17239 City Council met for a work session on Monday, August 13, 2018 at 5:00 p.m. in City Council Chambers to discuss the 2019 Budget Proposal. Present at the meeting were Mayor Mike Levsen and City Council Members David Bunsness, Alan Johnson, Dave Lunzman, Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. No action was taken by the Council. CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, August 13, 2018 at 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Council Members David Bunsness, Alan Johnson, Dave Lunzman, Dennis “Mike” Olson by teleconference call, Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Dave McNeil, Bob Braun, and Cody Roggatz. Mayor Levsen led the Pledge of Allegiance. MINUTES Bunsness moved, Remily seconded to approve the minutes of August 6, 2018, as circulated. Upon roll call, all voting aye, motion carried. OPEN FORUM – no one was present. CONSENT CALENDAR Ronayne moved, Remily seconded to approve the following items on the consent calendar: EXCAVATION BOND – of $2,000 for Sideline Pipe, LLC – receive and place on file. SET HEARING DATE – of August 27, 2018 at 5:30 p.m. for the following applications for alcoholic beverage licenses: 1) Special One-Day Retail On-Sale Liquor License on October 6, 2018 for Aberdeen Downtown Association dba Oktoberfest at Aberdeen Civic Arena, 203 South Washington Street; 2) Special One-Day Retail On-Sale Liquor Licenses for Aberdeen Chamber of Commerce on September 13, 2018 –Presentation College, 1500 North Main Street; October 11, 2018 – Pierson Ford-Lincoln-Mercury, 701 Auto Plaza; November 8, 2018 – Aberdeen Civic Arena, 203 South Washington Street. APPLICATION FOR COMMUNITY EVENT PERMIT – for “Delzer-Portra Get-Together” on September 15, 2018 at 3011 – 8th Avenue, NE #206 with a request for a time extension for the music until 11:00 p.m. Upon roll call, all voting aye, motion carried. NEW BUSINESS ORDINANCE NO. 18-08-01 City Attorney Ron Wager presented Ordinance No. 18-08-01 expanding the number of economic development projects eligible for a sales tax refund. Wager explained that the ordinance allows a 50 % sales tax rebate for qualifying projects that add at least $5 million in taxable value to the city’s property tax base; represent an investment in non-realty capital assets of not less than $10 million; or the combination of new construction and non-realty assets that exceed $10 million. The proposed Ordinance expands at Section 50-93 the number of projects eligible for a refund by requiring the project include new construction or equipment purchases of at least 20% of the requirements for large projects and that the projects will promote economic development in the City. In July, the Aberdeen Development Corporation had requested a tax rebate of up to 100% and authority to review project applications for sales tax refunds. Mike Bockorny, CEO of Aberdeen Development Corporation, spoke in favor of up to a tax refund of 100% on a case by case basis to expand tools to entice business expansion. Remily moved,  17240 Bunsness seconded to approve first reading of Ordinance No. 18-08-01 as presented. Ronayne moved, Remily seconded to amend the motion by striking the first sentence in Section 50-97 and replacing it with “The council by resolution may determine a refund up to one hundred percent (100%) of the sales and use taxes paid to the city with respect to an approved project. The refund shall be fifty percent (50%) of the sales and use taxes paid to the city with respect to the project.” Mayor Levsen and Council Members Olson, Remily, and Lunzman were in favor of Ronayne’s amendment. Bunsness spoke in opposition to giving a 100% sales tax rebate to businesses. Slaight-Hansen said she hasn’t heard enough from businesses on this issue and is voting against the ordinance amendment. Rux said he couldn’t support an amendment approving a 100% sales tax rebate because sales tax revenue is what funds fire protection, street improvements, and other city services. Rod Tobin, Aberdeen Development Corporation’s Attorney, commented that to offer a business an incentive in the form of a tax abatement is essentially an investment in the business coming with a prospect of providing jobs to generate sales tax and infuse money into the economy. Tobin said the sales tax rebate should be viewed as a one-time expense for a long-term gain. On the motion for an amendment in Section 50-97 to change the 50% tax rebate to up to 100%, upon roll call, Remily, Ronayne, Lunzman, Olson, and Mayor Levsen voting aye, Slaight-Hansen, Johnson, Bunsness, and Rux voting nay, 5 ayes and 4 nays, motion carried. On the main motion to approve first reading of Ordinance No. 18- 08-01 as amended, upon roll call, Bunsness, Johnson, and Slaight-Hansen voting nay, Lunzman, Olson, Remily, Ronayne, Rux, and Mayor Levsen voting aye, 3 nays and 6 ayes, motion carried. PUBLIC HEARING ON 2019 CAPITAL IMPROVEMENTS PROGRAM This being the time and place set for a public hearing regarding the 2019 Capital Improvement Program, Mayor Levsen opened the hearing. No one was present to discuss or make comments on the Capital Improvement Program as presented. Mayor Levsen closed the hearing. Johnson moved, Slaight-Hansen seconded to approve the 2019 Capital Improvement Program and Resolution No. 18-08-02R as follows: Whereas, the Aberdeen Home Rule Charter provides for the submission of a Five-Year Capital Improvement Program to be proposed no later than the final date for submission of the budget, and Whereas, the City Manager has presented a Capital Improvement Program as required by his duties as City Manager with a public hearing being held on August 13, 2018, with the published notice on August 2, 2018, stating the meeting time and place, and Whereas, the City Council is required to adopt the Capital Improvement Program by resolution after the public hearing with or without amendments to the Capital Improvement Program. Now, therefore be it resolved, that the City Council approves the Capital Improvement Program as presented by the City Manager and proposed at the public hearing held on August 13, 2018, without any amendments. Upon roll call, all voting aye, motion carried. HEARING CANCELLED ZUE3 LLC withdrew applications for Retail On-Off Sale Wine and Retail On-Off Sale Malt Beverage & SD Farm Wine Licenses for Eskimo Joes at 601 Riverside Drive. Hearing was cancelled. JUSTICE ASSISTANCE GRANT Police Chief Dave McNeil requested approval of an application for a Justice Assistance Grant from the U.S. Department of Justice for the Police Department in the amount of $14,506.00. Ronayne moved, Rux seconded to approve the application for a Justice Assistance Grant for the Police Department. Upon roll call, all voting aye, motion carried. CHANGE ORDER/PAYMENT FOR 3rd AVE., SE IMPROVEMENTS  17241 City Engineer Robin Bobzien presented a Change Order in the amount of a decrease of -$2,262.00 and a Payment Request in the amount of $166,601.70 to Sharpe Enterprises for work on the 3rd Ave., SE Street Improvements Project. Rux moved, Lunzman seconded to approve Change Order #1 in the amount of -$2,262.00 and the Payment Request #2 in the amount of $166,601.70 to Sharpe Enterprises. Upon roll call, all voting aye, motion carried. SUBSURFACE EXPLORATION FOR AVIATION APRON PROJECT Transportation Director Cody Roggatz requested acceptance of a subsurface exploration (soil boring) proposal from American Engineering Testing, Inc. in the amount of $17,640 for the future General Aviation Apron Reconstruction Project. Johnson moved, Ronayne seconded to approve and authorize the City Manager to sign the proposal from American Engineering Testing, Inc. to perform the subsurface exploration for the future General Aviation Apron Reconstruction Project. Upon roll call, all voting aye, motion carried. PASSENGER BOARDING BRIDGE ACQUISITION Transportation Director Cody Roggatz requested approval to award the AIP #3-46- 0001-038-2018 Passenger Boarding Bridge Acquisition to John Bean Technologies JBT Corporation in the amount of $854,067 contingent upon receipt of a FAA Grant offer and authorize the City Manager to sign all necessary documentation for the project. Johnson moved, Remily seconded to approve awarding the AIP #3-46-0001-038-2018 Passenger Boarding Bridge Acquisition to John Bean Technologies JBT Corporation. Upon roll call, all voting aye, motion carried. PAYMENT REQUESTS ON AIRPORT PROJECTS Transportation Director Cody Roggatz presented a payment request in the amount of $8,005.00 to Helms & Associates for professional services on acquiring the Passenger Loading Bridge for the Airport. Bunsness moved, Johnson seconded to approve and authorize the City Manager to sign the payment request in the amount of $8,005.00 to Helms & Associates. Transportation Director Cody Roggatz presented a payment request in the amount of $4,479.15 to Helms & Associates for work on the AIP #3-46-0001-37-2017 Wildlife Hazard Assessment & Mitigation Project for the Airport.
