17994 MINUTES ABERDEEN CITY COUNCIL MEETING City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, September 27, 2021 at 5:30 p.m., regular meeting of the City Council. CALL TO ORDER MEETING ROLL CALL Present at roll call were City Council Members Rob Ronayne, Mark Remily, Dave Lunzman, Josh Rife, Alan Johnson, Justin Reinbold, Clint Rux, and Mayor Travis Schaunaman. City Council Member Tiffany Langer was absent. City Staff present were Joe Gaa, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Dave McNeil, Jeremiah Maxfield, and Joel Weig. PLEDGE OF ALLEGIANCE Mayor Schaunaman led the Pledge of Allegiance. APPROVAL OF AGENDA Motion by Rux, second by Remily to approve the agenda. Voice vote to approve, all present voting aye, motion carried. MINUTES Motion by Johnson, second by Reinbold to approve the minutes of the September 20, 2021 City Council Meeting, as circulated. Voice vote to approve, all present voting aye, motion carried. OPEN FORUM Troy McQuillen was present in support of the two-way Main Street proposal. NEW BUSINESS PUBLIC HEARING ON ORDINANCE NO. 21-09-01 – ZONING OF CANNABIS ESTABLISHMENTS Mayor Schaunaman opened a hearing on an ordinance regarding zoning of cannabis establishments. City Attorney Ron Wager proceeded to discuss the progression of the marijuana zoning ordinance. Wager stated that the marijuana zoning ordinance was reviewed by the Planning Commission on September 21, 2021 and the Planning Commission recommended its approval with a suggestion for a change in zoning districts included in the areas. City GIS Technician Jeremiah Maxfield was present to provide the Council with a map indicating the areas within city limits where cannabis establishments may be located. Motion by Ronayne, second by Rux to approve first reading of Ordinance No. 21-09-01 amending the zoning regulations of the Aberdeen City Code regarding cannabis establishments. Discussion followed. Motion by Ronayne, second by Rux to approve amendments to the ordinance, recommended by the City Attorney, as follows: in Sec. 60- 362(d) deleting “where the dispensary is proposed.” and in Sec. 60-353 deleting “providing documentation of” and adding the text “To obtain an initial permit from the city, the requirement for a valid license may be met by providing verification from the State of South Dakota of the submission to it of a completed application for a cannabis establishment satisfying all conditions for registration except a copy of the permit from the city”. Roll call vote to approve the amendments, all present voting aye, motion carried. No other public comments were received so Mayor Schaunaman closed the hearing. On the main motion to approve first reading of Ordinance No. 21-09-01 as amended, roll call vote to approve, all present voting aye, motion carried. ORDINANCE NO. 21-09-04 – REFUNDS OF CERTAIN SALES AND USE TAXES City Manager Joe Gaa explained the reason for an ordinance amending Chapter 50 –  17996 Taxation of the Aberdeen Code regarding refunds of certain sales and use taxes. Gaa stated that the proposed amendment makes minor changes to the process, reduces the project eligibility amounts, and simplifies criteria of refunds over 50%. Gaa hopes these revisions would encourage economic growth in the City. Motion by Rux, second by Johnson to approve first reading of Ordinance No. 21-09-04 amending Chapter 50 – Taxation of the Aberdeen City Code regarding refunds of certain sales and use taxes. Roll call vote to approve, all present voting aye, motion carried. LICENSE FOR WHEELCHAIR RAMP ENCROACHMENT ON RIGHT-OF-WAY City Attorney Ron Wager presented a request from Steven Nemmers for a license to permit a wheelchair ramp encroachment on right-of-way abutting 1024 South 1st Street. Motion by Ronayne, second by Remily to approve of the request by Steven Nemmers for a license to encroach upon the right-of-way abutting the residence at 1024 South 1st Street for a wheelchair ramp and to authorize the City Manager to execute the same. Roll call vote to approve, all present voting aye, motion carried. REVIEW AND APPROVAL OF CLAIMS AND PAYROLL Motion by Lunzman, second by Reinbold to approve payment of the bills listed for September 27, 2021 and payroll for the period from September 12, 2021 through September 25, 2021.
