Present at roll call were City Councilors David Bunsness, Alan Johnson, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen by teleconference call. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, and Angela Senger. Mayor Levsen led the Pledge of Allegiance. MINUTES Rux moved, Olson seconded to approve the minutes of May 7, 2018, as circulated. All voting aye, motion carried. PROCLAMATION Mayor Levsen read and proclaimed May 19, 2018 as “Kids to Parks Day”. OPEN FORUM – No one was present. CONSENT CALENDAR Bunsness moved, Johnson seconded to approve the following items on the consent calendar: DECLARE SURPLUS PROPERTY – City vehicles and miscellaneous items to be sold at the public auction to be held on May 18, 2018 at 5:30 p.m. at the Public Works Shop Area on 3rd Avenue, SW. The list of items is on file at the City Finance Office. LICENSE – Taxi Cab Driver – Lisa Anderson SET HEARING DATE – of May 29, 2018 at 5:30 p.m. for an application for Special One-Day Liquor License on July 12, 2018 for Aberdeen Area Chamber of Commerce’s Business After Hours on First Avenue, SE between South Main Street and Market Street with an application for a Community Event Permit. SET BID DATE – of June 5, 2018 at 2:00 p.m. for an advertisement for bids on a Perimeter Fence Project for the Water Reclamation Facility. PETITION OF VOLUNTARY ANNEXATION – for Lot 2, Neitzel First Subdivision in the NW ¼ of Section 6, T123N, R63W of the 5th P.M., Brown County, South Dakota (3030 North Dakota Street) – refer petition to City Attorney, City Engineer, and Planning/Zoning Director for review and recommendations. MOVING BOND DEPOSIT – of $500 for Glaesman Moving – receive and place on file. Upon roll call, all voting aye, motion carried. NEW BUSINESS RESOLUTION NO. 18-05-01R City Engineer Robin Bobzien requested approval of Resolution No. 18-05-01R accepting dedication of essential public facilities in HAPI 1st through 4th Central Subdivision from the developer Homes Are Possible, Inc. Ronayne moved, Rux seconded to approve Resolution No. 18-05-01R as follows: WHEREAS, Homes Are Possible, Inc., a South Dakota nonprofit corporation (hereafter referred to as the “Developer”), was the original owner of all of the subdivided real property in those certain recorded plats highlighted on the map attached hereto as Exhibit A and identified as follows (hereafter referred to as the “HAPI 1st – 4th Central Subdivision”): a. HAPI FIRST CENTRAL SUBDIVISION TO ABERDEEN; b. HAPI SECOND CENTRAL SUBDIVISION TO ABERDEEN; c. HAPI THIRD CENTRAL SUBDIVISION TO ABERDEEN; d. HAPI FOURTH CENTRAL SUBDIVISION TO ABERDEEN; and e. The public streets and rights-of-way contiguous and associated to such plats; and  17171 WHEREAS, HAPI 1st – 4th Central Subdivision is situated wholly within the real property legally described as: THE WEST HALF (W1/2) OF THE NORTHEAST QUARTER (NE ¼) OF SECTION 30, TOWNSHIP 123 NORTH, RANGE 63 WEST OF THE FIFTH P.M., BROWN COUNTY, SOUTH DAKOTA; and WHEREAS, Developer petitions, without compensation, to dedicate to the City of Aberdeen, a South Dakota municipal corporation, and for the City to accept for public use the following essential public facilities in rights-of-way, utility easements, and public grounds located wholly within the HAPI 1st – 4th Central Subdivision: a. Water system; b. Sanitary sewer system; c. Storm water drainage system, including the retention ponds located on LOT 1, BLOCK 2, HAPI THIRD CENTRAL SUBDIVISION TO THE CITY OF ABERDEEN and LOT 16, BLOCK 2, HAPI FOURTH CENTRAL SUBDIVISION TO THE CITY OF ABERDEEN; d. Streets; and e. Curb and gutter. WHEREAS, said essential public facilities are in conformance with the applicable subdivision regulations and meet engineering and construction standards established by the City Engineer. NOW, THEREFORE, BE IT RESOLVED that the City of Aberdeen hereby appropriates and accepts the following dedicated essential public facilities in the HAPI 1st – 4th Central Subdivision: a. Water system; b. Sanitary sewer system; c. Storm water drainage system, including the retention ponds located on LOT 1, BLOCK 2, HAPI THIRD CENTRAL SUBDIVISION TO THE CITY OF ABERDEEN and LOT 16, BLOCK 2, HAPI FOURTH CENTRAL SUBDIVISION TO THE CITY OF ABERDEEN; d. Streets; and e. Curb and gutter. BE IT FURTHER RESOLVED that those dedicated public facilities specified above shall hereafter become the property of the City free from all claims from any person or entity and that this Resolution shall operate as a conveyance of each accepted public facility and that each accepted public facility placed within a public or platted right-of-way or dedicated public easement is irrevocably dedicated to the public use without any right of reimbursement or compensation to Developer of any kind; and BE IT FURTHER RESOLVED that Developer shall have no claim, direct or implied, in the title or ownership of the public facilities dedicated to and accepted by the City and that the City hereby takes full title to the public facilities. BE IT FURTHER RESOLVED that the City hereafter shall enter upon and assume the use, operation, and maintenance according to law of those essential public facilities accepted herein. BE IT FURTHER RESOLVED that the Mayor and City Manager are hereby authorized to execute, and the Finance Officer is authorized to accept, all deeds and instruments necessary to convey the above-described essential public facilities to the City. Upon roll call, all voting aye, motion carried. REQUEST TO LOCATE POLE IN RIGHT-OF-WAY Planning/Zoning Director Brett Bill presented a request by Northwestern Energy for a  17172 license to locate a pole in the right-of-way adjacent to 405 North Commerce Street for advanced metering infrastructure. He stated that the Zoning Board of Adjustment approved the request with stipulations that Northwestern Energy obtain a license from the City Council to occupy the public right-of-way, required permits be obtained prior to construction, and that Northwestern Energy be responsible for maintenance and liability of the structure. Remily moved, Ronayne seconded to approve the request by Northwestern Energy for a license to locate the pole within the public right-of-way at 405 North Commerce Street with stipulations recommended by the Zoning Board of Adjustment. Chelsea Sheridan with Clark Engineering was present to describe the project and answer questions from the Council. Upon roll call, Bunsness, Johnson, Lunzman, Remily, Ronayne, Rux, Slaight-Hansen, and Mayor Levsen voting aye, Olson voting nay, motion carried.
