18248 MINUTES ABERDEEN CITY COUNCIL MEETING City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, October 17, 2022 at 5:30 p.m., regular meeting of the City Council. CALL TO ORDER MEETING ROLL CALL Present at roll call were City Council Members Rob Ronayne, Erin Fouberg, Charlotte Liebelt, Josh Rife, Alan Johnson by teleconference, Justin Reinbold, Tiffany Langer, David Novstrup, and Mayor Travis Schaunaman. OPEN FORUM Jeff Hayes spoke on the need for enforcement of the city ordinance regarding animals on private property and boulevards. Roll call vote to approve, all voting aye, motion carried. NEW BUSINESS ORDINANCE NO. 22-10-05 – FIRST READING City Finance Officer Jordan McQuillen presented Ordinance No. 22-10-05 supplementing the 2022 Budget for various unanticipated projects, activities, and expenses. Motion by Ronayne, second by Rife to approve first reading of Ordinance No. 22-10-05 as presented. Roll call vote to approve, all voting aye, motion carried. APPROVAL OF 2022 BUDGETED TRANSFERS City Finance Officer Jordan McQuillen requested authorization for the Finance Office to perform 2022 Budgeted Transfers between funds as needed and provided for in Ordinance No. 21-09-02 “2022 Annual Appropriation”. Motion by Reinbold, second by Ronayne to approve the 2022 Budgeted Transfers between funds as requested by the Finance Officer. Roll call vote to approve, all voting aye, motion carried. RESOLUTION NO. 22-10-01R – ESTABLISH CONSOLIDATED BOARD OF EQUALIZATION AND DESIGNATE MEMBER Motion by Langer, second by Liebelt to approve Resolution No. 22-10-01R to establish a Consolidated Board of Equalization pursuant to SDCL §10-11-66 and designate Mayor Travis Schaunaman as the member and Council Member Rob Ronayne as the alternate member of the City Council to serve on the Consolidated Board of Equalization from April - May, 2023. Roll call vote to approve, all voting aye, number of ayes 9, number of nays 0, members abstaining 0, motion carried. RESOLUTION NO. 22-10-01R A RESOLUTION TO ESTABLISH A CONSOLIDATED BOARD OF EQUALIZATION PURSUANT TO SDCL §10-11-66 THROUGH SDCL §10-11-77 BE IT RESOLVED that a Consolidated Board of Equalization as authorized by SDCL §10-11-66 shall be established pursuant to the Resolution of the Governing Boards of Brown County, City of Aberdeen, and the Aberdeen School District 6-1. The Consolidated Board of Equalization as created by this Resolution shall be authorized to exercise all powers contained in SDCL §10-11. BE IT FURTHER RESOLVED that three members from the Brown County Commission, one member of the Aberdeen City Council, and one member of the Aberdeen School District 6-1 School Board shall constitute a Consolidated Board of Equalization as  18250 provided by SDCL §10-11-66. BE IT FURTHER RESOLVED that the Aberdeen City Council, Brown County Commission, and the Aberdeen School District 6-1 shall be responsible for the per diem, salary, and mileage costs of the respective members that serve on the Consolidated Board of Equalization. Brown County Commission shall be responsible for the ordinary and customary expenses associated with the equalization of property including appeals to the State Board of Equalization. The financial responsibilities contained in this resolution shall remain unless either the Aberdeen City Council, Brown County Commission, or the Aberdeen School District 6-1 shall request that they be modified prior to December 1st of each year. THIS RESOLUTION shall be binding upon the Aberdeen City Council, Aberdeen, South Dakota and upon each governing body adopting this Resolution according to law. The foregoing Resolution was adopted at a regular meeting of the Aberdeen City Council on the 17th day of October, 2022. PUBLIC HEARING AND APPROVAL OF RESOLUTION NO. 22-10-02R APPROVING LEASE OF AIRPORT HANGAR AREAS TO PRIVATE PERSONS FOR FIVE YEARS Mayor Schaunaman opened a hearing on proposed leases of airport hangar areas to private persons for 5 years beginning in 2023. City Attorney Ron Wager explained the lease process and asked the Council for approval of Resolution No. 22-10-02R leasing hangar areas at the Aberdeen Regional Airport for a period of five years to private persons and for annual rental amounts. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Johnson, second by Ronayne to approve Resolution No. 22-10-02R leasing hangar areas at the Airport for a period of five years beginning January 1, 2023 to private persons and annual rental amounts identified therein, upon further terms and conditions to be set forth in a Private Hangar Lease Agreement or Executive Hangar Lease Agreement which permits use of the hangars for non-commercial aviation activities, and authorizing the City Manager to execute the same. Roll call vote to approve, Ronayne, Fouberg, Liebelt, Rife, Johnson, Langer, Novstrup, and Mayor Schaunaman voting aye, Reinbold abstaining, number of ayes 8, number of nays 0, members abstaining 1, motion carried. RESOLUTION NO. 22-10-02R RESOLUTION APPROVING LEASES OF AIRPORT LAND FOR HANGAR AREAS WHEREAS, the City Council adopted Resolution No. 22-09-03R stating its intent to lease municipally-owned property to private persons for terms exceeding 120 days and for rental amounts exceeding $500.00 annual value, such terms and rental amounts invoking the requirements of SDCL §9-12-5.2; and WHEREAS, the notice of hearing was published as required by law and the public  18251 hearing on the proposed leases was held by the City Council in City Council Chambers, 123 South Lincoln Street, Municipal Building, in the City of Aberdeen, South Dakota, on the 17th day of October, 2022 at 5:30 p.m., when and where any persons interested in the leases had an opportunity to appear and be heard prior to any action on such leases. NOW, THEREFORE, BE IT RESOLVED that, after public hearing and due consideration of any comments of persons interested in such leases, the Council hereby approves the leases of the property owned by the City of Aberdeen described as hangar areas at the Aberdeen Regional Airport, at 4740 – 6th Ave., SE, Aberdeen, South Dakota, for a period of five (5) years beginning January 1, 2023, to the following private persons: Aberdeen Professionals Hangar #16 Arment/Wirebaugh Hangar #17 Bellikka, Neil Hangar #26 Berg, William Hangar #5 Berg, William Hangar #30 Beving, Morgan Hangar #20 Braun, Kevin/Richelle Hangar #3 Gengerke, Ryan d/b/a Hard Deck Aviation Hangar #4 Hillestad, Darrell Hangar #6 Huber, Weylin Hangar #8 Johnson, Rolf Hangar #21 Knie, Dean Hangar #13 Knie, Dean Hangar #14 Lamont, Chris – Lamont Companies Hangar #29 Outka, Wade Hangar #12 Theobald, Daryl Hangar #7 Theobald, Daryl Hangar #9 Werth, Roger Hangar #23 BE IT FURTHER RESOLVED that the hangar area leaseholds shall be based upon rental amounts for the footprint of the hangar structure of $0.25 per square foot in Year 2023, $0.27 per square foot in Year 2024, $0.29 per square foot in Year 2025; $0.31 per square foot in Year 2026, and $0.33 per square foot in Year 2027; and for the footprint of the approach, fifty percent (50%) of the per square foot rental for the tenant’s hangar structure; and upon further terms and conditions to be set forth in a Private Hangar Lease Agreement or Executive Hangar Lease Agreement that permits use of the hangars primarily for non- commercial aviation activities. BE IT FURTHER RESOLVED that the City Manager is authorized to execute all documents necessary to finalize such leases.  18252 The foregoing Resolution was approved after first reading and passed at a regular meeting of the Aberdeen City Council on the 17th day of October, 2022. PUBLIC HEARING AND APPROVAL OF SPECIAL LIQUOR LICENSE AND COMMUNITY EVENT PERMIT FOR ABERDEEN DOWNTOWN ASSOCIATION AND ABERDEEN OKTOBERFEST Mayor Schaunaman opened a hearing on a request for a Special One-Day Retail On- Sale Liquor License on November 5, 2022 for Aberdeen Downtown Association at the Aberdeen Civic Arena, 203 South Washington Street, in conjunction with the Aberdeen Oktoberfest Event. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Reinbold, second by Novstrup to approve of a Special One-Day Retail Liquor License for Aberdeen Downtown Association and a Community Event Permit for Aberdeen Oktoberfest for their event on November 5, 2022 at the Aberdeen Civic Arena, 203 South Washington Street. Roll call vote to approve, all voting aye, motion carried. FAA GRANT APPLICATION FOR FEDERAL ASSISTANCE ON AIRPORT RUNWAY 13/31 PAVEMENT REHABILITATION AND LIGHTING IMPROVEMENTS PROJECT Transportation Director Rich Krokel requested approval to proceed with a Federal Aviation Administration Grant application for funding assistance on the Airport AIP #3-46- 0001-49 and AIP #3-46-0001-50 Runway 13/31 Pavement Rehabilitation and Lighting Improvements Project and authorization for the City Manager to sign all documents related to the project. Krokel said that the grant pre-application under the Airport Improvement Program (AIP) is for funds in the amount of $1,111,111.10 and under the Bipartisan Infrastructure Law (BIL) for funds in the amount of $1,728,888.90. The 2023 project costs are estimated at $2,840,000.00 of which funding is 90% Federal, 6.5% State, and 3.5% Local. Motion by Johnson, second by Rife to proceed with Federal Aviation Administration (FAA) Grant application initiation request for federal assistance and to authorize the City Manager to sign all required documents to proceed and for execution of the grant award and offer from the Federal Aviation Administration and State Agreement with the DOT Aeronautics for Runway 13/31 Pavement Rehabilitation and Lighting Improvements. Roll call vote to approve, all voting aye, motion carried. PAYMENTS FOR AIRPORT IMPROVEMENT PROJECTS Transportation Director Rich Krokel requested approval of the following payments for Airport Improvement Projects: 1) Payment #35 – AIP #3-46-0001-43-2021 Taxiway Geometry – Helms & Associates, in the amount of $27,961.41; 2) Payment #9 – AIP #3-46- 0001-43-2021 Taxiway Geometry – Sharpe Enterprises, in the amount of $30,540.37; 3) Payment #19 – AIP #3-46-0001-47-2022 GA Apron Reconstruction – Helms & Associates, in the amount of $2,127.11; 4) Payment #1 – AIP #3-46-0001-48-2022 Runway 13/31 Rehabilitation/Lighting Improvements – Helms & Associates, in the amount of $9,983.92. Motion by Johnson, second by Reinbold to approve and authorize the City Manager to sign  18253 the payment requests for work on the Airport Improvement Projects. BIDS FOR CITY HALL CHILLER REPLACEMENT City Engineer Robin Bobzien requested approval to award the bid for the City Hall Chiller Replacement Project to CDJ Electric Plumbing & Heating, Inc. in the amount of $113,384.00. Motion by Rife, second by Novstrup to award the bid for the City Hall Chiller Replacement to CDJ Electric Plumbing & Heating, Inc. in the amount of $113,384.00 and authorize the City Manager and Finance Officer to sign all the necessary documents after approval by the City Attorney. Roll call vote to approve, Ronayne, Fouberg, Liebelt, Rife, Johnson, Reinbold, Novstrup, and Mayor Schaunaman voting aye, Langer abstaining, motion carried. CHANGE ORDER/PAYMENT REQUEST FOR SOUTH ROOSEVELT STREET SANITARY SEWER IMPROVEMENTS City Engineer Robin Bobzien requested approval of Change Order #1 in the amount of $47,721.54 and Payment #2 in the amount of $216,330.47 to Dahme Construction for work on the South Roosevelt Street Sanitary Sewer Improvements Project. Motion by Ronayne, second by Novstrup to approve of Change Order #1 in the amount of $47,721.54 and Payment #2 in the amount of $216,330.47 to Dahme Construction for the South Roosevelt Street Sanitary Sewer Improvements. OTHER Kevin Harr of the Masonic Lodge spoke in regards to the replacement of windows at the Masonic Lodge, 505 South Main Street, and the requirements for historically registered property.
