NEW BUSINESS PURCHASE POLARIS RANGER FOR FIRE DEPARTMENT Fire Chief Joel Weig requested approval to purchase a Polaris Ranger UTV in the amount of $34,798.55 from Polaris Sales Inc. for the Fire Department. Motion by Langer, second by Johnson to approve the request from the Fire Department to purchase a Polaris Ranger UTV in the amount of $34,798.55 from Polaris Sales Inc. PAYMENT REQUESTS FOR WATER RECLAMATION FACILITY IMPROVEMENT AND EXPANSION PROJECT Water Reclamation Superintendent Peggi Badten gave an update on the Water 01/23/2023 Page 4 of 72  Reclamation Facility Improvement and Expansion Project and requested approval of Payment #2 in the amount of $85,230.00 and Payment #3 in the amount of $261,860.00 to Banner Associates Inc. for engineering services on the project. Motion by Johnson, second by Liebelt to approve of Payment #2 and Payment #3 in the total amount of $347,090.00 to Banner Associates Inc. for work on the Water Reclamation Facility Improvement and Expansion Project. WHEREAS, pursuant to Sec. 60-286, the City of Aberdeen planning and zoning commission held a public hearing on January 17, 2023, upon notice properly given, to study and report on the proposed amendment to the Zoning ordinance, and thereafter approved and recommended adoption of the amendment by the City Council; and WHEREAS, the City Council has determined that the following amendment will benefit the health, safety, and property of its citizens. BE IT ORDAINED BY THE CITY OF ABERDEEN, SD, THAT THE FOLLOWING CHANGES AND ADDITIONS SHALL BE MADE TO THE ABERDEEN CITY CODE: 1. “Kennel” as defined in Sec. 60-1 of the Aberdeen City Code is hereby amended as follows: 01/23/2023 Page 46 of 72 Sec. 60-1. Definitions. The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: . . . Kennel, animal, means any premises, or portion thereof, where dogs, cats and other household pets are maintained, boarded, bred 1or cared for, in return for remuneration or are kept for the purpose of sale. . . . 2. Severability. The provisions of this ordinance are severable. If any provision of this ordinance or the application thereof to any person or circumstance is held to be invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provision or application. 3. Effective Date. The City Finance Officer shall cause this ordinance to be published in the official newspaper in clean text with all deletions and additions incorporated therein and footnotes omitted. This ordinance shall become effective twenty (20) days after the completed publication, unless the referendum is invoked. Animal breeding operations prohibited. No person shall own or operate an animal breeding operation within the city limits. The term "animal breeding operation" means anyone who, for profit, periodically breeds his or her animals and thusly has at least one female animal with young animals at least once a year.
