ADJOURN 03/10/2020 Page 1 of 4 CITY OF ABERDEEN WATER RECLAMATION FACILITY INDUSTRIAL PRETREATMENT PROGRAM PUBLIC NOTICE OF SIGNIFICANT NONCOMPLIANCE BY AG PROCESSING INC. (AGP) The Federal Clean Water Act established the National Pretreatment Program to control the discharge of waste into sanitary sewer systems operated by Publicly Owned Treatment Works (POTW), in this case the Aberdeen Water Reclamation Facility. Under a delegation from the State of South Dakota, the City of Aberdeen is responsible to apply and enforce pretreatment standards for industrial users served by the City of Aberdeen. These standards are administered through the issuance of wastewater discharge permits to industrial users of the POTW. Pursuant to Section 403.8 of the Code of Federal Regulations, the City of Aberdeen must publish notice of industrial users that have demonstrated a pattern of noncompliance with applicable pretreatment standards or had a significant noncompliance incident. The definition of significant noncompliance can be found in Chapter 54 of the Aberdeen City Code. This notice is intended to inform the public that Ag Processing Inc (AGP) of 4815 8th Avenue NE, Aberdeen, South Dakota, was found to be in significant noncompliance (SNC) for discharging wastewater to the Aberdeen Water Reclamation Facility that did not meet the pollutant limitations set forth in its wastewater discharge permit. The SNC violations are as follows: 1. AGP was found to be in SNC for chronic violations of its biochemical oxygen demand (BOD) discharge limit. The daily maximum limit is 275 mg/l.  Fifty-four measurements were taken for BOD in a 6-month period from July 2019 through December 2019.  100% of the fifty-four measurements taken exceeded the daily maximum limit.  AGP had an average BOD of 504 mg/l for the period of July 2019 through December 2019. 2. AGP was found to be in SNC for technical review criteria (TRC) of the BOD violations. The TRC BOD limitation is 385 mg/l.  92.6% of the measurements taken for BOD in a 6-month period from July 2019 through December 2019 exceeded the TRC limitation. 3. AGP was found to be in SNC by adversely affecting the operations and implementation of the Pretreatment Program by discharging waste containing high BOD levels into the City wastewater collection system and adversely affecting the normal operating conditions of the system.
