17334 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, January 22, 2019 at 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Council Members David Bunsness, Alan Johnson, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Dave McNeil, Doug Johnson, Mark Hoven, Peggi Badten, and Rich Krokel. Mayor Levsen led the Pledge of Allegiance. MINUTES Motion by Bunsness, second by Olson to approve the minutes of January 14, 2019, as circulated. All voting aye, motion carried. OPEN FORUM Casey Weismantel, CVB Executive Director, was present to thank the Council for their support and discuss the award presented to the CVB at the SD Tourism Conference. Doug Johnson, Parks, Recreation & Forestry Director, discussed the award that Wylie Park received at the conference. CONSENT CALENDAR Motion by Rux, second by Remily to approve the following items on the consent calendar: SET HEARING DATE – of February 4, 2019 at 5:30 p.m. for an application for a Special Retail On-Sale Liquor License on February 7, 2019 for the Brown County Democratic Party Fundraiser at 220 South Main Street. LICENSES – Advertising/Sign Hanging – Atwood Electric, Inc.; Taxi Cab Driver – Richard Flying Horse, Jr.; Taxi Cab Driver – Robert Grandbois; Taxi Cab Driver – Justen Smith. PLATS – 1) Harr Auto Body First Addition to the City of Aberdeen in the S ½ , SW ¼ of Section 16, T123N, R63W of the 5th P.M., Brown County, SD with stipulations that sidewalks are installed along platted right-of-way within five years (225 Brown County Hwy. 19 South); 2) Ladner’s First Addition to the City of Aberdeen in the SW ¼, Section 13, T123N, R64W of the 5th P.M., Brown County, SD with stipulations that sidewalks are installed along platted right- of-way within five years (402 – 3rd Avenue, SW). NEW BUSINESS City Planning and Zoning Director Brett Bill presented a petition from Alissa Battest and Terry Larson to approve a vacation of public right-of-way for the 120’ of the 16’ wide public alley right-of-way located between Lot 1, Battest First Consolidation Subdivision and Lots 7 – 10, Block 43, Roches East Side Addition all in the SW ¼ of Section 17, T123N, R63W of the 5th P.M., Brown County, SD (North/South Alley between 402 Illinois Street South and 423 Harvard Street South). Motion by Bunsness, second by Olson to approve Resolution No. 19- 01-01R to vacate the public right-of-way. All voting aye, motion carried. APPOINTMENT TO ABERDEEN-BROWN COUNTY RAILROAD AUTHORITY City Attorney Ron Wager explained the request to appoint a City representative to the Aberdeen-Brown County Regional Railroad Authority (ABCRRA). Motion by Ronayne, second by Rux to approve the following Resolution No. 19-01-02R appointing Mayor Mike Levsen as the City’s representative and Rob Ronayne as the alternate to the Aberdeen-Brown County Regional Railroad Authority for a three-year term expiring on July 20, 2022: WHEREAS, the Aberdeen-Brown County Regional Railroad Authority (ABCRRA)  17335 was established in 1991, pursuant to SDCL Ch. 49-17A, and membership currently includes the City of Aberdeen, Brown County, Edmunds County, Spink County, and Beadle County; and WHEREAS, it is necessary to the City of Aberdeen, South Dakota, to nominate and appoint every three years a respresentative as its Commissioner to ABCRRA and the term of the last-appointed representative expired in 2018; NOW, THEREFORE, BE IT HEREBY RESOLVED that Mike Levsen is hereby appointed by the City of Aberdeen as its representative and Commissioner to the ABCRRA, and Rob Ronayne is appointed as alternate, until such time as new appointments are made or for a term of three years, whichever period is less. DISPOSAL OF AIRPORT PASSENGER LOADING BRIDGE Transportation Director Rich Krokel presented Resolution No. 19-01-03R to dispose of the Airport Passenger Loading Bridge. Motion by Johnson, second by Slaight-Hansen to approve the following Resolution No. 19-01-03R: BE IT RESOLVED by the Aberdeen City Council, that the following described property shall be disposed of according to law in accordance with SDCL 6-13-1 or FAA Guidelines, said property to be described as follows: Passenger Loading Bridge, Asset #4116, SN #1036. BE IT FURTHER RESOLVED by the Aberdeen City Council that the Transportation Director may dispose of this property as allowed by law. All voting aye, motion carried. HEARING ON MALT BEVERAGE AND WINE LICENSES A hearing was held on applications for a Retail On-Off Sale Malt Beverage & SD Farm Wine and Retail On-Off Sale Wine & Cider Licenses for JUE3, LLC dba Eskimo Joe’s Bar, Grill and Outpost at 601 Riverside Drive. Stacey Johnson from the Richardson Law Office was present representing the applicant. Motion by Johnson, second by Remily to approve the Retail Malt Beverage & SD Farm Wine and Retail Wine & Cider Licenses for JUE3, LLC at 601 Riverside Drive. All voting aye, motion carried. LICENSE FOR ENCROACHMENT ON ALLEY City Attorney Ron Wager explained the request by David Arlt, LLC for a license to encroach within the alley right-of-way at 21 North Main Street for a loading dock(s) and building entrance. Motion by Ronayne, second by Slaight-Hansen to approve the request by David Arlt, LLC for a license to permit encroachment on alley at 21 North Main Street as recommended by the City Attorney. All voting aye, motion carried. PROPERTY TAX ABATEMENT City Finance Officer Karl Alberts presented a request from the Brown County Auditor’s Office for approval of a property tax abatement for 105 – 2nd Curve in the amount of $211.00 of which City’s share is $34.69 due to a mobile home removed from the property and taxes being uncollectible. Motion by Bunsness, second by Lunzman to approve the property tax abatement as requested. All voting aye, motion carried. PURCHASE OF DESKTOPS AND NOTEBOOKS City Finance Officer Karl Alberts presented a request to purchase desktop computers and notebooks in the amount of $37,646 from HP of Boston, Massachusetts through SD State Contracts. Motion by Rux, second by Johnson to approve the purchase of the desktops and notebooks as requested. All voting aye, motion carried. DIGESTER BOILER REPLACEMENT Water Reclamation Superintendent Peggi Badten presented a request to accept the quote for the purchase of a Hurst Boiler from G & R Controls in the amount of $57,410.00 and the quote for installation of the boiler from Redlinger Brothers Plumbing and Heating in the amount of $17,240.00. Motion by Bunsness, second by Ronayne to approve the purchase of a  17336 Hurst Boiler from G & R Controls and obtain Redlinger Brothers Plumbing & Heating for the installation of the boiler at the Water Reclamation Facility. All voting aye, motion carried. CHANGE ORDER/PAYMENT FOR WATER RECLAMATION IMPROVEMENTS Water Reclamation Superintendent Peggi Badten presented a Change Order to decrease the contract amount for the Water Reclamation Facility 2016 Improvements by -$10,000.00 and a Payment Request for the work in the amount of $133,038.88 to Industrial Process Technologies. Motion by Bunsness, second by Johnson to approve Change Order #2 for a decrease of -$10,000.00 to the contract amount and Payment Request in the amount of $133,038.88 to Industrial Process Technologies. Upon roll call, all voting aye, motion carried. CHANGE ORDER/PAYMENT FOR 8TH AVE. RECONSTRUCTION City Engineer Robin Bobzien presented a Change Order in the amount of $57,356.00 for the 8th Ave., NW Reconstruction Project and a Payment Request for the work in the amount of $77,485.95 to Reede Construction. Motion by Rux, second by Bunsness to approve Change Order #5 in the amount of $57,356.00 and Payment Request #5 in the amount of $77,485.95 to Reede Construction. Police Chief Dave McNeil gave an update on a problem that occurred early Tuesday afternoon with the 911 Dispatch System at the Brown County Dispatch Center. CITY MANAGER’S REPORT Lynn Lander gave the City Manager’s Report including the topic of vaping which the Police Department will be making a presentation on at the next council meeting.
