area Habitat for Humanity at the Wylie
Park Pavilion, no public comments received, Mayor Levsen closed the hearing. Remily moved,
Lunzman seconded to approve the Special One-Day Liquor License on May 5th for Hub Area
Habitat for Humanity at the Wylie Park Pavilion, 2306 – 24th Avenue, NW. Upon roll call, all
present voting aye, motion carried.
