Present at roll call were City Council Members David Bunsness, Alan Johnson, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Tanner Jondahl, Rich Krokel, and Jill Mohr. Mayor Levsen led the Pledge of Allegiance. MINUTES Moved by Rux, second by Johnson to approve the minutes of December 10, 2018, as circulated. All voting aye, motion carried. OPEN FORUM – No one was present. OLD BUSINESS ORDINANCE NO. 18-11-01 Motion by Bunsness, second by Rux to approve final adoption of Ordinance No. 18-11- 01. Motion by Olson, second by Ronayne to amend Ordinance No. 18-11-01 as follows: In Sec. 26-118(c)(1), strike “and are not stored inside a building”, and in Sec. 26-118(c)(5), before “disassembled bicycles” insert “junk, inoperable, or”. All voting aye, motion carried. Upon request of the Mayor, the City Attorney informed the Council that the amendment did not substantially alter the substance of the ordinance so that final adoption of the ordinance may be considered at this time. There being no further amendments, Mayor Levsen called for approval of final adoption of Ordinance No. 18-11-01, as amended. Upon roll call vote, Bunsness, Johnson, Lunzman, Olson, Remily, Rux, Slaight-Hansen, and Mayor Levsen voting aye, Ronayne voting nay, motion carried. ORDINANCE NO. 18-12-03 Motion by Ronayne, second by Johnson to approve second reading and final adoption of Ordinance No. 18-12-03 establishing the number of regular full-time positions and their position titles and fixing the bonds of City Officials and Employees. Upon roll call vote, all voting aye, motion carried. ORDINANCE NO. 18-12-04 Motion by Remily, second by Rux to approve second reading and final adoption of Ordinance No. 18-12-04 supplementing the 2018 Budget for various unanticipated projects, activities, and expenses. Upon roll call vote, all voting aye, motion carried. ORDINANCE NO. 18-12-05 Motion by Johnson, second by Olson to approve second reading and final adoption of Ordinance No. 18-12-05 revising Chapter 52 – Traffic and Vehicles of the City Code regarding the prohibition against unmuffled jake braking. NEW BUSINESS PETITION TO VACATE PUBLIC RIGHT-OF-WAY Motion by Ronayne, second by Lunzman to approve Resolution No. 18-12-01R for the vacation of Lancelot Drive N. public right-of-way as follows: BE IT RESOLVED by the Aberdeen City Council, Aberdeen, Brown County, South Dakota, that, subject to satisfaction of the recommended stipulations set forth in the Staff Report dated November 20, 2018, the Petition to Vacate the Public Right-of-Way filed by Father Mark Lichter of Sacred Heart Church, is hereby granted and the public right-of-way is hereby vacated for the following described areas: The entire 99’ Wide Lancelot Drive N. City Manager’s Proposed Action: Motion by _______, second by ________ to declare as surplus a 2002 Chevy 3500 (VIN 1GBJG31GX21154794), a 2002 Chevy 3500 (VIN 1GJG31G62115434550), and a 2007 Chevy Uplander (VIN 1GBDV13107D144474), and authorize the City Manager to transfer title to such vehicles to Aspire, a non-profit corporation providing humanitarian services, to effect the termination of the 5309 Grant under which each vehicle was acquired. Overview: These vehicles were originally purchased under separate 5309 Grants with SD DOT for Ride Line. After a number of years, the buses were transferred to Aspire (Adjustment Training Center) for their use. Because of the original terms of the Grants, the City was required to remain on the title as owner and was also required to administer random drug and alcohol testing for any persons operating the buses, which included Aspire drivers. In return, Ride Line was allowed to count all the rides provided by these vehicles in its ride total. By releasing these vehicles, the City will no longer administer drug and alcohol testing for Aspire drivers and will be released from further liability on the 5309 Grants. Ride Line no longer will be able to include their rides in its count. Overview: Finance Office staff and Aberdeen Fire & Rescue Collection Specialist has determined that ambulance accounts totaling $219,936.93 are delinquent after vigorous collection attempts by staff. Some of these outstanding balances are due various reasons (deaths, small amounts, Medicaid limitations, etc.), in which case we have no recourse for collections ($15,369.83). The remaining outstanding balances ($204,567.10) are from out of state accounts that will be turned over to a collection agency. Any amounts written off as uncollectible must receive formal action from the governing body according to SDCL 9-22-4. Issues/Alternatives to Consider: Many of these accounts are patients who simply cannot pay or out-of-state patients.
