17228 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, July 23, 2018 at 5:30 p.m., regular meeting of the Board of City Council Members, Deputy Mayor Rob Ronayne presiding. Present at roll call were City Council Members David Bunsness, Alan Johnson, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, and Clint Rux. Mayor Mike Levsen and City Council Member Jennifer Slaight-Hansen were absent. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, and Dave McNeil. Deputy Mayor Ronayne led the Pledge of Allegiance. MINUTES Bunsness moved, Rux seconded to approve the minutes of July 16, 2018, as circulated. All present voting aye, motion carried. OPEN FORUM – No one was present. CONSENT CALENDAR Remily moved, Olson seconded to approve the following items on the consent calendar: SET HEARING DATE – of August 6, 2018 at 5:30 p.m. for an application for a Special Five- Day Retail On-Sale Liquor License on August 8 – 12, 2018 for ACT2, Inc. dba Aberdeen Community Theatre, 417 South Main Street. LICENSES – Private Security – Jarred Iron Horse; Residential Building Contractor – Jacob Merkel dba H & M Custom Coatings. PLATS – 1) Rolling Meadows Second Addition in the NE ¼ of Section 1, T123N, R64W of the 5th P.M., Brown County, SD (3510 Rolling Meadows Drive); 2) HARR Motors Second Subdivision to the City of Aberdeen in the SW ¼ of Section 16, T123N, R63W of the 5th P.M., Brown County, SD (4255 – 6th Avenue, SE); 3) CorTrust Bank Second Addition to the City of Aberdeen in the SE ¼ of Section 13 and the NE ¼ of Section 24, all in T123N, R64W of the 5th P.M., Brown County, SD (519 – 6th Avenue, SE); 4) Steele-Teigen Addition in the NW ¼, SW ¼, of Section 16, T123N, R63W of the 5th P.M., Brown County, SD (115 Brown County 19 South); 5) Kopetsky Addition to the City of Aberdeen in the NE ¼ of Section 13, T123N, R64W of the 5th P.M., Brown County, SD (518 North Kline Street). LOTTERY NOTICES – ACT2, Inc. dba Aberdeen Community Theatre; Sidney L. Smith American Legion Post #24 – receive and place on file. SET BID DATE – of August 7, 2018 at 2:00 p.m. for an invitation for bids on the Passenger Boarding Bridge for the Airport. All present voting aye, motion carried. NEW BUSINESS ORDINANCE NO. 18-07-01 City Planning/Zoning Director Brett Bill presented a petition to rezone from Bryan Fehr and Ordinance No. 18-07-01 to rezone property described as Lot 10, Block 10, North Aberdeen Addition in the NW ¼ of Section 13, T123N, R64W of the 5th P.M., Aberdeen, Brown County, SD (116 North First Street) from (C-3) Central Business District to (R-3) High Density Residential District. Remily moved, Johnson seconded to approve first reading of Ordinance No. 18-07-01 as presented. Upon roll call, all present voting aye, motion carried. REQUEST FOR PROPERTY TAX ABATEMENTS City Finance Officer Karl Alberts presented a request from the Brown County Auditor’s Office for approval of property tax abatements for 110 – 5th Curve in the amount of $273.91 of which City’s share is $79.68; for 213 – 6th Curve in the amount of $40.91 of which City’s share is $12.91; and for 1711 Melody Lane in the amount of $2,057.77 of which City’s share is $339.06. Bunsness moved, Olson seconded to approve the property tax abatements as requested. All present voting aye, motion carried. 17229 DECLARE SURPLUS PROPERTY City Manager Lynn Lander presented a request from the Fire Department for permission to declare a cardiac monitor surplus property to be donated to the SD District IV EMS Association. Remily moved, Rux seconded to approve the surplus of a cardiac monitor for donation to the SD District IV EMS Association. All present voting aye, motion carried. APPLICATION FOR COMMUNITY EVENT PERMIT An application was presented for a Community Event Permit for Fallout Creative Community and the Mayor’s Advisory Board for People with Disabilities for an ADA Celebration Event on July 27th with a street closing on South Main Street to the 2nd Avenue, SW Alley from 11:00 a.m. to 10:00 p.m. Rux moved, Lunzman seconded to approve a Community Event Permit for Fallout Creative Community and the Mayor’s Advisory Board for People with Disabilities for their ADA Celebration Event on July 27th as requested. All present voting aye, motion carried. CITY MANAGER’S REPORT Lynn Lander presented the City Manager’s Report including the 2018 Code Enforcement Nuisance Summary and City Engineer Robin Bobzien discussed the snow removal operations and snow gates. JOINT CITY COUNCIL/COUNTY COMMISSION PROCEEDINGS Brown County Commission Chambers, 25 Market Street, Aberdeen, South Dakota, July 24, 2018, at 8:45 a.m., Joint City Council/County Commission Meeting. Deputy Mayor Rob Ronayne presiding. Present at roll call were City Council Members Alan Johnson, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, and Clint Rux. Mayor Mike Levsen and City Council Members David Bunsness and Jennifer Slaight-Hansen were absent. Brown County Commissioners present were Tom Fischbach, Doug Fjeldheim, Nancy Hansen, Duane Sutton, 17230 and Rachel Kippley. City Staff present were Brett Bill and Karl Alberts. County Auditor Maxine Fischer was present. ORDINANCE NO. 18-07-02 A petition to rezone from Burt Elliot and Ordinance No. 18-07-02 was presented to rezone property described as Lot 14, Block 3, Moulton’s First Subdivision in the SE ¼ of Section 2, T122N, R64W of the 5th P.M., Brown County, SD (West of 13687 – 387th Avenue) from (A-1) Agricultural District to (M-AG) Mini-Agricultural District. Johnson moved, Rux seconded to approve first reading of Ordinance No. 18-07-02. Upon roll call, all present voting aye, motion carried. Fischbach moved, Hansen seconded to approve first reading of Ordinance No. 18-07-02 (478) as presented. All voting aye, motion carried. ORDINANCE NO. 18-07-03 A petition to rezone from Judy Hauge and Diane Tollefson and Ordinance No. 18-07-03 was presented to rezone property described as Lots 1 and 2, Peter Reinbold Exception in the SW ¼ of Section 2, T123N, R64W of the 5th P.M., Brown County, SD (1402 and 1412 – 24th Avenue, NW) from (C-2) Highway Commercial District to (R-2) Medium Density Residential District. Johnson moved, Lunzman seconded to approve first reading of Ordinance No. 18-07- 03. Upon roll call, all present voting aye, motion carried. Sutton moved, Kippley seconded to approve first reading of Ordinance No. 18-07-03 (479) as presented. All voting aye, motion carried. There being no further business, Rux moved, Remily seconded that the meeting be adjourned. All present voting aye, motion carried.
