Aberdeen City Planning Commission May 17, 2016 MINUTES ABERDEEN CITY PLANNING COMMISSION May 17, 2016 The City Planning Commission was called to order by Acting Chairman Rich Kezar. Members present at roll call were Kezar, Lien, Marske, and Rivett. Absent were: Cogley, Jung, and Woodward. Also present were Chris Witzel, City Planner, Brett Bill, Planning & Zoning Director, Ken Hubbart, City Planner, and Paula Nelson, Planning Commission Secretary. Rivett moved and Lien seconded to approve the minutes of April 19, 2016, all members voting aye, the motion carried. There being no old business Chairman Kezar began with new business as follows: 1) Permission to replace two windows in a building located in a (C-1) Neighborhood Commercial District at property described as “Lot 7, Easton’s 1st Subdivision,” (a.k.a. 702 2nd St N) was submitted by Jeff Weismantel. Chris Witzel stated that the petitioner is requesting permission to replace two windows, all the same size, in a building located in a (C-1) Neighborhood Commercial District. Following discussion Marske moved and Rivett seconded to approve, all members voting aye, the motion carried. 2) A preliminary and final plat described as “V + G Webb Addition to the City of Aberdeen, in the South ½ of Section 12, T123N-R64W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 902 Washington St N) was submitted by Vincent & Gita Webb. Chris Witzel stated that the petitioner is requesting this preliminary and final plat in order to combine three underlying lots into one new lot to facilitate the construction of a residential addition. The newly created lot will meet all minimum lot width and depth requirements in the (R-2) Medium Density Residential District. Following discussion Rivett moved and Lien seconded to approve, all members voting aye, the motion carried. 3) A petition to Vacate the Public Right-of-Way described as “The portion of 1st Ave SW public right-of-way beginning a the NE corner of Lot 12, Block 18, 1st Addition to Aberdeen, thence S89˚ 30’14” west 6 feet to the Point of Beginning, thence S89˚ 30’ 14” west 16 feet, thence N 21’14” West 14 feet, thence N89˚ 30’ 14” east 16 feet, thence S 21’ 14” East 14 feet to the Point of Beginning,” (a.k.a. 124 2nd St S) was submitted by Aberdeen News. Chris Witzel stated that the petitioner is requesting this vacation of public right-of-way in order to vacate a 14’ x 16’ portion of public right-of-way so that it may be utilized in order to construct a loading dock for the Aberdeen News warehouse building. First Avenue SW is a fully constructed and utilized public right-of-way and the proposed vacation will create safety concerns with traffic visibility at the intersection and ADA regulations regarding public sidewalks. Staff believes there are several other possibilities to provide loading/unloading space on the south side of the property that would not adversely affect public safety. Following discussion Marske moved and Rivett seconded to deny, all members voting aye, the motion carried. (On 05/18/16 this property was readdressed to 221 1st Ave SW) 4) A petition to rezone from (R-3) High Density Residential District/(M) Municipal, State, and County Use District to (R-3) High Density Residential District for property described as “Lot 2, Brown County Commissioner’s 1st Subdivision,” (a.k.a. 1121 1st Ave SE) was submitted by Michael P. Herman – Boys and Girls Club. Chris Witzel stated that the petitioner is requesting this petition to rezone in order to eliminate split zoning and bring 1 Aberdeen City Planning Commission May 17, 2016 the property into compliance with its proposed future use as a new Boys and Girls Club Facility. An application requesting building variances, special exceptions, and appeals for this property was approved at the May 12, 2016 meeting of the Board of Zoning Adjustment Agenda. Following discussion Rivett moved and Lien seconded to approve, all members voting aye, the motion carried. 5) A petition to rezone from (R-5) Trailers, Trailer Parks, and Planned Residential Area (Trailers) to (R-3) High Density Residential District for property described as “Lots 5-6, Block 23, Highland Park Addition and that 32’ x 100’ portion of vacated Ninth Ave SW public right-of-way to the north of and adjacent to Lots 5-6, Block 23, Highland Park Addition,” (a.k.a. 1423 9th Ave SW) was submitted by Bill Sutton. Bill Sutton was present to represent the property. Chris Witzel stated that the petitioner is requesting this petition to rezone in order to bring the property into compliance with its current use as a single family dwelling and to facilitate a potential future residential addition. Following discussion Marske moved and Rivett seconded to approve, all member voting aye, the motion carried.
