17217 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, July 9, 2018 at 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Council Members David Bunsness, Alan Johnson, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, and Jennifer Slaight-Hansen. City Council Member Clint Rux was absent. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Dave McNeil, Shirley Arment, Cody Roggatz, and Tom Wanttie. Mayor Levsen led the Pledge of Allegiance. MINUTES Johnson moved, Bunsness seconded to approve the minutes of July 2, 2018, as circulated. All present voting aye, motion carried. OPEN FORUM – No one was present. CONSENT CALENDAR Remily moved, Ronayne seconded to approve the following item on the consent calendar: REQUEST FOR STREET USE – alley on 5th Avenue, SW to South Main Street by Malchow’s Furniture Store on July 13th from 5:00 a.m. to 6:00 p.m. on July 14th for Crazy Days. NEW BUSINESS RESOLUTION NO. 18-07-01R City Planning/Zoning Director Brett Bill presented Resolution No. 18-07-01R for annexation of 1.98 acres described as proposed Lot 1, Steele-Teigen Addition in the NW ¼, SW ¼, of Section 16, T123N, R63W of the 5th P.M., Brown County, South Dakota (115 Brown County 19 South) into the city limits of the City of Aberdeen. Johnson moved, Remily seconded to approve Resolution No. 18-07-01R to annex the property for Loren D. Steele into the city limits. All present voting aye, motion carried. RESOLUTION NO. 18-07-02R City Planning/Zoning Director Brett Bill presented Resolution No. 18-07-02R for annexation of 58.5 acres described as the SE ¼ of the NW ¼ and West 640’ of the SW ¼ of the NE ¼ (except the North 250’ thereof) and the North 100’ of the East 1200’ of the NE ¼ of the SW ¼ , all in Section 20, T123N, R63W of the 5th P.M., Brown County, South Dakota (East of Willowwood Subdivision) into the city limits of the City of Aberdeen. Olson moved, Bunsness seconded to approve Resolution No. 18-07-02R to annex the property for Lamont Development, Stiles & Byron, LLC, and Lamont Enterprises Limited Partnership into the city limits. All present voting aye, motion carried. HEARING ON SPECIAL LIQUOR LICENSES FOR ADA This being the time and place for a hearing on applications for Special One-Day Retail On-Sale Liquor Licenses on July 12th, August 9th, August 24th, and August 25th for Aberdeen Downtown Association Events and requests for Community Event Permits, Mayor Levsen opened the hearing, no public comments were received, Mayor Levsen closed the hearing. Remily moved, Lunzman seconded to approve Special Liquor Licenses and Community Event Permits for Aberdeen Downtown Association as follows: Special Liquor Licenses and Community Event Permits for July 12th and August 9th for the Summer Concert Series on South Main Street from Railroad Avenue to 1st Avenue; Special Liquor Licenses and Community Event Permits for August 24th for the Summer Concert Series and August 25th for Sizzlin Summer Nights both on 3rd Avenue SE/SW to Alleys off of South Main Street; a Community Event Permit for Crazy Days on July 14th on Main Street from 6th Avenue to 2nd Avenue; and a Community Event Permit for Collegepalooza on August 28th on South Main Street from 3rd Avenue to 5th Avenue with street closings as requested. All present voting aye, motion carried.  17218 HEARING ON MALT BEVERAGE-WINE LICENSE FOR NATURAL ABUNDANCE This being the time and place set for a hearing on an application for a new Retail On-Off Sale Malt Beverage and SD Farm Wine License for Natural Abundance Cooperative at 112 North Main Street, Suite #2, Mayor Levsen opened the hearing, no public comments were received, Mayor Levsen closed the hearing. Ronayne moved, Remily seconded to approve the new Retail On-Off Sale Malt Beverage and SD Farm Wine License for Natural Abundance Cooperative at 112 North Main Street, Suite #2. All present voting aye, motion carried. COMMUNITY EVENT PERMIT FOR NSU Remily moved, Johnson seconded to approve the application for a Community Event Permit for Northern State University’s Gypsy Day Parade on September 29th on Main Street with street closings from North Main Street and 15th Avenue North through downtown Main Street to 12th Avenue South from 6:00 a.m. to 1:00 p.m. All present voting aye, motion carried. 2018 BUDGET SUPPLEMENT FOR LIBRARY City Manager Lynn Lander presented a request for a 2018 Budget Supplement for adding afternoon hours on Sundays for the K.O. Lee Aberdeen Public Library that was approved by the Library Board of Trustees. Lander asked the Library Board of Trustees to explain the Plan #1 Request to the Council for a budget supplement in the amount of $13,845.79 to finance the cost of salaries which includes hiring an extra full-time library technician who would work 5 hours on Sunday as part of their 40 hour weekly schedule and hiring four part-time staff for 4 hour shifts. Library Director Shirley Arment was present to discuss the request. After the discussion, no action was taken by the Council. PAYMENT FOR PERMANENT EASEMENT FOR WEST WATER LOOP City Engineer Robin Bobzien presented a request for payment to Trevor Lien in the amount of $5,089 for a permanent easement on the East 50’ of the SE ¼ of Section 15, T123N, R64W of the 5th P.M., in Lien Outlot A in the SW ¼ of Section 14, T123N, R64W of the 5th P.M., and the SE ¼ of Section 15, T123N, R64W of the 5th P.M., Brown County, South Dakota for installation and maintenance of utilities on the West Water Loop Project. Bunsness moved, Olson seconded to approve the payment of $5,089 to Trevor Lien for the permanent easement. Upon roll call, all present voting aye, motion carried. CHANGE ORDER/PAYMENT FOR ACCESS QUADRANT PROJECT City Engineer Robin Bobzien presented a change order in the amount of $33,163.34 and a payment request in the amount of $63,711.39 to CWF Masonry & Construction for work performed on the Accessible Quadrant Improvements Project (CONC-2018-2). Bunsness moved, Olson seconded to approve and authorize the City Manager to sign Change Order #1 in the amount of $33,163.34 and Payment Request #2 in the amount of $63,711.39 to CWF Masonry & Construction. Upon roll call, all present voting aye, motion carried. PAYMENT FOR THIRD AVE. SE STREET PROJECT City Engineer Robin Bobzien presented a payment request in the amount of $253,758.60 to Sharp Enterprises for work on the Third Ave., SE Street Improvements. Johnson moved, Slaight-Hansen seconded to approve and authorize the City Manager to sign Payment Request #1 in the amount of $253,758.60 to Sharp Enterprises.
