CALL TO ORDER MEETING ROLL CALL Present at roll call were City Council Members Rob Ronayne, Mark Remily, Dave Lunzman, Josh Rife by teleconference, Justin Reinbold, Tiffany Langer by teleconference, Clint Rux, and Mayor Travis Schaunaman. City Council Member Alan Johnson was absent. City Staff present were Joe Gaa, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Dave McNeil, Rich Krokel, and Joel Weig. OLD BUSINESS ORDINANCE NO. 21-12-01 Motion by Rux, second by Langer to approve second reading of Ordinance No. 21- 12-01 to rezone property described as Lots 7 and 8, Block 11, Sullivan & Easton Addition in the SW ¼, Sec. 12, T123N, R64W of the 5th P.M., Aberdeen, Brown County, South Dakota (909 North Main Street) from (R-2) Medium Density Residential District/(R-4) Special Density Residential District to (C-1) Neighborhood Commercial District for Ashley Bennett. City Council Member Ronayne requested an amendment to the ordinance indicating that the property should be rezoned back to the residential district once the business ceases operation or the property is sold. After further discussion, motion made by Ronayne, second by Rux to amend the ordinance to add a paragraph stipulating that the owner meet all applicable Building Code requirements pertaining to the Americans With Disability Act, as well as general life safety, and that the property be rezoned back to (R-2)/(R-4) Residential Districts once the commercial use ceases or upon sale of the property. Roll call vote to approve, all present voting aye, motion carried. On the original motion to approve second reading of Ordinance No. 21-12-01, as amended, all present voting aye, motion carried. Since the Council did approve an amendment at the second reading of the ordinance that substantially alters the substance of the ordinance from the first reading, City Attorney Ron Wager stated that the ordinance would require a third reading and final adoption at the next regular council meeting on January 18, 2022. NEW BUSINESS HEARING AND ADOPTION OF RESOLUTION NO. 22-01-01R TO LEASE CITY-  18060 OWNED LAND AT AIRPORT TO FIXED BASE OPERATORS Mayor Schaunaman opened a hearing regarding a Resolution approving a lease to Fixed Base Operators (FBOs) of city-owned land at the Airport for 20 years beginning in 2022. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Ronayne, second by Rux to approve Resolution No. 22-01-01R. Roll call vote to approve, Ronayne, Remily, Lunzman, Rife, Langer, Rux, and Mayor Schaunaman voting aye, Reinbold abstaining, number of ayes 7, number of nays 0, members abstaining 1, motion carried. RESOLUTION NO. 22-01-01R RESOLUTION APPROVING LEASE OF AIRPORT LAND TO FIXED BASE OPERATORS WHEREAS, the City Council adopted Resolution No. 21-12-01R stating its intent to lease municipally-owned Airport property to Fixed Base Operators for a term exceeding 120 days and for a rental amount exceeding $500.00 annual value, such leases invoking the requirements of SDCL §9-12-5.2; and WHEREAS, the notice of hearing was published as required by law and the public hearing on the proposed leases was held by the City Council in City Council Chambers, 123 South Lincoln Street, Municipal Building, in the City of Aberdeen, South Dakota, on the 3rd day of January , 2022, at 5:30 p.m., when and where any persons interested in the leases had an opportunity to appear and be heard prior to any action on such leases. NOW, THEREFORE, BE IT RESOLVED that, after public hearing and due consideration of any comments of persons interested in such leases, the Council hereby approves the leases of certain land owned by the City of Aberdeen at the Aberdeen Regional Airport, at 4740 – 6th Ave., SE, Aberdeen, South Dakota, to private persons; to wit, 79,436 square feet of land to Aberdeen Flying Service for a 2022 rental value of $8,686.77, adjusted thereafter, and 71,123 square feet of land to Quest Aviation, Inc., for a 2022 rental value of $7,223.11, adjusted thereafter, for a period of twenty (20), upon terms and conditions for Fixed Base Operators to be set forth in a “Commercial Aviation Net Ground Lease.” BE IT FURTHER RESOLVED that the City Manager is authorized to execute all documents necessary to finalize such leases, as approved by the City Attorney. The foregoing Resolution was approved after first reading and passed at a regular meeting of the Aberdeen City Council on the 3rd day of January, 2022. RESOLUTION NO. 22-01-02R ADOPTING BROWN COUNTY HAZARD MITIGATION PLAN City Manager Joe Gaa requested approval of Resolution No. 22-01-02R adopting the Brown County Hazard Mitigation Plan. Gaa indicated that the language in Item #3 of the Resolution needed to be corrected changing “Planner” to “Engineer”. Motion by Reinbold, second by Lunzman to approve Resolution No. 22-01-02R as amended. Roll call vote to  18061 approve, all present voting aye, number of ayes 8, number of nays 0, members abstaining 0, motion carried. RESOLUTION NO. 22-01-02R RESOLUTION TO ADOPT THE BROWN COUNTY HAZARD MITIGATION PLAN WHEREAS, the City of Aberdeen has experienced severe damage from strong winds, flooding, hail, heavy snow, heavy rain, and tornadoes on many occasions in the past century, resulting in property loss, loss of life, economic hardship, and threats to public health and safety; WHEREAS, a Hazard Mitigation Plan has been developed after more than one year of research and work by the City of Aberdeen, Brown County Emergency Management, NECOG, and the Natural Hazard Mitigation Committee; WHEREAS, the Plan recommends hazard mitigation actions that will protect the people and property affected by the natural hazards that face the City; WHEREAS, a public meeting was held to review the Plan as required by law; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Aberdeen: 1. The Hazard Mitigation Plan is hereby adopted as an official plan of the City of Aberdeen. 2. The respective City official identified in the strategy of the Plan is hereby directed to implement the recommended action assigned to them. These officials will report annually on the activities, accomplishments, and progress to Brown County Emergency Management. 3. The City of Aberdeen Engineer will provide annual progress reports on the status of implementation of the plan to the Mayor and City Council. This report shall be submitted to the Mayor and City Council by November 1st of each year. Adopted and passed by the Council of the City of Aberdeen, South Dakota on this 3rd day of January, 2022. HEARING ON RETAIL WINE AND MALT BEVERAGE LICENSES FOR ENGELS EVENT COMPANY, LLC Mayor Schaunaman opened a hearing on a new Retail On-Off Sale Wine and Cider License and a new Retail On-Off Sale Malt Beverage and SD Farm Wine License for Engels Event Company, LLC at 209 South Main Street. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Remily, second by Reinbold to approve a Retail On-Off Sale Wine and Cider License and a Retail On-Off Sale Malt Beverage and SD Farm Wine License for Engels Event Company, LLC at 209 South Main Street. HEARING ON RETAIL WINE LICENSE FOR HUB CITY AXE THROWING, LLC  18062 Mayor Schaunaman opened a hearing on a new Retail On-Off Sale Wine and Cider License for Hub City Axe Throwing, LLC at 3315 – 6th Avenue, SE Suite #10. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Remily, second by Lunzman to approve a Retail On-Off Sale Wine and Cider License for Hub City Axe Throwing, LLC at 3315 – 6th Avenue, SE Suite #10. Roll call vote to approve, all present voting aye, motion carried. TRANSIT GRANT AGREEMENTS WITH SD DEPARTMENT OF TRANSPORTATION Transportation Director Rich Krokel requested approval and authorization for the City Manager to sign the following Transit Grant Agreements with the South Dakota Department of Transportation for Aberdeen Ride Line: Section 5310 – Preventative Maintenance Grant in the amount of $12,838.56 and Section 5311 - Payroll Expense Grant in the amount of $118,553.65. Motion by Ronayne, second by Rux to approve the Transit Grant Agreements with the South Dakota Department of Transportation to provide funding for equipment and facility maintenance and payroll expenses for the continued operation of the public transit program. Roll call vote to approve, all present voting aye, motion carried. DECLARE CERTAIN UNPAID AMBULANCE ACCOUNTS UNCOLLECTIBLE Fire Chief Joel Weig requested approval to declare $244,113.84 in unpaid ambulance accounts as uncollectible and allow the Fire and Rescue Department to write-off these balances. Weig said that $233,078.06 of the outstanding balances will be turned over to a collection agency and the remaining balance of $11,035.78 is uncollectible. Motion by Ronayne, second by Remily to declare certain unpaid ambulance accounts uncollectible and allow the Fire Department to write-off these balances. Voice vote to approve, all present voting aye, motion carried. REQUEST TO PURCHASE RECTRAC SOFTWARE FOR THE PARKS, RECREATION & FORESTRY DEPARTMENT City Finance Officer Karl Alberts requested approval to purchase software and move to the hosted version of RECTRAC used by the Parks, Recreation & Forestry Department at a price of $20,100.00 from Vermont Systems, Inc. Motion by Ronayne, second by Remily to purchase the RECTRAC software from Vermont Systems, Inc. at a price of $20,100.00 as requested. Roll call vote to approve, all present voting aye, motion carried. REQUEST TO PURCHASE EXCAVATOR FOR PUBLIC WORKS-UTILITY DEPARTMENT City Engineer Robin Bobzien requested approval to purchase a 2022 John Deere 60G Compact Excavator from RDO Equipment Company in the amount of $76,660.00 for the Public Works-Utility Department. Motion by Rux, second by Ronayne to approve of the purchase of the John Deere Excavator from RDO Equipment in the amount of $76,660.00. Roll call vote to approve, all present voting aye, motion carried. REQUEST TO PURCHASE MOTOR GRADER FOR PUBLIC WORKS DEPARTMENT  18063 City Engineer Robin Bobzien requested approval to purchase a new CAT 150 Motor Grader from Butler Machinery Company in the amount of $327,500.00 for the Public Works Department through Sourcewell Bid Process. Motion by Rux, second by Lunzman to approve of the purchase of the CAT Motor Grader from Butler Machinery Company in the amount of $327,500.00. Roll call vote to approve, all present voting aye, motion carried.
